which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Patient Protection and Affordable Care Act to provide for additional requirements with respect to the navigator program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4BED5B3DD50E47FB8033B1320B5595C2"><section section-type="section-one" id="H388682F2EDCC45549428E6619ABCC3CD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expand Navigators’ Resources for Outreach, Learning, and Longevity Act of 2025</short-title></quote> or the <quote><short-title>ENROLL Act of 2025</short-title></quote>.</text></section><section id="H7147B603855346C290BAA537835CD740"><enum>2.</enum><header>Providing for additional requirements with respect to the navigator program</header><subsection id="HB52C33EE46EC431D855B9268364A52EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1311(i) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031(i)</external-xref>) is amended—</text><paragraph id="HC97CA83327004605988DABD5A2A9E3EE"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id44c14b2b251b4540895084b14a0d07dc"><subparagraph id="H9242C36F2DBE4ACA8615928C3599B16B"><enum>(C)</enum><header>Selection of recipients</header><text display-inline="yes-display-inline">In the case of an Exchange established and operated by the Secretary within a State pursuant to section 1321(c), in awarding grants under paragraph (1), the Exchange shall—</text><clause commented="no" id="HD99F18656F5C4AD7831E8F64ECE50BFA"><enum>(i)</enum><text display-inline="yes-display-inline">select entities to receive such grants based on an entity’s demonstrated capacity to carry out each of the duties specified in paragraph (3);</text></clause><clause id="H5C24105A84264F05A82EAD6F24D43694"><enum>(ii)</enum><text>not take into account whether or not the entity has demonstrated how the entity will provide information to individuals relating to group health plans that are not qualified health plans; and</text></clause><clause id="H6D902EF237494BA18E393D2FF71AA31A" commented="no"><enum>(iii)</enum><text>ensure that, each year, the Exchange awards such a grant to at least 1 entity described in this paragraph that is a community and consumer-focused nonprofit group.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H62947929294E489EBBF8A4A8221672D3"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="H9C49674E79E846F588B4427F2F367DE5" commented="no"><enum>(A)</enum><text>in subparagraph (C), by inserting after <quote>qualified health plans</quote> the following: <quote>, State Medicaid plans under title XIX of the Social Security Act, and State children’s health insurance programs under title XXI of such Act</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30552d5acbd34dcfb79aac86964a18f0"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d9f1829b94d4ace9e080902ba0c7224"><enum>(C)</enum><text>in subparagraph (E), by striking the period and inserting <quote>; and</quote>;</text></subparagraph><subparagraph id="id1dfebb1b0190425989f1dc0a12d9d03a" commented="no"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18bb83ff297e40d7ade5f792793d1845"><subparagraph commented="no" display-inline="no-display-inline" id="iddaf119faf569436e9ec55b68b23e1491"><enum>(F)</enum><text display-inline="yes-display-inline">conduct public education activities in plain language to raise awareness of the requirements of and the protections provided under qualified health plans.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF08897956E8C4EE48E98E320ADB4D067"><enum>(E)</enum><text>by adding at the end the following flush left sentence:</text></subparagraph><continuation-text continuation-text-level="paragraph"><quote>The duties specified in the preceding sentence may be carried out by such a navigator at any time during a year.</quote>;</continuation-text></paragraph><paragraph id="H88A26749BAAD4753844A070DBB0FE017"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4)(A)—</text><subparagraph id="H2D090D880657456CA291CCB2A5E8CFED"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>not</quote>;</text></subparagraph><subparagraph id="HF8FCFD9A844646A69EF42DA66E33EE6B"><enum>(B)</enum><text>in clause (i)—</text><clause id="H9F4A2FA96422433F8D22233C9977C2BD"><enum>(i)</enum><text>by inserting <quote>not</quote> before <quote>be</quote>; and</text></clause><clause id="H0392573D151A40368549B0897A178676"><enum>(ii)</enum><text>by striking <quote>; or</quote> and inserting a semicolon;</text></clause></subparagraph><subparagraph id="HB6EBD8CDC7FE4B2ABD7B6B9478C110A7"><enum>(C)</enum><text>in clause (ii)—</text><clause id="H9BB307470C4D4B22A22F805D7865BBD5"><enum>(i)</enum><text>by inserting <quote>not</quote> before <quote>receive</quote>; and</text></clause><clause id="H4F1C7E52465E40C19610AF71DC2BEE7B"><enum>(ii)</enum><text>by striking the period and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="H8B069A5C70E743918D4CD5D670995AF7"><enum>(D)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7E49CC47BE754DFD96CEBC9B6E54475B"><clause id="H60B773F1E81942C99EE8419144B68E2D"><enum>(iii)</enum><text display-inline="yes-display-inline">maintain physical presence in the State of the Exchange so as to allow in-person assistance to consumers.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9A7AC6E9F0DF4B60A15CBD8471C44703"><enum>(4)</enum><text>in paragraph (6)—</text><subparagraph id="HB3AE3FE95E014B9CA6B87D6483570F3B"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph">Funding</header-in-text>.—Grants under</quote> and inserting</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HC7AED6179E4C495982F8245CEF8A786A"><text><header-in-text level="subsection" style="OLC">Funding</header-in-text>.—</text><subparagraph id="H6971EA02B52E4A9CB536A2796F3F29CD"><enum>(A)</enum><header>State Exchanges</header><text display-inline="yes-display-inline">Grants under</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAFB42A81EA4F4C3AADC7831B4688E894"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD532C66A3E594FF6A2F34A633F3F2B3A"><subparagraph id="HA447CC683FCF4AD7A1835ED1B4C928EE"><enum>(B)</enum><header>Federal Exchanges</header><text display-inline="yes-display-inline">For purposes of carrying out this subsection, with respect to an Exchange established and operated by the Secretary within a State pursuant to section 1321(c), the Secretary shall obligate $100,000,000 out of amounts collected through the user fees on participating health insurance issuers pursuant to section 156.50 of title 45, Code of Federal Regulations (or any successor regulations) for fiscal year 2026 and each subsequent fiscal year. Such amount for a fiscal year shall remain available until expended.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H434568A1D8574BCAA93484E347F36336"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to plan years beginning on or after January 1, 2026.</text></subsection></section></legis-body></bill>
