aircraft imported from the People's Republic of China, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H54A9B8A7E74044AD9975DE053AF79527"><section section-type="section-one" id="HDAEBF483E1814CD0B67034B9A19ECD0A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drones for America Act</short-title></quote>.</text></section><section id="H26F1B2B60D364FC79CA9F72012F24819"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H756AF1FC12E449949D153B3D412E0CAE"><enum>(1)</enum><text>the United States has a national security interest in securing the supply chain for unmanned aircraft in the United States;</text></paragraph><paragraph id="HB606548056AE42FBB6B0DFBC96DC05D6"><enum>(2)</enum><text>implementing tariffs on unmanned aircraft and components for such aircraft from the People’s Republic of China has the effect of incentivizing sourcing from the United States and allies of the United States, which in turn has the effect of promoting resilient supply chains for unmanned aircraft and components for such aircraft; and</text></paragraph><paragraph commented="no" id="H4DA988E40D70423A93DACD4DC8733163"><enum>(3)</enum><text display-inline="yes-display-inline">applying protective duties against foreign adversary countries, such as the People’s Republic of China, is prudent and necessary to safeguard the domestic unmanned aircraft industry.</text></paragraph></section><section id="H532609A81E594E87BEA9A6D46ADE5A50"><enum>3.</enum><header>Duty increase for imports of unmanned aircraft from the People's Republic of China</header><subsection id="H41500AD1618F4E11A25FED7D95D72A75"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of chapter 99 of the Harmonized Tariff Schedule of the United States (in this Act referred to as the <quote>HTS</quote>) is amended as follows:</text><paragraph id="HBD3E34E128474746BADA26D5B2D1D1AF"><enum>(1)</enum><text display-inline="yes-display-inline">By inserting in numerical sequence the following, with the article description for heading 9903.87.01 having the same degree of indentation as the article description for heading 9903.85.11:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE28F64AB6DD34D63BEC3F89672C1A639"><table blank-lines-before="1" table-type="exception-quote" table-template-name="Duty Modification, 7-Column" align-to-level="section" frame="none" colsep="1" rowsep="0" line-rules="hor-ver" rule-weights="0.0.0.0.4.17"><tgroup block-style="1" cols="7" display-inline="yes-display-inline">By inserting in numerical sequence the following new U.S. note:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA1E933D90EED44C3BF58EB57FBBAFF6D"><paragraph id="H33838B527E9D45AE88343C5E4837E895"><enum>31.<?LEXA-Enum 31.?></enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4CE232F473EC4647A4E9A7716F0E1B24"><enum>(a)<?LEXA-Enum (a)?></enum><text display-inline="yes-display-inline">Products of China classified in headings 9903.87.01 and 9903.87.02 shall be subject to an ad valorem rate of duty specified in subdivision (b), which shall, notwithstanding U.S. note 1 to this subchapter, be in addition to—</text><clause commented="no" display-inline="no-display-inline" id="id39e57721eb4b4c948f1dcf1cca26c4bf" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">the rates of duty provided for such articles in chapter 88 and this subchapter; and</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="idfe025f46f0094057b51b4747254acfee"><enum>(ii)</enum><text>any other applicable duties (including antidumping and countervailing duties), fees, exactions, or charges.</text></clause></subparagraph><subparagraph commented="no" id="HADD6E4747CBC4F41988FF7AFA793FA3D" indent="up1"><enum>(b)<?LEXA-Enum (b)?></enum><text>The rates of duty specified in this subdivision and applicable with respect to products of China classified in headings 9903.87.01 and 9903.87.02 are as follows:</text><clause commented="no" id="H815495866D894867B3625DA2ECA58ED7"><enum>(i)</enum><text display-inline="yes-display-inline">With respect to products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on the day that is 30 days after the date of the enactment of the <short-title>Drones for America Act</short-title> through 11:59 p.m. eastern time on the day that is 1 year after such date of enactment, 30%.</text></clause><clause commented="no" id="HAE705AFD94C4461BAEF1E6DE03F34552"><enum>(ii)</enum><text display-inline="yes-display-inline">With respect to products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on the day after the day that is 1 year after such date of enactment through 11:59 p.m. eastern time on the day that is 2 years after such date of enactment, 35%.</text></clause><clause commented="no" id="H102A4CAABA1340A39F82933A8A0C137C"><enum>(iii)</enum><text display-inline="yes-display-inline">With respect to products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on the day after the day that is 2 years after such date of enactment through 11:59 p.m. eastern time on the day that is 3 years after such date of enactment, 40%.