which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of funds for military force against Iran, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No War Against Iran Act</short-title></quote>.</text></section><section id="id9f244b7c5a9e44b69d44c8bf25367609"><enum>2.</enum><header>Prohibition of unauthorized military force in or against Iran</header><subsection id="id2b9ea832ea134de4a0f1ea28cbcee7e8"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text><paragraph id="id037e5ffa71074c49b932aa05223130e9"><enum>(1)</enum><text>Congress has the sole power to declare war under article I, section 8 of the United States Constitution.</text></paragraph><paragraph id="idaace5ddbb005419db0bcc77d343ff51d"><enum>(2)</enum><text>Congress has not declared war against Iran nor has Congress enacted a specific statutory authorization for the use of force against Iran.</text></paragraph><paragraph id="id796a18e647364102bf0085a15998df10"><enum>(3)</enum><text>Article I, section 9 of the United States Constitution vests Congress with the sole authority over Federal expenditures and states, <quote>No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law.</quote>.</text></paragraph></subsection><subsection id="id639d42018c3b44d3aa9b9415942960c2"><enum>(b)</enum><header>Clarification of current law</header><text>Nothing in the Authorization for Use of Military Force (<external-xref legal-doc="public-law" parsable-cite="pl/107/40">Public Law 107–40</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541</external-xref> note), the Authorization for Use of Military Force Against Iraq Resolution of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/243">Public Law 107–243</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541</external-xref> note), or any other provision of law enacted before the date of the enactment of this Act may be construed to provide authorization for the use of military force against Iran.</text></subsection><subsection id="id6ed1758578e2445f8592d2d2fc495390"><enum>(c)</enum><header>Prohibition of unauthorized military force in or against Iran</header><paragraph id="idc1da599cd6d2404282d971327635cc22"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), no Federal funds may be obligated or expended for any use of military force in or against Iran unless Congress has—</text><subparagraph id="ida7b733211dec4d268f2406b9872d47b5"><enum>(A)</enum><text>declared war; or</text></subparagraph><subparagraph id="id9726c5af4e35401c8e133a575b069401"><enum>(B)</enum><text>enacted specific statutory authorization for such use of military force after the date of the enactment of this Act that meets the requirements of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="id5d275269a4d04d1d92855c318997086a"><enum>(2)</enum><header>Exception</header><text>The prohibition under paragraph (1) shall not apply to a use of military force that is consistent with section 2(c) of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541(c)</external-xref>).</text></paragraph></subsection><subsection id="id11c60ac0cb3248ac84f454c0a11b3f31"><enum>(d)</enum><header>Rules of construction</header><paragraph id="id5E0B1C72817B4AC2B21C08876562D555"><enum>(1)</enum><header>Self-defense</header><text>Nothing in this Act may be construed to prevent the President from using necessary and appropriate force to defend United States allies and partners if Congress enacts specific statutory authorization for such use of force consistent with the requirements of the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541 et seq.</external-xref>).</text></paragraph><paragraph id="idc2f4ef78b41f4535b06dc9f14b411231"><enum>(2)</enum><header>War Powers Resolution requirements</header><text>Nothing in this Act may be construed to relieve the executive branch of restrictions on the use of force, reporting, or consultation requirements set forth in the War Powers Resolution (<external-xref legal-doc="usc" parsable-cite="usc/50/1541">50 U.S.C. 1541 et seq.</external-xref>).</text></paragraph><paragraph id="id9eb90962282d445a907c945b8dd2fadb"><enum>(3)</enum><header>No authority for use of military force</header><text>Nothing in this Act may be construed to authorize the use of military force.</text></paragraph></subsection></section></legis-body></bill>
