<section section-type="section-one" id="id6e2cc537-92ee-406a-ab9a-5b671dcd10ce" changed="not-changed"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Continuing High-quality Evaluations of Concerning and Known Persons Of Interest through National Training Updates Act</short-title></quote> or the <quote><short-title>CHECKPOINT Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3da3c1fa-426c-4663-a636-76b94407fbbb" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="id2fd596d5f108472cae0f2fdb3c2c0c41" changed="not-changed"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id85b5e9690ecc4e7aa93642c426126442"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>; and</text></subparagraph>
<subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="ida09d85104e7e40e8af14fec7f736c7e3"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>.</text></subparagraph></paragraph> <paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id6dc9fa2453634260b99f7df6a1a90d16"><enum>(2)</enum><header display-inline="yes-display-inline">Assistant chief</header><text>The term <term>Assistant Chief</term> means the Assistant Chief selected to manage the CPMO pursuant to section 3(a)(2).</text></paragraph>
<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id9d3e9ff81c4c46eeb84456701adba931"><enum>(3)</enum><header display-inline="yes-display-inline">Checkpoint</header><text>The term <term>checkpoint</term> means a permanent or temporary checkpoint operated by the U.S. Border Patrol.</text></paragraph> <paragraph id="id6421ba4c254c42aca6fbd0d4cec73fb4" changed="not-changed"><enum>(4)</enum><header>Chief</header><text>The term <term>Chief</term> means the Chief of the U.S. Border Patrol.</text></paragraph>
<paragraph id="id89fb40d70dcd4d148e419d0307a1b014" changed="not-changed"><enum>(5)</enum><header>CPMO</header><text>The term <term>CPMO</term> means the Checkpoint Program Management Office established pursuant to section 3.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id881890d491c044c3889c3befb7bb8e75" changed="not-changed"><enum>3.</enum><header display-inline="yes-display-inline">Improving border security</header> <subsection id="id551af28a-13d3-485d-916f-1ce67ee64999" changed="not-changed"><enum>(a)</enum><header>Checkpoint Program Management Office</header> <paragraph commented="no" display-inline="no-display-inline" id="id10cd2bcf6df248339cba19a94a0839f0" changed="not-changed"><enum>(1)</enum><header>Establishment</header><text>The Commissioner for U.S. Customs and Border Protection shall establish and operate, within the U.S. Border Patrol, the Checkpoint Program Management Office, which shall provide oversight over checkpoint operations nationwide.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idb437ae99746e4203807919e481446c1a" changed="not-changed"><enum>(2)</enum><header>Assistant chief</header><text display-inline="yes-display-inline">The Chief shall select an Assistant Chief to manage the CPMO for a term of at least 2 years.</text></paragraph> <paragraph id="idb1532581-36b6-4e79-976e-9e916b3c89ba" changed="not-changed"><enum>(3)</enum><header>Authorities, roles, and responsibilities</header><text>Not later than 180 days after the date of the enactment of this Act, the Chief shall—</text>
<subparagraph id="idb10b1dc9004b400484465235526bdd98" changed="not-changed"><enum>(A)</enum><text>issue a memorandum, or update relevant existing memoranda, outlining the authority, roles, and responsibilities of the CPMO; and</text></subparagraph> <subparagraph id="idfaa3187bae7e4a1d9d25482629fdfb23" changed="not-changed"><enum>(B)</enum><text>provide copies of such new or updated memoranda to the field points of contact designated pursuant to section 4(b).</text></subparagraph></paragraph></subsection>
<subsection id="ida21b7c3f1a384960b1e48600bb6ffea5" changed="not-changed"><enum>(b)</enum><header>CPMO Administration</header><text>The Chief, working through the Assistant Chief, shall—</text> <paragraph id="idd3bbef5592494c7f90ff5d44f1a7fede" changed="not-changed"><enum>(1)</enum><text>establish and maintain policies and standard operating procedures that detail the authority, roles, and responsibilities of the CPMO;</text></paragraph>
