                    and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Inspector General Act of 1978 to establish an Office of
            Inspector General in the Executive Office of the President, and for other
 purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFFE03E7CE50D445396924061FD86B6F0"><section section-type="section-one" id="HA9F7DA3C8B264C59973251E1B72F792F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bringing Executive Accountability, Clarity, and Oversight Now Act</short-title></quote> or the <quote><short-title>BEACON Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HE0D2F7F9B3384D52B39D726442909DE8"><enum>2.</enum><header>Office of Inspector General in the Executive Office of the President</header><subsection id="H407ACEA3DBB14D798CC42DD09EE252E6"><enum>(a)</enum><header>Establishment</header><paragraph id="HEAE10A758EE54F8C91653CB2190B7E42"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 401 of title 5, United States Code (commonly referred to as the <quote>Inspector General Act of 1978</quote>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id71920759d2f147b0a3a87f5f37bac756"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>or the National Reconnaissance Office</quote> and inserting <quote>the National Reconnaissance Office, or the Executive Office of the President</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id684547bce5f743a489930639d929a00d"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>or the Director of the National Reconnaissance Office</quote> and inserting <quote>the Director of the National Reconnaissance Office; or the President (with respect to the Executive Office of the President)</quote>.</text></subparagraph></paragraph><paragraph id="H24E2E968ABAD41F688D2AB838377A45E"><enum>(2)</enum><header>Appointment of Inspector General</header><text>Not later than 120 days after the date of enactment of this Act, the President shall appoint an individual as the Inspector General of the Executive Office of the President in accordance with the requirements of section 403(a) of title 5, United States Code.</text></paragraph></subsection><subsection id="H2262FBBA8AA2407B99C0D0D2F93F20DB"><enum>(b)</enum><header>Special provisions</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/4">Chapter 4</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/424">section 424</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H63CCCC15713742EFBE955AC6979887E8"><section id="HC9F1B0FBD34848DFA7C649BC726996B2"><enum>425.</enum><header>Special provisions concerning the Executive Office of the
 President</header><subsection id="H3EEBE351C8894DA59A81706FBB0410B7"><enum>(a)</enum><header>Audits, investigations, and issuance of subpoenas</header><paragraph id="H005795062DEF4426A15D49972821F064"><enum>(1)</enum><header>Authority, direction, and control</header><text display-inline="yes-display-inline">Notwithstanding the last 2 sentences of section 403(a), the Inspector General of the Executive Office of the President shall be under the authority, direction, and control of the President with respect to audits or investigations, or the issuance of subpoenas, that require access to information concerning any of the following:</text><subparagraph id="HCB44F5079673443AACD7A45DD9AED572"><enum>(A)</enum><text>The identity of a confidential source, including a protected witness.</text></subparagraph><subparagraph id="H16818A5DF6794EC8A6D17547C81FF75A"><enum>(B)</enum><text>An intelligence or counterintelligence matter.</text></subparagraph><subparagraph id="H3CF1444081534481850E65FB698FDDD5"><enum>(C)</enum><text>An undercover operation.</text></subparagraph></paragraph><paragraph commented="no" id="HDCB30DC5DCD94ED39692C475BE217695"><enum>(2)</enum><header>Prohibition in certain situations</header><text>With respect to the information described in paragraph (1), the President may prohibit the Inspector General of the Executive Office of the President from initiating, carrying out, or completing any audit or investigation, or from issuing any subpoena, after the Inspector General has decided to initiate, carry out, or complete such audit or investigation, or to issue such subpoena, if the President determines that such prohibition is necessary to prevent the disclosure of any information described in paragraph (1).</text></paragraph><paragraph id="H8260AED970D14D3F850FD7C8566444C3"><enum>(3)</enum><header>Notice after prohibition</header><subparagraph id="H262FDA3602B0444A9A8FF37D72DF81FB"><enum>(A)</enum><header>To Inspector General</header><text>If the President exercises any power under paragraph (2), not later than 30 days after exercising any such power, the President shall notify the Inspector General of the Executive Office of the President in writing, stating the reasons for exercising that power.</text></subparagraph><subparagraph id="HC4280DBA1F384BEC8CA88971A6E4F9F5"><enum>(B)</enum><header>To Congress</header><text>Not later than 30 days after receiving a notice under subparagraph (A), the Inspector General of the Executive Office of the President shall transmit a copy of the notice to the chair and ranking member of each of the following:</text><clause commented="no" display-inline="no-display-inline" id="id6390af2d5e5d44e3a8cbe9edbc360025"><enum>(i)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>.</text></clause><clause commented="no" display-inline="no-display-inline" id="id8c581f4bbb284f97979a8d3f8146e059"><enum>(ii)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>.