which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase transparency, fairness, and protections for diplomatic personnel affected by reductions in force, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting America’s Diplomatic Workforce Act</short-title></quote>.</text></section><section id="idb0ed4047909841058f6ca9348205ad69"><enum>2.</enum><header>Improved transparency and justifications for significant reductions in force</header><subsection commented="no" display-inline="no-display-inline" id="id44b1cf1523e54bd2b4e4e660609a13c4"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Except as provided in subsection (b), during any 6-month period, a covered agency may not separate more than 50 employees from service pursuant to 1 or more reductions in force.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc60560b8301e42bab83335fb1daa86cd"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">A covered agency may separate more than 50 employees from service pursuant to 1 or more reductions in force during a 6-month period only if, before carrying out the reduction in force that would cause the covered agency to violate subsection (a), the covered agency—</text><paragraph id="id181e7a1e4f1a4ae88568fc67e7a8c8e6"><enum>(1)</enum><text>not later than 20 days before submitting a notice of the reduction in force to affected employees, submits to the appropriate congressional committees of jurisdiction a detailed explanation of the reduction in force that includes—</text><subparagraph id="id8718075b8ecf47789c9cf9a91364947e"><enum>(A)</enum><text>the steps the covered agency has taken to exhaust all other options before carrying out the proposed reduction in force, including whether the covered agency considered reassigning the employees to an equivalent position;</text></subparagraph><subparagraph id="id76e9d2c1249f468db7e8d5d9b80fe87e"><enum>(B)</enum><text>the justification for the reduction in force; </text></subparagraph><subparagraph id="id980ab141df9a466fa16e61f9b2c76387"><enum>(C)</enum><text>an assessment of whether the proposed reduction in force will negatively impact the covered agency’s ability to carry out its mission and obligations required by statute;</text></subparagraph><subparagraph id="idd8ab4d32631349aab14ecae43840aef6"><enum>(D)</enum><text>an assessment of how the proposed reduction in force will affect United States diplomatic presence and engagement and the United States ability to compete with adversaries; and</text></subparagraph><subparagraph id="id80af9a4bfc0f429fb6b23c1b5f9ea46d"><enum>(E)</enum><text>with respect to employees in the civil service, information about how the covered agency has complied with—</text><clause commented="no" display-inline="no-display-inline" id="idd6d998fa770f4d518091e4d07ceedcdd"><enum>(i)</enum><text display-inline="yes-display-inline">subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/35">chapter 35</external-xref> of title 5, United States Code; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbabdd6aa5aed44718b175e43d4167bfd"><enum>(ii)</enum><text display-inline="yes-display-inline">part 351 of title 5, Code of Federal Regulations (or any successor regulation); and</text></clause></subparagraph></paragraph><paragraph id="idc86083b7b69c4465b11832ab9cb16b30"><enum>(2)</enum><text>briefs the appropriate congressional committees of jurisdiction on the justification for the reduction in force and the other criteria described in paragraph (1).</text></paragraph></subsection></section><section id="id6861f308eaca4e1cbfa373e32826429b" commented="no"><enum>3.</enum><header>Foreign Service reduction in force procedures</header><subsection commented="no" display-inline="no-display-inline" id="id4bbfb3bb15bc4e569b4be0b3bc1a7634"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 611 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4010a">22 U.S.C. 4010a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2e53a06580594a22a217e8ebbb2085b5"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subsection (a) to read as follows:</text><quoted-block id="idF85735202D4F4B12815DAE75BB191F70" style="OLC" act-name=""><subsection id="id270B67ABD1724CB49E7B70FBA94B180F"><enum>(a)</enum><header>Authorization</header><text>The Secretary may conduct reductions in force for the separation of members of the Service holding a career or career candidate appointment under chapter 3 of this Act for reasons such as reorganization or shortage of funds.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id0dd38308bbd4484faf217e28b2c85d27"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (e) and (f), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5595ec1736484641bb5266c4b3e42e8b"><enum>(3)</enum><text>by inserting after subsection (a) the following new subsections:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddcd5a58698d84267adfe541e378a2714"><subsection commented="no" display-inline="no-display-inline" id="id04aca21493cb4e2986d083d40421c435"><enum>(b)</enum><header>Competitive area</header><text display-inline="yes-display-inline">The competitive area for a reduction in force shall be worldwide, with employees of the same rank and cone or specialist competing against each other for retention.