which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to prohibit a person from engaging in the business of destroying firearms unless such person has received a license to do so from the Attorney General, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HEAEAB321EEDC48018D26FD37C4994667"><section section-type="section-one" id="H06F781BE07614A36A558045074AF9CAC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Firearm Destruction Licensure Act of 2025</short-title></quote>.</text></section><section id="H90AA7FBE7FA8487AAAB5F74C3E746AAE"><enum>2.</enum><header>License required to engage in the business of destroying firearms</header><subsection id="HFD408C76B51E40708513B88A230D518E"><enum>(a)</enum><header>Definitions</header><text>Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="H7FA3EDCCF0624B878E9FC21C3A423EDD"><enum>(1)</enum><text>in paragraph (11)—</text><subparagraph id="HE7680E4C37A04FBC84C776030C709DA7"><enum>(A)</enum><text>by striking <quote>or (C)</quote> and inserting <quote>(C)</quote>; and</text></subparagraph><subparagraph id="HC5292428F8AF44D6A6A9CC95FAA4BBFD"><enum>(B)</enum><text>by inserting <quote>, or (D) any person who is a firearm destroyer</quote> after <quote>pawnbroker</quote>; </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE7B8A76E56E64A43941AC855A07D42FA"><enum>(2)</enum><text>in paragraph (21)—</text><subparagraph id="H6EB4B64D2FD64C2294D169679C16EE54"><enum>(A)</enum><text>by redesignating subparagraphs (E) and (F) as subparagraphs (F) and (G), respectively; and</text></subparagraph><subparagraph id="H23A982BDEAF341FB9816E6BC67EE3F9A"><enum>(B)</enum><text>by inserting after subparagraph (D) the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HB6F5DE8F56534467A3E4DD626D20036D"><subparagraph id="H0C7286A7785042268026BA024A8322A6" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">as applied to destroying firearms, engaging in a business or occupation that includes receiving a firearm for the purposes of destroying such firearm;</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE6D3352E3AE946F1A6C9903DE98DF2A1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H85BD312C88D74B2291E1A0A8E4F03A39"><paragraph id="HEE4C586E2EA44DD8AA6A019DA4DC52CB" indent="up1"><enum>(39)</enum><text display-inline="yes-display-inline">The term <term>firearm destroyer</term>—</text><subparagraph id="H4FEE5695B0774924AEF3D82963799AE5"><enum>(A)</enum><text>means any person engaged in the business of destroying firearms; and</text></subparagraph><subparagraph id="HC103C76B2C1A47E58A48D780DD6F40CB"><enum>(B)</enum><text>does not include a local law enforcement authority, Federal law enforcement agency, or any other entity of a Federal, State, local, or Tribal government.</text></subparagraph></paragraph><paragraph id="H3F95D7BF04E2493BA4CA606474C4D709" indent="up1"><enum>(40)</enum><text>The term <term>covered method of firearm destruction</term> means a method that renders a firearm and all parts, attachments, accessories, or other components received with such firearm unable to be restored to working condition and otherwise reduced to scrap.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H26156C4084DC4709815E1C61EC92A0B0"><enum>(b)</enum><header>Unlawful acts</header><text>Section 922 of title 18, United States Code, is amended—</text><paragraph id="H7A0C27594B7C4513804D94EFC10F990E"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="HE494AD8530134999B00FAD858ACD25B6"><enum>(A)</enum><text>in subparagraph (A) by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H673C1AD156A54256B10E30B3A127D7F3"><enum>(B)</enum><text>in subparagraph (B) by adding <quote>or</quote> at the end; and </text></subparagraph><subparagraph id="HA7219C33DD1140E09BB2EA6275BD8036"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H12D8D84413EC41F4A8C4A4BA3344D05B"><subparagraph id="HBE0AB0CBB23F439E8E3478F744C99CA6"><enum>(C)</enum><text display-inline="yes-display-inline">except a licensed dealer to engage in the business of destroying firearms;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5938F690B0B84A4E9B7144E4F5BA6C79"><enum>(2)</enum><text>in subsection (u) by inserting <quote>destroying,</quote> after <quote>manufacturing,</quote>. </text></paragraph></subsection><subsection id="H128F8BF4397F42558F02CA30D89A0BD7"><enum>(c)</enum><header>Licensing</header><text>Section 923 of title 18, United States Code, is amended—</text><paragraph id="H28740AE0E51945DC86C803646F210B7D"><enum>(1)</enum><text>in subsection (a) by inserting <quote>destroying,</quote> before <quote>or dealing</quote>; </text></paragraph><paragraph id="H4B70CF73866B4204894AAB9CB692032D"><enum>(2)</enum><text>in subsection (d)(1)(G)—</text><subparagraph commented="no" id="HA26B68A3A3054C639AE5D9F3901665D1"><enum>(A)</enum><text>by