 activities to eliminate hepatitis C virus in the United States.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cure Hepatitis C Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id5bfffb4d60da4e5cb31fce5441bef63a"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6dc705b09fd04cee8c96007871a8d7f4"><enum>(1)</enum><header>Correctional facility</header><text>The term <term>correctional facility</term> has the meaning given that term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph><paragraph id="id9C199B0A7B15414F9BB2CDC3DBC58078"><enum>(2)</enum><header>Hepatitis C treatment</header><text>The term <term>hepatitis C treatment</term> means a direct acting antiviral drug approved under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) for the treatment of hepatitis C virus infection.</text></paragraph><paragraph id="idfffe4f473141474582fee650a3ad1097"><enum>(3)</enum><header>Indian health program</header><text>The term <term>Indian health program</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idece11e6955f14210985b94d429b37226"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph commented="no" id="id09BF18DFAEA54FC285CE0A5AAB1DF79A"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph commented="no" id="id44A3A6F47E2F41819335D1048BA3180B"><enum>(A)</enum><text>each of the several States of the United States;</text></subparagraph><subparagraph commented="no" id="id886A8587DB3A4468AC3782FDBE57F555"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph commented="no" id="id4F2001201F044070B4FCB4ACADD979B9"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph commented="no" id="idFB5BC4B405BC4E60BF8DEBB93899B781"><enum>(D)</enum><text>Guam;</text></subparagraph><subparagraph commented="no" id="idFE37D7CDEC0B4A288E831B8B5E0EA450"><enum>(E)</enum><text>American Samoa;</text></subparagraph><subparagraph commented="no" id="id79208879C54446F4B9A6EB40BFF78B09"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph commented="no" id="idAD2C649542D74643980A538FFDBB3103"><enum>(G)</enum><text>the Federated States of Micronesia;</text></subparagraph><subparagraph commented="no" id="id160350E2CB4749549C6E130BDC342341"><enum>(H)</enum><text>the Republic of the Marshall Islands;</text></subparagraph><subparagraph commented="no" id="id27E3B7E8F4B64035969A97B7452DE430"><enum>(I)</enum><text>the Republic of Palau; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0D32231C0DCD4C42886F0B13DE9B7DDC"><enum>(J)</enum><text>the United States Virgin Islands.</text></subparagraph></paragraph><paragraph id="ida069ef4f8d2c489bafa6ca4764035876"><enum>(6)</enum><header>State or local correctional system</header><text>The term <term>State or local correctional system</term> means a department, agency, or other instrumentality of a State or unit of local government (as such term is defined in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>)) that operates or contracts for the operation of 1 or more correctional facilities.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id73d6cc33a50e431b9c4680a6b8c8fe04"><enum>3.</enum><header>Hepatitis C Elimination Program</header><subsection id="iddf1a6834974a4972b4fa3d044a2027e4"><enum>(a)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a program, to be known as the <quote>Hepatitis C Elimination Program</quote> (referred to in this section as the <term>Program</term>), under which the Secretary shall coordinate activities under this Act for the purposes of eliminating hepatitis C virus.</text></subsection><subsection id="id3b1735379870481cab9c05835cc41a8c"><enum>(b)</enum><header>Strategy and implementation plan</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall issue a national strategy and implementation plan to carry out activities under this Act, including—</text><paragraph id="id81902d4c718643e0a0b143f430827ed8"><enum>(1)</enum><text>a description of priority populations that experience higher rates of hepatitis C virus infection and related adverse health outcomes;</text></paragraph><paragraph id="idf6a4bfc9240343b5b40cb86e2c9fc13a"><enum>(2)</enum><text>an inventory of all relevant Federal strategies, plans, policies, and programs relating to hepatitis C virus, including an assessment of any gaps within, or areas of duplication between, such strategies, plans, policies, and programs;</text></paragraph><paragraph id="idb60a2819ce2a4756818ce934feb85cfb"><enum>(3)</enum><text>specific goals, objectives, and strategies to improve the prevention, detection, and treatment of hepatitis C virus in order to achieve the goals of the Program; and</text></paragraph><paragraph id="id49cc9d3af98a4d6ab0d8d0ff461fe436"><enum>(4)</enum><text>performance metrics to assess progress toward achieving each goal, strategy, and objective identified under paragraph (3).</text></paragraph></subsection><subsection id="id353a0279ea7b454b85b6a5f8cb7d1685"><enum>(c)</enum><header>Advisory committee</header><paragraph commented="no" display-inline="no-display-inline" id="id1c9b8381f92d4abe8d30d1fc34fbb4cb"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish an advisory committee to advise the Secretary with respect to the Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f623596aa7d49a6aa706129e163b811"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The advisory committee established under paragraph (1) shall be composed of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id05b4c3b2ce994ea18d25d68ecd6aa9bd"><enum>(A)</enum><text display-inline="yes-display-inline">individuals with lived experience with hepatitis C virus;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38688af405154bd9854dd79eabaaf3de"><enum>(B)</enum><text display-inline="yes-display-inline">clinicians;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd29f6b4032d643be9af4e57f18c5627e"><enum>(C)</enum><text display-inline="yes-display-inline">State and local public health officials;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf68f1a58aab247c7b1198557ab7579ca"><enum>(D)</enum><text display-inline="yes-display-inline">pharmacists;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7cbff722c9284ba8b1b028e9a5a14ec0"><enum>(E)</enum><text display-inline="yes-display-inline">representatives of drug and diagnostic test manufacturers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3cc581aa92543d4a67e2871b9136e31"><enum>(F)</enum><text display-inline="yes-display-inline">representatives of health plans and health insurance issuers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaec447b02bf5466fb7b9e8ae689e2df5"><enum>(G)</enum><text display-inline="yes-display-inline">others individuals engaged in the Program.</text></subparagraph></paragraph></subsection><subsection id="idff319aba8a8e4981836c2dadfb17bbae"><enum>(d)</enum><header>Interagency working group</header><paragraph id="idaf6b68401d4840a68f1ae119fafac67a"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an interagency working group to support the development, implementation, evaluation, and improvement of the Program.</text></paragraph><paragraph id="idef58f1ddf8a24a048bce467f5a1fb3ed"><enum>(2)</enum><header>Membership</header><text>The interagency working group shall include the following individuals or their designees:</text><subparagraph id="id5901eb465ef24b40bb5cace004f8d10f"><enum>(A)</enum><text>The Director of the Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="idbb23bfd389be43cb951d3f1fe87313a8"><enum>(B)</enum><text>The Administrator of the Health Resources and Services Administration.</text></subparagraph><subparagraph id="id54912dc6cc9f4410b87459b399baec2e"><enum>(C)</enum><text>The Administrator of the Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph id="id599e94c220b04ee58e47f211e2b8a6f7"><enum>(D)</enum><text>The Assistant Secretary for Mental Health and Substance Use.</text></subparagraph><subparagraph id="id0a1045406a0a4f72bcf443209c9c94ff"><enum>(E)</enum><text>The Director of the Indian Health Service.