        <official-title>To facilitate the development of a whole-of-government strategy for nuclear
            cooperation and nuclear exports, and for other purposes.</official-title>

            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>International Nuclear Energy Act of 2025</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Definitions</header>
 <text display-inline="no-display-inline">In this Act:</text> <paragraph id="idef602d08dbb44c598bf4e4d64c1a20e6" commented="no"> <enum>(1)</enum> <header>Advanced nuclear reactor</header> <text>The term <term>advanced nuclear reactor</term> means—</text>
                <subparagraph commented="no" display-inline="no-display-inline"
                    id="id9011ebdb81e74a1bba9788a11a15b74b">
                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">a nuclear fission reactor, including a prototype plant (as defined in sections 50.2 and 52.1 of title 10, Code of Federal Regulations (or successor regulations)), with significant improvements compared to reactors operating on October 19, 2016, including improvements such as—</text>
                    <clause id="idb604dc513966435fa59d30f0c4a2232e">
                        <enum>(i)</enum>
 <text>additional inherent safety features;</text> </clause> <clause id="id51ffb2d51d3d4d58bd8548a8f0f5f1d6"> <enum>(ii)</enum> <text>lower waste yields;</text>
                    </clause>
                    <clause id="id44435f6a127146fe90cfd3a95f347080">
                        <enum>(iii)</enum>
 <text>improved fuel and material performance;</text> </clause> <clause id="id4ab4de8ab5fe4db7a3813e04bd6b76fd"> <enum>(iv)</enum> <text>increased tolerance to loss of fuel cooling;</text>
                    </clause>
                    <clause id="idc95efe48242f4c929519959e43c91576">
                        <enum>(v)</enum>
 <text>enhanced reliability or improved resilience;</text> </clause> <clause id="id27cda79a99f746858fdec458d471b9b5"> <enum>(vi)</enum> <text>increased proliferation resistance;</text>
                    </clause>
                    <clause id="idf0c2fc3c8e474ccba0be19c875f9c39f">
                        <enum>(vii)</enum>
 <text>increased thermal efficiency;</text> </clause> <clause id="id81e3b29afc464631b5e42c10cbf16965"> <enum>(viii)</enum> <text>reduced consumption of cooling water and other environmental impacts;</text>
                    </clause>
                    <clause id="id3251301563e24bf4aa6554e9339e4068">
                        <enum>(ix)</enum>
 <text>the ability to integrate into electric applications and nonelectric applications;</text>
                    </clause>
                    <clause id="id5c6158395e45442cb3fdd5f08a03fef5">
                        <enum>(x)</enum>
 <text>modular sizes to allow for deployment that corresponds with the demand for electricity or process heat; and</text>
                    </clause>
                    <clause id="id78b888100b6041d1b6a11cb3a9e9df36">
                        <enum>(xi)</enum>
 <text>operational flexibility to respond to changes in demand for electricity or process heat and to complement integration with intermittent renewable energy or energy storage;</text>
                    </clause>
                </subparagraph>
                <subparagraph id="idc04b3c0c08ac44d7ba61df0c2dd65a94">
                    <enum>(B)</enum>
 <text>a fusion reactor; and</text> </subparagraph> <subparagraph id="idf2846e90b10d47efb3103b9df8f36359"> <enum>(C)</enum> <text>a radioisotope power system that utilizes heat from radioactive decay to generate energy. </text>
                </subparagraph>
            </paragraph>
            <paragraph id="id86898778F910459EB359BBBA918AF024">
                <enum>(2)</enum>
                <header>Ally or partner nation</header>
 <text>The term <term>ally or partner nation</term> means—</text> <subparagraph id="id2DB3D42FC08E4413BB93A738595FAB69"> <enum>(A)</enum> <text>the Government of any country that is a member of the Organisation for Economic Co-operation and Development;</text>
                </subparagraph>
                <subparagraph id="id5F0A4DDA4A3B443BBC110797FEDC28CE">
                    <enum>(B)</enum>
 <text>the Government of the Republic of India; and</text> </subparagraph> <subparagraph id="idEEEFF7D4707F44758C851BFA04709663"> <enum>(C)</enum> <text>the Government of any country designated as an ally or partner nation by the Secretary of State for purposes of this Act.</text>
                </subparagraph>
            </paragraph>
            <paragraph id="id0B0650FE65BF454FB1520BA0022A24C6">
                <enum>(3)</enum>
                <header>Appropriate committees of Congress</header>
 <text>The term <term>appropriate committees of Congress</term> means—</text> <subparagraph id="id962DFE01C9A94E9A868FD72EA3643377"> <enum>(A)</enum> <text>the Committees on Foreign Relations and Energy and Natural Resources of the Senate; and</text>
                </subparagraph>
                <subparagraph id="idC04E2535D5AF4C7EA02ED778FF803A83">
                    <enum>(B)</enum>
 <text>the Committees on Foreign Affairs and Energy and Commerce of the House of Representatives. </text>
                </subparagraph>
            </paragraph>
            <paragraph id="idB009F3A1988747DCAA91F66BBCEA82FB">
                <enum>(4)</enum>
                <header>Assistant</header>
 <text>The term <term>Assistant</term> means the Assistant to the President and Director for International Nuclear Energy Export Policy described in section 3(a)(1)(D).</text>
            </paragraph>

