id="id7b23ea99ecc243d8a7b1da030136a584" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Protecting covered information in public records</header><subsection id="idA7C1B1A97D614D259FA0B0C2F4619367" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idb691e3c3340e48fdafca1850d4342ef2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Applicable legislative officers</header><text display-inline="yes-display-inline">The term <term>applicable legislative officers</term> means—</text><subparagraph commented="no" id="id9482DFFE624E479889079ACF5AFBD5F2" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a Member of the Senate or a designated Senate employee, the Sergeant at Arms and Doorkeeper of the Senate and the Secretary of the Senate, acting jointly; and</text></subparagraph><subparagraph id="id51FB3ED875EF4A11AFEF9880731D4E69" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a Member of, or Delegate or Resident Commissioner to, the House of Representatives or a designated House employee, the Sergeant at Arms of the House of Representatives and the Chief Administrative Officer of the House of Representatives, acting jointly.</text></subparagraph></paragraph><paragraph id="id6066ea830a4241018d3a7d1cdeecafaf" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">At-risk individual</header><text display-inline="yes-display-inline">The term <term>at-risk individual</term> means—</text><subparagraph id="idd47e9c2ca5654852abb85c776f776a92" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a Member of Congress;</text></subparagraph><subparagraph id="id802c51238f354dce8dd5f0ef77712e5b" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any individual who is the spouse, parent, sibling, or child of an individual described in subparagraph (A);</text></subparagraph><subparagraph id="idda2edc75f2814f309163b3edddfb1798" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any individual to whom an individual described in subparagraph (A) stands in loco parentis;</text></subparagraph><subparagraph id="ide6dcc5ccdbd747daa4d7e716ecce4733" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">any other individual living in the household of an individual described in subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc9bd4aeb4754151ad087edccf2b1756"><enum>(E)</enum><text display-inline="yes-display-inline">any designated Senate employee; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id340d8234113a40e8b6630b5919c0b2cd"><enum>(F)</enum><text display-inline="yes-display-inline">any designated House employee; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3fdf789e9bb473caf9c55bfbf5190c5"><enum>(G)</enum><text display-inline="yes-display-inline">a former Member of Congress.</text></subparagraph></paragraph><paragraph id="id91655530ad2d43dcbbe2796bee464ed6" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Candidate</header><text display-inline="yes-display-inline">The term <term>candidate</term> has the meaning given the term in section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb43fd41eed8047518b4c256b4b73dc84"><enum>(4)</enum><header display-inline="yes-display-inline">Covered employee</header><text display-inline="yes-display-inline">The term <term>covered employee</term> has the same meaning given such term in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>).</text></paragraph><paragraph id="idd0202d29c551447991f56c3735a2f2c4" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Covered information</header><text display-inline="yes-display-inline">The term <term>covered information</term>— </text><subparagraph commented="no" display-inline="no-display-inline" id="id8a5e28e138a94ef4a21c46537e81b549"><enum>(A)</enum><text display-inline="yes-display-inline">means—</text><clause id="id8be93ae575d143da9725c618503eb0f6" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a home address, including a primary residence or secondary residences;</text></clause><clause id="id10644094c82a4c3698f7268e34d5c506" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a home or personal mobile telephone number;</text></clause><clause id="idf6844faf88b84e898315317ecc7caa97" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a personal email address;</text></clause><clause id="id5e0bd5d65ac64285aa69cdbb9aa283eb" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">a social security number or driver’s license number;</text></clause><clause id="id951fc640813142559a9c4bf0d35e85ef" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">a bank account or credit or debit card number;</text></clause><clause id="idd4aa8828b4bc469d933902b1319bb039" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">a license plate number or other unique identifier of a vehicle owned, leased, or regularly used by an at-risk individual;</text></clause><clause id="id33914bf87c36426f9a14093e91112789" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">the identification of a child, who is under 18 years of age, of an at-risk individual;</text></clause><clause id="idfcb3e02416d140a5949bf4c9f2f5dc7f" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">information regarding current or future school or day care attendance, including the name or addresses of the school or day care;</text></clause><clause id="id96b430f870804a46a78b6ff13e007856" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">information regarding schedules of school or day care attendance or routes taken to or from the school or day care by an at-risk individual;</text></clause><clause id="id813ce7404a9c404685eef3829e7c6ec6" commented="no" display-inline="no-display-inline"><enum>(x)</enum><text display-inline="yes-display-inline">information regarding routes taken to or from an employment location by an at-risk