striking <quote>that secure</quote> and inserting the following:</text><quoted-block style="USC" display-inline="yes-display-inline" id="HB81F7170D44849D2B29007F2B996B7CC"><text>that—</text><clause commented="no" id="HB3D90209E9CD4249AB1B82BDC8818A35" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">secure</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA8925AF0C68945F0A48A928BE6913D51"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H397394DB6F7C4DB8A66470C0B6E0A2E5"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HEF9637770E8E469FAC69345F186482DF"><clause id="H3A84C23F1483457A947948A5B05C3271" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">if the applicant receives a firearm from a local law enforcement authority, Federal law enforcement agency, or any other entity of a Federal, State, local, or Tribal government for the purposes of destroying such firearm, the applicant will destroy such firearm using a covered method of firearm destruction.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6E0BD894328E484BA24E0AD361D60899"><enum>(3)</enum><text>in subsection (g)—</text><subparagraph id="H357D4C7815CA4DAE9E022FB89F190942"><enum>(A)</enum><text>in paragraph (1)(A) by inserting <quote>destruction,</quote> after <quote>sale,</quote>; and</text></subparagraph><subparagraph id="HB4C16C7E5F8F43EF927D43806AE4993F"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HA62AE02091914A8BBDDD2D50AD761C4C"><paragraph id="HB2C8E99DC57A4FD793CDC68FD23591A9" indent="up1"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7B6AC32B93444594B6EFA5228F33F8AA"><enum>(A)</enum><text>Not later than 1 year after the effective date of the <short-title>Firearm Destruction Licensure Act of 2025</short-title>, and each year thereafter, each licensed dealer who is a firearm destroyer shall submit a report to the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives on the number of firearms the licensed dealer destroyed during the previous year, including the number of firearms that the licensed dealer—</text><clause id="H4979C506D47244B88FC4088EE3935ABC" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">received for the purposes of destroying such firearms; </text></clause><clause id="H542F735B37734162B773907FDD4438DC" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">received from a local law enforcement authority, Federal law enforcement agency, or any other entity of a Federal, State, local, or Tribal government and destroyed using a covered method of firearm destruction; and</text></clause><clause id="HD2C6AA34BBD24D7B9F06C48A43B1FCCD" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">destroyed other than pursuant to clause (ii), including the number of firearms whereby the licensed dealer destroyed the frame, receiver, or other part, attachment, accessory, or other component of a firearm but did not render all parts, attachments, accessories, or other components received with such firearm unable to be restored to working condition and otherwise reduced to scrap.</text></clause></subparagraph><subparagraph id="HC62DE912B39B4A3CBFF82861A59C3C7F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Attorney General, acting through the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, shall make publicly available—</text><clause id="H71848C2DEAE243E8A73B94F4CA7395B9"><enum>(i)</enum><text>each report submitted under subparagraph (A); and</text></clause><clause id="H2D97B437DA8343B5B7CA18C93473F4B6"><enum>(ii)</enum><text>an aggregate of the information submitted under subparagraph (A). </text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD9244D1F00E8419FA737C051F2C51949"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA5D3E84CE1D048328F045311D2FCCD45"><subsection id="HAB3D708734354E86AF0D259858E0B103"><enum>(m)</enum><text display-inline="yes-display-inline">A licensed dealer who receives a firearm from a local law enforcement authority, Federal law enforcement agency, or any other entity of a Federal, State, local, or Tribal government for the purposes of destroying such firearm shall—</text><paragraph id="H98C48502E5474CC5A823E738B7CAF17B"><enum>(1)</enum><text display-inline="yes-display-inline">destroy such firearm using a covered method of firearm destruction, unless the licensed dealer and such entity agree otherwise; and</text></paragraph><paragraph id="H1AA9A4B7BA6D4EEA99EE034B50D1E8DB"><enum>(2)</enum><text display-inline="yes-display-inline">make publicly available information regarding any amount the licensed dealer charges a local law enforcement authority, Federal law enforcement agency, or any other entity of a Federal, State, local, or Tribal government to destroy firearms.