</text></subparagraph><subparagraph id="id47098214ddde429c972d55a46c7a9567"><enum>(F)</enum><text>The Commissioner of Food and Drugs.</text></subparagraph><subparagraph id="idfad8ec8a3dca45d0850d27a364e74735"><enum>(G)</enum><text>The Assistant Secretary for Health.</text></subparagraph><subparagraph id="id3465838c60394613a94be4527781c3f7"><enum>(H)</enum><text>The Director of the Bureau of Prisons.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbbeea82cdbb746d79cc3c6fa5b833868"><enum>(I)</enum><text>The heads of such other relevant Federal departments and agencies, as the Secretary designates.</text></subparagraph></paragraph></subsection><subsection id="iddf8f2442477b4b21ba15879071b46b10"><enum>(e)</enum><header>Hepatitis C dashboard</header><text>The Secretary shall establish and maintain a publicly available dashboard for purposes of monitoring progress toward achieving the goals of the Program, including performance metrics established pursuant to subsection (b)(4).</text></subsection><subsection id="id62ffd49a1df84f81a19e556435da0695"><enum>(f)</enum><header>Stakeholder engagement</header><text>In carrying out this Act, the Secretary shall consult with all relevant stakeholders, which may include through public meetings, publication of notices in the Federal Register, and other strategies.</text></subsection><subsection id="id313a00ee044b4b9c9d1a5c11db8c2890"><enum>(g)</enum><header>Reports</header><text>Not later than 90 days after the date of issuance of the strategy and implementation plan under subsection (b), and annually thereafter until September 30, 2032, the Secretary shall submit to the Committees on Finance, Health, Education, Labor, and Pensions and Appropriations of the Senate and the Committees on Energy and Commerce, Ways and Means, and Appropriations of the House of Representatives a report that describes the progress of activities carried out under this Act and the amendments made by this Act.</text></subsection></section><section id="ide7ad1a1b50d148e59cc3fe2498ae4a4a"><enum>4.</enum><header>Provision of Hepatitis C treatments to certain populations</header><subsection id="id9babdc99f3344728b71ee48adeeb3226"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id89aafc402b124666a0870049a9c70110"><enum>(1)</enum><header>Covered population</header><text>The term <term>covered population</term> means the population of individuals determined under subsection (b)(2).</text></paragraph><paragraph commented="no" id="id4df73607ed8b455a93b6e33258255e22"><enum>(2)</enum><header>Minimum essential coverage</header><text>The term <term>minimum essential coverage</term> means health insurance coverage under a public or private plan that constitutes minimum essential coverage under <external-xref legal-doc="usc" parsable-cite="usc/26/5000A">section 5000A(f)(1)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id350631a8ac7f47bc98e425c4b64c718d"><enum>(3)</enum><header>Participating State or local correctional system</header><text>The term <term>participating State or local correctional system</term> means a State or local correctional system that opts to participate in the program under subsection (b)(3)(A).</text></paragraph><paragraph commented="no" id="ide81dc229015d44a9bd8284adfdf5012f"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the subscription program for hepatitis C treatments established under subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec40baf926384f50b68ec4b69f1426fa"><enum>(5)</enum><header>Registered pharmacy; registered site of dispensing</header><text>The terms <term>registered pharmacy</term> and <term>registered site of dispensing</term> mean a pharmacy or site of dispensing, respectively, that enters into an agreement with the Secretary under subsection (b)(5)(B).</text></paragraph></subsection><subsection id="id85b7f8fd5ad6498e82ec043bf53fe62a"><enum>(b)</enum><header>Subscription program for purchase of hepatitis c treatments for covered
 populations</header><paragraph id="id67ecc8622c694783b4fe641d3958d081"><enum>(1)</enum><header>Establishment</header><subparagraph commented="no" display-inline="no-display-inline" id="id6a9e7a08c4bf4d72ad0cbc82c84f8a3a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a subscription program for hepatitis C treatments under which—</text><clause commented="no" display-inline="no-display-inline" id="id74d6d58fb6e54c2486a9ae2783ee1693"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary—</text><subclause id="id5916ce57471a4d9f9f3780fce4e0663e"><enum>(I)</enum><text>shall enter into agreements with 1 or more drug manufacturers for the purchase of hepatitis C treatments under a subscription model described in paragraph (4); and</text></subclause><subclause id="idbf4fd43161ac40d893060831b27cde7b"><enum>(II)</enum><text>shall provide for the distribution of hepatitis C treatments purchased under such agreements among registered pharmacies and registered sites of dispensing, participating State and local correctional systems, the Bureau of Prisons, and facilities of the Indian Health Service, in accordance with paragraph (5); and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0c6b7ffd807f4c36a768126874278cbe"><enum>(ii)</enum><text>each individual within the covered population, in receiving hepatitis C treatments that were purchased under such an agreement, is entitled to receive the treatments without cost-sharing.</text></clause></subparagraph><subparagraph commented="no" id="idf1351062939e4269a055f1bfb673ecbe"><enum>(B)</enum><header>Program prohibition</header><clause commented="no" id="id03f6ddb938ab4f0689644c15abd6a86d"><enum>(i)</enum><header>In general</header><text>Health care providers, pharmacies, and sites of dispensing shall not utilize any other Federal drug discount program, including the drug discount program under section 340B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b</external-xref>), with respect to hepatitis C treatments obtained through the program.</text></clause><clause commented="no" id="id43f1ae9c35634dc2b8b7afb137d2fa69"><enum>(ii)</enum><header>Enforcement</header><text>To ensure compliance with clause (i), the Secretary shall—</text><subclause id="id64d6a89c0c70458eb9fb4dce5567399e"><enum>(I)</enum><text>ensure that relevant data, including data on health care providers, pharmacies, manufacturers, and sites of dispensing participating in the program, is available for administration of the drug discount program under such section 340B;</text></subclause><subclause id="id1c017734593d40628011abbe4e9719bd"><enum>(II)</enum><text>provide necessary resources, from the amounts made available to the Secretary under this section, to carry out program audit, oversight, and administrative activities;</text></subclause><subclause id="id4a4c6f6274614d048b9905bd875264e7"><enum>(III)</enum><text>supplement existing audit guidance issued pursuant to section 340B(a)(5)(C) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b(a)(5)(C)</external-xref>) to give notice to relevant health care providers, pharmacies, and sites of dispensing related to the prohibition and its enforcement; and</text></subclause><subclause id="ide6ad5183e2fd4de3a3b23afed547bf56"><enum>(IV)</enum><text>audit, at the Secretary’s expense, the records of any participating health care provider or registered pharmacy or registered site of dispensing to ensure compliance with the requirements under this subsection.</text></subclause></clause></subparagraph><subparagraph id="id30df3680eabd48999758d2b0674edc0d"><enum>(C)</enum><header>Effect</header><text>Nothing in this paragraph shall prohibit a covered entity (as defined in section 340B(a)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b(a)(4)</external-xref>)) that receives hepatitis C treatments under the program from purchasing hepatitis C treatments pursuant to an agreement under section 340B(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256b">42 U.S.C. 256b(a)(1)</external-xref>), provided that such covered entity complies with section (B)(i).