<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Free Americans from Ideological Reporting Act</short-title></quote> or the <quote><short-title>FAIR Act</short-title></quote>.</text></section> <section id="idce376aa8290a41238ffa5f111d685fe8"><enum>2.</enum><header>Corporation for public broadcasting</header> <subsection id="idd1ff76577c7f4fc79262807bb99988e9"><enum>(a)</enum><header>In general</header><text>Section 396 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/396">47 U.S.C. 396</external-xref>) is amended by adding at the end the following:</text>

<subsection id="id73561fed35184483a66533b5e61b8ed6"><enum>(m)</enum><header>Prohibition on Federal funding for NPR and PBS</header>
<paragraph id="id977d06bd3db64771b822d97c7c808322"><enum>(1)</enum><header>In general</header><text>After the date of enactment of this subsection, no Federal funds may, directly or indirectly, be made available to or used to support an organization described in paragraph (2), including through the payment of dues to or the purchase of programming from the organization by a public broadcast station using Federal funds received by the station. The Corporation shall cancel any direct and indirect funding to the maximum extent allowed by law and shall decline to provide future funding to such organizations, including by ensuring that licensees and permittees of public radio and television stations, as well as any other recipients of funds under this section, do not use Federal funds for such organizations.</text></paragraph> <paragraph id="id30315709c7084f1fbf8232e0d80900ae"><enum>(2)</enum><header>Organizations described</header><text>The organizations described in this paragraph are—</text>
<subparagraph id="id0a4798f7564c422c8a67d158177b0a4b"><enum>(A)</enum><text>the organization known, as of the date of enactment of this subsection, as <quote>National Public Radio</quote>;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ida0390025bff04b62ad87919307b6546e"><enum>(B)</enum><text display-inline="yes-display-inline">the organization known, as of the date of enactment of this subsection, as <quote>Public Broadcasting Service</quote>;</text></subparagraph>
<subparagraph id="idaf8c61bdd09d47ffbdc98d14aa12dc97"><enum>(C)</enum><text>any successor organization to an organization described in subparagraph (A) or (B); or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id8ed986b969a441c7b6111a5c2239a5c8"><enum>(D)</enum><text display-inline="yes-display-inline">any licensee or permittee of an organization described in subparagraph (A) or (B).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id0c13cf8b4e2e45d4b07b9b887b5ddd88"><enum>(3)</enum><header>Grants revisions</header><text display-inline="yes-display-inline">The Corporation shall revise the applicable Television Community Service Grants General Provisions and Eligibility Criteria and Radio Community Service Grants General Provisions and Eligibility Criteria to prohibit direct or indirect funding to the organizations described in paragraph (2) and take all other necessary steps to minimize or eliminate its indirect funding of such organizations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="id6505661245894937a261ec370bd947b8"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>) is amended—</text>
<paragraph id="id5eeef8b12a60476eb97edff58c106d8d"><enum>(1)</enum><text>in section 396(k) (<external-xref legal-doc="usc" parsable-cite="usc/47/396">47 U.S.C. 396(k)</external-xref>)—</text> <subparagraph id="id818aef30840e4f8598d2da51a52266d9"><enum>(A)</enum><text>in paragraph (4), in the first sentence, by striking <quote>, unless the governing body</quote> and all that follows through <quote>reasons for closing the meeting</quote> and inserting a period;</text></subparagraph>
<subparagraph id="id0575feea647747d19b0c08abe49973a0"><enum>(B)</enum><text>by striking paragraph (9);</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id830eb9e197cd4534b84eb06526cbc9bc"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (10), (11), and (12) as paragraphs (9), (10), and (11), respectively; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id53b32fe64db84240ae0a3e074e7dbbc2"><enum>(D)</enum><text>in paragraph (9), as so redesignated, in subparagraph (D), by striking <quote>paragraphs (4), (5), (8), and (9)</quote> and inserting <quote>paragraphs (4), (5), and (8)</quote>; and</text></subparagraph></paragraph> <paragraph id="idc3f2dcf8672049cba1fdd70baf6b93e1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in section 398(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/47/398">47 U.S.C. 398(b)(1)</external-xref>), by striking <quote>by the Public Broadcasting Service and National Public Radio (or any successor organization) and</quote>.</text></paragraph></subsection></section>
<section id="id47c9d4bd1fd44e03b50d30031eab9520"><enum>3.</enum><header>Federal agencies</header><text display-inline="no-display-inline">The heads of each Federal agency shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="idd101fac7d8e045d7bd23dd308e1ed5d5"><enum>(1)</enum><text display-inline="yes-display-inline">identify and terminate, to the maximum extent consistent with applicable law, any direct or indirect funding of the organizations described in subsection (m)(2) of section 396 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/396">47 U.S.C. 396</external-xref>), as added by this Act; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id7ecd174bdd494fc28f6e4d6b49f5594d"><enum>(2)</enum><text display-inline="yes-display-inline">identify any remaining grants, contracts, or other funding instruments entered into with such organizations and determine such organizations are in compliance with the terms of those instruments, taking appropriate steps under the terms of those instruments if a determination of noncompliance is made.</text></paragraph></section> <section id="idcad762803e2c4722a0115c61522fbd1c"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or an amendment made by this Act, is held invalid, the remainder of this Act shall not be affected thereby. If the application of any provision of this Act, or an amendment made by this Act, to any agency, person, or circumstance is held invalid, the application of such provision to another agency, person, or circumstance shall not be affected thereby.</text></section>
<section id="idff7cac3884964edf8f4e54a4c80f7a51"><enum>5.</enum><header>Rules of construction</header>
<subsection commented="no" display-inline="no-display-inline" id="id891072a84c3b4a4a810d549c84aaa91a"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this order shall be construed to impair or otherwise affect—</text> <paragraph id="id5f2ded0bfa294f3e94aca366316079d8"><enum>(1)</enum><text>the authority granted by law to an executive department or agency, or the head thereof; or</text></paragraph>
<paragraph id="id07855f06172f4b8a8d62a0ea3f2d1ed8"><enum>(2)</enum><text>the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</text></paragraph></subsection> <subsection id="id57d90257b6ea4570ac6a16f39339bc9b"><enum>(b)</enum><header>No private right of action</header><text>This Act is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.</text></subsection></section>