                <enum>(5)</enum>
                <header>Associated entity</header>
 <text>The term <term>associated entity</term> means an entity that—</text> <subparagraph id="id46eb5f7d55384491a3f9b84c973a66ec" commented="no"> <enum>(A)</enum> <text>is owned, controlled, or operated by—</text>
                    <clause id="idD8F34BECAEC5429AB3E7E1DB720EBE0E" commented="no">
                        <enum>(i)</enum>
 <text>an ally or partner nation; or</text> </clause> <clause id="id0BCC71AB74944FC88A74398859FB4C85" commented="no"> <enum>(ii)</enum> <text>an associated individual; or</text>
                    </clause>
                </subparagraph>
                <subparagraph id="id71417c1658af4a179c575f950b948d65" commented="no">
                    <enum>(B)</enum>
 <text>is organized under the laws of, or otherwise subject to the jurisdiction of, a country described in paragraph (2), including a corporation that is incorporated in a country described in that paragraph.</text>
                </subparagraph>
            </paragraph>
            <paragraph id="idF4362F11A7A246C7A004B5B4C2009D37">
                <enum>(6)</enum>
                <header>Associated individual</header>
 <text>The term <term>associated individual</term> means a foreign national who is a national of a country described in paragraph (2).</text>
            </paragraph>

                <enum>(7)</enum>
                <header>Civil nuclear</header>
 <text>The term <term>civil nuclear</term> means activities relating to—</text> <subparagraph id="idCF4233951B354A529D3CDF897C3C383C"> <enum>(A)</enum> <text>nuclear plant construction; </text>
                </subparagraph>
                <subparagraph id="id21C7FEFB64E047F682F4FBACE26A8F6E">
                    <enum>(B)</enum>
 <text>nuclear fuel services; </text> </subparagraph> <subparagraph id="idE7EFF984682F4AF7A8DEF44C9391251D"> <enum>(C)</enum> <text>nuclear energy financing;</text>
                </subparagraph>
                <subparagraph id="idD97DF7C2CCF14A1FA660ED67CF4F33AC">
                    <enum>(D)</enum>
 <text>nuclear plant operations;</text> </subparagraph> <subparagraph id="id81F4BFA213FA44399CC35BC471246C34"> <enum>(E)</enum> <text>nuclear plant regulation;</text>
                </subparagraph>
                <subparagraph id="idB30AACC5BB5D4F23BB7B8C529A74337B">
                    <enum>(F)</enum>
 <text>nuclear medicine;</text> </subparagraph> <subparagraph id="idFCC4AC23FE3A46FB894AC0AD8B9F1023"> <enum>(G)</enum> <text>nuclear safety;</text>
                </subparagraph>
                <subparagraph id="idD4573D109B094B6C9BD790B79292EC3E">
                    <enum>(H)</enum>
 <text>community engagement in areas in reasonable proximity to nuclear sites;</text>
                </subparagraph>
                <subparagraph id="idD43A1775A2814AE793F6A6BA725B2D61">
                    <enum>(I)</enum>
 <text>infrastructure support for nuclear energy;</text> </subparagraph> <subparagraph id="id32711FF34C0348EE8E04E8D65F2D759B"> <enum>(J)</enum> <text>nuclear plant decommissioning;</text>
                </subparagraph>
                <subparagraph id="id88280394354A4A2F8547FD0064A12B13">
                    <enum>(K)</enum>
 <text>nuclear liability;</text> </subparagraph> <subparagraph id="id6041E36598BA42A3BE2FCD13713CD52D"> <enum>(L)</enum> <text>safe storage and safe disposal of spent nuclear fuel;</text>
                </subparagraph>
                <subparagraph id="idDAA48EA9BE6D45F0AE8459BE13269782">
                    <enum>(M)</enum>
 <text>environmental safeguards;</text> </subparagraph> <subparagraph id="idC84514E95A714EB2A7B7040506870157"> <enum>(N)</enum> <text>nuclear nonproliferation and security; and</text>
                </subparagraph>
                <subparagraph id="idD7CEB080B33740A086A504AB51FE4A8D">
                    <enum>(O)</enum>
 <text>technology related to the matters described in subparagraphs (A) through (N). </text>
                </subparagraph>
            </paragraph>

