            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prototype to Production Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Modifications to other transactions</header>
            <subsection id="idf362fd95cbb34b829a3a91108ad51fc7">
                <enum>(a)</enum>
                <header>In general</header>
 <text>Section 4022 of title 10, United States Code, is amended—</text> <paragraph id="id9f1982bb73ac46fda4d90444a396a42c"> <enum>(1)</enum> <text>in subsection (a)—</text>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id43247a01064849d08f4e7555294be4f2">
                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">by amending paragraph (2) to read as follows:</text>
                        <quoted-block style="OLC" display-inline="no-display-inline" id="id42827b8964f84f0ca275e4373db280a5">
                            <paragraph id="idd0cf113f3efd414ca8c81c71a67178b2" indent="up1">
                                <enum>(2)</enum>
 <text>The authority of this section may be exercised for a transaction for a prototype project, or for a transaction for a follow-on production contract or transaction that is awarded pursuant to subsection (f) or (g), that is expected to cost the Department of Defense in excess of $100,000,000 (including all options) only upon a written determination that the requirements of subsection (d) will be met by a head of the contracting activity, or, for the Defense Advanced Research Projects Agency, the Defense Innovation Unit, or the Missile Defense Agency, the director of the agency.</text>
                            </paragraph>

                    </subparagraph>
                    <subparagraph id="idef632daf681c476490f52d8cf29cb9eb">
                        <enum>(B)</enum>
 <text>by amending paragraph (3) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idb6ba1b2e25cd4a4eac423d7970e489d6"> <paragraph id="id200f5b4f8bf947a288a1aa2e852bc966" indent="up1"> <enum>(3)</enum> <text>The authority of the head of the contracting activity, the director of the Defense Advanced Research Projects Agency, the director of the Defense Innovation Unit, the director of the Missile Defense Agency, or the senior procurement executive, as applicable, under paragraph (2), may not be delegated.</text>
                            </paragraph>

                    <enum>(2)</enum>
 <text>in subsection (e)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id95c714c917fb4dbfb9335f4ea81df34d"> <enum>(A)</enum> <text display-inline="yes-display-inline">by amending paragraph (1) to read as follows:</text>

                                <enum>(1)</enum>
 <text>The term <term>head of the contracting activity</term> means those officials within the organization who have responsibility for and manage an acquisition organization and usually hold unlimited procurement authority.</text>
                            </paragraph>

                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idf9a61a6d9e4f4f0d9fe64b5530a769a4">
                        <enum>(B)</enum>
 <text>by adding at the end the following new paragraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id26299d1497a3496eb2cc708c75988052"> <paragraph id="id4d378b6f647042d297480bec07068037"> <enum>(6)</enum> <text>The term <term>follow-on production</term> means a contract or transaction that is intended to further develop, test, produce, deploy, operate, or sustain a capability that was successfully prototyped under the authority established in subsection (a).</text>
                            </paragraph>

                    </subparagraph>
                </paragraph>

                    <enum>(3)</enum>
 <text>by redesignating subsections (h) and (i) as subsections (i) and (j), respectively; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="idf1d025761ed84adb9faedcca46e14cec">
                    <enum>(4)</enum>
 <text display-inline="yes-display-inline">by inserting after subsection (g) the following new subsection:</text>

                            <enum>(h)</enum>
                            <header>Authority To award a production transaction to rapidly field an
                                existing capability</header>
 <text>A production transaction may be awarded, with or without the use of competitive procedures, to acquire emergent and proven technologies and field production quantities of new or upgraded systems that do not require additional development and have been demonstrated in a relevant environment when the appropriate service or component acquisition executive determines in writing that exceptional circumstances justify the use of such a transaction to address a high priority warfighter need.</text>
                        </subsection>