</text></subparagraph></paragraph><paragraph id="id536c97c2d6bc45a3af8df3e58732ba58"><enum>(2)</enum><header>Covered population</header><subparagraph id="id4008ae36fbd240ceb72dfc4596a2c4cf"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the covered population of individuals entitled to receive hepatitis C treatment under the program in accordance with paragraph (1)(A)(ii) is composed of individuals who have been diagnosed with hepatitis C infection and who—</text><clause id="idd164b360d96d48de98a994573b030f61"><enum>(i)</enum><text>subject to paragraph (3)(A)—</text><subclause commented="no" display-inline="no-display-inline" id="id0eb7a9c893434683b1c885272f32c507"><enum>(I)</enum><text display-inline="yes-display-inline">are enrolled in medical assistance under a State Medicaid program that is participating in the program;</text></subclause><subclause id="idb2aad4113c964d009efa3ed41ce4fffe"><enum>(II)</enum><text>are enrolled in child health assistance or pregnancy-related assistance under a State CHIP program that is participating in the program; or</text></subclause><subclause id="idcae118591b9344079af58f5c62109d85"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="ida6c787cf6e2747a0ad4b269b60893ebe"><enum>(aa)</enum><text>are confined in a correctional facility operated by or on behalf of a participating State or local correctional system; or</text></item><item commented="no" display-inline="no-display-inline" indent="up1" id="ide23fba4dd3e344fc8a7e37047de0ced2"><enum>(bb)</enum><text>were confined in a correctional facility operated by or on behalf of a participating State or local correctional system, and who, at the time of release from confinement, had started but not completed a course of hepatitis C treatment;</text></item></subclause></clause><clause id="id01a348da689647edb15bcef5e5ce12d5"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id628cf2c678384abbb360bca94ef59843"><enum>(I)</enum><text>are confined in a facility operated by or on behalf of the Bureau of Prisons; or</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id031a5a32b9ed4409aeea51c6df79544c"><enum>(II)</enum><text>were confined in a facility operated by or on behalf of the Bureau of Prisons, and who, at the time of release from confinement, had started but not completed a course of hepatitis C treatment;</text></subclause></clause><clause id="id2b54cdb951e74b8d92b4cc72212b1973"><enum>(iii)</enum><text>are without minimum essential coverage; or</text></clause><clause id="ida3af30cd58d44a16a65fc8d64d5625e7"><enum>(iv)</enum><text>receive health care services through an Indian health program.</text></clause></subparagraph><subparagraph id="idf2f8bc7207b74fe49489408189427a54"><enum>(B)</enum><header>Requirements</header><clause id="id48865928029a498cbe3b23404ec5b334"><enum>(i)</enum><header>Medicaid and chip</header><text>In the case of an individual described in subclause (I) or (II) of subparagraph (A)(i), the State Medicaid or CHIP program, as applicable, shall coordinate with registered pharmacies and registered sites of dispensing to verify such individual’s enrollment in the State Medicaid program or State CHIP program, as applicable, before the dispensing of a hepatitis C treatment to the individual in accordance with paragraph (1)(A)(ii).</text></clause><clause id="id50393adb0aab4d6b9791a569e54ae73d"><enum>(ii)</enum><header>Bureau of prisons</header><text>The Director of the Bureau of Prisons shall issue a policy regarding determining which individuals in the custody of the Bureau of Prisons are eligible to receive hepatitis C treatment in accordance with paragraph (1)(A)(ii).</text></clause><clause id="idf068876e7555447c8aab112c2c5370b5"><enum>(iii)</enum><header>Individuals without minimum essential coverage</header><subclause id="id3a828bb6f63f4186af9e3d8f062f3547"><enum>(I)</enum><header>In general</header><text>In the case of an individual described in subparagraph (A)(iii), a health care provider designated under subclause (II) shall—</text><item id="idd0ddc2ae93a843fc91d154b37d293251"><enum>(aa)</enum><text>assess whether such individual qualifies as an individual without minimum essential coverage; and</text></item><item id="id48fab7f9f7774570bde57f6324556127"><enum>(bb)</enum><text>if such individual qualifies as an individual without minimum essential coverage, authorize such individual to receive hepatitis C treatment in accordance with paragraph (1)(A)(ii).</text></item></subclause><subclause id="id0bc893eff0ed4392be93d7d40e5cee9b"><enum>(II)</enum><header>Designation of health care providers</header><text>The Secretary, in consultation with State public health departments, shall designate health care providers for purposes of subclause (I).</text></subclause><subclause id="id4dca559fe3584f1884cccaa7c23141b5"><enum>(III)</enum><header>List</header><text>For purposes of verifying whether an individual is authorized under subclause (I)(bb), the Secretary shall maintain, and make available to registered pharmacies and registered sites of dispensing that are dispensing hepatitis C treatment under the program, a list of health care providers designated under subclause (II).</text></subclause><subclause id="id92a15438bb6749d7bd05fb8989163023"><enum>(IV)</enum><header>Guidance</header><text>The Secretary shall issue guidance for health care providers designated under subclause (II) to make determinations under subclause (I)(aa) based on relevant best practices from the program under title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-11">42 U.S.C. 300ff–11 et seq.</external-xref>; commonly referred to as the <quote>Ryan White HIV/AIDS Program</quote>) and the program under section 1928 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396s">42 U.S.C. 1396s</external-xref>; commonly referred to as the <quote>Vaccines for Children program</quote>).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8877a66bb193406dbcbcc4aec4abe84e"><enum>(iv)</enum><header>Indian health service</header><text>The Director of the Indian Health Service shall issue a policy regarding determining which individuals described in subparagraph (A)(iv) are eligible to receive hepatitis C treatment in accordance with paragraph (1)(A)(ii).</text></clause></subparagraph></paragraph><paragraph id="idbe931b3b698b4df2b0556d6bffcc51a0"><enum>(3)</enum><header>Program participation</header><subparagraph id="id596766c20dba4442aed2193398fe2a90"><enum>(A)</enum><header>In general</header><text>Each State Medicaid or CHIP agency or State or local correctional system that seeks to participate in the program shall—</text><clause id="id444f1e3de1854a98b99c5a7d26bebd75"><enum>(i)</enum><text>for the applicable covered population described in subclauses (I) through (III) of paragraph (2)(A)(i), opt into the program by notifying the Secretary by the end of such reasonable period as the Secretary may establish;</text></clause><clause id="idb588b4b1a1e341289ba9c720bcc48eeb"><enum>(ii)</enum><text>submit to the Secretary a letter of intent for participation for the 5-year term of the agreement entered into under paragraph (4);</text></clause><clause id="id80816ae7db5c495a84216b4d5ea9af82"><enum>(iii)</enum><text>agree to not impose prior authorization requirements for screening and treatment for hepatitis C virus with respect to hepatitis C treatments obtained pursuant to the program;</text></clause><clause id="id91140b3228a14290a72363f718a039a8"><enum>(iv)</enum><text>in the case of a State or local correctional system, agree to provide to individuals described in paragraph (2)(A)(i)(III), upon release from confinement—</text><subclause id="id53e41a63f3434234a6f0e170d5c18ffd"><enum>(I)</enum><text>the remainder of the course of hepatitis C treatment; and</text></subclause><subclause id="idd790b719b2cb4cb68491e3e1b1de8ed9"><enum>(II)</enum><text>a referral to ongoing care; and</text></subclause></clause><clause id="id0d7f07951c294f3cbcb0d276e06bdb41"><enum>(v)</enum><text>agree to such other conditions relating to participation in the program as the Secretary may establish.</text></clause></subparagraph><subparagraph id="id91c81c9e339c420292a1fcf1fe5e5812"><enum>(B)</enum><header>Required participation</header><text>The Bureau of Prisons and the Indian Health Service shall participate in the program.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd425aa4b69164b87bb19fdf48947f522"><enum>(C)</enum><header>Correctional facilities operated on behalf of participating state or
