introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Anti-Border Corruption Act of 2010 with respect to waiving the polygraph examination requirement for former Federal law enforcement officers seeking employment with U.S. Customs and Border Protection, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Recruitment Enhancement Act</short-title></quote>.</text></section><section id="id44464b12c96c40d082c35276ce472ee2"><enum>2.</enum><header>Hiring flexibility</header><text display-inline="no-display-inline">Section 3 of the Anti-Border Corruption Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/6/221">6 U.S.C. 221</external-xref>) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86BDE7ADF75541569D1E99C348EFBF5B"><subsection commented="no" display-inline="no-display-inline" id="idc468117bad844af3a79a87d6ceffb3eb"><enum>(b)</enum><header>Waiver authority</header><text>The Commissioner for U.S. Customs and Border Protection may waive the application of subsection (a)(1) for any of the following individuals:</text><paragraph commented="no" display-inline="no-display-inline" id="idcf12c58c2b584d048a821cb816e5de3f"><enum>(1)</enum><text>A current, full-time law enforcement officer employed by a State or local law enforcement agency who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id72467dba7e684a47ba906018dec9b9ce"><enum>(A)</enum><text>has served as a law enforcement officer for not fewer than 3 years with no break in service during the most recent 3-year period;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idab253a7874f649dba572442beff9db79"><enum>(B)</enum><text>is authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and has statutory powers for arrest or apprehension;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4a274ab678044ac5a7260a01c509955d"><enum>(C)</enum><text>is not currently under investigation, does not have disciplinary, misconduct, or derogatory records, has not been convicted of, and does not have pending charges related to, a criminal offense or misconduct;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23ba1a60364444f68bf2eea54ce6b864"><enum>(D)</enum><text display-inline="yes-display-inline">has not resigned from a law enforcement officer position under investigation or in lieu of termination;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide03c3bf1ec1b4fe2b929b69a9eb93dbb"><enum>(E)</enum><text display-inline="yes-display-inline">has not been dismissed from a law enforcement officer position; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf734c53ae0594421adc15179d00b700e"><enum>(F)</enum><text>has, within the most recent 10-year period, successfully passed a polygraph examination as a condition of employment with such officer's current law enforcement agency and can provide verification of passing such examination.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id208557363B624DDBA60250CB7B32670E"><enum>(2)</enum><text>A current, full-time Federal law enforcement officer who—</text><subparagraph commented="no" display-inline="no-display-inline" id="idF990C78857B245259B1C915F7062967D"><enum>(A)</enum><text>has served as a law enforcement officer for not fewer than 3 years with no break in service during the most recent 3-year period;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE321EF978EA441A5AA3217E35D8BD301"><enum>(B)</enum><text>is authorized to make arrests, conduct investigations, conduct searches, make seizures, carry firearms, and serve orders, warrants, and other processes;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C467168FEA04C0BBFD1B52074659546"><enum>(C)</enum><text>is not currently under investigation, does not have disciplinary, misconduct, or derogatory records, has not been convicted of, and does not have pending charges related to, a criminal offense or misconduct;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc837624ab5c440897fcbb623a8f275d"><enum>(D)</enum><text display-inline="yes-display-inline">has not resigned from a law enforcement officer position under investigation or in lieu of termination;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9839f334e1d44da089bf86f80be1ff70"><enum>(E)</enum><text display-inline="yes-display-inline">has not been dismissed from a law enforcement officer position; and</text></subparagraph><subparagraph id="id89BB54A5573142B49BE571024D8E87CA" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>holds a current background investigation, in accordance with current standards required to be eligible for access to Top Secret or Top Secret/Sensitive Compartmented Information. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida88274844cbf48e7b7597d712a55e9c3"><enum>(3)</enum><text>A member of the Armed Forces (or of a reserve component thereof) or a veteran who—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf1089535b29e48eda885524a81fc3a92"><enum>(A)</enum><text>has served in the Armed Forces for not fewer than 3 years;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa133d2788b744a48568b985ec13913f"><enum>(B)</enum><text>holds, or has undergone within the most recent 5-year period, a current background investigation in accordance with current standards required to be eligible for access to Top Secret or Top Secret/Sensitive Compartmented Information;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id519760e2c7d245eba1291d55e42d8fb2"><enum>(C)</enum><text>received, or is eligible to receive, an honorable discharge from service in the Armed Forces;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f71928da8624553b3c71daec3a25fed"><enum>(D)</enum><text display-inline="yes-display-inline">has not been convicted of, and does not have pending criminal charges related to, a criminal offense or misconduct; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id542430185d3b4ced9b2f3f18efdc3e6a"><enum>(E)</enum><text display-inline="yes-display-inline">has not committed a military offense under the Uniform Code of Military Justice; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1c75306468c44547a3a0536aa1bb68b1"><enum>(F)</enum><text display-inline="yes-display-inline">does not have disciplinary, misconduct, or derogatory records.