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="HED91C98188B44C8EAEFB404A680795F5"><enum>(d)</enum><header>Penalties</header><text>Section 924(a)(5) of title 18, United States Code, is amended by striking <quote>subsection (s)</quote> and inserting <quote>subsection (a)(1)(C), (s),</quote>.</text></subsection><subsection id="H3C126DD6352446A4B74442F207F5AE72"><enum>(e)</enum><header>Grants for destroying firearms</header><text>The Brady Handgun Violence Prevention Act (<external-xref legal-doc="public-law" parsable-cite="pl/103/159">Public Law 103–159</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HF25FA9F61F99474C9E195AD4DB979E53"><section id="H4168CE30A144409D8DDA5168FDE4352A"><enum>107.</enum><header>Grants for destroying firearms</header><subsection id="HF003C9E3004044FE9486DE128C7C1305"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1766E92B29AD452FAFFA48FD8EABF156"><enum>(1)</enum><header>Covered method of firearm destruction; licensed dealer</header><text>The terms <term>covered method of firearm destruction</term> and <term>licensed dealer</term> have the meanings given such terms in section 921(a) of title 18, United States Code. </text></paragraph><paragraph id="HDF072CC937F748569F0075889F5D0A38"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a State, local, or Tribal government.</text></paragraph><paragraph id="HA76BBFAAF487435F904219991AC8B295"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph></subsection><subsection id="H0028A1F7C69B498EA96BFCCD3B0EB45D"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the effective date of the <short-title>Firearm Destruction Licensure Act of 2025</short-title>, the Attorney General, acting through the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, shall award grants to eligible entities for the purposes of paying a licensed dealer to destroy firearms using a covered method of firearm destruction. </text></subsection><subsection id="H56BE24E65FC649B3A6ABC3520B39F3DE"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section such sums as may be necessary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H515E8862CC1144D5A2178C5B7C997EED"><enum>(f)</enum><header>Applicability; rulemaking</header><paragraph id="HF3ACD7E959DD43C6BC72BC613992C632"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the terms <term>dealer</term>, <term>firearm destroyer</term>, and <term>licensed dealer</term> have the meanings given such terms in section 921(a) of title 18, United States Code, as amended by this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b0c752b1ed345639d776e476226c22f"><enum>(2)</enum><header>Applicability</header><subparagraph id="HED2930F7E2A34C7390205B1C9E562FEE"><enum>(A)</enum><header>In general</header><text>The amendments made by this section shall apply with respect to a dealer who obtains a license under section 923 of title 18, United States Code, prior to the effective date of this section.</text></subparagraph><subparagraph id="H43AE13CCD19743D29931681FE6DC3529"><enum>(B)</enum><header>Certification of compliance</header><text display-inline="yes-display-inline">Not later than the effective date of this section, a dealer who obtains a license under section 923 of title 18, United States Code, prior to the effective date of this section shall submit to the Attorney General the certification required under section 923(d)(1)(G)(ii) of such title, as amended by this Act.</text></subparagraph><subparagraph commented="no" id="H94AF981411CC47C198AA0C48083F94B4"><enum>(C)</enum><header>Failure to comply</header><text>The Attorney General may, after notice and opportunity for hearing, revoke the license of a dealer issued under section 923 of title 18, United States Code, if the holder of such license willfully violates subparagraph (B).</text></subparagraph></paragraph><paragraph id="H23E7A284F80442CDB2D1F6F45396C58C"><enum>(3)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General, acting through the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, shall issue a final rule to implement this section, including by prescribing—</text><subparagraph id="H38BD76A79CB94714B75E645AA13C09F4"><enum>(A)</enum><text display-inline="yes-display-inline">acceptable methods of destruction to render a firearm and all parts, attachments, accessories, or other components received with such firearm unable to be restored to working condition and otherwise reduced to scrap; and</text></subparagraph><subparagraph id="HD5E64C381A88420E986F436506350A21"><enum>(B)</enum><text>records or documents required to be kept by a licensed dealer who is a firearm destroyer.</text></subparagraph></paragraph></subsection><subsection id="HD4937BC36584435BBEB4476B6F94AE2A"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect 180 days after the date of enactment of this Act. </text></subsection></section></legis-body></bill>