 local correctional systems</header><text>A State or local correctional system that seeks to participate in the program shall agree to provide hepatitis C treatment to an individual in the covered population who is or was confined in a correctional facility operated by or on behalf of the State or local correctional system.</text></subparagraph></paragraph><paragraph id="id6c242422e3ef457e800109a148f8ceaa"><enum>(4)</enum><header>Procurement of hepatitis c drugs</header><subparagraph id="ide82f804e7d7c477fa2bc5822d30b540e"><enum>(A)</enum><header>In general</header><text>The Secretary shall enter into an agreement with 1 or more drug manufacturers for the purchase of hepatitis C treatments under a subscription model described in subparagraph (B).</text></subparagraph><subparagraph id="idf23a6c7801024e11b3677f1c4999dc8a"><enum>(B)</enum><header>Subscription model described</header><text>Under a subscription model described in this subparagraph, the Secretary shall enter into an agreement under which 1 or more drug manufacturers agree to provide as many units of hepatitis C treatment as the Secretary requires for the term of the agreement for an amount specified in the agreement, to be paid annually for the term of the agreement.</text></subparagraph><subparagraph id="id7c9fbe76c35b4d73b81399d7cf873f0e"><enum>(C)</enum><header>Term</header><text>The term of an agreement under subparagraph (A) shall be 5 years.</text></subparagraph><subparagraph id="id630d96d1a4144a9aa11e78c720ddcc93"><enum>(D)</enum><header>Solicitation of bids</header><clause id="ide4f18373612541cab7da456a6da86de3"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), in seeking to enter into an agreement under subparagraph (A), the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="idb02e9ebcd9614ef983d465f241da2091"><enum>(I)</enum><text display-inline="yes-display-inline">use competitive procedures to solicit bids from drug manufacturers to provide 100 percent of the hepatitis C treatments for the covered population, as specified by the Secretary under clause (iii); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id68d83c27122342b1aadf7b6dccbc8a1d"><enum>(II)</enum><text display-inline="yes-display-inline">select 1 or more drug manufacturers whose bid or bids represent the best value to the Federal Government, as determined by the Secretary.</text></subclause></clause><clause id="idf2955b8e48d143eb995f70a3502f9ad6"><enum>(ii)</enum><header>Awarding multiple agreements</header><text>In selecting drug manufacturers with which to enter into an agreement under clause (i), the Secretary may enter into an agreement with—</text><subclause id="idae6220dd0ec04258a1cd60e0df56c642"><enum>(I)</enum><text>a single drug manufacturer to provide 100 percent of the hepatitis C treatments for the covered population, for the total amount specified in the bid submitted by the drug manufacturer; or</text></subclause><subclause id="id9212c405c6444fdeb050d4feb942c903"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idcb8048203b4e482eb3e51b16adbb4a08"><enum>(aa)</enum><text>the drug manufacturer with the best bid, as determined by the Secretary, to provide 70 percent of the hepatitis C treatments for the covered population, for an amount that is 70 percent of the total amount specified in the bid submitted by the drug manufacturer; and</text></item><item commented="no" display-inline="no-display-inline" indent="up1" id="id397af6af3dd6442b9ebf96ed4d7636af"><enum>(bb)</enum><text>the drug manufacturer with the second-best bid, as determined by the Secretary, to provide 30 percent of the hepatitis C treatments for the covered population, for an amount that is 30 percent of the total amount specified in the bid submitted by the drug manufacturer described in item (aa).</text></item></subclause></clause><clause id="id42b688acb3d243b3a0546a46892cccf9"><enum>(iii)</enum><header>Required information</header><text>Prior to beginning the contracting process under this paragraph, and in any case not later than 180 days after the date of enactment of this Act, the Secretary shall specify the covered population, and a reasonable estimate of the size of that population, to support the development of bids by interested drug manufacturers under this subparagraph.</text></clause></subparagraph></paragraph><paragraph id="id27229aa90b764a028952a30203dcd6d9"><enum>(5)</enum><header>Distribution of hepatitis c drugs to program participants</header><subparagraph id="ide9d3984b0a4c462ca53dfecb2878b514"><enum>(A)</enum><header>In general</header><text>In providing for distribution of hepatitis C treatments procured pursuant to 1 or more agreements under paragraph (4), the Secretary may—</text><clause id="id9355b45508a241fa93d622853954c1ee"><enum>(i)</enum><text>provide in such an agreement that the drug manufacturer shall—</text><subclause id="id89de2d0c2b89441ba8a6a223dc54eaab"><enum>(I)</enum><text>distribute, or provide for the distribution of, such hepatitis C treatments to registered pharmacies and registered sites of dispensing, State and local correctional systems, the Indian Health Service, and the Bureau of Prisons;</text></subclause><subclause id="idcf4f9bff1abc4f128468aa4ea23c2cb1"><enum>(II)</enum><text>provide data about distribution in the form and manner prescribed by the Secretary; and</text></subclause><subclause id="id1106ebaa7c9c4fa6a14652afbb000e99"><enum>(III)</enum><text>meet such other conditions relating to such distribution as are prescribed by the Secretary; or</text></subclause></clause><clause id="id3b5d0cac5eac4b04b8711e0d86894618"><enum>(ii)</enum><text>enter into a separate agreement for the distribution of such hepatitis C treatments to registered pharmacies and registered sites of dispensing, State and local correctional systems, the Indian Health Service, and the Bureau of Prisons.</text></clause></subparagraph><subparagraph id="id6c105bc270e941f2b57923fd39a10804"><enum>(B)</enum><header>Registered pharmacies and registered sites of dispensing</header><text>A retail pharmacy or site of dispensing that seeks to receive hepatitis C treatments under subparagraph (A) shall become a registered pharmacy or registered site of dispensing by entering into an agreement with the Secretary under which such retail pharmacy or site of dispensing shall agree—</text><clause commented="no" id="idd114719f3b884aa6b660d80780fb72eb"><enum>(i)</enum><text>to dispense hepatitis C treatments to individuals described in clauses (i)(I), (i)(II), and (iii) of paragraph (2)(A); and</text></clause><clause id="id628c440d8c0a4272ad529268386c5441"><enum>(ii)</enum><text>to such conditions as the Secretary may establish for the program.</text></clause></subparagraph><subparagraph id="idc155efcf07a249b79c7a832b98ab7c9e"><enum>(C)</enum><header>Advance stock</header><text>In providing for the distribution of hepatitis C treatments under an agreement entered into under paragraph (4), the Secretary shall provide for the provision of advance stock of such hepatitis C treatments to registered pharmacies, registered sites of dispensing, participating State and local correctional systems, facilities of the Bureau of Prisons, and facilities of the Indian Health Service with high volumes of patients in need of hepatitis C treatments, as determined by the Secretary.</text></subparagraph><subparagraph id="idfc4b08e6164d4c1bb00235694f12ee38"><enum>(D)</enum><header>Dispensing fees</header><text>The Secretary shall pay, based on customary and usual fees for the region, reasonable dispensing fees to registered pharmacies that dispense hepatitis C treatments to individuals within the covered population.</text></subparagraph><subparagraph id="idd0299a383a8a40bab0c99fbb6e159e62"><enum>(E)</enum><header>Requirement to use existing inventory</header><text>Registered sites of dispensing, participating State and local correctional systems, facilities of the Bureau of Prisons, and facilities of the Indian Health Service shall use unexpired, on-hand inventory of previously purchased hepatitis C treatments, if any, before dispensing hepatitis C treatments received under subparagraph (A) to individuals within the covered population.</text></subparagraph></paragraph></subsection><subsection id="id29f9fbeeb1e74271b1519255b3626170"><enum>(c)</enum><header>Exclusion from medicaid best price and average manufacturer price