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idedfa620673ae4df0a4da874327ad4b57"><enum>(c)</enum><header>Termination of waiver authority</header><text>The authority to issue a waiver under subsection (b) shall terminate on the date that is 5 years after the date of the enactment of the <short-title>Border Patrol Recruitment Enhancement Act</short-title>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id482ab4079694435f8ca90cbc69d34153"><enum>3.</enum><header>Supplemental Commissioner authority and definitions</header><subsection commented="no" display-inline="no-display-inline" id="id5891cdb6bbe44ba6acdc129110c11220"><enum>(a)</enum><header>Supplemental Commissioner authority</header><text>Section 4 of the Anti-Border Corruption Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/376">Public Law 111–376</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3723C500263C490EAF7A2F6C60C4A0CA"><section commented="no" display-inline="no-display-inline" id="id1c21f424ca484a799d362437aad0ee9d"><enum>4.</enum><header>Supplemental Commissioner authority</header><subsection commented="no" display-inline="no-display-inline" id="idfc8e9646964142209fd911318d3f3bf1"><enum>(a)</enum><header display-inline="yes-display-inline">Non-Exemption</header><text>Any individual who receives a waiver pursuant to section 3(b) is not exempt from other hiring requirement relating to suitability for employment and eligibility to hold a national security designated position, as determined by the Commissioner for U.S. Customs and Border Protection.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida9d46ce9e52d46b6b13c67dd5896a009"><enum>(b)</enum><header>Background investigations</header><text>Any individual who receives a waiver pursuant to section 3(b) and holds a background investigation in accordance with current standards required for access to Top Secret or Top Secret Sensitive Compartmented Information shall be subject to an appropriate background investigation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4210d7e38dc4477897947e9d86bd3ec9"><enum>(c)</enum><header>Administration of polygraph examination</header><text>The Commissioner for U.S. Customs and Border Protection is authorized to administer a polygraph examination to an applicant or employee who receives, or is eligible for, a waiver under section 3(b) if information is discovered before the completion of a background investigation that results in a determination that a polygraph examination is necessary to make a final determination regarding suitability for employment or continued employment, as the case may be.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="iddf38e1155e504448bd39b51e885cbcbf"><enum>(b)</enum><header>Report</header><text>The Anti-Border Corruption Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/376">Public Law 111–376</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE234F6FF8BAF4599996BC0A527192515"><section commented="no" display-inline="no-display-inline" id="idf55f3576498b43529cb6ae2ff8f0bb7c"><enum>5.</enum><header>Reporting requirements</header><subsection commented="no" display-inline="no-display-inline" id="ide88ce4a762824aac83b5225d6087a522"><enum>(a)</enum><header>Annual report</header><text>Not later than 1 year after the date of the enactment of the <short-title>Border Patrol Recruitment Enhancement Act</short-title>, and annually thereafter for the following 4 years, the Commissioner for U.S. Customs and Border Protection shall submit a report to Congress that includes, with respect to the reporting period—</text><paragraph commented="no" display-inline="no-display-inline" id="id153341a645764c9794658b479f17ba34"><enum>(1)</enum><text>the number of waivers granted pursuant to section 3(b);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76319b70d05f4c648cf2d8021a2de916"><enum>(2)</enum><text>the number of requests for a waiver under section 3(b) that were denied, including the reasons for each such denial;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc9d8b445127c4015b6a0fa6fbe1c2da0"><enum>(3)</enum><text>the percentage of applicants who were hired after receiving a waiver pursuant to section 3(b);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac803eb81a1646e7ba7e0595a476c78c"><enum>(4)</enum><text>the number of instances in which a polygraph examination was administered to an application who initially received a waiver pursuant to section 3(b), and the results of each such examination;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4024daa86f8c4ab883de035a6b18cc67"><enum>(5)</enum><text>an assessment of the impact of the polygraph waiver program on filling law enforcement positions at U.S. Customs and Border Protection;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf39c249deb81447c84d3a1145350ec13"><enum>(6)</enum><text>additional authorities that U.S. Customs and Border Protection needs to better utilize the polygraph waiver program in order to achieve its intended goals; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3258fd8da774308976fb0ee18048fa1"><enum>(7)</enum><text>any disciplinary actions taken against law enforcement officers hired after receiving a waiver pursuant to section 3(b).