            perinatal, or postpartum health care.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Healthy Moms and Babies Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Essential health benefits to include prenatal, childbirth, neonatal, perinatal,
                and postpartum health care</header>
            <subsection commented="no" display-inline="no-display-inline" id="id6b471f10778241e7af5df36e720d6b0b">
                <enum>(a)</enum>
                <header display-inline="yes-display-inline">In general</header>
 <text display-inline="yes-display-inline">Section 1302(b) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18022">42 U.S.C. 18022(b)</external-xref>) is amended—</text>
                <paragraph commented="no" display-inline="no-display-inline" id="id53147621612c4291b86e99e7fe3d01db">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph (6); and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id82a6a9f879cf43e89b5ba3beda99b726">
                    <enum>(2)</enum>
 <text>by inserting after paragraph (4) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ide9a7caf88aa6476db776589849a43598"> <paragraph id="id977711cee93547b0a02668e2d7eaca6b"> <enum>(5)</enum> <header>Maternity and newborn care requirements</header> <subparagraph id="id9a1ef8cb2eef41619307682fe75d3c93"> <enum>(A)</enum> <header>In general</header> <text>The benefits referred to in paragraph (1)(D) shall include comprehensive prenatal, labor and delivery, neonatal, perinatal, and postpartum care and screenings.</text>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline" id="id54f67b0ecc4a4bcbbbb5457614fd9a4e">
                                <enum>(B)</enum>
                                <header>Requirement</header>
 <text display-inline="yes-display-inline">At a minimum, the care and screenings described in subparagraph (A) shall include—</text>
                                <clause id="id97f550e9d50e43569ff7fb28df0a5306">
                                    <enum>(i)</enum>
 <text>ultrasounds by a licensed provider;</text> </clause> <clause id="iddb0ca28420e74d31acd1672849d21e07"> <enum>(ii)</enum> <text>services caring for the individual relating to spontaneous pregnancy loss or spontaneous miscarriage;</text>
                                </clause>
                                <clause id="id8e6d1c3ef72540569a45420b8ac01177">
                                    <enum>(iii)</enum>
 <text>delivery services, including services rendered during delivery, such as anesthesiology, fetal monitoring, consultations with specialists, and services relating to postpartum health;</text>
                                </clause>
                                <clause id="id404a66f7afe24f00966f785b32581929">
                                    <enum>(iv)</enum>
 <text>the services required to be covered under section 2725 of the Public Health Service Act, section 711 of the Employee Retirement Income Security Act of 1974, and <external-xref legal-doc="usc" parsable-cite="usc/26/9811">section 9811</external-xref> of the Internal Revenue Code of 1986;</text>
                                </clause>
                                <clause id="id110bb12591fb4e2fac506f163d41bd52">
                                    <enum>(v)</enum>
 <text>postpartum care services that are not preventive, including behavioral health services, for conditions that may have been exacerbated by pregnancy or conditions as a result of pregnancy, such as diabetes, hypertension, and obesity; and</text>
                                </clause>
                                <clause id="id176658bb9f0d4176a39e3ae92200e722">
                                    <enum>(vi)</enum>
 <text>for legal parents of a new child who do not physically give birth to the child, behavioral health services relating to new parenthood for the 1-year period beginning on the day of the birth of the child.</text>
                                </clause>
                            </subparagraph>
                            <subparagraph id="id8fb77479626e4d7882bea11ab367e3bb">
                                <enum>(C)</enum>
                                <header>Definition of postpartum</header>
 <text>In this paragraph, the term <term>postpartum</term> means the 1-year period beginning immediately after the pregnancy ends.</text>
                            </subparagraph>
                        </paragraph>

            </subsection>

                <enum>(b)</enum>
                <header>Application</header>
 <text>The amendment made by subsection (a) shall be considered as if included in the enactment of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>).</text>
            </subsection>
            <subsection id="id8c05af3bd79a438c861546bf87ea2366">
                <enum>(c)</enum>
                <header>Plan years</header>
 <text>The amendment made by subsection (a) shall apply with respect to plan years beginning on or after the date of enactment of this Act.</text>
            </subsection>

            <enum>3.</enum>
            <header>No cost-sharing for prenatal, childbirth, neonatal, perinatal, or postpartum
                health care</header>

                <enum>(a)</enum>
                <header>In general</header>
 <text>Part D of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111 et seq.</external-xref>) is amended by adding at the end the following:</text>

                            postpartum health care</header>
                        <subsection id="idd3172ef58f604f56b2c121d963f87ac7">
                            <enum>(a)</enum>
                            <header>In general</header>
 <text>For plan years beginning on or after the date of enactment of the <short-title>Supporting Healthy Moms and Babies Act</short-title>, a group health plan and a health insurance issuer offering group or individual health insurance coverage shall provide coverage for the benefits described in section 1302(b)(1)(D) of the Patient Protection and Affordable Care Act, to the same extent that qualified health plans (as defined in section 1301 of such Act) are required to provide coverage for such benefits, and shall not impose any cost-sharing requirements for such benefits.</text>
                        </subsection>

                            <enum>(b)</enum>
                            <header>Definition of cost-Sharing</header>
 <text>In this section, the term <term>cost-sharing</term> has the meaning given the term in section 1302(c)(3) of the Patient Protection and Affordable Care Act.</text>

 <text display-inline="yes-display-inline">Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185 et seq.</external-xref>) is amended by adding at the end the following:</text>

                                <header>In general</header>
 <text>For plan years beginning on or after the date of enactment of the <short-title>Supporting Healthy Moms and Babies Act</short-title>, a group health plan and a health insurance issuer offering group health insurance coverage shall provide coverage for the benefits described in section 1302(b)(1)(D) of the Patient Protection and Affordable Care Act, to the same extent that qualified health plans (as defined in section 1301 of such Act) are required to provide coverage for such benefits, and shall not impose any cost-sharing requirements for such benefits.</text>

 <text>For plan years beginning on or after the date of enactment of the <short-title>Supporting Healthy Moms and Babies Act</short-title>, a group health plan shall provide coverage for the benefits described in section 1302(b)(1)(D) of the Patient Protection and Affordable Care Act, to the same extent that qualified health plans (as defined in section 1301 of such Act) are required to provide coverage for such benefits, and shall not impose any cost-sharing requirements for such benefits. </text>
                            </subsection>