 calculation</header><text>Section 1927 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8</external-xref>) is amended—</text><paragraph id="id08d52ba4898d49ccbda0f7807a19dee9"><enum>(1)</enum><text>in subsection (c)(1)(C)(i)—</text><subparagraph id="id4351f8be0c5648f4bbfa8763c619c72c"><enum>(A)</enum><text>in subclause (V), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id7ee3e9997f8d43c38638537545882dcb"><enum>(B)</enum><text>in subclause (VI), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id52e5d3484b144bb89f6dc0e39b4dcadc"><enum>(C)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6bf8404c73744c4b80cfd029418035aa"><subclause id="idd47c32f8fddc4931b4ebad0743078183"><enum>(VII)</enum><text>any prices charged under the subscription program for hepatitis C treatments established under section 4(b) of the <short-title>Cure Hepatitis C Act of 2025</short-title>.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="iddab6f77147ae468486072b8e864227c6"><enum>(2)</enum><text>in subsection (k)(1)(B)(i)—</text><subparagraph id="id0a7d9e1270144507a6442b15ba891cc4"><enum>(A)</enum><text>in subclause (IV), by inserting a semicolon at the end;</text></subparagraph><subparagraph id="id4dffb7c38f5a409288618d8a42b14c98"><enum>(B)</enum><text>in subclause (VII), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id61818fc567874ce3a77d79ce8dfce559"><enum>(C)</enum><text>in subclause (VIII), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="ide5a358536a8242868163d06b4e3aee9f"><enum>(D)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfcc43b01f6f44fbaadffdde62a88f8e5"><subclause id="id27e227f153f3402ea8ec2dc51927483b"><enum>(IX)</enum><text>any prices charged under the subscription program for hepatitis C treatments established under section 4(b) of the <short-title>Cure Hepatitis C Act of 2025</short-title>.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idb0d9d748b98c4648922371a0ada5960a"><enum>(d)</enum><header>Funding</header><text>To carry out this section, there is authorized to be appropriated, and there is appropriated, to the Secretary, out of any amounts in the Treasury not otherwise appropriated, $5,500,000,000 for fiscal year 2025, to remain available through fiscal year 2031.</text></subsection></section><section id="idb735def1e6da4f40bb153e672cbd251e"><enum>5.</enum><header>Public health activities to support hepatitis c elimination</header><subsection id="idee701b231f68462594ee1778cc1fcd49"><enum>(a)</enum><header>State awards</header><paragraph id="id567227adf3134cc2a48bba98cb61f686"><enum>(1)</enum><header>Definition of covered individual</header><text>In this subsection, the term <term>covered individual</term> means an individual within the covered population (as defined in section 4(a)) who is at increased risk of hepatitis C virus infection.</text></paragraph><paragraph id="idfcdf8c69168048f19ecb3fa30a20e0e3"><enum>(2)</enum><header>Awards</header><subparagraph id="id34ca47d5e3624ed184ede6314103c8c5"><enum>(A)</enum><header>In general</header><text>The Secretary shall make grants to, or enter into contracts or cooperative agreements with, States and, as appropriate, political subdivisions of States, for purposes of facilitating access to hepatitis C virus screening, diagnosis, treatment, and related wraparound services for covered individuals.</text></subparagraph><subparagraph id="id07af5bbf1a494f10a89b5791d0a67644"><enum>(B)</enum><header>Designated lead entities</header><text>A State or political subdivision of a State receiving an award under subparagraph (A) may designate a lead entity, such as an institution of higher education, that demonstrates the capacity to fulfill the requirements of the award, to manage the award.</text></subparagraph></paragraph><paragraph id="id228eed796975468caee80479a09411fe"><enum>(3)</enum><header>Use of funds</header><text>A State or political subdivision of a State that receives an award under paragraph (2)(A) shall use funds received pursuant to such award—</text><subparagraph id="ide3315fcb33df48728ee29dc82fa717c3"><enum>(A)</enum><text>to improve outreach to covered individuals, which may include activities to increase awareness of the risks of hepatitis C virus and the availability of curative treatments;</text></subparagraph><subparagraph id="id9b2cb8a8287a47658cf9285bf1e4e2f8"><enum>(B)</enum><text>to increase rates of screening for, diagnosis of, and treatment of hepatitis C virus among covered individuals;</text></subparagraph><subparagraph id="idbbc62cf1476f4ce392af9c1c976dc2f3"><enum>(C)</enum><text>to support the coordination and provision of appropriate health care and social services to covered individuals to improve health outcomes relating to hepatitis C virus infection; and</text></subparagraph><subparagraph id="id98a706ac26e84469b9df7d7cccb80578"><enum>(D)</enum><text>improve, as appropriate, other public health capacities and capabilities relating to hepatitis C virus prevention, detection, diagnosis, treatment, and outbreak preparedness and response.</text></subparagraph></paragraph><paragraph id="idbe8ed4c820f34d76919bd631bd0b75db"><enum>(4)</enum><header>Applications</header><subparagraph id="id2e481f4ce2394a7e8192035b493c6464"><enum>(A)</enum><header>In general</header><text>A State or political subdivision of a State seeking to receive an award under paragraph (2)(A) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph><subparagraph id="id5f1a1d80bfcf4fc881b7af9185fd4cda"><enum>(B)</enum><header>Awards to other entities</header><text>In the case of a State that does not submit an application for an award under subparagraph (A), the Secretary may make an award to an entity within such State, such as an institution of higher education, that demonstrates the capacity to fulfill the requirements of the award.</text></subparagraph></paragraph><paragraph id="iddf4e428fe3224738ba4cb899dcddaf34"><enum>(5)</enum><header>Partnerships</header><text>A State or political subdivision of a State or an entity described in paragraph (4)(B) that receives an award under this subsection shall carry out the activities described in paragraph (3) through partnerships with entities located in such State or political subdivision of a State, including through subawards to public and private entities such as—</text><subparagraph id="idc26a6485948e4af8876ab845d7e65185"><enum>(A)</enum><text>local public health departments;</text></subparagraph><subparagraph id="idd9eb0eaf6ba64ce5af8b8667971251b7"><enum>(B)</enum><text>community-based organizations; and</text></subparagraph><subparagraph id="id3c32f998cc394104b4d1bd6c850978b7"><enum>(C)</enum><text>health care providers and health care facilities.</text></subparagraph></paragraph><paragraph id="id85c0ae86294645b4a36178f3599099fa"><enum>(6)</enum><header>Allocation formula</header><subparagraph id="id6e74b336286d476fa0088205f7693479"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a formula to allocate funds under this subsection among States and political subdivisions of States.