                <enum>(8)</enum>
                <header>Embarking civil nuclear nation</header>
                <subparagraph id="id5BC9209FB419418DA2A6E824D533CD9B">
                    <enum>(A)</enum>
                    <header>In general</header>
 <text>The term <term>embarking civil nuclear nation</term> means a country that—</text>
                    <clause id="id73CB3D32F0794D77A535D3AD7D81E41A">
                        <enum>(i)</enum>
 <text>does not have a civil nuclear energy program;</text> </clause> <clause id="id1AC277DD6AA14D24927A2F2A56F5E6C8"> <enum>(ii)</enum> <text>is in the process of developing or expanding a civil nuclear energy program, including safeguards and a legal and regulatory framework, for—</text>
                        <subclause id="id93B0CC0302C54D75B8C930286C1B0699">
                            <enum>(I)</enum>
 <text>nuclear safety; </text> </subclause> <subclause id="id51F570AAA0D846BEABFA1704E905A3F8"> <enum>(II)</enum> <text>nuclear security; </text>
                        </subclause>
                        <subclause id="id5D4ACB625D534AFDA3A02EA046ECAAE2">
                            <enum>(III)</enum>
 <text>radioactive waste management; </text> </subclause> <subclause id="idAE51AB2E11624061BDCC3A1249DD3791"> <enum>(IV)</enum> <text>civil nuclear energy;</text>
                        </subclause>
                        <subclause id="id8625D315A77140FEBC607B8EE21267C8">
                            <enum>(V)</enum>
 <text>environmental safeguards;</text> </subclause> <subclause id="id0DE85A6FD1E74D139EC87856EF3598C5"> <enum>(VI)</enum> <text>community engagement in areas in reasonable proximity to nuclear sites;</text>
                        </subclause>
                        <subclause id="id4000AB0296AF40598D3A63234358FB31">
                            <enum>(VII)</enum>
 <text>nuclear liability; or</text> </subclause> <subclause id="idD396738B5AE54EB899A64EA3885116A6"> <enum>(VIII)</enum> <text>advanced nuclear reactor licensing;</text>
                        </subclause>
                    </clause>
                    <clause id="idA3D741F361CD4E26897ED202B6D831D2">
                        <enum>(iii)</enum>
 <text>is in the process of selecting, developing, constructing, or utilizing advanced light water reactors, advanced nuclear reactors, or advanced civil nuclear technologies; or</text>
                    </clause>
                    <clause commented="no" display-inline="no-display-inline"
                        id="ida724574db7c4412da7133f3ebaff9549">
                        <enum>(iv)</enum>
 <text display-inline="yes-display-inline">is eligible to receive development lending from the World Bank.</text>
                    </clause>
                </subparagraph>
                <subparagraph id="id6B19C206F2C24BC4905057E7D36BD1A4">
                    <enum>(B)</enum>
                    <header>Exclusions</header>
 <text>The term <term>embarking civil nuclear nation</term> does not include—</text>
                    <clause id="id5E91A017311F4456ADCC2AFC4D53AC65">
                        <enum>(i)</enum>
 <text>the People’s Republic of China;</text> </clause> <clause id="id010B01D4FB7748DFAE397CEC6DE34391"> <enum>(ii)</enum> <text>the Russian Federation;</text>
                    </clause>
                    <clause id="idA20DAA245DF34B16BA3B2C705DF677EC">
                        <enum>(iii)</enum>
 <text>the Republic of Belarus;</text> </clause> <clause id="id24C19A01B3CB4396B41DD61023F07DDA"> <enum>(iv)</enum> <text>the Islamic Republic of Iran;</text>
                    </clause>
                    <clause id="idCC32ECC7B1BA470E8521F13A3912C32E">
                        <enum>(v)</enum>
 <text>the Democratic People’s Republic of Korea;</text> </clause> <clause id="idA57D46DE1312418797F0FCD25B9B89A9"> <enum>(vi)</enum> <text>the Republic of Cuba;</text>
                    </clause>
                    <clause id="id9B5943AD0D404C80B8266F5B73399A4E">
                        <enum>(vii)</enum>
 <text>the Bolivarian Republic of Venezuela;</text> </clause> <clause id="id04497722036946FF942619C88C8703BD"> <enum>(viii)</enum> <text>the Syrian Arab Republic; </text>
                    </clause>
                    <clause id="id7B114477566D44A5B4CEDB4BE00A5988">
                        <enum>(ix)</enum>
 <text>Burma; or</text> </clause> <clause id="id763AA309D962443E97362E972A46810C"> <enum>(x)</enum> <text>any other country—</text>
                        <subclause id="idA7ABFFEE10BF4F328FBBE5F8C17F8B73">
                            <enum>(I)</enum>
 <text>the property or interests in property of the government of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or </text>
                        </subclause>
                        <subclause id="id71FBED866D4C46A286355B1890B6F29E">
                            <enum>(II)</enum>
 <text>the government of which the Secretary of State has determined has repeatedly provided support for acts of international terrorism for purposes of—</text>

