            participation in community solar programs and the receipt of associated benefits, and
 for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H092AF44E7EBC491194595B7A0FD045D7"><section section-type="section-one" id="H5933023479F7466FB65F99F36FF0EEBC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Solar Consumer Choice Act of 2025</short-title></quote>.</text></section><section id="H31E2C0B365FB460BB669BAB1F716AA72"><enum>2.</enum><header>Community solar consumer choice program; Federal Government participation in
 community solar</header><subsection id="HDBCF38D5D2E84168BD747403BEC3A4A0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="HD5E55C68ECB4420FA3970F3D13BDB491"><enum>(1)</enum><header>Community solar facility; community solar program; subscriber</header><text>The terms <term>community solar facility</term>, <term>community solar program</term>, and <term>subscriber</term> have the meanings given those terms in paragraph (22)(A) of section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>).</text></paragraph><paragraph id="HBE4AFDF51226424983280D735CB6989C"><enum>(2)</enum><header>National Laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E2F797381D541CE8858597FC2DE584A"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="HD3421FD8710047D0A79062B23F0347EC"><enum>(b)</enum><header>Establishment of community solar consumer choice program</header><paragraph id="HB74B493BADC0401B99BA3B010D0A970A"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a program to increase access to community solar programs for—</text><subparagraph id="HD44AFDD7C0D44B6680E1F3CC980D5ECA"><enum>(A)</enum><text>individuals, particularly individuals that do not have regular access to onsite solar, including low- and moderate-income individuals;</text></subparagraph><subparagraph id="HD74F22F2AFE841EF8EF2C623C3768823"><enum>(B)</enum><text>businesses;</text></subparagraph><subparagraph id="H091A07830B9D4CAA8676E4D95EE15C90"><enum>(C)</enum><text>nonprofit organizations; and</text></subparagraph><subparagraph id="H4DA1213FBE1143EBA9BA4CE786C3022E"><enum>(D)</enum><text>State, local, and Tribal governments.</text></subparagraph></paragraph><paragraph id="H33E7E12C669A4E978D07FE22EE9578CC"><enum>(2)</enum><header>Alignment with existing Federal programs</header><text>The Secretary shall align the program established under paragraph (1) with existing Federal programs that serve low-income communities.</text></paragraph><paragraph id="H2754A1ACD4574D328AD50877BED5994A"><enum>(3)</enum><header>Assistance to State, local, and Tribal governments</header><text>In carrying out the program established under paragraph (1), the Secretary shall—</text><subparagraph id="H6A2CC5AB8FE34BBDBCF7DDCDF65877DE"><enum>(A)</enum><text>provide technical assistance to State, local, and Tribal governments, and other entities, for projects to increase access to community solar programs;</text></subparagraph><subparagraph id="H72456DC325F34B8A85516607EEED8E2F"><enum>(B)</enum><text>assist State, local, and Tribal governments in the development of new and innovative financial and business models, including affordable rate structures, that leverage competition in the energy marketplace in order to serve subscribers; and</text></subparagraph><subparagraph id="HA7099DC545684BBDB973EF57242BD260"><enum>(C)</enum><text>use National Laboratories to collect and disseminate data to assist private entities in the financing of, subscription to, and operation of community solar facilities and community solar programs.</text></subparagraph></paragraph></subsection><subsection id="H1E5A39934AF84404A191008671EB48BC"><enum>(c)</enum><header>Federal Government participation in community solar programs</header><text>The Secretary, to the extent practicable, shall expand the existing grant, loan, and financing programs of the Department of Energy to include community solar programs.</text></subsection></section><section id="H1ADBD703DB104ADDAAFE755DDE198D48"><enum>3.</enum><header>Establishment of community solar programs</header><subsection id="H38AC43A407824F31ACCA83291B8676F8"><enum>(a)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC111C27733624FBCAFA1B89C81530535"><paragraph id="H1E9BE71A2D2143E7B056FC4119602D53"><enum>(22)</enum><header>Community solar programs</header><subparagraph id="HC78BDD9A2A5C4FA7B2B27CB958080A45"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="H4CAFE5C5772C40488ADCC25B951BD166"><enum>(i)</enum><header>Community solar facility</header><text display-inline="yes-display-inline">The term <term>community solar facility</term> means a solar photovoltaic system that—</text><subclause id="H4FC1B6A4D7A2469E890AB1FD3BCC9EF8"><enum>(I)</enum><text>allocates electricity to multiple electric consumers served by an electric utility;</text></subclause><subclause id="HC5BC728C4FD740138F98AA9CBA697CC0"><enum>(II)</enum><text>is connected to local distribution infrastructure of the electric utility;</text></subclause><subclause id="HCD34D028D46E47F4B34F89F86810E5BA"><enum>(III)</enum><text>is located either on or off the property of 1 or more subscribers; and</text></subclause><subclause id="H6ED1184C224A4289BD7EF7EB4E6D3367"><enum>(IV)</enum><text>may be owned by an electric utility, 1 or more subscribers, or a third party.</text></subclause></clause><clause id="H96F621602EB94B11AE97239A0F76EC01"><enum>(ii)</enum><header>Community solar program</header><text>The term <term>community solar program</term> means a service provided by an electric utility to an electric consumer served by the electric utility through which the value of electricity generated by a community solar facility may be used to offset charges billed to the electric consumer by the electric utility.