        <official-title>To require the Financial Crimes Enforcement Network to issue an advisory
            about how homegrown violent extremists and other perpetrators of domestic terrorism
            procure firearms and firearm accessories, and for other purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gun Violence Prevention Through Financial Intelligence Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Advisory on the procurement of firearms and firearm accessories</header>
            <subsection id="H2E208CDE1702404B8D2F6D0F59CE6C4D">
                <enum>(a)</enum>
                <header>Definitions</header>
 <text display-inline="yes-display-inline">In this section:</text> <paragraph id="H481D522CE58E48F197319A46AC86A3EA"> <enum>(1)</enum> <header>Domestic terrorism</header> <text display-inline="yes-display-inline">The term <term>domestic terrorism</term> has the meaning given the term in section 2331 of title 18, United States Code.</text>
                </paragraph>

                    <enum>(2)</enum>
                    <header>FinCEN</header>
 <text display-inline="yes-display-inline">The term <term>FinCEN</term> means the Financial Crimes Enforcement Network.</text>
                </paragraph>

                    <enum>(3)</enum>
                    <header>Financial institution</header>
 <text>The term <term>financial institution</term> has the meaning given the term in section 5312(a) of title 31, United States Code.</text>
                </paragraph>

                    <enum>(4)</enum>
                    <header>Firearm</header>
 <text>The term <term>firearm</term> has the meaning given the term in section 921(a) of title 18, United States Code.</text>
                </paragraph>
            </subsection>
            <subsection id="H72AEB1806EE94359A18C69144BB9C607">
                <enum>(b)</enum>
                <header>Request for information</header>
                <paragraph id="H6959F4F0D60D49689F1B8093AE46BED2">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>Not later than 1 year after the date of enactment of this Act, FinCEN shall request information from financial institutions for the purpose of developing an advisory about the identification and reporting of suspicious activity relating to—</text>
                    <subparagraph id="HD8E1FF925327452E848BAE054BDF0F14">
                        <enum>(A)</enum>
 <text>how homegrown violent extremists and perpetrators of domestic terrorism procure firearms and firearm accessories for the purpose of carrying out lone actor or lone wolf acts of terror within the United States; and</text>
                    </subparagraph>
                    <subparagraph id="HD84D52EA2CDC4051B85F4173047B1362">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">the ways in which the firearms market in the United States is exploited to facilitate gun violence in the United States.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="id8D5E2D914B2E4D0ABDFEF70436A3EC6A">
                    <enum>(2)</enum>
                    <header>Application of section <enum-in-header>5318(g)</enum-in-header> of title
                        31</header>
 <text>Section 5318(g) of title 31, United States Code, shall apply to a request for information from a financial institution by FinCEN under paragraph (1) in the same manner that section applies to a requirement by the Secretary of the Treasury of a financial institution to report a suspicious transaction under that section.</text>
                </paragraph>
                <paragraph id="H3510F81F7FD14AAEB79A6D97453A61BE">
                    <enum>(3)</enum>
                    <header>Tailoring</header>
 <text display-inline="yes-display-inline">In requesting information from a financial institution under paragraph (1), FinCEN shall consider the size of the financial institution and tailor the request accordingly.</text>
                </paragraph>
                <paragraph id="H8E261104A116426990236FD5ECBD4EB5">
                    <enum>(4)</enum>
                    <header>Consultation</header>
 <text display-inline="yes-display-inline">Before requesting information from a financial institution under paragraph (1), FinCEN shall consult, with respect to the nature of the request, with—</text>
                    <subparagraph id="H4B00A7E303B54BDA84F4E30BDFD484B6">
                        <enum>(A)</enum>
 <text>the Director of the Federal Bureau of Investigation;</text> </subparagraph> <subparagraph id="HE0293352F1BD4E5EA5C7BCBAE8434344"> <enum>(B)</enum> <text>the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives of the Department of Justice; and</text>
                    </subparagraph>
                    <subparagraph id="H452791B534A34A199350D3BC1A011C4A">
                        <enum>(C)</enum>
 <text>sellers of firearms and firearm accessories.</text> </subparagraph> </paragraph> </subsection> <subsection id="HE986B11D880F45DA8D4FEA830C389B89"> <enum>(c)</enum> <header>Advisory</header> <paragraph id="H766B5BBC833C41CC9131352D0BA44158"> <enum>(1)</enum> <header>Sufficient information collected</header> <text display-inline="yes-display-inline">Not later than 540 days after the date of enactment of this Act, if FinCEN determines that the information collected under subsection (b)(1) is sufficient to develop the advisory described in that subsection, FinCEN shall issue the advisory.</text>
                </paragraph>
                <paragraph id="HEDE9A968632C46EB8EBA3328D6499E88">
                    <enum>(2)</enum>
                    <header>Insufficient information collected</header>
 <text display-inline="yes-display-inline">Not later than 540 days after the date of enactment of this Act, if FinCEN determines that the information collected under subsection (b)(1) is not sufficient to develop the advisory described in that subsection, FinCEN shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report that describes—</text>
                    <subparagraph id="H7580BAA232E1447EBBA12048977BCDDA">
                        <enum>(A)</enum>
 <text>the type information collected under subsection (b)(1);</text> </subparagraph> <subparagraph id="H572ABB28FB374B45874DE27481F1B38E"> <enum>(B)</enum> <text>the methodology used to collect such information;</text>
                    </subparagraph>
                    <subparagraph id="HE222C2A75AB24BB5813410D5FBBF6987">
                        <enum>(C)</enum>
 <text>the degree to which financial institutions provided information requested;</text>
                    </subparagraph>
                    <subparagraph id="H84B07EEB1C744AFE8FC9D5D2D02E789C">
                        <enum>(D)</enum>
 <text>why such information is not sufficient to develop the advisory described in subsection (b)(1); and</text>
                    </subparagraph>
                    <subparagraph id="HDA38FA22EA9945A0B8C40217C305CA05">
                        <enum>(E)</enum>
 <text>any barriers to obtaining the information that is required to develop the advisory described in subsection (b)(1).</text>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection id="H8D96E756413246AF8871670DD47ABCC5">
                <enum>(d)</enum>
                <header>Rulemaking</header>
 <text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, FinCEN, in consultation with the Director of the Federal Bureau of Investigation and the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives of the Department of Justice, shall promulgate a rule that defines the following terms for the purpose of this section:</text>

                    <enum>(1)</enum>
 <text>Firearm accessory.</text> </paragraph> <paragraph id="H8D4FEFEAC93E4042988BE3808B7FFD6A"> <enum>(2)</enum> <text display-inline="yes-display-inline">Homegrown violent extremist.</text>
                </paragraph>