                                <enum>(aa)</enum>
 <text>section 620A(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371(a)</external-xref>);</text>
                            </item>
                            <item id="id59689f2a9f7b42c39081a460fae0f212" commented="no">
                                <enum>(bb)</enum>
 <text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>);</text>
                            </item>

                                <enum>(cc)</enum>

                <enum>(10)</enum>
                <header>Secretary</header>
 <text>The term <term>Secretary</term> means the Secretary of Energy.</text> </paragraph> <paragraph id="id1A19BD5BA3DD447C9688D8D5A54082FE" commented="no"> <enum>(11)</enum> <header>Spent nuclear fuel</header> <text>The term <term>spent nuclear fuel</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
            </paragraph>

                <header>U.S. nuclear energy company</header>
 <text>The term <term>U.S. nuclear energy company</term> means a company that—</text> <subparagraph commented="no" id="id3C5979AD140D47C29A79BF8F87E68682"> <enum>(A)</enum> <text>is organized under the laws of, or otherwise subject to the jurisdiction of, the United States; and</text>
                </subparagraph>
                <subparagraph id="id6F91248CB6BB4E8A87C83787CA45F07F" commented="no"
                    display-inline="no-display-inline">
                    <enum>(B)</enum>
 <text>is involved in the nuclear energy industry.</text> </subparagraph> </paragraph> </section> <section commented="no" display-inline="no-display-inline" id="id072e623f75884b08a1c22e9b52907926"> <enum>3.</enum> <header>Civil nuclear coordination and strategy</header> <subsection id="id0B75E80C496C40A4A80172F909EBE123"> <enum>(a)</enum> <header>White house focal point on civil nuclear coordination</header> <paragraph id="idA63D1FB31B3246B696FA8E11866EC749"> <enum>(1)</enum> <header>Sense of congress</header> <text>Given the critical importance of developing and implementing, with input from various agencies throughout the executive branch, a cohesive policy with respect to international efforts related to civil nuclear energy, it is the sense of Congress that—</text>
                    <subparagraph id="idD965CA27CFDB411596BF4C8A623DBB4F">
                        <enum>(A)</enum>
 <text>there should be a focal point within the White House, which may, if determined to be appropriate, report to the National Security Council, for coordination on issues relating to those efforts;</text>
                    </subparagraph>
                    <subparagraph id="id0FA45014201B4584AAD34BF7F6EA40C3">
                        <enum>(B)</enum>
 <text>to provide that focal point, the President should designate, within the National Energy Dominance Council, an office, to be known as the <quote>Office of the Assistant to the President and Director for International Nuclear Energy Export Policy</quote> (referred to in this subsection as the <term>Office</term>);</text>
                    </subparagraph>
                    <subparagraph id="idA96F9DA33ADF4D188E4AD7CE8E06014E">
                        <enum>(C)</enum>
 <text>the Office should act as a coordinating office for—</text> <clause id="idAEB58FF65D1E467B94041BB73428BC83"> <enum>(i)</enum> <text>international civil nuclear cooperation; and </text>
                        </clause>
                        <clause id="idE635F647CD9C493A8C352B987C63366F">
                            <enum>(ii)</enum>
 <text>civil nuclear export strategy;</text> </clause> </subparagraph> <subparagraph id="id480678B33E84408F953564A39F89AE0F"> <enum>(D)</enum> <text>the Office should be headed by an individual appointed as an Assistant to the President with the title of <quote>Director for International Nuclear Energy Export Policy</quote> who is also a member of the National Energy Dominance Council; and</text>
                    </subparagraph>
                    <subparagraph id="id297F62CFA5324C2DAA4CFB754A0977B4">
                        <enum>(E)</enum>
 <text>the Office should—</text> <clause id="id0B0E14DB46454002B51732CE602EFFAE"> <enum>(i)</enum> <text>coordinate civil nuclear export policies for the United States;</text>
                        </clause>
                        <clause id="id0984CC0894A748C39217368D85B58D0D">
                            <enum>(ii)</enum>
 <text>develop, in coordination with the officials described in paragraph (2), a cohesive Federal strategy for engagement with foreign governments (including ally or partner nations and the governments of embarking civil nuclear nations), associated entities, and associated individuals with respect to civil nuclear exports; </text>
                        </clause>
                        <clause id="idFCD558957279494CA0F6675CC0470174">
                            <enum>(iii)</enum>
 <text>coordinate with the officials described in paragraph (2) to ensure that necessary framework agreements and trade controls relating to civil nuclear materials and technologies are in place for key markets; and</text>
                        </clause>
                        <clause id="id6C1EE225DA9C41559304387FD020CE48">
                            <enum>(iv)</enum>
 <text>develop—</text> <subclause id="idE084E6BE48864CE6AC85EFE6902DB6F6"> <enum>(I)</enum> <text>a whole-of-government coordinating strategy for civil nuclear cooperation;</text>
                            </subclause>
                            <subclause id="id968A56899A5F4420BDCC6D46885E4485">
                                <enum>(II)</enum>
 <text>a whole-of-government strategy for civil nuclear exports; and</text>
                            </subclause>
                            <subclause id="idA38C6B1239C44BA4B28D3211CFC313F6" commented="no"
                                display-inline="no-display-inline">
                                <enum>(III)</enum>
 <text>a whole-of-government approach to support appropriate foreign investment in civil nuclear energy projects supported by the United States in embarking civil nuclear nations.</text>
                            </subclause>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline"
                    id="id0BA9D2E693724FBAA09AF60510EC6C2D">
                    <enum>(2)</enum>
                    <header>Officials described</header>
 <text>The officials referred to in paragraph (1)(E) are—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id23B58C0928A045BCB798751E2C0FC1B2"> <enum>(A)</enum> <text>appropriate officials of any Federal agency that the President determines to be appropriate; and</text>
                    </subparagraph>
                    <subparagraph display-inline="no-display-inline" commented="no"
                        id="idF8E66B695F38435D8DEDFB2548E370F3">
                        <enum>(B)</enum>
 <text>appropriate officials representing foreign countries and governments, including—</text>
                        <clause display-inline="no-display-inline" commented="no"
                            id="id514106994408403283B0A2D66F0DF5F4">
                            <enum>(i)</enum>

                    <header>Establishment</header>
 <text>There is established a working group, to be known as the <quote>Nuclear Exports Working Group</quote> (referred to in this subsection as the <term>working group</term>).</text>
                </paragraph>

                    <enum>(2)</enum>
                    <header>Composition</header>
 <text>The working group shall be composed of—</text> <subparagraph id="id251C5BC4B0164E608C42CE944A33F1E4"> <enum>(A)</enum> <text>senior-level Federal officials, selected internally by the applicable Federal agency or organization, from any Federal agency or organization that the President determines to be appropriate; and</text>
                    </subparagraph>