</text></clause><clause commented="no" id="HB7E822E274EC459CB0743F04D9E4E2AD"><enum>(iv)</enum><text display-inline="yes-display-inline">With respect to products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on the day after the day that is 3 years after such date of enactment through 11:59 p.m. eastern time on the day that is 4 years after such date of enactment, 45%.</text></clause><clause commented="no" id="H86370B55DDB4465E929B3BBB4B14EDD3"><enum>(v)</enum><text display-inline="yes-display-inline">With respect to products entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on the day after the day that is 4 years after such date of enactment, $100 each + 50%.</text></clause></subparagraph><subparagraph id="H900135FCFAEE4F879F7A7F1B2FE7BC3C" indent="up1"><enum>(c)<?LEXA-Enum (c)?></enum><text>Products of China that are classified in headings 9903.87.01 and 9903.87.02 that are eligible for temporary duty exemptions or reductions under subchapter II to this chapter shall be subject to the rates of duty specified in subdivision (b) notwithstanding such exemptions or reductions.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAEE71CC4FE7F424197C90DF7A5B55F8E"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall with respect to articles entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on the day that is 30 days after the date of the enactment of this Act.</text></subsection></section><section id="H7612EBD9B66745C9A3870DD80B88FB83" commented="no"><enum>4.</enum><header>Strengthened rules of origin for entries of unmanned aircraft and parts for unmanned aircraft</header><subsection id="H5B611AE344024FDFA200DBC0083563DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any provision of the general notes to the HTS, unmanned aircraft classified under heading 8806 of the HTS, and parts for such aircraft classified under heading 8807 of the HTS, may not enter the customs territory of the United States unless—</text><paragraph id="HF237E5EB3BF847BC9400AEB48A1005DA"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idab2a5b2ecc52462bb2a1f4ddb3292691"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an unmanned aircraft, the entry of the aircraft is accompanied by a certificate or other documentation required by U.S. Customs and Border Protection establishing that the aircraft does not contain a flight controller, radio, data transmission device, camera, gimbal, permanent magnets (including neodymium iron boron magnets), ground control system, operating software, network connectivity hardware, or data storage manufactured in the People’s Republic of China; and</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id0fa9bd7708ba4ba197539ad5253f28fb"><enum>(B)</enum><text>in the case of a part, the entry of the part is accompanied by a certificate or other documentation required by U.S. Customs and Border Protection establishing that the part was not manufactured in the People’s Republic of China; and</text></subparagraph></paragraph><paragraph id="H3C67C3F6EEB9462EA8FAE164FE36EDF6"><enum>(2)</enum><text>U.S. Customs and Border Protection confirms the veracity of the certificate or other documentation required by paragraph (1).</text></paragraph></subsection><subsection id="H4EEE2107E4964F0B9ECFEAF949E8EBF6"><enum>(b)</enum><header>Exemption</header><paragraph id="H51D9FC66A13B44C8B85BE20CCC59455F"><enum>(1)</enum><header>In general</header><text>Subsection (a) shall not apply with respect to unmanned aircraft classified under heading 8806 of the HTS that—</text><subparagraph id="H0F75EB103EFD4A16AE48B992EBF35D68"><enum>(A)</enum><text>the Federal Aviation Administration has, before January 1, 2026—</text><clause id="H55C394A016D04EB9B1F4B28B9FB23400"><enum>(i)</enum><text>authorized for operations under the provisions of part 135 of title 14, Code of Federal Regulations; or</text></clause><clause id="H776BBB6C357842D2BE8B57B39C37BCD7"><enum>(ii)</enum><text>included in an air carrier’s exemption under section 44807 of title 49, United States Code; and</text></clause></subparagraph><subparagraph id="H293E1008F4624B01B38217702777BB0E"><enum>(B)</enum><text display-inline="yes-display-inline">are not manufactured in whole by a covered foreign entity or in a foreign adversary country.</text></subparagraph></paragraph><paragraph id="H5B7D21AFD0CE42238ABFC8557F275614"><enum>(2)</enum><header>List</header><text display-inline="yes-display-inline">Not later than January 1, 2026, the Administrator of the Federal Aviation Administration shall—</text><subparagraph id="H1374312B096F48E8A1B346ED28FD0780"><enum>(A)</enum><text>provide the Commissioner for U.S. Customs and Border Protection with a list of unmanned aircraft that qualify for the exemption under this subsection; and</text></subparagraph><subparagraph id="H4C1B5387E8E84DCAA017A702FE6052F3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>certify that the list required by subparagraph (A) contains only unmanned aircraft that are not manufactured in whole by a covered foreign entity or in a foreign adversary country.