 genetic information in bankruptcy.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Don’t Sell My DNA Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id496ca8020635490eaf6fb51e544b6b51" section-type="subsequent-section"><enum>2.</enum><header>Amendments to title 11, United States Code, relating to protection of genetic
 information</header><subsection commented="no" display-inline="no-display-inline" id="idd9fbe11b444a4d2d9da0457e545bdbb8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title 11, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id74bb2ea99da646618636b7e083a8e19f"><enum>(1)</enum><text>in section 101(41A)(A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7752e78241454b40ada984983bd5c1c3"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (v), by striking <quote>or</quote> at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfee8316ea3ee4981afeb7467428b0417"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idceb7b926fe8743a1aaa5b00ef721ce90"><clause commented="no" display-inline="no-display-inline" id="id02e87517760a4a52b1a23689ca4fb24d"><enum>(vii)</enum><text>genetic information, as defined in section 201 of the Genetic Information Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff</external-xref>); or</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ide25f355abd72454494218af833a76c44"><enum>(2)</enum><text>in section 363—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide0ed4ef3b4e4487dace19402a54c6a03"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(B), by striking clause (ii) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="ideea2306d7b324565b35ee739c8689c50"><clause id="idee1c5e26-d2b3-11ef-b6a4-f401a3b3fdac" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">finding that no showing was made that such sale or such lease would violate applicable nonbankruptcy law,</text></clause><quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">provided,
                                however, that no use, sale, or lease shall be approved if the
                                personally identifiable information consists, in whole or in part,
                                of genetic information (as defined in section 201 of the Genetic
                                Information Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff</external-xref>)),
                                unless all affected persons, including non-parties, have
                                affirmatively consented in writing to such use, sale, or lease after
 the commencement of the case.</quoted-block-continuation-text><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b75755fa0114d1396e58eb4c8009071"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="ida6950a0c82544be4a3c27fcc098eeec5"><subsection id="id3a6b450aa5fb4cc4ad02add425b33ed0"><enum>(q)</enum><text>Any use, sale, or lease of genetic information (as defined in section 201 of the Genetic Information Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff</external-xref>)) shall not be considered final and valid unless each person whose genetic information would be subject to such use, sale, or lease is provided with actual prior written notice of such use, sale, or lease.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90f0a7ad766e4f61b998c1804ac8b0c2"><enum>(3)</enum><text>in section 1107, by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idc8900b54dc854dcd9e69410c462fb83c"><subsection id="idd6418e3afbcb4d6da4c5c4f17b6c8eb2"><enum>(c)</enum><text>A trustee serving in a case under this chapter or debtor in possession shall delete, using methods proscribed by the court (which may include the Guidelines for Media Sanitization issued by the National Institute of Standards and Technology (NIST Special Publication 800–88), or any successor thereto), any genetic information (as defined in section 201 of the Genetic Information Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff</external-xref>)) that was property of the estate and that was not subject to a sale, lease, or other disposition under section 363 of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide878e0a7f3854ee89d376bf866897c48"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text>The amendments made by this section—</text><paragraph id="idc824f53e088546a5bb27032bb2f96aad"><enum>(1)</enum><text>shall take effect on the date of enactment of this Act; and</text></paragraph><paragraph id="id25a88361674e4e38af66a8c9bcb3962b"><enum>(2)</enum><text>shall apply to any case under title 11, United States Code, that is—</text><subparagraph id="ida1c0eb643e5e45b98d187302d758fbb7"><enum>(A)</enum><text>pending as of the date of enactment of this Act; or</text></subparagraph><subparagraph id="id5fab67abfd644258a67a68f2d6330582"><enum>(B)</enum><text>commenced or reopened on or after the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