                        <enum>(B)</enum>
 <text>other senior-level Federal officials, selected internally by the applicable Federal agency or organization, from any other Federal agency or organization that the Secretary determines to be appropriate.</text>

                    <enum>(3)</enum>
                    <header>Reporting</header>
 <text>The working group shall report to the appropriate White House official, which may be the Assistant (if appointed).</text>

                    <header>Duties</header>
 <text>The working group shall coordinate, not less frequently than quarterly, with the Civil Nuclear Trade Advisory Committee of the Department of Commerce, the Nuclear Energy Advisory Committee of the Department of Energy, and other advisory or stakeholder groups, as necessary, to maintain an accurate and up-to-date knowledge of the standing of civil nuclear exports from the United States, including with respect to meeting the targets established as part of the 10-year civil nuclear trade strategy described in paragraph (5)(A). </text>

                    <enum>(5)</enum>
                    <header>Strategy</header>
                    <subparagraph id="id546ADEA8119441B4B3AFBD3132BFDCFB">
                        <enum>(A)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the working group shall establish a 10-year civil nuclear trade strategy, including biennial targets for the export of civil nuclear technologies, including light water and non-light water reactors and associated equipment and technologies, civil nuclear materials, and nuclear fuel that align with meeting international energy demand while seeking to avoid or reduce emissions.</text>
                    </subparagraph>
                    <subparagraph id="id8BA6E28BB62B4A238B7CAAA87069A1A6">
                        <enum>(B)</enum>
                        <header>Collaboration required</header>
 <text display-inline="yes-display-inline">In establishing the strategy under subparagraph (A), the working group shall collaborate with—</text>