</text></subparagraph></paragraph></subsection><subsection id="id2e34368047c04639838d3d8615ffad26"><enum>(c)</enum><header>Applicability</header><text>The prohibition under subsection (a) shall apply—</text><paragraph commented="no" display-inline="no-display-inline" id="id0c5d88c69b8f46b598c7f08323bcdfb0"><enum>(1)</enum><text>with respect to unmanned aircraft classified under heading 8806 of the HTS, on and after January 1, 2028; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa9b4fe5d5334c0db52ea29cd4e5c9da"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to parts for such aircraft classified under heading 8807 of the HTS, on and after January 1, 2031.</text></paragraph></subsection></section><section id="H7A01D0550CCF472B91D686E5CF00BACF"><enum>5.</enum><header>Grant program to ensure first responders, farmers and ranchers, and critical infrastructure providers have secure unmanned aircraft systems</header><subsection id="H29F0E1070D1744E18014B768D7319D65"><enum>(a)</enum><header>Secure Unmanned Aircraft Systems Trust Fund</header><paragraph id="H6C3D1DFAB0EA4058BFFEB95479D2A2C5"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund, to be known as the <quote>Secure Unmanned Aircraft Systems Trust Fund</quote> (in this section referred to as the <quote>Trust Fund</quote>), consisting of—</text><subparagraph id="idb5feeb5f9a624a9595eb6f2523283cdb"><enum>(A)</enum><text>amounts transferred to the Trust Fund under paragraph (2); and</text></subparagraph><subparagraph id="idf440b5a603cb47e4aeb4824330b7a272"><enum>(B)</enum><text>any amounts that may be credited to the Trust Fund under paragraph (3).</text></subparagraph></paragraph><paragraph id="id2c62b9cf3fd44b26a6072d14acf741fd"><enum>(2)</enum><header>Transfer of amounts</header><subparagraph id="id997175b4ddf04489b14807883d6d1557"><enum>(A)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer to the Trust Fund, from the general fund of the Treasury, for fiscal year 2026 and each fiscal year thereafter, an amount equivalent to the amount received into the general fund during that fiscal year and attributable to duties imposed and collected by the United States under headings 9903.87.01 and 9903.87.02 of the HTS and in accordance with U.S. note 31 to subchapter III of chapter 99 of the HTS, as added by section 3(a).</text></subparagraph><subparagraph id="idbc7950a0c85e4f13a99d737c847034b5"><enum>(B)</enum><header>Frequency of transfers</header><text>The Secretary shall transfer amounts required by subparagraph (A) to the Trust Fund not less frequently than quarterly.</text></subparagraph></paragraph><paragraph id="id0e63edd2c9a74d4f99648e883d3e7130"><enum>(3)</enum><header>Investment of amounts</header><subparagraph id="idb983abc85ed645f1b684db7dc409bb4f"><enum>(A)</enum><header>Investment of amounts</header><text>The Secretary shall invest such portion of the Trust Fund as is not required to meet current withdrawals in interest-bearing obligations of the United States or in obligations guaranteed as to both principal and interest by the United States.</text></subparagraph><subparagraph id="idc44e76753a2140d2bc25300391135d5c"><enum>(B)</enum><header>Interest and proceeds</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Trust Fund shall be credited to and form a part of the Trust Fund.</text></subparagraph></paragraph><paragraph id="H2795559639D7401DAE3B4EF3B44C6E13"><enum>(4)</enum><header>Use of amounts</header><subparagraph commented="no" display-inline="no-display-inline" id="ide0c60c72ff44429fb96503017047f17a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts in the Trust Fund shall be available, without further appropriation, to carry out the grant program established under subsection (b).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idffddd77a6f194ded8ae319c37fe391e3"><enum>(B)</enum><header>Availability of amounts</header><text>Amounts in the Trust Fund shall be available for obligation and expenditure during the fiscal year during which the amounts were transferred or credited to the Trust Fund and the fiscal year thereafter.</text></subparagraph><subparagraph id="ida04a7730cc2d4de3b6a5427eb5f5a073"><enum>(C)</enum><header>Reports required</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report on amounts disbursed from the Trust Fund in the preceding year.