</text></subparagraph><subparagraph id="id13d7b6ba283a470a97e24f8c5aeeea81"><enum>(B)</enum><header>Considerations</header><text>In establishing the formula under subparagraph (A), the Secretary shall consider—</text><clause id="ida9e64cfefa1a487ea9f78320cafa760e"><enum>(i)</enum><text>the relative incidence of hepatitis C virus, and morbidity and mortality associated with hepatitis C virus within each State; and</text></clause><clause id="ide49df8f5e80c4add93b846d56b51ade7"><enum>(ii)</enum><text>the anticipated covered population (as defined in section 4(a)), within each State.</text></clause></subparagraph></paragraph></subsection><subsection id="idf2ac2089b4c04a6792bc4b3ccf857b74"><enum>(b)</enum><header>Other awards</header><paragraph id="ida3a048ec55e64f45b2701e33fe2cb526"><enum>(1)</enum><header>In general</header><text>The Secretary shall make grants, or enter into contracts or cooperative agreements, in accordance with paragraphs (4) through (8).</text></paragraph><paragraph id="idb4b8f7de15804e1cab7046e737daca0e"><enum>(2)</enum><header>Use of funds</header><text>Funds received pursuant to an award under paragraph (1) may be used by the recipient to carry out the activities described in subparagraphs (A) through (D) of subsection (a)(3), as applicable, in addition to applicable activities described in paragraphs (4) through (8).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1df7e9d6ff72455391ee1e38ea294ccb"><enum>(3)</enum><header>Coordination</header><text>The Secretary shall ensure that awards made under paragraph (1) are coordinated with the activities of the Hepatitis C Elimination Program established under section 3(a).</text></paragraph><paragraph id="idc05a212b72294ed298d1e910ef2bfd01"><enum>(4)</enum><header>Opioid treatment programs and certified community behavioral health
 clinics</header><text>The Secretary shall make awards described in paragraph (1) to opioid treatment programs and certified community behavioral health clinics, as determined eligible by the Secretary, to support hepatitis C virus testing and treatment at such programs and clinics.</text></paragraph><paragraph id="id765a30e0705f4534b14e72ff8c035ac1"><enum>(5)</enum><header>Tribal areas</header><text>The Secretary shall make awards described in paragraph (1) to Indian health programs and health facilities located in Tribal areas for hepatitis C virus testing, linkage to care, and treatment.</text></paragraph><paragraph id="id58547aac9bbb491eb0e5af76dd010373"><enum>(6)</enum><header>Community health centers</header><text>The Secretary shall make awards described in paragraph (1) to health centers eligible for awards under section 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/245b">42 U.S.C. 245b</external-xref>)—</text><subparagraph id="id170b8fec64a845ab88b30383ef5bc9d3"><enum>(A)</enum><text>to expand access to hepatitis C virus testing, case management, and treatment; and</text></subparagraph><subparagraph id="id68735c8e7d6c4c27b143030b96d1e85b"><enum>(B)</enum><text>to build capacity—</text><clause id="idfc0c5b7f6ccb4cfa954307c63a72039c"><enum>(i)</enum><text>to track anticipated referrals for hepatitis C treatment for patients within the target population of the health center; and</text></clause><clause id="idcf4c28a5fa1544faa24cda8a62638c5d"><enum>(ii)</enum><text>to provide hepatitis C treatment to individuals within the covered population (as defined in section 4(a)).</text></clause></subparagraph></paragraph><paragraph id="id132a6ef5e28342ce8186b29f32a644a8"><enum>(7)</enum><header>Correctional facilities</header><subparagraph id="idf18b7b13dd0a482a918802fd8f6bf8cf"><enum>(A)</enum><header>In general</header><text>The Secretary shall make awards described in paragraph (1) to entities described in subparagraph (B) to provide diagnostic testing and treatment to individuals in State and local correctional systems and to facilitate continued care for individuals who began receiving hepatitis C treatment while in custody and who require continued hepatitis C treatment after being released from custody.</text></subparagraph><subparagraph id="id75c5b06bef454d848986865c8a1f1dcd"><enum>(B)</enum><header>Recipients</header><text>The Secretary may make awards under this paragraph to State, local, or territorial health departments, State or local correctional systems, and community-based organizations.</text></subparagraph></paragraph><paragraph id="idaa16741ef4934063adb331f9011e4211"><enum>(8)</enum><header>Ryan white clinics</header><subparagraph id="id5146424093654775bc2d4dbf9bdce8bf"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish a pilot program under which the Secretary shall make awards described in paragraph (1) to not more than 25 eligible entities for the purposes of providing care at facilities that receive funding under title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-11">42 U.S.C. 300ff–11 et seq.</external-xref>) to individuals infected with hepatitis C virus, without regard to whether such infection is a co-occurring condition (as defined in section 2689 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-88">42 U.S.C. 300ff–88</external-xref>)).</text></subparagraph><subparagraph id="id2bd8bc6c1a524d7a82a43c042c7f2038"><enum>(B)</enum><header>Eligible entities</header><text>To be eligible to receive an award under the pilot program established under subparagraph (A), an entity shall be a recipient of an award under part A, B, or C of title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-11">42 U.S.C. 300ff–11 et seq.</external-xref>).</text></subparagraph><subparagraph id="idf9fa77ab63244038b9c86ba6ebfca877"><enum>(C)</enum><header>Requirements</header><text>An eligible entity that receives an award under this paragraph shall use the award funds to provide core medical services and support services relevant to individuals with hepatitis C virus.</text></subparagraph></paragraph></subsection><subsection id="id2f9d74ba74394bdbac5702b6bb1ccbf2"><enum>(c)</enum><header>Technical assistance</header><text>The Secretary, in consultation with the heads of other relevant Federal agencies, shall provide technical assistance to States and other eligible entities seeking awards under this section.</text></subsection><subsection id="id7595e467b65f4a08a8bfee5b20a0010c"><enum>(d)</enum><header>Coordination</header><text>The Secretary shall issue guidance to States regarding ensuring that—</text><paragraph id="idba5cab83e36b4bac92e9f9b5f5625cf0"><enum>(1)</enum><text>patients in need of the care of a specialist for hepatitis C management are appropriately referred for specialty services;</text></paragraph><paragraph id="id36a032ea17ef44e1a7f6bdf176996619"><enum>(2)</enum><text>existing hepatitis B virus screening, vaccination services, programs, and activities are coordinated with activities carried out under this section to support linkage to care for patients with hepatitis B virus; and</text></paragraph><paragraph id="idd7ac8bd0669e4cfbbf5c0ecc1b9c65c2"><enum>(3)</enum><text>activities carried out under this section are coordinated with other existing Federal efforts relating to hepatitis C prevention, such as treatment for opioid use disorder, carried out by the Department of Health and Human Services, the Department of Veterans Affairs, and the Department of Defense.</text></paragraph></subsection><subsection id="id9c884410b71d4afb8d907748291ab99d"><enum>(e)</enum><header>Hepatitis c point-of-Care testing</header><paragraph id="idca341b6426104c1396e5b9143e409fd9"><enum>(1)</enum><header>Point-of-care testing</header><text>The Secretary may—</text><subparagraph id="id04d086e8e455486fbb261311d75fab3d"><enum>(A)</enum><text>enter into agreements with vendors for the purpose of purchasing and distributing in vitro diagnostic point-of-care tests to facilitate hepatitis C virus diagnosis and treatment;</text></subparagraph><subparagraph id="id524be57359c543c595d5ac06f5be9e31"><enum>(B)</enum><text>provide for the distribution of hepatitis C in vitro diagnostic point-of-care tests to entities receiving an award under subsections (a) and (b); and</text></subparagraph><subparagraph id="id005fd64724a249febd67dad49833f584"><enum>(C)</enum><text>set conditions, including reporting and effective use requirements, for entities receiving hepatitis C in vitro diagnostic point-of-care tests under this subsection.