</text></clause><clause commented="no" display-inline="no-display-inline" id="id09c5fd8f9af4475ab5ec3a4efa6155af"><enum>(iii)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="">Committee on Oversight and Government Reform of the House of Representatives</committee-name>.</text></clause><clause commented="no" display-inline="no-display-inline" id="id20d96d96938f4cf2abbb39133a6dac49"><enum>(iv)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc8e6181e2264474c9ad9632ea42a74d0"><enum>(v)</enum><text display-inline="yes-display-inline">Any other appropriate committee or subcommittee of Congress.</text></clause></subparagraph></paragraph></subsection><subsection id="H56B3CD99B9CE4959B0C47902266EC31B"><enum>(b)</enum><header>Semiannual reports</header><paragraph id="HEF5A2CD0AF2F4C56BAFE2DE03541CF0C"><enum>(1)</enum><header>Additional information to be included</header><text>Any semiannual report prepared by the Inspector General of the Executive Office of the President under section 405(b) shall also include the following:</text><subparagraph id="H0F565E570C9948148302750D1F4B1C88"><enum>(A)</enum><text>With respect to each significant recommendation on which corrective action has been completed, a description of the corrective action.</text></subparagraph><subparagraph id="H25A24B1D454E4515BD5001C791229266"><enum>(B)</enum><text>A certification of whether the Inspector General of the Executive Office of the President has had full and direct access to all information relevant to the performance of the functions of the Inspector General.</text></subparagraph><subparagraph id="H932D96B3AABA437F90517952490A110F"><enum>(C)</enum><text>A description of any audit, inspection, or evaluation occurring during the reporting period in which the Inspector General of the Executive Office of the President could not obtain relevant information due to an exercise of power by the President under subsection (a)(2).</text></subparagraph><subparagraph id="H560BBE8697334E9BBD2F9E08ED7944D8"><enum>(D)</enum><text>Such recommendations as the Inspector General of the Executive Office of the President considers appropriate with respect to efficiency in the administration of programs and operations undertaken by the President, and the detection and elimination of fraud, waste, and abuse in such programs and operations.</text></subparagraph></paragraph><paragraph id="H545AF7B498E648D2B97EA7EE74D4365C"><enum>(2)</enum><header>Submission to President</header><text display-inline="yes-display-inline">Notwithstanding section 405(c), the Inspector General of the Executive Office of the President shall submit to the President the semiannual reports prepared under section 405(b), including the additional information required under paragraph (1), not later than April 30 and October 31 of each year.</text></paragraph><paragraph id="H8C4FADFD74D84CB08057716D6771A0D1"><enum>(3)</enum><header>Transmission to Congress</header><text>Not later than 30 days after submitting the semiannual report to the President under paragraph (2), the Inspector General of the Executive Office of the President shall transmit the semiannual report to the chair and ranking member of each of the following:</text><subparagraph id="HCD144A2B262B42028DC89110E52BD38F"><enum>(A)</enum><text>The <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>.</text></subparagraph><subparagraph id="HD7B5786C53DF48EDBDB91515DE7C7E7E"><enum>(B)</enum><text>The <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>.</text></subparagraph><subparagraph id="H4B992C2605A64F6E89E970B4DB97B15A"><enum>(C)</enum><text>The <committee-name committee-id="">Committee on Oversight and Government Reform of the House of Representatives</committee-name>.</text></subparagraph><subparagraph id="HD02FE27B12EB40B0B89178FB9B47A7F5"><enum>(D)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id49343d7304cd485ead80c1899b03da5f"><enum>(c)</enum><header>Audit of the Office of the Inspector General of the Executive
 Office of the President</header><paragraph commented="no" display-inline="no-display-inline" id="id6aff2f2f11d24bd28c6bad983d27824f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the President appoints an individual as the Inspector General of the Executive Office of the President, and annually thereafter, the Council of Inspectors General on Integrity and Efficiency shall conduct an audit of the Office of the Inspector General of the Executive Office of the President to ensure that the office is able to effectively provide oversight of the Executive Office of the President.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01554d4731b043b3b4d93da335509185"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than October 31 after the first audit is completed under paragraph (1), and annually thereafter, the Council of Inspectors General on Integrity and Efficiency shall submit to Congress a report on the findings of the audit.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3A547E0953BD472DB39CC8F1DE17A636"><enum>(c)</enum><header>Technical and conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="ida0d064db679246a7b33f1406d98cca61"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/4">Chapter 4</external-xref> of title 5, United States Code, is amended—</text><subparagraph id="H61D161769698413CB39B0F5C884552EC"><enum>(A)</enum><text>in section 415(a)(2)—</text><clause id="H4FABD2AE96EE49C386134283FD3F20B6"><enum>(i)</enum><text>by striking subparagraph (C); and</text></clause><clause id="H6E48588FC0F94D45962C4F26E0B0749F"><enum>(ii)</enum><text>by redesignating subparagraphs (D) through (F) as subparagraphs (C) through (E), respectively; and</text></clause></subparagraph><subparagraph id="H73DAF70654B14FD1A84507D7597550DB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in section 418, by striking <quote>or 421</quote> and inserting <quote>, 421, or 425</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0dc2431d39664494a2ccb9bb8fdac579"><enum>(2)</enum><header display-inline="yes-display-inline">Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/4">chapter 4</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3aa71b7fadf24d39bdecdafc72ac74ea"><toc><toc-entry level="section" bold="off">425. Special provisions concerning