</text></subparagraph></paragraph></subsection><subsection id="HB1B71F3E7EFE4EAD954F291BB054CF89"><enum>(b)</enum><header>Grant program</header><paragraph id="H143E64B76EAC4340861D3859F9D358AF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of the enactment of this Act, the Secretary of Homeland Security shall establish and carry out a program to provide grants—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5d47a3f2f09a4f46ba33f4bd4a51b7ae"><enum>(A)</enum><text display-inline="yes-display-inline">to first responders, farmers and ranchers, and providers of critical infrastructure to—</text><clause id="H78684B0B6E3E4E6FB85B8EC3B2C604B1"><enum>(i)</enum><text display-inline="yes-display-inline">purchase or lease secure unmanned aircraft systems;</text></clause><clause id="H71FFEE00D9CD4274B2124751C3E6BE64"><enum>(ii)</enum><text>support operational capabilities of such systems by the grant recipient; and</text></clause><clause id="HE99EBAD29E67401E8002669F1EFA41F9"><enum>(iii)</enum><text>support the program management capability of the grant recipient to use such systems; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6177e16122f24d7c8d238deaed33bffa"><enum>(B)</enum><text>to entities that manufacture components for unmanned aircraft systems in the United States—</text><clause commented="no" display-inline="no-display-inline" id="id296aa85577a04fb984d3b9d594c5d901"><enum>(i)</enum><text display-inline="yes-display-inline">for workforce development; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ided8a6f8bbb304d9887307bca39f4a18f"><enum>(ii)</enum><text>to otherwise increase the capacity to manufacture such components in the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H383DAABA4F7346E1BFA719F6FC6EEC6B"><enum>(2)</enum><header>Consultation</header><text>In carrying out the program established under paragraph (1), the Secretary shall—</text><subparagraph commented="no" id="H7B5D9947D5564A2CB8A440B3A3C0106A"><enum>(A)</enum><text>consult with the Secretary of Agriculture with respect to developing criteria for reviewing applications for grants submitted on behalf of farmers and ranchers; and</text></subparagraph><subparagraph commented="no" id="H29DE3541C5F94C3D8A3BDA88A4E2FD9C"><enum>(B)</enum><text display-inline="yes-display-inline">consult with the Secretary of Transportation with respect to providing grants to providers of critical infrastructure.</text></subparagraph></paragraph><paragraph id="idf7ef709b805c4691a8a598639a0db3ed"><enum>(3)</enum><header>Priority for grants</header><text>Of the amounts in the Trust Fund in any fiscal year—</text><subparagraph id="HFE5D9B5766F54C4AB8E271D40BDB6D79"><enum>(A)</enum><text>not more than 60 percent of such amounts shall be made available for grants to first responders under subparagraph (A) of paragraph (1);</text></subparagraph><subparagraph id="HBD7789C9D17D4BEC9F8091A1A4200A5F"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 20 percent of such amounts shall be made available for grants to farmers and ranchers under that subparagraph;</text></subparagraph><subparagraph id="H943177F323FF4A9F997D178E0F0D4D95"><enum>(C)</enum><text display-inline="yes-display-inline">not more than 20 percent of such amounts shall be made available for grants to providers of critical infrastructure under that subparagraph; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0389679bcc75479f9fa1b0882c9f7a52"><enum>(D)</enum><text display-inline="yes-display-inline">not more than 10 percent of such amounts shall be made available for grants to entities that manufacture components for unmanned aircraft systems in the United States under subparagraph (B) of that paragraph.</text></subparagraph></paragraph><paragraph id="HE2940333DEF54D7485CEA22CB7D5391F"><enum>(4)</enum><header>Review of applications</header><subparagraph id="H4CB3F7ED7AC242FBA77DE86C84D632DF"><enum>(A)</enum><header>Deadline</header><clause id="HE34D09F4B93D41C38CFDF3CE267AFC67"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (iii), the Secretary shall approve or deny an application for a grant under the program established under paragraph (1) not later than 90 days after the date the Secretary receives the application.</text></clause><clause id="H0EE9BAC8FD62494A9E6AD1CA6D7A9505"><enum>(ii)</enum><header>Allocation timing</header><text>Amounts available for providing grants under the program established under paragraph (1) shall be allocated on a first-come, first-served basis, determined by the date the Secretary receives the application.</text></clause><clause id="H4CFDD937B1AF48F79F0A85EB5EB58B77"><enum>(iii)</enum><header>Additional time needed for review</header><text>If the Secretary determines that, because an excessive number of applications have been filed at one time, the Secretary needs additional time to process the applications, the Secretary may extend the deadline under clause (i) for not more than 45 days.</text></clause></subparagraph><subparagraph id="H4B3B4AD6CC9842F9ABC4DC0D582B0778"><enum>(B)</enum><header>Effect of denial</header><text>Denial of an application for a grant under the program established under paragraph (1) shall not preclude the applicant from resubmitting the application with additional documentation or submitting a new application at a later date.