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1681663e698b4f79b4f8fef757c18053"><enum>(c)</enum><header>Criteria</header><text display-inline="yes-display-inline">Reduction in force procedures shall be designed to ensure that determinations are based primarily on performance as determined by previous selection board rankings. Tenure of employment, language capabilities, and military preference, subject to section 3501(a)(3) of title 5, United States Code, shall also be considered.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2a8240b5d9824a70961e333d0c71b0a1"><enum>(d)</enum><header>Required notice</header><text display-inline="yes-display-inline">Absent unforeseen circumstances, employees shall be given 120 days' advance notice of separation. In no case shall employees be given less than 60 days’ advance notice.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id09db888082534770bf70d69a49797565"><enum>(e)</enum><header>Protections</header><text display-inline="yes-display-inline">Foreign Service employees shall be afforded the same protections afforded to career members of the civil service under section 3503 of title 5, United States Code, in the event of a transfer of function.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id969bb3b189164b4cbd4cd1348a1ba38d"><enum>(4)</enum><text>in subsection (g), as redesignated by paragraph (2), by striking the second sentence and inserting the following: <quote>The Foreign Service Grievances Board shall have the same authority as the Merit Systems Protection Board to adjudicate reduction in force grievances.</quote>. </text></paragraph></subsection><subsection id="id2c43489bc1ad40f8b4d83904146c3106" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Management rights</header><text>Section 1005(a)(3) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4105">22 U.S.C. 4105(a)(3)</external-xref>) is amended by striking <quote>, and to prescribe regulations for the separation of employees pursuant to such reductions in force conducted under section 611</quote>.</text></subsection></section><section id="ide93e606158974528849ec6c1d2357fe3"><enum>4.</enum><header>Reduction in force notice period</header><text display-inline="no-display-inline">The notice period for a reduction in force pursuant to section 3502 of title 5, United States Code, at a covered agency shall be 60 days.</text></section><section id="idd464a637495a4c3992b1b7863c4e84e6" commented="no"><enum>5.</enum><header>Foreign Affairs Manual changes</header><text display-inline="no-display-inline">Section 5318 of the Department of State Authorization Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/22/2658a">22 U.S.C. 2658a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idd22c5afb6b8044f7b5b6c2e58856727c"><enum>(1)</enum><text>in subsection (c)(1), by striking <quote>5 years</quote> and inserting <quote>8 years</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03e9ec0bed45487c9de725f00e1ce5fa"><enum>(2)</enum><text display-inline="yes-display-inline">adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbefca49ff9a44decbb44f39e29f5de2b"><subsection commented="no" display-inline="no-display-inline" id="id5bc86d4fedbb45a7ab34d7c9c2eed838"><enum>(d)</enum><header>Notice; consultation; briefing</header><text display-inline="yes-display-inline">Before effectuating any changes in the Foreign Affairs Manual, the Secretary of State shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idc767026219cb451f84df9e603085c564"><enum>(1)</enum><text display-inline="yes-display-inline">provide notice to, and consult with, the appropriate congressional committees in writing, not later than 30 days before such changes are scheduled to take effect; and</text></paragraph><paragraph id="idf8c4b2f2d8e34ef6abc9c55e07fb5d1d" commented="no"><enum>(2)</enum><text>provide a briefing to the appropriate congressional committees regarding the proposed changes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id86ec0a17cc9c4af5a48ec4f1a0fc45e5"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id140571b9112848baa63f5f1f354baa1f"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id639bed786b614659b27b4a9a3c2d30b8"><enum>(2)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbb497a2656c04c8dba150115cbc4c79f"><enum>(A)</enum><text>the Department of State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77331175c9f94dafa41d25b7175eb5b4"><enum>(B)</enum><text>the United States Agency for International Development;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f40b2c2403c43cfb3319b8a5f497189"><enum>(C)</enum><text>the Millennium Challenge Corporation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id358c38820b534087ad17b21ba4ff632a"><enum>(D)</enum><text>the United States International Development Finance Corporation;</text></subparagraph><subparagraph id="idf9bb3d073a8b4597896f8c926c456ad5"><enum>(E)</enum><text>the Peace Corps;</text></subparagraph><subparagraph id="idf76ca29131fb4f9ab0665efbf35aaf6d"><enum>(F)</enum><text>the United States Trade and Development Agency; and</text></subparagraph><subparagraph id="id9daf003dfda24c23803a91c0ccb8593f"><enum>(G)</enum><text>the United States Agency for Global Media and its networks.</text></subparagraph></paragraph></section></legis-body></bill>