individual; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida3116df4b20e4bc983eb702a47035bbd"><enum>(xi)</enum><text display-inline="yes-display-inline">precise geolocation data that is not anonymized and can identify the location of a device of an at-risk individual; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a4ab6ed6f934f7e8ef4e016d146df32"><enum>(B)</enum><text display-inline="yes-display-inline">does not include information described in subparagraph (A) that is contained in—</text><clause id="id2823508190d4438aafee357f4c6fb888" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">any report or other record required to be filed with the Federal Election Commission; or</text></clause><clause id="id5cf265e0e6d1447c96397e6f5f12bfc3" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">any report or other record otherwise required under Federal or State law to be filed—</text><subclause id="ida3ae927a917948a4bb877ade8b6c80ed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">by an individual to qualify as a candidate for the office of Member of Congress; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id87cdf96335e74ddfb9df42ea6a78c6c3"><enum>(II)</enum><text display-inline="yes-display-inline">by any candidate for the office of Member of Congress.</text></subclause></clause></subparagraph></paragraph><paragraph id="id1d3c97b47c044684b12b8ed10e6d840d" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Data broker</header><subparagraph id="ide0af1df8ea374c39811ae38d866a5e37" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>data broker</term> means a commercial entity engaged in collecting, assembling, or maintaining personal information concerning an individual who is not a customer, client, or an employee of that entity in order to sell the information or otherwise profit from providing third-party access to the information.</text></subparagraph><subparagraph id="id3291d8090b224d0c9e7e34b3c16a1d5b" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>data broker</term> does not include a commercial entity engaged in the following activities:</text><clause id="id9e59b0f7efdd451a8c5a9c0233337cc9" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Engaging in reporting, news-gathering, speaking, or other activities intended to inform the public on matters of public interest or public concern.</text></clause><clause id="idacf31fc2d2544fba8f02370badc72c14" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">Providing 411 directory assistance or directory information services, including name, address, and telephone number, on behalf of or as a function of a telecommunications carrier.</text></clause><clause id="id603f24dc9776481497b5a4cee580bd59" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">Using personal information internally, providing access to businesses under common ownership or affiliated by corporate control, or selling or providing data for a transaction or service requested by or concerning the individual whose personal information is being transferred.</text></clause><clause id="idbd890ca1f0d1454596898242ee5d92ad" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">Providing publicly available information via real-time or near-real-time alert services for health or safety purposes.</text></clause><clause id="id64c991f89508460d94a5ae563dc903da" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">A consumer reporting agency, only while engaging in activity subject to the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>).</text></clause><clause id="id7b9afa84b8a84d3f90869af9c616cc65" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">A financial institution subject to the Gramm-Leach-Bliley Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/102">Public Law 106–102</external-xref>) and regulations implementing that Act.</text></clause><clause id="id83e6845d0dd74f26b7fe1582147b82f5" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">A covered entity for purposes of the privacy regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note).</text></clause><clause id="id8bc7f0c44e6d41739c0ab33b491501b8" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">The collection and sale or licensing of covered information incidental to conducting the activities described in clauses (i) through (vii).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6de6eeafd1634490821e5fc534c281b9"><enum>(7)</enum><header display-inline="yes-display-inline">Designated House employee</header><text display-inline="yes-display-inline">The term <term>designated House employee</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idde6ef8a728ec447e8784892a873b80a8"><enum>(A)</enum><text display-inline="yes-display-inline">a covered employee designated in writing by—</text><clause commented="no" display-inline="no-display-inline" id="id282500e195f549a0986340749329135e"><enum>(i)</enum><text display-inline="yes-display-inline">a Member of, or Delegate or Resident Commissioner to, the House of Representatives; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida3c766af017040c78a0d7d11b5dd2a64"><enum>(ii)</enum><text display-inline="yes-display-inline">an officer of the House of Representatives; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53a7699d986f405a90c81eb3ec7e422d"><enum>(B)</enum><text display-inline="yes-display-inline">an officer of the House of Representatives.