            <enum>1.</enum>
            <header>Sexual assault survivors' rights</header>
            <subsection commented="no" display-inline="no-display-inline"
                id="id3deb334459d04ad3aa334a4839e88d9a">
                <enum>(a)</enum>
                <header>Tiered funding for State incentives</header>
 <text>Section 5903(a) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="usc" parsable-cite="usc/34/10441">34 U.S.C. 10441</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>) is amended—</text>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="id2313ce303bae436d9188e0cb4316ec73">
                    <enum>(1)</enum>
 <text>by striking paragraph (2) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idA60C66DA9EBF4BB6A4AF0C96F96F3A06"> <paragraph id="id8635b56aecb64c2d916d28072e00968b"> <enum>(2)</enum> <header>Grant increase</header> <text>The Attorney General shall increase the amount of the covered formula grant provided to a State in accordance with this subsection if the State has in effect—</text>
                            <subparagraph commented="no" display-inline="no-display-inline"
                                id="id6d930400a1e84114b4242af1b5a3b33e">
                                <enum>(A)</enum>
 <text display-inline="yes-display-inline">a law that provides to sexual assault survivors the rights, at a minimum, under section 3772 of title 18, United States Code;</text>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline"
                                id="id811E2C5DACE942B9A194F8B8EEC7C054">
                                <enum>(B)</enum>
 <text display-inline="yes-display-inline">any combination of laws, regulations, practices, and policies that provides to sexual assault survivors the rights, at a minimum, under section 3772 of title 18, United States Code; or</text>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline"
                                id="idA6FB810BDD474E97AA0FB98828C99C0F">
                                <enum>(C)</enum>
 <text display-inline="yes-display-inline">any combination of laws, regulations, practices, and policies that provides to sexual assault survivors rights that are substantially similar to the rights under section 3772 of title 18, United States Code.</text>
                            </subparagraph>
                        </paragraph>

                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"

                    <enum>(2)</enum>
 <text>in paragraph (3), by inserting <quote>, regulation, practice, or policy, as applicable,</quote> after <quote>law</quote>;</text>
                </paragraph>

                    <enum>(3)</enum>
 <text>by redesignating paragraph (5) as paragraph (6); and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id75810ef357054baea53a7f6bcc11e577"> <enum>(4)</enum> <text>by inserting after paragraph (4) the following:</text>

                            <enum>(5)</enum>
                            <header>Allocation of funds</header>
                            <subparagraph commented="no" display-inline="no-display-inline"

                                <enum>(A)</enum>
                                <header display-inline="yes-display-inline">Funding tiers</header>
 <text>Of the amounts made available to carry out this subsection—</text>
                                <clause commented="no" display-inline="no-display-inline"
                                    id="idc5aad7c9c4b7435197ea95d5dfeac7ce">
                                    <enum>(i)</enum>
 <text display-inline="yes-display-inline">60 percent shall be allocated to States that have in effect a law described in paragraph (2)(A);</text>
                                </clause>
                                <clause commented="no" display-inline="no-display-inline"

                                    <enum>(ii)</enum>
 <text display-inline="yes-display-inline">25 percent shall be allocated to States that have in effect a law, regulation, practice, or policy described in paragraph (2)(B); and</text>
                                </clause>
                                <clause commented="no" display-inline="no-display-inline"

                                    <enum>(iii)</enum>
 <text display-inline="yes-display-inline">15 percent shall be allocated to States that have in effect a law, regulation, practice, or policy described in paragraph (2)(C).</text>
                                </clause>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline"
                                id="id2a396c6c08d44b408749f899fbe521b1">
                                <enum>(B)</enum>
                                <header>Eligibility for single tier only</header>
 <text display-inline="yes-display-inline">A State may not receive an allocation under more than 1 of the 3 funding tiers described in subparagraph (A).</text>
                            </subparagraph>
                        </paragraph>

            </subsection>
            <subsection commented="no" display-inline="no-display-inline"

                <enum>(b)</enum>
                <header>Preservation of evidence kits</header>
 <text>Section 3772(a)(2)(A) of title 18, United States Code, is amended by striking <quote>for the duration of the maximum applicable statute of limitations or 20 years, whichever is shorter</quote> and inserting <quote>for not less than 20 years</quote>.</text>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline"

                <enum>(c)</enum>
                <header>Manner of request for notification before disposal of evidence kit or for
                    further preservation</header>
 <text>Section 3772(a)(3) of title 18, United States Code, is amended by striking <quote>written request</quote> each place that term appears and inserting <quote>request</quote>.</text>
