<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2210</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250708">July 8, 2025</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> (for himself, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, and <cosponsor name-id="S417">Mr. Budd</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that the provision of portable benefits to an individual is not considered in determining whether such individual is an employee of a person, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unlocking Benefits for Independent Workers Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id83b900947da547b1a2a0cd78c506ac64"><enum>2.</enum><header>Consideration of portable benefits with respect to employment status</header><text display-inline="no-display-inline">A determination whether an individual is an employee of a person for the purposes of any Federal law shall be made without considering whether such person provides to the individual—</text><paragraph commented="no" display-inline="no-display-inline" id="id0c2ed5d2674846318becd24e018d9498"><enum>(1)</enum><text>a benefit or protection that the individual may maintain without regard to whether the individual continues to perform work for such person;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc53fcbf70c19493d9c36e609c5c3eadb"><enum>(2)</enum><text display-inline="yes-display-inline">a benefit or protection of a type that is commonly provided to a full-time employee;</text></paragraph><paragraph id="ida2e764914ca0428aa5949bbfab53bc5c"><enum>(3)</enum><text>a contribution, financial or otherwise, with respect to a benefit described in paragraph (1) or (2) that is—</text><subparagraph id="id118ae8d706d14e0d9c5d1231dd5573e6"><enum>(A)</enum><text>made on behalf of the individual by the person in connection with work performed by the individual for the person; or</text></subparagraph><subparagraph id="ide39f4e3b7e744bc5a238dda22251b08e"><enum>(B)</enum><text>made by the individual; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35fd5cd30fc941ab8d41508a0a41573f"><enum>(4)</enum><text>a benefit, protection, or contribution that is a combination of any benefit, protection, or contribution described in paragraph (1), (2), or (3).</text></paragraph></section></legis-body></bill>
