            commercial motor vehicle operator testing requirements, and for other
 purposes.</official-title></form><legis-body><section id="id26906042aa1b4ea9b69b4e16bb8d5fa4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commercial Motor Vehicle English Proficiency Act</short-title></quote>.</text></section><section id="id4dc366c900c04723a6da6ae8e1b54599" section-type="subsequent-section"><enum>2.</enum><header>Commercial motor vehicle operator testing requirements</header><subsection commented="no" display-inline="no-display-inline" id="id4e02e9bdbb2f49f488344fe673e6a12e"><enum>(a)</enum><header display-inline="yes-display-inline">Testing standards</header><text>Section 31305(a) of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc4c896170e1f4c3da6ba2e673f06ca90"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting the clauses appropriately;</text></paragraph><paragraph id="idb53e3fe105bf4fbea386b360f1e0772b"><enum>(2)</enum><text>in paragraph (5)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0fbb2fef72d34228929eb8453dee83a2"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by redesignating clauses (i) through (iv) as subclauses (I) through (IV), respectively, and indenting the subclauses appropriately; and</text></subparagraph><subparagraph id="ide148558f184244d28f37a4e3e043171d"><enum>(B)</enum><text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting the clauses appropriately;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddbde8abf7d1843a4ac0e4320705c00d3"><enum>(3)</enum><text>in paragraph (8), by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting the clauses appropriately;</text></paragraph><paragraph id="id2bd1a7d6fc88456aa490e5f63392105f"><enum>(4)</enum><text>by redesignating paragraphs (1) through (8) as subparagraphs (A) through (H), respectively, and indenting the subparagraphs appropriately;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddcd76d46900d46c3994ce1efc0545303"><enum>(5)</enum><text>in the matter preceding subparagraph (A) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2d64b132b21948b9ba88d7fc0bcec1e8"><enum>(A)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>The regulations</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ided5ef13d71054046b1dbd5551426fb0d"><paragraph commented="no" display-inline="no-display-inline" id="id01389250f07a40d092b5ce5a7590042d"><enum>(2)</enum><header>Requirements</header><text>The regulations under paragraph (1)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id892cc15c73ac4bb394ae601f1d44c9be"><enum>(B)</enum><text>in the first sentence, by striking <quote>The Secretary of Transportation shall prescribe regulations on</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id315bdf64efe6447987e3489a556a5b15"><paragraph id="id0a1877af3480459fa48692603f330174"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation (referred to in this section as the <term>Secretary</term>) shall prescribe regulations establishing</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1493b1468ac04bb28891222a29823823"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8d8f69705f3f4d848279d4d723e18329"><paragraph commented="no" display-inline="no-display-inline" id="id5ce29cc8b5a747ccb25f3671b426cc67"><enum>(3)</enum><header>English language proficiency</header><subparagraph commented="no" display-inline="no-display-inline" id="ida4824f5f9e5542289bdbcef4b965c4b5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of law (including regulations), effective beginning on the date that is 2 years after the date of enactment of the <short-title>Commercial Motor Vehicle English Proficiency Act</short-title>, an individual shall not be eligible to pass a knowledge test, in written, verbal, or automated format, under this subsection, or to receive a certification of fitness to operate a commercial motor vehicle, unless the individual demonstrates the ability to understand in English the basic information needed to effectively operate, and to communicate in English while operating, a commercial motor vehicle, including—</text><clause id="id1f104eefead24c72b069a22df333cd79"><enum>(i)</enum><text>reading and understanding traffic signs in English;</text></clause><clause id="idf718bdb47364444e8efc90905613d3c6"><enum>(ii)</enum><text>communicating in English with traffic safety officers, border patrol agents, agricultural checkpoint officers, and cargo weight-limit station personnel; and</text></clause><clause id="idcbb01ad869724f02ab4e028c2bc0f33b" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>providing and receiving feedback and directions in English.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62edc3e5626d4d8cb48e42afe924d3a7"><enum>(B)</enum><header display-inline="yes-display-inline">Prohibition</header><text>Notwithstanding any other provision of law (including regulations), effective beginning on the date that is 2 years after the date of enactment of the <short-title>Commercial Motor Vehicle English Proficiency Act</short-title>, a knowledge test, in written, verbal, or automated format, under this subsection may not be administered in any language other than English.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf8c8b5858fbe46809100d917bdca0f65"><enum>(b)</enum><header>Amendment to regulations</header><text display-inline="yes-display-inline">The Secretary of Transportation shall modify the regulations contained in part 383 of title 49, Code of Federal Regulations, as the Secretary of Transportation determines to be necessary to implement this section and the amendments made by this section by the date that is 2 years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