<paragraph id="id94b74156aab04137aa7bc7adfca46220" changed="not-changed"><enum>(2)</enum><text>provide oversight of checkpoint data quality and accuracy to U.S. Border Patrol sectors that have checkpoints;</text></paragraph> <paragraph id="id8516a39922e644699ba471ab27518f07" changed="not-changed"><enum>(3)</enum><text>provide regular training regarding policies, standard operating procedures, data entry, and data quality and accuracy to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id19c9e565142942bdaba85306f37ed83f" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">employees of U.S. Border Patrol sectors with checkpoints; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ide4cae511a37b42769e6ef5b95b8bc022" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">employees stationed where checkpoints have been approved to operate;</text></subparagraph></paragraph>
<paragraph id="idaf918938a12940b0b3172c8753cb9228" changed="not-changed"><enum>(4)</enum><text>conduct regular reviews of checkpoint staffing and resources;</text></paragraph> <paragraph id="id6453810254fc46aeaa24ca0e7c7f87ef" changed="not-changed"><enum>(5)</enum><text>serve as the liaison with U.S. Border Patrol sector officials with respect to any ongoing checkpoint issues, including the field points of contact designated pursuant to section 4(b); and</text></paragraph>
<paragraph id="idbd0dcc1c72324867bdb35b6d3fb37ebe" changed="not-changed"> <enum>(6)</enum> <text>coordinate regular reviews of checkpoint operations, including covert testing by U.S. Customs and Border Protection's Operational Field Testing Division.</text> </paragraph></subsection></section> <section id="idb9b1fd2877584b3a8c7a7121b18cb797" changed="not-changed"><enum>4.</enum><header>Coordination of checkpoint activities</header> <subsection id="id6252227ade6346e0a07d520980282aff" changed="not-changed"><enum>(a)</enum><header>Headquarters coordination</header><text>The Commissioner for U.S. Customs and Border Protection shall require the CPMO to regularly coordinate with offices of U.S. Customs and Border Protection that support checkpoint operations, including—</text>
<paragraph id="id0c71f267224b4110aa86920b5a993e33" changed="not-changed"><enum>(1)</enum><text>the U.S. Customs and Border Protection National Canine Program;</text></paragraph> <paragraph id="id39666f1727e048f4bf7e771c92ecd4c1" changed="not-changed"><enum>(2)</enum><text>the U.S. Customs and Border Protection Operational Field Testing Division;</text></paragraph>
<paragraph id="idacc7c2e9dd824963a42efde3bada9448" changed="not-changed"><enum>(3)</enum><text>the U.S. Border Patrol Mission Support Directorate;</text></paragraph> <paragraph id="id2d2e79a9716243e793b06faa33651467" changed="not-changed"><enum>(4)</enum><text>the U.S. Border Patrol Strategic Planning and Analysis Directorate; and</text></paragraph>
<paragraph id="idd9d41c170e06421a8f0ab86c4341a8cd" changed="not-changed"><enum>(5)</enum><text>the Office of Field Operations Non-Intrusive Inspection Program Office.</text></paragraph></subsection> <subsection id="id095c5bc3b09b4e6b85b72f1bc7704ac4" changed="not-changed"><enum>(b)</enum><header>Field points of contact</header><text>The Chief shall require, in each U.S. Border Patrol sector with checkpoints, a designated checkpoints point of contact, who shall—</text>
<paragraph id="idbfc2b02ed4224ce48e876dea7030aadc" changed="not-changed"><enum>(1)</enum><text>serve as the liaison between U.S. Border Patrol sector officials and the CPMO regarding checkpoint policies and procedures;</text></paragraph> <paragraph id="idc1daea85d2234bba99c78a3d97a23aba" changed="not-changed"><enum>(2)</enum><text>maintain responsibility for any communication related to checkpoint policy updates and checkpoint training;</text></paragraph>
<paragraph id="id107eb228b61e4418b46b0d2b4033bbaf" changed="not-changed"><enum>(3)</enum><text>coordinate with the sector-level data integrity team to ensure sector checkpoint data reliability and accuracy; and</text></paragraph> <paragraph id="ide3106351cf1548ab94bb77269dd921bc" changed="not-changed"><enum>(4)</enum><text>meet on a regular basis with CPMO staff to discuss policy updates, operational issues, and leading practices.</text></paragraph></subsection>
<subsection id="idebaf6c3194a842d5848a2e47e658bca6" changed="not-changed"><enum>(c)</enum><header>Establishment of standard operating procedures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Chief shall approve standard operating procedures for the CPMO, which shall govern its checkpoint oversight activities, including—</text> <paragraph id="id46476b76b8a54bdb9ad38f1792849232" changed="not-changed"><enum>(1)</enum><text>oversight of checkpoint data quality;</text></paragraph>
