which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to modify the eligibility requirements for asylum.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Refugees Using Legal Entry Safely Act</short-title></quote> or <quote><short-title>RULES Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb47600774d494137a477506190ad4be6"><enum>2.</enum><header>Modification of asylum eligibility</header><text display-inline="no-display-inline">Section 208(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9b5905656711405aa7bf62f487bce024"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5A77D870F604C3AAC3230E34E623240"><paragraph id="id633dee1edb6c42799f750c1839c6a134"><enum>(1)</enum><header>Application at ports of entry</header><subparagraph commented="no" display-inline="no-display-inline" id="id3b9daded68254e5488fb78ebf221d303"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who arrives at a port of entry of the United States, irrespective of such alien's status, may, only at such a port of entry, apply for asylum in accordance with this section or, as applicable, section 235(b).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79c008959e5944e4a372a1e49c1463ff"><enum>(B)</enum><header>Prohibition on parole or release into the United States</header><text display-inline="yes-display-inline">Notwithstanding section 236(a)(2), an alien applying for asylum at a port of entry may not be paroled or released into the United States.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21857cefdd5d49aaa1c8d8166635862d"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbbddc02cac8d42bdaa29d9877640e073"><enum>(A)</enum><text>by striking subparagraph (B)</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33ca8e1c10b443be9488261c4cf7ff54"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>Subject to subparagraph (D), paragraph</quote> and inserting <quote>Paragraph</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf374df9873be4e9bbac3f2b128be147c"><enum>(C)</enum><text>by striking subparagraph (D);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id494f2ca11d34405483394b04c339ddf2"><enum>(D)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>Subparagraphs (A) and (B)</quote> and inserting <quote>Subparagraph (A)</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc7069ef420fb481d931c6c85c8fa057b"><enum>(E)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (C) and (E) as subparagraphs (B) and (C), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92a065a8c81d408e882d59f1d5a34123"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC7D3C12C118642119F3CC1FAE79A6097"><subparagraph commented="no" display-inline="no-display-inline" id="id7418ef407187461c829c4fe176e34f72"><enum>(D)</enum><header>Effect of apprehension in the United States</header><text>Paragraph (1) shall not apply to any alien who is apprehended by or referred to the Secretary of Homeland Security as an alien who has entered the United States without inspection and admission or who has remained in the United States beyond the alien's period of authorized stay.</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf4394a286904c58b975546e21244537"><enum>(3)</enum><text>by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Attorney General or the Secretary of Homeland Security, as applicable,</quote>.</text></paragraph></section></legis-body></bill>