        </section>
        <section id="idEE1B49BCC1734656891A55B2F3F0746C">
            <enum>4.</enum>
            <header>Engagement with ally or partner nations</header>
            <subsection id="id2cfae9a781974e3389df0ad8f207564b">
                <enum>(a)</enum>
                <header>In general</header>
 <text>The President shall launch, in accordance with applicable nuclear technology export laws (including regulations), an international initiative to modernize the civil nuclear outreach to embarking civil nuclear nations.</text>
            </subsection>
            <subsection id="idF2C3D9B501EC4931B039648553D2A841">
                <enum>(b)</enum>
                <header>Financing</header>
 <text>In carrying out the initiative described in subsection (a), the President, acting through an appropriate Federal official, who may be the Assistant (if appointed), if determined to be appropriate, and in coordination with the officials described in section 3(a)(2), may, if the President determines to be appropriate, seek to establish cooperative financing relationships for the export of civil nuclear technology, components, materials, and infrastructure to embarking civil nuclear nations.</text>
            </subsection>
            <subsection id="idbd158a4941ad4c3abcf42355ea71aafe">
                <enum>(c)</enum>
                <header>Activities</header>
 <text>In carrying out the initiative described in subsection (a), the President shall—</text>
                <paragraph id="id6538E3275D4C4C908C1664C7504C1421">
                    <enum>(1)</enum>
 <text>assist nongovernmental organizations and appropriate offices, administrations, agencies, laboratories, and programs of the Department of Energy and other relevant Federal agencies and offices in providing education and training to foreign governments in nuclear safety, security, and safeguards—</text>
                    <subparagraph id="id453E1D5E22474BC29FFB447406533B43">
                        <enum>(A)</enum>
 <text>through engagement with the International Atomic Energy Agency; or</text>
                    </subparagraph>
                    <subparagraph id="idF47426F2B78C4495B578296F77265F18">
                        <enum>(B)</enum>
 <text>independently, if the applicable entity determines that it would be more advantageous under the circumstances to provide the applicable education and training independently;</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="idc1c73f5f774e42b7a1a22696aee47059">
                    <enum>(2)</enum>
 <text>assist the efforts of the International Atomic Energy Agency to expand the support provided by the International Atomic Energy Agency to embarking civil nuclear nations for nuclear safety, security, and safeguards;</text>
                </paragraph>
                <paragraph id="id45332948a6814499b4bd9d8cb9715687">
                    <enum>(3)</enum>
 <text>coordinate with appropriate Federal departments and agencies on efforts to expand outreach to the private investment community and establish public-private financing relationships that enable the adoption of civil nuclear technologies by embarking civil nuclear nations, including through exports from the United States;</text>
                </paragraph>
                <paragraph id="idbf0cb6d79f0e4bc8b47f649706d8f4ae">
                    <enum>(4)</enum>
 <text>seek to better coordinate, to the maximum extent practicable, the work carried out by any Federal agency that the President determines to be appropriate; and</text>
                </paragraph>
                <paragraph id="idE953B5F94BF34EBE9AC7AA5FFED98935" commented="no"
                    display-inline="no-display-inline">
                    <enum>(5)</enum>
 <text>coordinate with the Export-Import Bank of the United States to improve the efficient and effective exporting and importing of civil nuclear technologies and materials. </text>
                </paragraph>
            </subsection>
        </section>
        <section id="idA69B9734C703441C8970688C7967B8CC">
            <enum>5.</enum>
            <header>Cooperative financing relationships with ally or partner nations and embarking
                civil nuclear nations</header>
            <subsection id="idA510832C846D4B4D8EDDA479B1D21833">
                <enum>(a)</enum>
                <header>In general</header>
 <text display-inline="yes-display-inline">The President shall designate an appropriate White House official, who may be the Assistant (if appointed), to coordinate with the officials described in section 3(a)(2) to develop, as the President determines to be appropriate, financing relationships with ally or partner nations to assist in the adoption of civil nuclear technologies exported from the United States or ally or partner nations to embarking civil nuclear nations.</text>
            </subsection>
            <subsection id="idA3A740338688463B9674441DBC1DBBA9">
                <enum>(b)</enum>
                <header>United States competitiveness clauses</header>
                <paragraph id="idDAB58B4084F441508298B9447BC8C066" commented="no">
                    <enum>(1)</enum>
                    <header>Definition of United States competitiveness clause</header>
 <text>In this subsection, the term <term>United States competitiveness clause</term> means any United States competitiveness provision in any agreement entered into by the Department of Energy, including—</text>
                    <subparagraph id="idB9365BDC05584912A8E1C12706F85C0E" commented="no">
                        <enum>(A)</enum>
