 intercollegiate athletic associations from the antitrust laws.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id3a5ddabd60864056a41beb036f86acbd" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Collegiate Sports Integrity Act</short-title></quote>.</text></section><section id="S1"><enum>2.</enum><header>Antitrust exemption for intercollegiate athletic conferences and
 associations</header><subsection commented="no" display-inline="no-display-inline" id="id72cff72ff6d548fd84417d5dff38d4b8"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida33f6a1f7afd440fbb1fdf7a31c09f49"><enum>(1)</enum><header>Antitrust laws</header><text>The term <term>antitrust laws</term> has the meaning given the term in the first section of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12</external-xref>), except that such term includes section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) to the extent such section 5 applies to unfair methods of competition.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e1eda4b74874e5c998ccce53082f846"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d5270ff099c4935819186353feefad6"><enum>(3)</enum><header>Intercollegiate athletic conference</header><text>The term <term>intercollegiate athletic conference</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id05ac78bad3c24c038da98c90c1ae0b79"><enum>(A)</enum><text display-inline="yes-display-inline">an organization or association that—</text><clause id="id1bd9671537df4a2380558026e5b57aae"><enum>(i)</enum><text>exclusively has as members 2 or more institutions of higher education; and</text></clause><clause id="id2a138ab0207e451f87f9bfd27bd339e9"><enum>(ii)</enum><text>arranges championships and sets rules for intercollegiate athletic competition; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc61410ac90f4476fa3f338ae89a72d32"><enum>(B)</enum><text>any institution of higher education that competes against another institution of higher education in an athletic competition.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id919d3e933b1a460c9d74839430fb2568"><enum>(4)</enum><header>Interstate intercollegiate athletic association</header><text display-inline="yes-display-inline">The term <term>interstate intercollegiate athletic association</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idddd816cdc25144aab87b2a8f48deabb9"><enum>(A)</enum><text display-inline="yes-display-inline">means a not-for-profit corporation, an association, or any other group organized in the United States that—</text><clause commented="no" display-inline="no-display-inline" id="ida21ce73aafd44be18f8fd1f9e5d77080"><enum>(i)</enum><text>sponsors or arranges intercollegiate athletic competition between institutions and intercollegiate athletic conferences;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb654b0f4871d4cd8bf853df800cbce69">
                            <enum>(ii)</enum>
 <text>sets common rules, standards, procedures, or guidelines for the administration of intercollegiate athletic competition at institutions; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idfdb00d030eaf4845972be4d0c29da9f4"><enum>(iii)</enum><text display-inline="yes-display-inline">is composed of 2 or more institutions or conferences that are located in different States; and</text></clause></subparagraph><subparagraph id="id03c1df59e3324fd89ed35c66a9e4252e"><enum>(B)</enum><text>does not include a corporation, association, or other group affiliated with professional athletic competition.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6f7f9778a1544e99871a62a6eb0db13f"><enum>(b)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">The antitrust laws shall not apply to intercollegiate athletic conferences or interstate intercollegiate athletic associations.</text></subsection></section></legis-body></bill>