<paragraph id="id3d3cd532d5b54a76bdff6cd157468221" changed="not-changed"><enum>(2)</enum><text>reviews of checkpoint resources; and</text></paragraph> <paragraph id="idcddc7a57893d4bb3af42a6a682eae546" changed="not-changed"><enum>(3)</enum><text>other activities identified by the Assistant Chief.</text></paragraph></subsection></section>
<section id="id2327c4ed08534d2e848e037f15a61b58" changed="not-changed"><enum>5.</enum><header>Data collection</header>
<subsection id="id9aa1449f2d064b909597cc0cf9883280" changed="not-changed"> <enum>(a)</enum> <header>In general</header> <text>The Chief, in cooperation with the Assistant Chief, shall require the regular collection of data, including data relating to—</text> <paragraph id="id3aa1075a54924edb96a54135b92e1efa" changed="not-changed"> <enum>(1)</enum> <text>apprehensions and seizures occurring at checkpoints;</text> </paragraph> 
<paragraph id="id35043a77c7b642678036806b05e8e82e" changed="not-changed"> <enum>(2)</enum> <text>technology and assets used to carry out such enforcement actions;</text> </paragraph> <paragraph id="id609b78d2ca084f2abfd48361df93c704" changed="not-changed"> <enum>(3)</enum> <text>people involved in such enforcement actions;</text> </paragraph> 
<paragraph id="idadc693369415479ca147118e91810ee6" changed="not-changed"> <enum>(4)</enum> <text>apprehensions of smuggled people;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id5ae31e696a934442b0f04e0670fbdaa6" changed="not-changed"> <enum>(5)</enum> <text display-inline="yes-display-inline">canine assists with drug seizures;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id62ab9a66f9354451aa79decb1e700403" changed="not-changed"> <enum>(6)</enum> <text display-inline="yes-display-inline">seizures of trace amounts of marijuana;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id3da434ac1ddb4ae3870e09736e10fffe" changed="not-changed"> <enum>(7)</enum> <text display-inline="yes-display-inline">non-drug property seizures; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id765eb545f801431fb86b0c05b9b51f5d" changed="not-changed"> <enum>(8)</enum> <text display-inline="yes-display-inline">attempted checkpoint circumventions.</text> </paragraph> </subsection> <subsection id="id4df95a3d88054f91b8f5a77130c0dfc7" changed="not-changed"> <enum>(b)</enum> <header>Secondary inspections</header> <text>The Chief, in cooperation with the Assistant Chief, shall require the regular collection of data on secondary inspections that occur at checkpoints using—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id7740a7dc310941c0914ecb4b2bbe0229" changed="not-changed"> <enum>(1)</enum> <text display-inline="yes-display-inline">the Border Enforcement Secondary Tool; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id2b1cdcc6551849c8b564cf6527ba75a8" changed="not-changed"> <enum>(2)</enum> <text display-inline="yes-display-inline">any additional tools developed to document information about secondary inspections at checkpoints.</text> </paragraph> </subsection>
<subsection id="id867cc3c5cfcc4bb0ac49e800c1dc39d5" changed="not-changed"><enum>(c)</enum><header>Data collection plan</header><text>Not later than 180 days after the date of the enactment of this Act, the Chief shall develop a plan that includes goals and milestones—</text> <paragraph id="idf03841264e1f4bb285f65a3151c20c62" changed="not-changed"><enum>(1)</enum><text>for improving checkpoint data collection;</text></paragraph>
<paragraph id="id44fc627a4a944e4282f1cf606015c180" changed="not-changed"><enum>(2)</enum><text>for improving checkpoint data reliability and accuracy; and</text></paragraph> <paragraph id="ide302965e14a847d098087b33ff02a0b1" changed="not-changed"> <enum>(3)</enum> <text>for addressing the checkpoint data collection issues identified in recommendations 1 through 3 of the Government Accountability Office’s report entitled <quote>Border Patrol: Actions Needed to Improve Checkpoint Oversight and Data</quote> (GAO–22–104568), published on June 6, 2022.</text> </paragraph></subsection></section>
<section id="id6472103921df4eaa8475c309b0e36f03"><enum>6.</enum><header>Reports</header>
<subsection id="idd0c8fda46d484b84bc3c96defab98b01" changed="not-changed"><enum>(a)</enum><header>Annual data collection report</header><text>The Chief, in collaboration with the Assistant Chief, shall submit an annual report to the appropriate congressional committees that describes—</text> <paragraph commented="no" display-inline="no-display-inline" id="idd9a0e64c0d5b4749b51ce90bfebcda64" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the data collected pursuant to subsections (a) and (b) of section 5;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id23ff406bf9d04af4aea0cd9eff47489a" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the steps taken to implement the plan developed pursuant to section 5(c); and</text></paragraph> <paragraph id="id13dab5923a2c44daa5754af19f7a7d6b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the actions taken to ensure oversight of the CPMO and the operations of checkpoints.</text></paragraph></subsection>