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5d86c21e02e6408084a1dbedd757211b"><enum>(8)</enum><header display-inline="yes-display-inline">Designated Senate employee</header><text display-inline="yes-display-inline">The term <term>designated Senate employee</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id89f5f8761ec145fca35253abedef6ef3"><enum>(A)</enum><text display-inline="yes-display-inline">a covered employee designated in writing by—</text><clause commented="no" display-inline="no-display-inline" id="id1e21703811f349e2ae31e7ce6a28060c"><enum>(i)</enum><text display-inline="yes-display-inline">a Member of the Senate; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id628be9b4596f47d3ae670ee99998c03c"><enum>(ii)</enum><text display-inline="yes-display-inline">an officer of the Senate; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6819db1598ae4dcc92799aaf10f944e7"><enum>(B)</enum><text display-inline="yes-display-inline">an officer of the Senate.</text></subparagraph></paragraph><paragraph id="idff7ed42c94d04452baee7a959486ebb7" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Government agency</header><text display-inline="yes-display-inline">The term <term>Government agency</term> includes—</text><subparagraph id="iddc9a80cbbdc9494691a5633cd095e343" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an Executive agency, as defined in section 105 of title 5, United States Code; and</text></subparagraph><subparagraph id="id26e4271b50a04a93a9f3c39f438ddb65" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any agency in the judicial branch or legislative branch.</text></subparagraph></paragraph><paragraph id="idcc5a893d9ae44a049e42ea352197c59d" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">Immediate family member</header><text display-inline="yes-display-inline">The term <term>immediate family member</term> means an at-risk individual—</text><subparagraph id="id850e6bd934a243d6b61f9b0aa6284e6a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">who is the spouse, parent, sibling, or child of another at-risk individual;</text></subparagraph><subparagraph id="id610a7a496559476fad4894e89cf14420" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to whom another at-risk individual stands in loco parentis; or</text></subparagraph><subparagraph id="id14d687935a3f4803b18b0f4a542c59be" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">living in the household of another at-risk individual.</text></subparagraph></paragraph><paragraph id="id430efa3f9e8c4caf9cee0b766687e278" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Member of Congress</header><text display-inline="yes-display-inline">The term <term>Member of Congress</term> means—</text><subparagraph id="id4A9D0ADF924948389E9FF653E1F6D368" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a Member of the Senate; or</text></subparagraph><subparagraph id="id9FE7D42AEE284A3D8A32BE42A7A91B7A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a Member of, or Delegate or Resident Commissioner to, the House of Representatives.</text></subparagraph></paragraph><paragraph id="ida3d4dc15ec864070854b166b34cfbf5b" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header display-inline="yes-display-inline">Transfer</header><text display-inline="yes-display-inline">The term <term>transfer</term> means to sell, license, trade, or exchange for consideration the covered information of an at-risk individual.</text></paragraph></subsection><subsection id="id16dc5bd37fdb4866a74759b42470950f" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Government agencies</header><paragraph id="id5d5af225443640fd8463f02906fca920" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each at-risk individual may—</text><subparagraph id="idf605c84d5a56481587be6a6d2ed35887" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">file written notice of the status of the individual as an at-risk individual, for themselves and their immediate family members, with each Government agency that includes information necessary to ensure compliance with this section, as determined by the applicable legislative officers; and</text></subparagraph><subparagraph id="id7417014b567343baa6e0c0328caf2182" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">request that each Government agency described in subparagraph (A) mark as private their covered information and that of their immediate family members.</text></subparagraph></paragraph><paragraph id="idf8c6377cbe2b4dd99bcc7573cb8fc99a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">No public posting</header><subparagraph id="idAC4E33D4125C4C099D2D86C04DC05ECA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Government agencies shall not publicly post or display publicly available content that includes covered information of an at-risk individual.</text></subparagraph><subparagraph id="id659531512CF34D3D870B60D7BAED33DB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">Upon receipt of a request by an at-risk individual under paragraph (1)(B), a Government agency shall remove the covered information of the at-risk individual, and any immediate family member on whose behalf the at-risk individual submitted the request, from publicly available content not later than 72 hours after such receipt.</text></subparagraph></paragraph><paragraph id="idbd3a66bf15ce4666a17484a3f06cad59" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">Nothing in this section shall prohibit a Government agency from providing access to records containing the covered information of an at-risk individual to a third party if the third party—</text><subparagraph id="id5c1c1c1fe91c4e05888f2712113eeb7a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">possesses a signed release from the at-risk individual or a court order;</text></subparagraph><subparagraph id="id6dc5d6c936d342d0a41984e7260ed47f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is subject to the requirements of title V of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6801">15 U.S.C. 6801 et seq.