</text></subparagraph></paragraph><paragraph id="idc4dee39cfa994f24acb7737a63825e5b"><enum>(2)</enum><header>Diagnostic test development</header><text>Of the amounts made available to carry out this section, the Secretary may use not more than $20,000,000 to support development of diagnostic point-of-care tests to facilitate hepatitis C diagnosis and treatment, including point-of-care hepatitis B tests to facilitate timely hepatitis C treatment.</text></paragraph></subsection><subsection id="idb4022153d0ad4459ad2d7c02e36f3cb6"><enum>(f)</enum><header>Provider training network</header><text>The Secretary, in consultation with the interagency working group established under section 3(d), shall award 1 or more contracts to eligible public or private entities to establish a national network to provide training and technical assistance on implementing hepatitis C prevention, diagnostic testing, care, coordination, and treatment in support of the Hepatitis C Elimination Program established under section 3(a).</text></subsection><subsection id="id03d952cda08b487fa1456149ce1d3ecf"><enum>(g)</enum><header>Public awareness and education</header><paragraph id="id93b8f1fef5684fc7976c3e801796bc21"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a national public awareness and education campaign relating to hepatitis C virus treatment and the activities carried out under this Act.</text></paragraph><paragraph id="id31302bacd4954458abb851d53f0eea8e"><enum>(2)</enum><header>Materials</header><text>In carrying out paragraph (1), the Secretary shall—</text><subparagraph id="id86380bd5f0a74a5186b2d785c10fe619"><enum>(A)</enum><text>tailor information to priority populations for hepatitis C virus; and</text></subparagraph><subparagraph id="idf5de43ca4aaf4e25b4f98e4b593af993"><enum>(B)</enum><text>consult with the advisory committee established under section 3(c).</text></subparagraph></paragraph></subsection></section><section id="id1e736554c18a419dae942096038a2d6d"><enum>6.</enum><header>Funding</header><subsection id="id11a5f7a90b7b49778248cdf853198e26"><enum>(a)</enum><header>In general</header><text>To carry out sections 3 and 5, there is authorized to be appropriated, and there is appropriated, to the Secretary, out of any amounts in the Treasury not otherwise appropriated, $4,283,000,000 for fiscal year 2025, to remain available through fiscal year 2031.</text></subsection><subsection id="ida020a58202024f19852f6450f63ed983"><enum>(b)</enum><header>Administrative expenses</header><text>Of the amount made available under paragraph (1), the Secretary may not use more than 5 percent for administrative expenses of the Hepatitis C Elimination Program established under section 3(a).</text></subsection><subsection id="idaf2722f79f194c9988796f523b4d320f"><enum>(c)</enum><header>Bureau of prisons</header><text>Of the amount appropriated under subsection (a), the Secretary shall transfer $25,000,000 to the Director of the Federal Bureau of Prisons for purposes of expenses of the Bureau of Prisons to carry out sections 3 and 5.</text></subsection></section><section id="id6416f073f89642cabc6ad3095d6d547a"><enum>7.</enum><header>Increasing access to treatments for hepatitis C in the Medicare program</header><subsection id="id0a4289f88ebf47c0a16d5e90be91b3df"><enum>(a)</enum><header>In general</header><text>Section 1860D–2 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(b)</external-xref>) is amended—</text><paragraph id="id34da90e90ecd4af4acb22e2c80931546"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id4aff3383d34d44858cb781476bdbee9f"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>and (9)</quote> and inserting <quote>, (9), and (10)</quote>;</text></subparagraph><subparagraph id="id3209d1c4c7eb44158f03d3e875f2b22f"><enum>(B)</enum><text>in paragraph (2)(A), by striking <quote>and (9)</quote> and inserting <quote>, (9), and (10)</quote>; and</text></subparagraph><subparagraph id="id235c5a45225c4995ad9ac9a6a75db485"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb11706517df64967945b00b0c40ead8c"><paragraph id="id5d0dc9e7267f4c92a0a5a655e93ef0d0"><enum>(10)</enum><header>Elimination of cost-sharing for direct acting antivirals for the treatment of hepatitis c</header><subparagraph commented="no" display-inline="no-display-inline" id="id74adb74cc6c04334bce8043104cca7cf"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>For plan years 2027 through 2031, subject to subparagraph (B), with respect to a covered part D drug that is a direct acting antiviral for the treatment of hepatitis C—</text><clause id="id2fc863ecec2a4caeacdc32423e0d6c6d"><enum>(i)</enum><text>the deductible under paragraph (1) shall not apply; and</text></clause><clause id="ide957d1bf839b4e04aca1bfec26218285"><enum>(ii)</enum><text>there shall be no coinsurance or other cost-sharing under this part with respect to such drug.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9a9967d32c064ff59d2b432be6ce04dd"><enum>(B)</enum><header>Authority to delay implementation</header><text display-inline="yes-display-inline">If the Secretary determines that it is not feasible to implement subparagraph (A) for plan year 2027, subparagraph (A) shall be applied by substituting <quote>2028</quote> for <quote>2027</quote>.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idd630c5c9ed1b4d5796746143aeb22179"><enum>(2)</enum><text>in subsection (c), by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4390393ac1354e84abb1c070cd0c26c5"><paragraph id="idd421e7b79b5a4bbca48e74798af21711"><enum>(7)</enum><header>Treatment of cost-sharing for direct acting antivirals for the
 treatment of hepatitis c</header><text>The coverage is provided in accordance with subsection (b)(10).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id76a21a393c684c42a1d74fc2a0e5f172"><enum>(b)</enum><header>Conforming amendments to cost-Sharing for low-Income individuals</header><text>Section 1860D–14(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)</external-xref>) is amended—</text><paragraph id="id64c46122df774d6abefdc51fd8718cd8"><enum>(1)</enum><text>in paragraph (1)(D), in each of clauses (ii) and (iii), by striking <quote>paragraph (6)</quote> and inserting <quote>paragraphs (6) and (7)</quote>; and</text></paragraph><paragraph id="id5bb7b624e19c4eb4b438cb91bebf66a4"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd09d55426435400eab70c22401fbb15b"><paragraph id="id5c793454c38f4a188598cb7e0da28b3b"><enum>(7)</enum><header>No application of cost-sharing or deductible for direct acting antivirals for the treatment of hepatitis c</header><subparagraph commented="no" display-inline="no-display-inline" id="id82575f6a815047568cfa18ec6cfbe629"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>For plan years 2027 through 2031, subject to subparagraph (B), with respect to a covered part D drug that is a direct acting antiviral for the treatment of hepatitis C—</text><clause id="id726a23e7bd5440e399b523c268f090b8"><enum>(i)</enum><text>the deductible under section 1860D–2(b)(1) shall not apply; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id62862c455b364af68f76c2f26ba95e43"><enum>(ii)</enum><text>there shall be no cost-sharing under this section with respect to such drug.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ab1ebc0041743d68adc05953c125d8f"><enum>(B)</enum><header>Authority to delay implementation</header><text display-inline="yes-display-inline">If the Secretary determines that it is not feasible to implement subparagraph (A) for plan year 2027, subparagraph (A) shall be applied by substituting <quote>2028</quote> for <quote>2027</quote>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id3bd53c880da64b86a35d67ab7e3dfaf4"><enum>8.