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id10c14a8f3cfa43b29ac4d7239c93d0ef"><enum>(b)</enum><header>Additional information</header><text>The first report submitted to Congress pursuant to subsection (a) shall include—</text><paragraph id="idab129ef0d8ea494bace6635d79902038"><enum>(1)</enum><text>an analysis of other employment suitability tests to detect deception that could be used in conjunction with traditional background investigations to evaluate potential employees for suitability; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa71613a2fab40a18f51746dcc2db0c9"><enum>(2)</enum><text>a recommendation regarding whether a test referred to in paragraph (1) should be utilized whenever the polygraph examination requirement is waived pursuant to section 3(b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id249b1aba973b4fd091cc760e6e430a7a"><enum>(c)</enum><header>GAO report</header><text>The Anti-Border Corruption Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/376">Public Law 111–376</external-xref>), as amended by subsections (a) and (b), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6A218F6DAD324F68B8006E7D923D13B7"><section commented="no" display-inline="no-display-inline" id="idca49af4594fc4eada2681c0a90df89eb"><enum>6.</enum><header>GAO report</header><text display-inline="no-display-inline">Not later than 5 years after the date of the enactment of the <short-title>Border Patrol Recruitment Enhancement Act</short-title>, and every 5 years thereafter for the following 10 years, the Comptroller General of the United States shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idd676d44924444dfebc602dd50333a0f8"><enum>(1)</enum><text>review the disciplinary, misconduct, and derogatory records of all individuals hired using the waiver authority under section 3(b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaa9daee509bf49a0ab53735d2ae7211b"><enum>(A)</enum><text>to determine the rates of disciplinary actions taken against individuals hired using such waiver authority compared to individuals hired after passing the polygraph examination required under section 3(a); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id998aee92dbb44e9eab176d50e833fc9f"><enum>(B)</enum><text>to address any other issue relating to discipline by U.S. Customs and Border Protection; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b32a298afd44054a93b1c0a1f7d5483"><enum>(2)</enum><text>submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that describes the results of the review described in paragraph (1), while appropriately protecting sensitive information.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id8762c0daf0c3448a8db449382b77393f"><enum>(d)</enum><header>Definitions</header><text>The Anti-Border Corruption Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/376">Public Law 111–376</external-xref>), as amended by subsections (a), (b), and (c), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id924D96EA1D96483FB683C8EEA653BF9B"><section commented="no" display-inline="no-display-inline" id="id4e41a8a9b5e64a0b9fe9d4752947bf12"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id14e4018ac6cd436e9a95e95c68a026da"><enum>(1)</enum><header>Criminal offense</header><text>The term <term>criminal offense</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd2ef7b1fc0db4c61a5a5c5b477d15256"><enum>(A)</enum><text>any felony punishable by a term of imprisonment of more than 1 year; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8d7b2b72adc45dfbedc92545be2ba6e"><enum>(B)</enum><text>any other crime for which an essential element involves fraud, deceit, or misrepresentation to obtain an advantage or to disadvantage another person.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4028886f0051441ea356f1d5fb92970f"><enum>(2)</enum><header>Federal law enforcement officer</header><text>The term <term>Federal law enforcement officer</term> has the meanings given the term <quote>law enforcement officer</quote> in sections 8331(20) and 8401(17) of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e4d6297515d4553b518305b865ef650"><enum>(3)</enum><header>Military offense</header><text>The term <term>military offense</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc52d010980c640d7b0b76ea89e305775"><enum>(A)</enum><text>an offense for which—</text><clause commented="no" display-inline="no-display-inline" id="id0fad790960764217b3a6dc4e568e2e56"><enum>(i)</enum><text>a member of the Armed Forces may be discharged or separated from service in the Armed Forces; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id1bb2187ddde24b2eb625286ee5841894"><enum>(ii)</enum><text>a punitive discharge is, or would be, authorized for the same or a closely related offense under the Manual for Courts-Martial pursuant to chapter 14–12 of Army Regulation 635–200; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96740921ed134ce0a57420144c996b24"><enum>(B)</enum><text>an action for which a member of the Armed Forces received a demotion in military rank as punishment for a crime or wrongdoing, which was imposed by a court martial or other authority.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c495d868fde485bb0d124be601d4d90"><enum>(4)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given such term in section 101(2) of title 38, United States Code.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
