<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2117</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250618">June 18, 2025</action-date><action-desc><sponsor name-id="S438">Mr. Husted</sponsor> (for himself and <cosponsor name-id="S415">Mr. Warnock</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Task Force on Artificial Intelligence in the Financial Services Sector to report to Congress on issues related to artificial intelligence in the financial services sector, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H33040ABD8C1D40EB8BE4AA25FA625B02"><section section-type="section-one" id="H4C2D692CD4CA4EEC857395FC79C73D3E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Deep Fake Scams Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HFA391C456ED44E59B95CA011E02B4B85"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H0B262F072D144D01833AD9B79CA1D937"><enum>(1)</enum><text display-inline="yes-display-inline">Artificial intelligence is being used in new and innovative ways by the financial services sector.</text></paragraph><paragraph id="HB93750E54AB34F218BD03C449D6A66D3"><enum>(2)</enum><text display-inline="yes-display-inline">Artificial intelligence may provide benefits to banks, credit unions, and banking consumers.</text></paragraph><paragraph id="H4C4BDEDD6DAC4C939D576E177787F96D"><enum>(3)</enum><text display-inline="yes-display-inline">Artificial intelligence poses unique threats to the safety and security of customer accounts.</text></paragraph><paragraph id="H6DF2CD983115428A913A8BAF3DB7826C"><enum>(4)</enum><text display-inline="yes-display-inline">Voice banking is offered by many banks for security and convenience reasons.</text></paragraph><paragraph id="HE33E935232704F4BAE378CEA8C827E30"><enum>(5)</enum><text display-inline="yes-display-inline">The popularity of social media has made video and audio of potential targets easier to obtain for bad actors. These materials can be exploited to replicate the voices and appearances of other people in pursuit of data theft, identity theft, or fraud.</text></paragraph><paragraph id="HC0179BF981C245D1B5487FD4EC51CA9A"><enum>(6)</enum><text>Bad actors could utilize deep fakes, including voice and audio manipulation, to compromise and access the financial accounts of a consumer.</text></paragraph></section><section id="H8732C2C106DE485188814E80E490EB27"><enum>3.</enum><header>Task Force on Artificial Intelligence in the Financial Services Sector</header><subsection id="HE109B922ECCF436A948E59D770456EF5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a Task Force on Artificial Intelligence in the Financial Services Sector (in this section referred to as the <quote>Task Force</quote>).</text></subsection><subsection id="H68B932FF1A834FE4BD41D4A66B4B454A"><enum>(b)</enum><header>Membership</header><text>The Task Force shall consist of the following:</text><paragraph id="HD903BD72283D4F21A392FB54D352C13B"><enum>(1)</enum><text>The Secretary of the Treasury, or a designee, who shall serve as Chair of the Task Force.</text></paragraph><paragraph id="H8880036972CE435C914D5701E6684809"><enum>(2)</enum><text>The Comptroller of the Currency, or a designee.</text></paragraph><paragraph id="H7E9B43546DBB4AF78600C312DCDA617B"><enum>(3)</enum><text>The Chairman of the Board of Governors of the Federal Reserve System, or a designee.</text></paragraph><paragraph id="HCB670A5A82E541A59ACC72EFD280A11C"><enum>(4)</enum><text>The Chairperson of the Federal Deposit Insurance Corporation, or a designee.</text></paragraph><paragraph id="HD1B52EBF8C814761840F21DAC26564E3"><enum>(5)</enum><text>The Director of the Bureau of Consumer Financial Protection, or a designee.</text></paragraph><paragraph id="HC54BE53F318F4B608089902204F1C3EB"><enum>(6)</enum><text display-inline="yes-display-inline">The Chairman of the National Credit Union Administration, or a designee.</text></paragraph><paragraph id="H8E434D7456DC4929840E33272326F1C9"><enum>(7)</enum><text>The Director of the Financial Crimes Enforcement Network, or a designee.</text></paragraph></subsection><subsection id="HE26B9C18C5864822AC09623D81092D5D"><enum>(c)</enum><header>Report</header><paragraph id="H4D47E18B25694ACBB483675830AD06C6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than the end of the 1-year period beginning on the date of enactment of this Act, the Task Force shall submit to Congress a report containing the contents described in paragraph (3).</text></paragraph><paragraph id="HB3A91EBA835A4EE39BB09BAA41A52742"><enum>(2)</enum><header>Consultation</header><subparagraph id="HCFA3C2CE828F4620BC0BE15855E2F74B"><enum>(A)</enum><header>Request for Information</header><text>Not later than 90 days after the date of enactment of this Act, the Task Force shall solicit public feedback on the report required under paragraph (1).</text></subparagraph><subparagraph id="HD4CCBDC5E7714D37B38800FFC8D03637"><enum>(B)</enum><header>Industry and expert stakeholders</header><text>In developing the report required under paragraph (1), the Task Force shall seek out and consult with industry and expert stakeholders, including—</text><clause id="H8A5678465C384BA498B41AA62B4961B4"><enum>(i)</enum><text>depository institutions of varying asset sizes;</text></clause><clause id="H5B4129BC23AC4A7AA0F902FA33D2D683"><enum>(ii)</enum><text>credit unions of varying asset sizes;</text></clause><clause id="H70A44A6F6C7B49358EB5C05106E2D825"><enum>(iii)</enum><text display-inline="yes-display-inline">third-party vendors who use artificial intelligence when providing services to depository institutions and credit unions; and</text></clause><clause id="HA594B73A98874EF4987B8770ACD0F2E7"><enum>(iv)</enum><text>artificial intelligence experts.</text></clause></subparagraph></paragraph><paragraph id="H995BFA054AE44AD096E638FEDC7CADE4"><enum>(3)</enum><header>Contents</header><text>The contents of the report described in this paragraph are as follows:</text><subparagraph id="HDA5F3164ACB24EBFA6746B6D26DCC52B"><enum>(A)</enum><text display-inline="yes-display-inline">A description of how banks and credit unions proactively protect themselves and consumers from fraud utilizing artificial intelligence.</text></subparagraph><subparagraph id="H7D6CC1D8D5584C2F95DF1E31374F7B11"><enum>(B)</enum><text display-inline="yes-display-inline">A list of standard definitions for the different manners in which artificial intelligence is used, including terms like <quote>generative AI</quote>, <quote>machine learning</quote>, <quote>natural language processing</quote>, <quote>algorithmic AI</quote>, and <quote>deep fakes</quote>.</text></subparagraph><subparagraph id="H01E7050B1EDA45E48726FA5A45AF1720"><enum>(C)</enum><text display-inline="yes-display-inline">A description of potential risks that could result from the use of artificial intelligence by bad actors to steal data and identities of consumers and commit fraud.</text></subparagraph><subparagraph id="HFF6EF1FFD35B400784F267990926F15B"><enum>(D)</enum><text>A list of best practices for financial institutions to protect their customers from attempts to steal data and identities of consumers or commit fraud.</text></subparagraph><subparagraph id="HF81912260B4E448AB9F3E8E4336F6749"><enum>(E)</enum><text display-inline="yes-display-inline">Legislative and regulatory recommendations for the regulation of artificial intelligence and to protect consumers from data theft, identity theft, and fraud.</text></subparagraph></paragraph></subsection><subsection id="H6DFF906BC35E4EEAAD35D0C73E6747C8"><enum>(d)</enum><header>Termination</header><text>The Task Force shall terminate on the date that is 90 days after the date on which the final report is issued pursuant to subsection (c).</text></subsection></section></legis-body></bill>
