        <official-title>To amend the Higher Education Act of 1965 to establish immigration and
            residency requirements for individuals served by Federal TRIO programs, and for other
            purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Putting American Students First Act</short-title></quote>.</text>
        </section>
        <section section-type="subsequent-section" id="H561CC1671083446881D8C4C95EE88DB8">
            <enum>2.</enum>
            <header>Eligibility for participation in Federal TRIO programs</header>
            <subsection id="HD7D2749EAA224097BE9F11CD1027AFE3">
                <enum>(a)</enum>
                <header>Eligibility</header>
 <text display-inline="yes-display-inline">Section 402A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11</external-xref>) is amended—</text>
                <paragraph id="H413341B2BD0248F384F0CBAAE2577009">
                    <enum>(1)</enum>
 <text>by redesignating subsections (f) through (h) as subsections (g) through (i), respectively; and</text>
                </paragraph>
                <paragraph id="HB49CF2F2D3174375A779534791EC93F6">
                    <enum>(2)</enum>
 <text>by inserting after subsection (e) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HC9F3583427074E79A8FCFCB8E782F85D"> <subsection id="H28936CEEC4EB4EC2AF8441F99D38A414"> <enum>(f)</enum> <header>Citizenship and residency requirements</header> <paragraph id="HBE9CF9FBC19A4CEE8F93A2C6B0F79B1C"> <enum>(1)</enum> <header>In general</header> <text>To be eligible to participate in a program that receives assistance under this chapter, an individual shall be—</text>
                                <subparagraph id="H61B02A675E39472ABCB35B2F0CC6A2C0">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">a national of the United States (as defined in paragraph (22) of section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>));</text>
                                </subparagraph>
                                <subparagraph id="HE1F123B31AC545BDBDA7930AFBEC1752">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">an alien (as defined in paragraph (3) of such section) lawfully admitted for permanent residence (as defined in paragraph (20) of such section);</text>
                                </subparagraph>
                                <subparagraph id="H88FE32521D9C4F2BA013681060614D7A">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">an alien (as defined in paragraph (3) of such section) who is physically present in the United States (as defined in paragraph (38) of such section) for other than a temporary purpose and who is able to provide evidence from the Secretary of Homeland Security of the alien’s intent to become lawfully admitted for permanent residence (as defined in paragraph (20) of such section);</text>
                                </subparagraph>
                                <subparagraph id="H121E2B084517447AA6F12BAF2254F4E4">
                                    <enum>(D)</enum>
 <text display-inline="yes-display-inline">a citizen of one of the Freely Associated States lawfully residing in the United States in accordance with the Compact of Free Association set forth in section 201 of the Compact of Free Association Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/48/1901">48 U.S.C. 1901</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/99/239">Public Law 99–239</external-xref>) or the Compact of Free Association set forth in section 201 of <external-xref legal-doc="public-law" parsable-cite="pl/99/658">Public Law 99–658</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/48/1931">48 U.S.C. 1931</external-xref> note);</text>
                                </subparagraph>
                                <subparagraph id="H9A27DDACC59C4D4F89568A625CB88C6E">
                                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">an alien having CNMI Resident status under section 6(e)(6) of the Joint Resolution entitled <quote>A Joint Resolution to approve the Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America, and for other purposes</quote>, approved March 24, 1976 (<external-xref legal-doc="usc" parsable-cite="usc/48/1806">48 U.S.C. 1806</external-xref>); or</text>
                                </subparagraph>
                                <subparagraph id="H5F9D1AC35C8247FCBA318097751D78AA">
                                    <enum>(F)</enum>
 <text>a lawful resident of one of the Freely Associated States.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H2E8D9D68C8C44391A8FDB030F0AC7F01">
                                <enum>(2)</enum>
                                <header>Waiver prohibited</header>
 <text display-inline="yes-display-inline">The requirement under paragraph (1) may not be waived under—</text>
                                <subparagraph id="H6E5E243D1B3545BA89A42E2F389D4590">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">any provision of section 523 of Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>);</text>
                                </subparagraph>
                                <subparagraph id="H2F50B48A2D2546A88BF2112E916CB3AC">
                                    <enum>(B)</enum>
 <text>any of the authorities provided by any of the laws referred to in subsection (b) of such section 523; or</text>
                                </subparagraph>
                                <subparagraph id="HD64DCC96B1534F66B7665D94EFCF17E7">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">any other authority provided in any law—</text>
                                    <clause id="H6E54B08A9ABC4F478B91FA7716BBF152">
                                        <enum>(i)</enum>
 <text>to carry out, or participate in, a Performance Partnership Pilot (as defined in section 526(a)(1) of the Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2014 (<external-xref legal-doc="usc" parsable-cite="usc/42/12301">42 U.S.C. 12301</external-xref> note)); or</text>
                                    </clause>
                                    <clause id="H87B6B1106AD7407FAFFA79491186E5F9">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">that allows additional time to operate, or participate in, a Performance Partnership Pilot site selected on or before the date of the enactment of such law.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>

            </subsection>
            <subsection id="H3EAEA2E431EA41D1BC3303F26028A111">
                <enum>(b)</enum>
                <header>Conforming amendments</header>
 <text display-inline="yes-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is further amended—</text>
                <paragraph id="H18F9BAA525A945CF8B5E238DBF171788">
                    <enum>(1)</enum>
 <text>in section 318(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/1059e">20 U.S.C. 1059e(b)</external-xref>), by striking <quote>section 402A(h)</quote> each place it appears and inserting <quote>section 402A(i)</quote>;</text>
                </paragraph>

                    <enum>(2)</enum>
 <text display-inline="yes-display-inline">in section 371(c) (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>), by striking <quote>section 402A(h)</quote> each place it appears and inserting <quote>section 402A(i)</quote>;</text>
                </paragraph>

                    <enum>(3)</enum>
 <text display-inline="yes-display-inline">in section 402E(g) (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-15">20 U.S.C. 1070a–15(g)</external-xref>), by striking <quote>section 402A(g)</quote> and inserting <quote>section 402A(h)</quote>; and</text>
                </paragraph>

                    <enum>(4)</enum>
 <text display-inline="yes-display-inline">in section 402H (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-18">20 U.S.C. 1070a–18</external-xref>), by striking <quote>section 402A(f)(4)</quote> each place it appears and inserting <quote>section 402A(g)(4)</quote>.</text>
