which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XI of the Social Security Act to establish a pilot program for testing the use of a predictive risk-scoring algorithm to provide oversight of payments for durable medical equipment and clinical diagnostic laboratory tests under the Medicare program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Transaction Fraud Prevention Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb60d4dce9e6942acb5b1f84985b2a71a"><enum>2.</enum><header>Pilot program testing use of predictive risk-scoring algorithm to provide oversight of payments for durable medical equipment and clinical diagnostic laboratory tests under the Medicare program</header><text display-inline="no-display-inline">Section 1128K of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7n">42 U.S.C. 1320a–7n</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbea45da2f7be42db92419a513d3cec6d"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading by inserting <quote><header-in-text level="section" style="OLC">; pilot program testing use of predictive risk-scoring algorithm to provide oversight of payments for durable medical equipment and clinical diagnostic laboratory tests under the Medicare program</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">abuse</header-in-text></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ff5d87f38ab4964808300ebde5ac6c7"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id15E48868CFC54E08B3BAA5F166D891E6"><subsection id="idbba40c8da62842fb9d9d39c8bea3ce2a"><enum>(d)</enum><header>Pilot program testing use of predictive risk-Scoring algorithm To provide oversight of payments for durable medical equipment and clinical diagnostic laboratory tests under the Medicare program</header><paragraph commented="no" display-inline="no-display-inline" id="idd4abf9af10fc4352a639bf1368d549c8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall establish a pilot program to test the use of predictive risk-scoring algorithms to provide oversight of relevant transactions (as defined in paragraph (8)(B)). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbecb336fb5674814b371129d080799de"><enum>(2)</enum><header>Duration</header><text>The pilot program shall be conducted for a period of 2 years, beginning not later than January 1, 2026.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1890759b2a234bee8dba0b5b5c6733c3"><enum>(3)</enum><header>Scope</header><subparagraph commented="no" display-inline="no-display-inline" id="id685b2a3e896e4187b01b267a4dfa8aa5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall limit the implementation of the pilot program to relevant transactions involving applicable items or services furnished to applicable beneficiaries (as defined in subparagraph (B)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdadbe4d0954462db3e3c9955f3432a7"><enum>(B)</enum><header>Applicable beneficiary defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>applicable beneficiary</term> means an individual who has opted in to—</text><clause commented="no" display-inline="no-display-inline" id="id8f1883bb4e0045a98c94aae0f653ee93"><enum>(i)</enum><text display-inline="yes-display-inline">receive electronic Medicare Summary Notices; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id253a43d6637549beb86418ae79e9f664"><enum>(ii)</enum><text display-inline="yes-display-inline">participate in the pilot program in accordance with subparagraph (C).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d5f7a3c14cf4c41b1709491cae1fb38"><enum>(C)</enum><header>Voluntary participation</header><text>An applicable beneficiary may participate in the pilot program on a voluntary basis and may terminate participation at any time.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8881e7680c04746adeac1243e887d91"><enum>(4)</enum><header>Considerations</header><text>The Secretary may, for purposes of identifying and calculating the risks of relevant transactions under the pilot program, consider the following factors:</text><subparagraph commented="no" display-inline="no-display-inline" id="id48468f20085b4d538d60ffa1223f8815"><enum>(A)</enum><text display-inline="yes-display-inline">The absence of a prior relationship between the beneficiary and a provider of services (as defined in section 1861(u)) or supplier (as defined in section 1861(d)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id742e3b31c7244c8986456ff3d640c2db"><enum>(B)</enum><text display-inline="yes-display-inline">Aberrant billing patterns for a provider of services or supplier with regards to volume of claims in one particular area.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52493f92cd844a5ead1c13e2e3979787"><enum>(C)</enum><text display-inline="yes-display-inline">Electronic fund transfer (EFT) changes.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0e028362a61435fb25ae477cafde25e"><enum>(D)</enum><text display-inline="yes-display-inline">Changes in ownership of a provider of services or supplier.</text></subparagraph></paragraph><paragraph id="idd90f5e72fc7847c39e74e6258c098319"><enum>(5)</enum><header>Collaboration</header><text>The Secretary shall work with industry representatives (including suppliers of durable medical equipment) on the development and implementation of the pilot program. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d66eee202a744ab867baf6fcc4cee5d"><enum>(6)</enum><header>Requirements</header><text display-inline="yes-display-inline">Under the pilot program, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8aa4e5dbfbc442238807128902010b22"><enum>(A)</enum><text display-inline="yes-display-inline">adopt a predictive risk-scoring algorithm that would learn from beneficiary data to score relevant transactions from 1 (least risky) to 99 (most risky);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcd87f79622e449bda3e6c98a583e8e43"><enum>(B)</enum><text display-inline="yes-display-inline">prior to implementation of any predictive risk-scoring algorithm adopted under subparagraph (A) under the pilot program—</text><clause commented="no" display-inline="no-display-inline" id="id0db3ced3e6af4a7f83e8d1e602e1a3bd"><enum>(i)</enum><text display-inline="yes-display-inline">require sufficient testing, evaluation, and review of such algorithm, taking into consideration Executive Order 14179 (90 Fed. Reg. 8741; relating to removing barriers to American leadership in artificial intelligence);</text></clause><clause commented="no" display-inline="no-display-inline" id="id6dd6e5bd788f442fa8e26750da316ae5"><enum>(ii)</enum><text>establish methods for notifying applicable beneficiaries and providers of services and suppliers impacted by the use of the algorithm regarding such usage (including information regarding how beneficiary data is collected and processed under the pilot program to produce a risk score for relevant transactions and the possible implications associated with the use of the algorithm); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4bed89919a644ff5b8c8015866db829c"><enum>(iii)</enum><text display-inline="yes-display-inline">establish methods of communication with the Office of the Inspector General of the Department of Health and Human Service, and the ability to waive or forgo notice to an applicable beneficiary or a provider of services or supplier if appropriate;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide0535853452941c783b68276f362da11"><enum>(C)</enum><text display-inline="yes-display-inline">for any relevant transaction involving an item or service furnished to an applicable beneficiary identified by a predictive risk-scoring algorithm adopted under subparagraph (A) and implemented under subparagraph (B) as having a risk score that exceeds a level of risk specified by the Secretary—</text><clause commented="no" display-inline="no-display-inline" id="idbfbc1270d7554e68b725bbbf0118c6ff"><enum>(i)</enum><text display-inline="yes-display-inline">review the relevant transaction to determine whether it should be suspended pending the applicable beneficiary's response under clause (ii);</text></clause><clause commented="no" display-inline="no-display-inline" id="id64a0453a4a5b488fa1cf94ffcce5afce"><enum>(ii)</enum><text display-inline="yes-display-inline">provide the applicable beneficiary the opportunity, by email or phone call response—</text><subclause commented="no" display-inline="no-display-inline" id="id466d674dd80c4f0eacf3f1e50f5d7222"><enum>(I)</enum><text display-inline="yes-display-inline">to cure a high-risk score or suspended transaction that the beneficiary believes is based on inaccurate underlying data; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id24544aaa41f448f6b440b84b41d747a2"> <enum>(II)</enum> <text display-inline="yes-display-inline">confirm the relevant transaction; and</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide0ecdeb3b2db480d8ff13b89c82c31a4"><enum>(iii)</enum><text>if, based on the results of the review, the relevant transaction is suspended—</text><subclause commented="no" display-inline="no-display-inline" id="id94e43b217a27497fa2c8842d2dc049c3"><enum>(I)</enum><text display-inline="yes-display-inline">trigger an automatic alert to the applicable beneficiary by electronically sending a Medicare Summary Notice that includes the relevant transaction;</text></subclause><subclause id="idfd540171d513499e992f9abca015ab77"><enum>(II)</enum><text>require that all subsequent Medicare Summary Notices involving the relevant transaction be sent electronically and in two week intervals for 3 months after the first alert is sent under subclause (I); and</text></subclause><subclause id="id42736b7fce1a48299057a60f2ecb684f"><enum>(III)</enum><text>include on such Medicare Summary Notices, as determined appropriate by the Secretary, information explaining how the beneficiary may report suspected fraud to relevant law enforcement agencies; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf5fd248387e04c9d893cef69815b13c3"><enum>(D)</enum><text>have the authority to determine when a Medicare card must be terminated or a new card issued to prevent fraud and abuse.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd6e6964fdc9428c81da1af2eca18d28"><enum>(7)</enum><header>Clarification</header><text display-inline="yes-display-inline">Any suspension of an account or transaction under the pilot program shall be based on a human review process, informed through the implementation of the predictive risk-scoring algorithm.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcdbabf99f47b4e84a7c3bdf79cf8271b"><enum>(8)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="ide9f74538e4ad41b6a89ce5922d10381b"><enum>(A)</enum><header>Applicable item or service</header><text display-inline="yes-display-inline">The term <term>applicable item or service</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id655a555703df44c4893522d551dbba2f"><enum>(i)</enum><text display-inline="yes-display-inline">an item of durable medical equipment (as defined in section 1861(n)); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id15c2f6446a6b400a9570f621374773b3"><enum>(ii)</enum><text display-inline="yes-display-inline">a clinical diagnostic laboratory test.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfa0661642ad4597aa26063f12f5a65b"><enum>(B)</enum><header>Relevant transaction</header><text display-inline="yes-display-inline">The term <term>relevant transaction</term> means a claim for payment for an applicable item or service furnished to an applicable beneficiary, as determined by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