</text></clause><clause id="H4AEAE5A32F4A42A6859B960CE0766277"><enum>(iii)</enum><header>Subscriber</header><text display-inline="yes-display-inline">The term <term>subscriber</term> means an electric consumer who participates in a community solar program.</text></clause></subparagraph><subparagraph id="HB883D21CC77546FBB3C3449F3A305C13"><enum>(B)</enum><header>Standard</header><clause id="id636894e76e3446a187e3c3f4e713f958"><enum>(i)</enum><header>Non-Tribal utilities</header><text>Each electric utility that is not a Tribal utility shall offer a community solar program to which all ratepayers of the electric utility, including low-income ratepayers, have equitable and demonstrable access.</text></clause><clause id="idd6fc41df3ee84aa1b159f08bdbf4c6dd"><enum>(ii)</enum><header>Tribal utilities</header><subclause id="idb188cae81b8d48a191e64b91943c5cc6"><enum>(I)</enum><header>In general</header><text>A Tribal utility may offer a community solar program.</text></subclause><subclause id="idcaa9e9e30d4e4983ac7f08a3aac4e283"><enum>(II)</enum><header>Resources</header><text>A Tribal utility that offers a community solar program may leverage the resources made available to the Tribal utility under this Act to carry out that community solar program.</text></subclause></clause></subparagraph><subparagraph id="id4db1edf92e5c4d8dbd86653efc35f3b0"><enum>(C)</enum><header>Ownership of community solar facilities</header><text>A community solar program established pursuant to this paragraph shall include a mechanism to allow electric utilities, non-utilities, and other appropriate entities to assume complete or partial ownership of relevant community solar facilities, as necessary to deliver customer benefits and mitigate the impacts of market concentration.</text></subparagraph><subparagraph id="id995d7b867c01462da4fb5819410c0de9"><enum>(D)</enum><header>Technical assistance and other guidance</header><text>The Secretary shall provide technical assistance and other guidance necessary to carry out a community solar program pursuant to this paragraph, including to State, local, and Tribal governments, as appropriate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7FA37BD5176B45D5BBE445F5A32F354F"><enum>(b)</enum><header>Compliance</header><paragraph id="HBEA2045360E340C8B85EA4F72582423B"><enum>(1)</enum><header>Time limitations</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id19fcf57771e446ed86a1bfa91aed8d63"><enum>(A)</enum><text display-inline="yes-display-inline">by indenting paragraphs (4) through (8), and any subparagraphs within those paragraphs, appropriately; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id545eb32e2dd440aaad14c77b59bf1eac"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="HF6A04DB5400E4E35BB250207C056A826"><paragraph id="H3279C9FF483E4CF8B06799004CD29D36" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB245F1D45D1143FF90FE9FDEBDA7E956"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated electric utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="id9e1e459a9fbb4ab59535c876d2d22474"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H412F54AB4E514BCCA5004C4ECB780A40"><enum>(2)</enum><header>Failure to comply</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended—</text><subparagraph id="H13984E0B40A94D808D8DC7D66839A20E"><enum>(A)</enum><text>in the first sentence, by striking <quote>subsection (b)(2)</quote> and inserting <quote>subsection (b)</quote>; and</text></subparagraph><subparagraph id="H64A6B00299914259A1FFF93DFAC377B6"><enum>(B)</enum><text>by adding at the end the following: <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (22).</quote>.</text></subparagraph></paragraph><paragraph id="H897BE41B00D34365BA30368B6DC2CDCF"><enum>(3)</enum><header>Prior State actions</header><subparagraph id="H66A8CAB2B035420EB2E27F6CEB9A4F70"><enum>(A)</enum><header>In general</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="idd0b46d1979404d748fced860ec74533d"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (h), in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Other</header-in-text></quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd0374c7fe3be439abd83baed80d302e7"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="H16782811847C435C820F9656B8F6D1F0"><subsection id="H41F5B29BC6424AEBBE96A30D2137FB87"><enum>(i)</enum><header>Prior State actions</header><text>Subsections (b) and (c) shall not apply to the standard established by paragraph (22) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="H07D244A45E9E40F1AE978080F5796FD6"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="H7CDE46B81F09492F9AD526B9CF3752FD"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="HB1B72123FD234BC3BB5CE5042DBBFDF4"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HEC72FC68261E48E7950B830690B82567"><enum>(B)</enum><header>Cross-reference</header><text>Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2634">16 U.S.C. 2634</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this section to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (22).</quote>.</text></subparagraph></paragraph></subsection></section><section id="HBE12576305B34C0BA12D78F65BFB5223"><enum>4.</enum><header>Federal contracts for public utility services</header><text display-inline="no-display-inline">Section 501(b)(1) of title 40, United States Code, is amended by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" id="H34AD997675A34A73BA6F4B2AB1956B3E"><subparagraph id="HAFE479BF1D71479E8703B50F843552D9"><enum>(B)</enum><header>Public utility contracts</header><text display-inline="yes-display-inline">A contract under this paragraph for public utility services may be for a period of not more than 30 years.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