</text></subparagraph></paragraph><paragraph id="H81D1C12E5C3C42E98D6049F81EF38798"><enum>(5)</enum><header>Report required</header><text>Not later than 1 year after the date on which the program is established under paragraph (1), and annually thereafter, the Secretary shall submit to Congress a report on the implementation of the program in the year preceding submission of the report, including a description of all grants provided under the program during that year and the amounts of such grants.</text></paragraph></subsection></section><section id="H43A8DFE070B940AF87B337359B35E4AD"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7EE8147A57754A6CA206FD1A422341D0"><enum>(1)</enum><header>Air carrier</header><text>The term <term>air carrier</term> has the meaning given that term in section 40102 of title 49, United States Code.</text></paragraph><paragraph id="H4223BA224CDA4FED8F2F1B5B6AD42C45"><enum>(2)</enum><header>Covered foreign entity</header><text display-inline="yes-display-inline">The term <term>covered foreign entity</term> means a foreign entity that is—</text><subparagraph id="H285476B1A5C54219B07B203BF03745A0"><enum>(A)</enum><text>on the Federal Government’s Consolidated Screening List;</text></subparagraph><subparagraph id="H459E4376556D411F90927BAF9A5DD731"><enum>(B)</enum><text>domiciled in the People’s Republic of China or subject to influence or control by the Government of the People’s Republic of China;</text></subparagraph><subparagraph id="HE2D6CE88612745B99697027C2C3FC998"><enum>(C)</enum><text>identified by the Secretary of Defense under section 1260H(a) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note) as a Chinese military company operating directly or indirectly in the United States;</text></subparagraph><subparagraph id="H1FE1CB519B9D4AD1BE65926894F367AB"><enum>(D)</enum><text>on the Non-SDN Chinese Military-Industrial Complex Companies List maintained by the Office of Foreign Assets Control of the Department of the Treasury pursuant to Executive Order 13959 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to addressing the threat from securities investments that finance communist Chinese military companies);</text></subparagraph><subparagraph id="id576db026019149e7927a2bc25e9c1479"> <enum>(E)</enum> <text>on a list maintained under clause (i), (ii), (iv), or (v) of section 2(d)(2)(B) of the Act entitled <quote>An Act to ensure that goods made with forced labor in the Xinjiang Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes</quote>, approved December 23, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) (commonly referred to as the <quote>Uyghur Forced Labor Prevention Act</quote>); or</text>
 </subparagraph><subparagraph commented="no" id="H0A9E87655EA547618BF8D901CA589967"><enum>(F)</enum><text>a covered foreign entity, as defined in section 1822 of the American Security Drone Act of 2023 (title XVIII of <external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; 137 Stat. 691; 41 U.S.C. note prec. 3901).</text></subparagraph></paragraph><paragraph id="HE51917EF2DA245B980DDD47CCB8C2D8D"><enum>(3)</enum><header>Critical infrastructure</header><text>The term <term>critical infrastructure</term> has the meaning given that term in the Critical Infrastructures Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c</external-xref>).</text></paragraph><paragraph id="HB21757DD2F654327A297D69B8310C4E0" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Customs territory of the United States</header><text>The term <term>customs territory of the United States</term> has the meaning given that term in general note 2 of the HTS.</text></paragraph><paragraph id="H330E8387037E48F5AB9C642374D7E75B"><enum>(5)</enum><header>First responder</header><text>The term <term>first responder</term> has the meaning given that term in section 3025 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10705">34 U.S.C. 10705</external-xref>).</text></paragraph><paragraph id="H6A17D993F31345CFADA4C488E6DC49B9"><enum>(6)</enum><header>Foreign adversary country</header><text display-inline="yes-display-inline">The term <term>foreign adversary country</term> means a covered nation, as defined in section 4872(f) of title 10, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2D8D4BA1F686409C9FF8B75E687D4C75"><enum>(7)</enum><header>Secure unmanned aircraft system</header><text display-inline="yes-display-inline">The term <term>secure unmanned aircraft system</term> means an unmanned aircraft system (as defined in section 44801 of title 49, United States Code) that is not manufactured or assembled by a covered foreign entity or in a foreign adversary country.</text></paragraph></section></legis-body></bill>
