        <official-title>To amend title 10, United States Code, to prohibit discrimination in the
            Armed Forces on the basis of gender identity, and for other purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fit to Serve Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header display-inline="yes-display-inline">Prohibition on discrimination in the Armed
                Forces on the basis of gender identity</header>
 <text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/49">Chapter 49</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/974">section 974</external-xref> the following new section:</text>

                    <enum>975.</enum>
                    <header>Prohibition on discrimination on the basis of gender identity</header>
                    <subsection id="H835BB0E8CEA24100BBF1692B8470544A">
                        <enum>(a)</enum>
                        <header>Prohibition</header>
 <text display-inline="yes-display-inline">The Secretary concerned may not, on the basis of gender identity (including a diagnosis or potential diagnosis of gender dysphoria)—</text>
                        <paragraph id="HA5BE07C1B14D47C49E114CD85622E6E0">
                            <enum>(1)</enum>
 <text>prescribe a qualification for service as a member of the Armed Forces;</text>
                        </paragraph>
                        <paragraph id="HA604890ADD0F447EB9022A25A161AD77">
                            <enum>(2)</enum>
 <text display-inline="yes-display-inline">involuntarily separate a member of the Armed Forces;</text>
                        </paragraph>
                        <paragraph id="HFFB413DBF46F4999A423DC33D61EDAF2">
                            <enum>(3)</enum>
 <text>deny medically necessary health care coverage to a member of the Armed Forces;</text>
                        </paragraph>
                        <paragraph id="HA4C2FC6D1270498F95FD53E1C8122914">
                            <enum>(4)</enum>
 <text>require an individual to serve as a member of the Armed Forces in the sex assigned at birth to the member;</text>
                        </paragraph>
                        <paragraph id="H0C1AC318C7D1474880AD1FBCAA3E5944">
                            <enum>(5)</enum>
 <text>deny accession, reenlistment, or continuation of service as a member of the Armed Forces; or</text>
                        </paragraph>
                        <paragraph id="HD7576C7C379A4B36A07CA0A1B9D65E13">
                            <enum>(6)</enum>
 <text display-inline="yes-display-inline">otherwise discriminate against a member of the Armed Forces.</text>
                        </paragraph>
                    </subsection>
                    <subsection id="H51CDEEDCEF714BFFAA726B1BF247A8A8">
                        <enum>(b)</enum>
                        <header>Gender identity defined</header>
 <text display-inline="yes-display-inline">In this section, the term <term>gender identity</term> means the gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual, regardless of the individual’s designated sex at birth.</text>
                    </subsection>