 the Executive Office of the President.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE6048243302A481ABA379C746366B40D"><enum>(d)</enum><header>Over-Classification audit</header><paragraph id="H4B77BF9C04654B889B8CD73231288A42"><enum>(1)</enum><header>Evaluations required</header><text display-inline="yes-display-inline">The Inspector General of the Executive Office of the President, in consultation with the Information Security Oversight Office of the National Archives and Records Administration, shall carry out 2 evaluations of the Executive Office of the President—</text><subparagraph id="HDFB6F1FCFC4149A2814F1E5213CDA5E4"><enum>(A)</enum><text display-inline="yes-display-inline">to assess whether applicable classification policies, procedures, rules, and regulations have been adopted, followed, and effectively administered within the Executive Office of the President; and</text></subparagraph><subparagraph id="HBB4A98AF8F114302850F67D38A1ACD04"><enum>(B)</enum><text display-inline="yes-display-inline">to identify policies, procedures, rules, regulations, or management practices that may be contributing to persistent misclassification of material within the Executive Office of the President.</text></subparagraph></paragraph><paragraph id="HF53B528027984E2DA7A0EE4F887E5054"><enum>(2)</enum><header>Deadlines for evaluations</header><subparagraph id="H956168B7B2184218B0C8C19DF18F92A2"><enum>(A)</enum><header>Initial evaluation</header><text display-inline="yes-display-inline">The first evaluation required under paragraph (1) shall be completed not later than 1 year after the date of enactment of this Act.</text></subparagraph><subparagraph id="HC941604A33D647809C9622FDB8FD9C90"><enum>(B)</enum><header>Second evaluation</header><text display-inline="yes-display-inline">The second evaluation required under paragraph (1) shall review progress made pursuant to the results of the first evaluation and shall be completed not later than 1 year after the date on which the first evaluation is completed.</text></subparagraph></paragraph><paragraph commented="no" id="H41B6478A37D54AD6AAE0D8A0B82BF324"><enum>(3)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Inspector General of the Executive Office of the President shall coordinate with other Inspectors General and the Information Security Oversight Office to ensure that evaluations follow a consistent methodology, as appropriate, that allows for cross-agency comparisons.</text></paragraph><paragraph id="HA25DF711D62A42B7A0E90865EE5012C8"><enum>(4)</enum><header>Reports required</header><subparagraph id="H7F5FF030F3FB4069AF7FD823A6D2BB5F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 45 days after the completion of an evaluation, the Inspector General of the Executive Office of the President shall submit to the appropriate entities a report on that evaluation.</text></subparagraph><subparagraph id="HCA2E7D051C564B4B8C7E900FFADC88B1"><enum>(B)</enum><header>Content</header><text display-inline="yes-display-inline">Each report submitted under subparagraph (A) shall include a description of—</text><clause id="H723369843D6546BFB69E46F3F171DCB1"><enum>(i)</enum><text display-inline="yes-display-inline">the policies, procedures, rules, regulations, or management practices, if any, identified by the Inspector General under paragraph (1)(B); and</text></clause><clause id="HC005907577BB4A1CA2467235D28BEBA9"><enum>(ii)</enum><text>the recommendations, if any, of the Inspector General to address any such identified policies, procedures, rules, regulations, or management practices.</text></clause></subparagraph></paragraph><paragraph id="H100A9F9022414AA98A38EFE2B122D361"><enum>(5)</enum><header>Appropriate entities defined</header><text>In this subsection, the term <quote>appropriate entities</quote> means each of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id09f35b781a08499ab257bc8d3e54ca87"><enum>(A)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id665281d446a047b287a8ed352ca0fae5"><enum>(B)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e02588e321d43e78950a3551116b1ca"><enum>(C)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="">Committee on Oversight and Government Reform of the House of Representatives</committee-name>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b0f48eec39a4949823189183149fc43"><enum>(D)</enum><text display-inline="yes-display-inline">The <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text></subparagraph><subparagraph id="H9DC5A99106F04235B131A1278A1BB5DF"><enum>(E)</enum><text>Any other appropriate committee or subcommittee of Congress.</text></subparagraph><subparagraph id="HFA9B12D3D47749C3964B24668F621F5F"><enum>(F)</enum><text>The President.</text></subparagraph><subparagraph id="H0E9541072BDB4752ABD2C1FE748945E3"><enum>(G)</enum><text>The Director of the Information Security Oversight Office.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