</external-xref>); or</text></subparagraph><subparagraph id="idf57e155168674457a67870d1636db15b" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">executes a confidentiality agreement with the Government agency.</text></subparagraph></paragraph></subsection><subsection id="idce64e9805d86421191cac917598e1c8f" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Delegation of authority</header><paragraph id="idcb4d5f62e3e74fe9a90e0528c6e58632" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An at-risk individual may directly, or through an agent designated by the at-risk individual, make any notice or request required or authorized by this section on behalf of the at-risk individual. The notice or request shall include information necessary to ensure compliance with this section.</text></paragraph><paragraph id="idb20bd221734d4673a42aaabcf1132e22" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of legislative officers and employees to make requests</header><subparagraph id="id5DFEF46C07F04A30BB118DF540FCE524" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Legislative officers</header><text display-inline="yes-display-inline">Upon written request of a Member of Congress, designated Senate employee, or designated House employee, the applicable legislative officers are authorized to make any notice or request required or authorized by this section on behalf of the Member of Congress, designated Senate employee, or designated House employee, respectively. The notice or request shall include information necessary to ensure compliance with this section, as determined by the applicable legislative officers. Any notice or request made under this subparagraph shall be deemed to have been made by the Member of Congress, designated Senate employee, or designated House employee, as applicable, and comply with the notice and request requirements of this section.</text></subparagraph><subparagraph id="id2afb4030b2d543a1a125134ff86b96e1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">List</header><clause commented="no" display-inline="no-display-inline" id="id22dfea312f4b494789114a6bd213f397"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In lieu of individual notices or requests, the applicable legislative officers may provide Government agencies, data brokers, persons, businesses, or associations with a list of— </text><subclause commented="no" display-inline="no-display-inline" id="ida8acad217ef64ca7a0c2ef895626476d"><enum>(I)</enum><text display-inline="yes-display-inline">Members of Congress, designated Senate employees, and designated House employees making a written request described in subparagraph (A); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0e1582ae955a4b8d98aa6d1d512876ce"><enum>(II)</enum><text display-inline="yes-display-inline">immediate family members of the Members of Congress, designated Senate employees, and designated House employees on whose behalf the written request was made.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idad4c655ffbd34be091951f6a1619dfa6"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">A list provided under clause (i) shall include information necessary to ensure compliance with this section, as determined by the applicable legislative officers for the purpose of maintaining compliance with this section.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2a428a238f7247d8abc4ad42cb220a6d"><enum>(iii)</enum><header display-inline="yes-display-inline">Compliance with notice and request requirement</header><text display-inline="yes-display-inline">A list provided under clause (i) shall be deemed to comply with individual notice and request requirements of this section.</text></clause></subparagraph></paragraph></subsection><subsection id="id5bcae3eda6e44c81ab4c10cefc7df4df" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Data brokers and other businesses</header><paragraph id="id6eaa978c113c44e39d4dccbdcafedcae" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Prohibitions</header><subparagraph id="id140e98606d8647c6ae3adacde9b95062" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Data brokers</header><text display-inline="yes-display-inline">It shall be unlawful for a data broker to knowingly sell, license, trade for consideration, or purchase covered information of an at-risk individual.</text></subparagraph><subparagraph id="id8e136b579d6c4de0acf9a26f080e72e7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Other businesses</header><clause id="id6f5b5b3500a2440cae9f51b2f843a014" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), no person, business, or association shall publicly post or publicly display on the internet covered information of an at-risk individual if the at-risk individual, or an immediate family member on behalf of the at-risk individual, has made a written request to that person, business, or association to not disclose the covered information of the at-risk individual.</text></clause><clause id="id3cdf80c8ad3e408f86418545cdfdaa93" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">Clause (i) shall not apply to—</text><subclause id="id391d96b61439420990125725793b4e6c" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the display on the internet of the covered information of an at-risk individual if the information is relevant to and displayed as part of a news story, commentary, editorial, or other speech on a matter of public concern;</text></subclause><subclause id="idbdd622b1ca244040ba5ad713f396b3b1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">covered information that the at-risk individual voluntarily publishes on the internet after the date of enactment of this Act; or</text></subclause><subclause id="iddadbcb9451d64d039d2a0f22b28dd784" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">covered information lawfully received from a Federal Government source (or from an employee or agent of the Federal Government).