<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2139</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250618">June 18, 2025</action-date><action-desc><sponsor name-id="S435">Mr. Sheehy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for expedited procurement for experimental purposes, and for other purposes.</official-title></form><legis-body><section id="idc229161326124b279fbc6baac64fb7c3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Procurement Reform for Immediate Military Equipment Act</short-title></quote> or the <quote><short-title>PRIME Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0974bcb03c254c83960cc1c1c3322d5d"><enum>2.</enum><header>Modifications to procurement for experimental purposes</header><text display-inline="no-display-inline">Section 4023 of title 10, United States Code, is amended—</text><paragraph id="id1fb2264dc9d4433b9d56f7d7919a6b87"><enum>(1)</enum><text>in subsection (a), by striking <quote>ordnance, signal, chemical activity, transportation, energy, medical, space flight, telecommunications, and aeronautical supplies, including parts and accessories, and designs thereof,</quote> and inserting <quote>demonstrations, prototypes, products, supplies, parts, accessories, auxiliary services, and design for defense-related articles</quote>;</text></paragraph><paragraph id="idccab8e21570344e6b3b089805a542e6d"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="idee2d66bb458845109bfa1f20eb608fba"><enum>(A)</enum><text>by inserting <quote>or modified</quote> after <quote>may be made</quote>; and</text></subparagraph><subparagraph id="id980f0f21311342618739014e0555774b"><enum>(B)</enum><text>by inserting <quote>prototyping,</quote> after <quote>greater than necessary for</quote>; and</text></subparagraph></paragraph><paragraph id="idaf6f973acb80407b83cf90078e3b1139"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d285bde79064eb489b04e816844121a"><subsection id="id7a8ac6ea4f994e00abb0be46939a6dcc"><enum>(c)</enum><header>Follow-On production contracts or transactions</header><text>Purchases under this section may allow for follow-on production contracts or transactions without the use of competitive procedures or further justification, even if explicit notification was not provided, if a combatant command submits a written determination that the purchased item successfully completed the experiment and intends to field the item.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
