<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2189</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250626" legis-day="20250624">June 26 (legislative day, June 24), 2025</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to treat certain assisted reproduction expenses as medical expenses of the taxpayer.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3E6F254CE96B41148ABD484E1D68BE2E"><section section-type="section-one" id="HF265C49901954C78AA5985098214B3E6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal Access to Reproductive Care Act</short-title></quote>. </text></section><section id="H9364B139EEEA4210A88A33FCC0EAAE89"><enum>2.</enum><header>Treatment of certain assisted reproduction expenses as medical expenses of the taxpayer</header><subsection id="H03CC5F2612D2440CA9478A2915620F36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/213">Section 213(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6F6812C74A1B4135B95C58DA1C0484AC"><paragraph id="H7F1A6939FDDC46D8BA6E7C669393B820"><enum>(12)</enum><header>Assisted reproduction expenses</header><subparagraph id="H5BBDC520968A4B03B9AFC73B79335807"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>medical care</quote> includes assisted reproduction.</text></subparagraph><subparagraph id="HB30BE7A6FF24434596FB7B263605CE00"><enum>(B)</enum><header>Assisted reproduction defined</header><text display-inline="yes-display-inline">The term <quote>assisted reproduction</quote> means any methods, treatments, procedures, and services for the purpose of effectuating a pregnancy and carrying it to term, including gamete and embryo donation, intrauterine insemination, in vitro fertilization, intracervical insemination, traditional reproductive surrogacy, and gestational reproductive surrogacy. </text></subparagraph><subparagraph id="H905AD4710DA64CC38E91098792108298"><enum>(C)</enum><header>Coverage of surrogacy, etc</header><text>Assisted reproduction shall be treated as medical care of the taxpayer or the taxpayer’s spouse or dependent to the extent that the taxpayer or the taxpayer’s spouse or dependent, respectively, intends to take legal custody or responsibility for any children born as a result of such assisted reproduction.</text></subparagraph><subparagraph id="H2A03B240B87F4881B08AA88ED7260570"><enum>(D)</enum><header>Coordination with certain other rules related to transportation, insurance, etc</header><text>Assisted reproduction shall be treated as medical care referred to in paragraph (1)(A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD345634893D74791B5B0E1D321ABEC04"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