 <text>a cooperative agreement;</text> </subparagraph> <subparagraph id="idD6D411C9A1DA4628B5EE228C009A862C" commented="no"> <enum>(B)</enum> <text>a cooperative research and development agreement; and</text>
                    </subparagraph>
                    <subparagraph id="id73F08283F67245CBA7095AEE1BFEA1BB" commented="no">
                        <enum>(C)</enum>
 <text>a patent waiver.</text> </subparagraph> </paragraph> <paragraph id="idEF201FAEB72F4DD897A82EC210601C8C"> <enum>(2)</enum> <header>Consideration</header> <text>In carrying out subsection (a), the relevant officials described in that subsection shall consider the impact of United States competitiveness clauses on any financing relationships entered into or proposed to be entered into under that subsection.</text>
                </paragraph>
                <paragraph id="idFD4461D6D9D54696851F2EC7067874D3" commented="no"
                    display-inline="no-display-inline">
                    <enum>(3)</enum>
                    <header>Waiver</header>
 <text>The Secretary shall facilitate waivers of United States competitiveness clauses as necessary to facilitate financing relationships with ally or partner nations under subsection (a).</text>
                </paragraph>
            </subsection>
        </section>
        <section id="idF5A2EF66DFCD4DBEA3204CEEA8EB0E01">
            <enum>6.</enum>
            <header>Cooperation with ally or partner nations on advanced nuclear reactor
                demonstration and cooperative research facilities for civil nuclear energy</header>
            <subsection id="idf8fa426c8cb0461185c5384c10fb0720">
                <enum>(a)</enum>
                <header>In general</header>
 <text>Not later than 2 years after the date of enactment of this Act, the Secretary of State, in coordination with the Secretary and the Secretary of Commerce, shall conduct bilateral and multilateral meetings with not fewer than 5 ally or partner nations, with the aim of enhancing nuclear energy cooperation among those ally or partner nations and the United States, for the purpose of developing collaborative relationships with respect to research, development, licensing, and deployment of advanced nuclear reactor technologies for civil nuclear energy.</text>
            </subsection>
            <subsection id="id1fca5caa27f14e65a0df7c76a5462fd2">
                <enum>(b)</enum>
                <header>Requirement</header>
 <text>The meetings described in subsection (a) shall include—</text> <paragraph id="id1A26386B2AB1489397096F83ACC10555"> <enum>(1)</enum> <text>a focus on cooperation to demonstrate and deploy advanced nuclear reactors, with an emphasis on U.S. nuclear energy companies, during the 10-year period beginning on the date of enactment of this Act to provide options for addressing energy security and climate change; and</text>
                </paragraph>
                <paragraph id="id848357386AE34E0A99CF7132926D5AD4">
                    <enum>(2)</enum>
 <text>a focus on developing a memorandum of understanding or any other appropriate agreement between the United States and ally or partner nations with respect to—</text>
                    <subparagraph id="id5D7E9CE4618243FDBA28F0D3A8F5754B">
                        <enum>(A)</enum>
 <text>the demonstration and deployment of advanced nuclear reactors; and </text>
                    </subparagraph>
                    <subparagraph id="idC246F317A2B54BB19A6B86CC397ED799">
                        <enum>(B)</enum>
 <text>the development of cooperative research facilities.</text> </subparagraph> </paragraph> </subsection> <subsection id="idb8e4ad0fba7c4e229dde721b8ab8ec6c"> <enum>(c)</enum> <header>Financing arrangements</header> <text>In conducting the meetings described in subsection (a), the Secretary of State, in coordination with the Secretary, the Secretary of Commerce, and the heads of other relevant Federal agencies and only after initial consultation with the appropriate committees of Congress, shall seek to develop financing arrangements to share the costs of the demonstration and deployment of advanced nuclear reactors and the development of cooperative research facilities with the ally or partner nations participating in those meetings.</text>
            </subsection>
            <subsection id="idf462335785434b6dbe8a09ca51611dc5">
                <enum>(d)</enum>
                <header>Report</header>
 <text>Not later than 1 year after the date of enactment of this Act, the Secretary, the Secretary of State, and the Secretary of Commerce shall jointly submit to the appropriate committees of Congress a report highlighting potential partners—</text>
                <paragraph id="idA431E7D9063D4ED4A94C1AC12ACAE3A6">
                    <enum>(1)</enum>
 <text>for the establishment of cost-share arrangements described in subsection (c) and the details of those arrangements; or </text>
                </paragraph>
                <paragraph id="idCE3E4808A5674303A1347DA2DF21AEE9">
                    <enum>(2)</enum>
 <text>with which the United States may enter into agreements with respect to—</text>
                    <subparagraph id="id60E4CE48CCDC4BA487D88C346E14420C" commented="no">
                        <enum>(A)</enum>
 <text>the demonstration of advanced nuclear reactors; or</text> </subparagraph> <subparagraph id="id128AB31503F24F00823886ADA29B0163" commented="no" display-inline="no-display-inline"> <enum>(B)</enum> <text>cooperative research facilities. </text>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>

