        <official-title>To amend title XVIII of the Social Security Act to provide for the continued
            designation of hospitals that met mountainous terrain or secondary roads distance
            requirement as critical access hospitals and to modify distance requirements for
            ambulance services furnished by critical access hospitals.</official-title>

        <section section-type="section-one" id="S1">
            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Emergency Access in Key Sites Act</short-title></quote> or the <quote><short-title>PEAKS Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Treatment of hospitals that met mountainous terrain or secondary roads distance
                requirement for designation as critical access hospital</header>
 <text display-inline="no-display-inline">Section 1820(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-4">42 U.S.C. 1395i–4(h)</external-xref>) is amended by adding at the end the following new paragraph:</text>

                    <enum>(4)</enum>
                    <header>Treatment of hospitals that met mountainous terrain or secondary roads
                        distance requirement for designation</header>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id5dbf84fada37435a88201e3d919dfb58">
                        <enum>(A)</enum>
                        <header display-inline="yes-display-inline">In general</header>
 <text>In the case of a hospital described in subparagraph (B), the hospital shall be deemed to meet the 15-mile distance requirement for mountainous terrain or secondary roads described in subsection (c)(2)(B)(i)(I) on or after January 1, 2026.</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id4763a92e47c14883a635a7d93a4161a5">
                        <enum>(B)</enum>
                        <header>Hospital described</header>
 <text display-inline="yes-display-inline">A hospital described in this subparagraph is a hospital that—</text>
                        <clause commented="no" display-inline="no-display-inline" id="id16e2413c272c4e758b716802e829571e">
                            <enum>(i)</enum>
 <text display-inline="yes-display-inline">as of the date of enactment of this paragraph, is designated as a critical access hospital;</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline"
                            id="id7add1f12bc9c42388d0306131f7e9296">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">demonstrates (in a manner determined by the Secretary) that the hospital met the 15-mile distance requirement for mountainous terrain or secondary roads described in subsection (c)(2)(B)(i)(I) as of the hospital's last certification as a critical access hospital; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id6e0fb6875cd144bebb5475c74128a86e">
                            <enum>(iii)</enum>
 <text display-inline="yes-display-inline">after such date of enactment, has a new hospital or other facility described in this subsection located within 10–15 miles of the hospital.</text>
                        </clause>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id10d4be0369f640628f86accf414e79ab">
                        <enum>(C)</enum>
                        <header>Regulations</header>
 <text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this paragraph, the Secretary shall promulgate regulations to carry out this paragraph.</text>
                    </subparagraph>
                </paragraph>

            <enum>3.</enum>
            <header>Modification of distance requirements for ambulance services furnished by
                critical access hospitals</header>
 <text display-inline="no-display-inline">Section 1834(l)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)(8)</external-xref>) is amended, in the flush matter following subparagraph (B), by inserting <quote>(or, for such services furnished on or after January 1, 2026, in the case of mountainous terrain or in areas with only secondary roads available, a 15-mile drive)</quote> after <quote>35-mile drive</quote>.</text>