</enum><header>Other matters</header><subsection commented="no" display-inline="no-display-inline" id="id5f0f74c406f84ca0817c15f1b139625f"><enum>(a)</enum><header display-inline="yes-display-inline">Application of provisions</header><text>Amounts appropriated pursuant to this Act and the amendments made by this Act shall be subject to the requirements contained in <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref> for funds provided under division D of such Public Law.</text></subsection><subsection id="id487801ad197648008879a1d8dc74cee3"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall supersede section 416 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/856">21 U.S.C. 856</external-xref>).</text></subsection></section><section commented="no" id="id2c7c83ddcc9a431c9953c2889370e445"><enum>9.</enum><header>Rulemaking authority</header><text display-inline="no-display-inline">The Secretary may issue regulations to carry out this Act.</text></section><section id="id207b014b9f634fb08b65545e249b3693"><enum>10.</enum><header>Use of funds</header><text display-inline="no-display-inline">Notwithstanding section 4(b)(2), the amounts appropriated pursuant to this Act and the amendments made by this Act may only be used to carry out the provisions of this Act with respect to an individual who is—</text><paragraph commented="no" display-inline="no-display-inline" id="id4d6c36fb55af4968ab7e9b81db4bc52a"><enum>(1)</enum><text display-inline="yes-display-inline">a citizen of the United States; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3547fba3ccf142b5ba06faa0df37e8d9"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id714dc99f98c74a82828083708743a3ed"><enum>(A)</enum><text>an alien lawfully admitted for permanent residence (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>));</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id6e7a6a7e0cd14d478b7da0ec6a184a77"><enum>(B)</enum><text>an alien paroled into the United States under section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>) for a period of not less than 1 year;</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id6ed5ef0efb514fcba26d7fc9c00162f8"><enum>(C)</enum><text>a refugee admitted to the United States under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id3b6545f167a642ceab9faccd87efa11a"><enum>(D)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id668b7fabefd444e4a7d2d7423d9053eb"><enum>(E)</enum><text>an alien entrant referred to in section 501(e) of the Refugee Education Assistance Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/8/1522">8 U.S.C. 1522</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/96/422">Public Law 96–422</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id11ed46099c2245ebb06f40d93228b785"><enum>(F)</enum><text>an alien admitted to the United States as an immigrant under section 584 of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1988 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/100/202">Public Law 100–202</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id3686e634748f4dcd9eb97cf567f0d641"><enum>(G)</enum><text>an alien admitted to the United States as a special immigrant described in section 101(a)(27) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)</external-xref>) pursuant to—</text><clause commented="no" display-inline="no-display-inline" id="idb440435479d848dbb1f4cb583abd9df9"><enum>(i)</enum><text display-inline="yes-display-inline">section 1059 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/8">Public Law 111–8</external-xref>);</text></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id9848aa730976479caaaa8bec5395d06d"><enum>(H)</enum><text>a citizen or national of Afghanistan (or a person with no nationality who last habitually resided in Afghanistan) described in section 2502 of the Afghanistan Supplemental Appropriations Act, 2022 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/43">Public Law 117–43</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id8bf76c0c5a094b888c685ed65f5621fa"><enum>(I)</enum><text>a citizen or national of Ukraine (or a person with no nationality who last habitually resided in Ukraine) described in section 401(a) of the Additional Ukraine Supplemental Appropriations Act, 2022 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/128">Public Law 117–128</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id1e4ea1059cdb4dca941630015671b138"><enum>(J)</enum><text>an alien who is a victim of a severe form of trafficking in persons (as defined in section 107(b)(1)(C) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(1)(C)</external-xref>));</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id0932e7a7ba044215861f3ffc4a92e382"><enum>(K)</enum><text>an alien who entered the United States as an unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) who—</text><clause commented="no" display-inline="no-display-inline" id="id76b1bbb772a2404498996352dbb6ced5"><enum>(i)</enum><text display-inline="yes-display-inline">is a special immigrant under section 101(a)(27)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="ideec9d0f6febe4addae3ffc80713c5a6a"><enum>(ii)</enum><text>on the date on which a dependency order described in that section was made—</text><subclause commented="no" display-inline="no-display-inline" id="id9b8116e9f4d340649d5aa13bc147a196"><enum>(I)</enum><text display-inline="yes-display-inline">was in the custody of the Secretary of Health and Human Services as an unaccompanied alien child; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf05e4961659846f2a23bb9682d56704f"><enum>(II)</enum><text>was receiving services under section 501(a) of the Refugee Education Assistance Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/8/1522">8 U.S.C. 1522</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/96/422">Public Law 96–422</external-xref>); or</text></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id2180b04b7eab47a98a8f9d05ef6e15f4"><enum>(iii)</enum><text>an alien who entered the United States as an unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) and has been granted nonimmigrant status under section 101(a)(15)(U) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(U)</external-xref>);</text></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id243011704ab74fb49dd3170e6fff7e97"><enum>(L)</enum><text>an individual who lawfully resides in the United States in accordance with a Compact of Free Association described in section 402(b)(2)(G) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612(b)(2)(G)</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idc545cff6a64143e8abfbd2da24edc0b7"><enum>(M)</enum><text>an alien described in section 431(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(c)</external-xref>);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="idd337b6bdafd54351916aa63f7a7e039f"><enum>(N)</enum><text>an alien granted conditional entry under subsection (a)(7) of section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) (as in effect on March 31, 1980);</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id09ceb4c9e77f436bbaa3c220b5bdb577"><enum>(O)</enum><text>an alien granted withholding of deportation under subsection (h) of section 243 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1253">8 U.S.C. 1253</external-xref>) (as in effect on the day before the effective date of section 307 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; 110 Stat. 3009–546));</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id26915c0059664c33904b1982ab3c7f5a"><enum>(P)</enum><text display-inline="yes-display-inline">an alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>); or</text></subparagraph><subparagraph id="id5792f4f403af4aab9127d5b1065731a9" indent="up1" commented="no" display-inline="no-display-inline"><enum>(Q)</enum><text>determined by the Secretary of Health and Human Services, through notice and comment rulemaking, to be eligible for services under this Act or the amendments made by this Act.</text></subparagraph></paragraph></section></legis-body></bill>