<subsection id="id00417604354b42ae9d453c02338cc4f1"><enum>(b)</enum><header>GAO report</header><text>Not later than 18 months after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the appropriate congressional committees that analyzes the effectiveness of the Checkpoint Program Management Office established pursuant to section 3(a).</text></subsection> <subsection id="idf5e87fd938d54b24bc72f94a75e7c24a"><enum>(c)</enum><header>Annual surveillance technology purchase and use report</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in collaboration with the Commissioner for U.S. Customs and Border Protection, shall submit an unredacted annual report to the appropriate congressional committees regarding the purchase and use by U.S. Customs and Border Protection of surveillance technology, which shall include—</text>
<paragraph id="idc01c8a2051774cf38196ad8f4a5ae896"><enum>(1)</enum><text>a comprehensive inventory of each surveillance technology owned, operated, developed, or maintained by, or on behalf of, U.S. Customs and Border Protection; and</text></paragraph> <paragraph id="idee5b8637fbe249ec9fb33ce7d868b5d6"><enum>(2)</enum><text>with respect to each surveillance technology referred to in paragraph (1)—</text>
<subparagraph id="idbdba9ce47e244c959e3efc1d31a899d3"><enum>(A)</enum><text>the source of such surveillance technology;</text></subparagraph> <subparagraph id="idbb1e6c1586a24a8c875a25676edea88e"><enum>(B)</enum><text>a description of the use of such surveillance technology;</text></subparagraph>
<subparagraph id="id5c0879a6fdc84c26ad23a171e3588a17"><enum>(C)</enum><text>a description of—</text> <clause commented="no" display-inline="no-display-inline" id="id28ccd1eead2d494e9c42ed80bddc7206"><enum>(i)</enum><text display-inline="yes-display-inline">the databases in which data derived from such surveillance technology is stored; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="idbc82bd7c1f4b4ea6a1700956a4c31e4b"><enum>(ii)</enum><text display-inline="yes-display-inline">the records management statutes, regulations, guidelines, and procedures for the storage, archiving, and deletion of such data; and</text></clause></subparagraph> <subparagraph id="iddbb190a61b4245cfb1f600d3919928df"><enum>(D)</enum><text>the annual recurring costs for the use of such surveillance technology and the storage and archival of the data described in subparagraph (C);</text></subparagraph></paragraph>
<paragraph id="id1b0a9c79ae9549ac955d0486bca64505"><enum>(3)</enum><text>with respect to the privacy issues relating to the use of the surveillance technology referred to in paragraph (1)—</text> <subparagraph id="id5a3d948b9ea6419b926f7db5fd93b22c"><enum>(A)</enum><text>the privacy impact assessments;</text></subparagraph>
<subparagraph id="id49a6ddd0f0ad45f5a88a6e60011885fa"><enum>(B)</enum><text>whether such assessments were modified or rescinded during the 1-year period immediately preceding the date of on which the report is submitted; and</text></subparagraph> <subparagraph id="iddf0051711f304ed88333d27e0c9fe1ff"><enum>(C)</enum><text>if a modification or rescission described in subparagraph (A) was made, a description of the basis for, and an identification of the individual who directed, such modification or rescission; and</text></subparagraph></paragraph>
<paragraph id="idf70d8715585e47c29391869a58ea6fe0"><enum>(4)</enum><text>the number and types of criminal investigations that used data acquired through the surveillance technology referred to in paragraph (1) and the results of such investigations.</text></paragraph></subsection></section> <section id="id4509797aa8824a1ea25ebda1dd85dd63"><enum>7.</enum><header>No additional funding</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</text></section>
<section id="id631afb326f7a4fe69cc9a9c83db9d82c"><enum>8.</enum><header>Sunset</header><text display-inline="no-display-inline">This Act shall cease to have any force or effect beginning on the date that is 5 years after the date of the enactment of this Act.</text></section> </legis-body> </bill>