</text></subclause></clause></subparagraph></paragraph><paragraph id="id7f965180fa1a4e7f9366b6ff855ffe97" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Required conduct</header><subparagraph id="id4df8bd701cab489d9dc7364f035bee29" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After receiving a written request under paragraph (1)(B)(i), the person, business, or association shall—</text><clause id="id4f0c4944b25740a293fd6fa2f4e80035" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">remove within 72 hours the covered information from the internet and ensure that the information is not made available on any website or subsidiary website controlled by that person, business, or association; and</text></clause><clause id="id5c7f8bf1bb8d4b2e9bcddd2c9bbfd415" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that the covered information of the at-risk individual is not made available on any website or subsidiary website controlled by that person, business, or association.</text></clause></subparagraph><subparagraph id="idc631c37d370248f8998730badee8d57a" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Transfer</header><clause id="id98b0f6e3197e44669c521409332bce4c" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), after receiving a written request under paragraph (1)(B)(i), the person, business, or association shall not transfer the covered information of the at-risk individual to any other person, business, or association through any medium.</text></clause><clause id="idd8f0cf4a33354b5b99282546448bd595" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">Clause (i) shall not apply to—</text><subclause id="id937ed63ebcd94395ae1835662f0fa49f" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the transfer of the covered information of the at-risk individual if the information is relevant to and displayed as part of a news story, commentary, editorial, or other speech on a matter of public concern;</text></subclause><subclause id="id09847be8b665417ead02d54154bc99f0" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">covered information that the at-risk individual voluntarily publishes on the internet after the date of enactment of this Act; or</text></subclause><subclause id="idaae31743afe8481c8e1a6604574a6cfe" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">a transfer made at the request of the at-risk individual or that is necessary to effectuate a request to the person, business, or association from the at-risk individual.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id46ff4cb0f3934cb9b40b7d06c7189280" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Redress</header><text display-inline="yes-display-inline">An at-risk individual whose covered information is made public as a result of a violation of this section may bring an action seeking injunctive or declaratory relief in any court of competent jurisdiction.</text></subsection><subsection id="id4cd880fbda1344b8b4354f8d8206f45b" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Rules of construction</header><paragraph id="id16e89e48e6094c3f9997caff366c324d" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this section shall be construed—</text><subparagraph id="iddce0c66e31594afeb5b9a1182b50a76b" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to prohibit, restrain, or limit—</text><clause id="id8fc770d613144f738eb5c955fb71da08" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the lawful investigation or reporting by the press of any unlawful activity or misconduct alleged to have been committed by an at-risk individual;</text></clause><clause id="id0ddff60d24e4458f905d0705da3c5623" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the reporting on an at-risk individual regarding matters of public concern; or</text></clause><clause id="id43FEFD99B0EE44FABBC2656102E31BA7" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the disclosure of information otherwise required under Federal law;</text></clause></subparagraph><subparagraph id="id3f9ac0981717453093ac9dade20e026d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to impair access to the actions or statements of a Member of Congress in the course of carrying out the public functions of the Member of Congress;</text></subparagraph><subparagraph id="idc631b6cdeb3c48759a34ef4bcc2fc4e9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to limit the publication or transfer of covered information with the written consent of the at-risk individual; or</text></subparagraph><subparagraph id="id26fcb7bfb4e843db9cd45b2947cc0537" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to prohibit information sharing by a data broker to a Federal, State, Tribal, or local government, or any unit thereof.</text></subparagraph></paragraph><paragraph id="id2c01df34425c4f2e8d97b49660383dbe" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Protection of covered information</header><text display-inline="yes-display-inline">This section shall be broadly construed to favor the protection of the covered information of at-risk individuals.</text></paragraph></subsection><subsection id="idb356a0776c0b4adc8b265e9231f45a23" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Severability</header><text display-inline="yes-display-inline">If any provision of this section, or the application of such provision to any person or circumstance, is held to be unconstitutional, the remaining provisions of this section, and the application of the provision to any other person or circumstance, shall not be affected.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20250929" chamber="Senate">Passed the Senate September 29, 2025.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