            <enum>7.</enum>
            <header>International civil nuclear energy cooperation</header>
 <text display-inline="no-display-inline">Section 959B of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16279b">42 U.S.C. 16279b</external-xref>) is amended—</text>

 <text>bilateral and multilateral arrangements developed and executed with the concurrence of the Secretary of State that contain commitments for the utilization of the reactors, fuel, equipment, services, and technology of U.S. nuclear energy companies (as defined in that section);</text>
                            </subparagraph>
                            <subparagraph id="idd88cc1fe811149f78347b2407339c28a">
                                <enum>(B)</enum>
 <text>the designation of 1 or more U.S. nuclear energy companies (as defined in that section) to implement an arrangement under subparagraph (A) if the Secretary determines that the designation is necessary and appropriate to achieve the objectives of this section; and</text>
                            </subparagraph>
                            <subparagraph id="idc0634ac5d5df4a409172131c35efc656">
                                <enum>(C)</enum>
 <text>the waiver of any provision of law relating to competition with respect to any activity related to an arrangement under subparagraph (A) if the Secretary, in consultation with the Attorney General and the Secretary of Commerce, determines that a waiver is necessary and appropriate to achieve the objectives of this section.</text>

 <text>Of funds appropriated or otherwise made available to the Secretary to carry out the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) in fiscal years 2026 through 2030, the Secretary may use $15,500,000 to carry out this section.</text>
                    </subsection>

            <header>International civil nuclear program support</header>

                <enum>(a)</enum>
                <header>In general</header>
 <text>Not later than 120 days after the date of enactment of this Act, the Secretary of State, in coordination with the Secretary and the Assistant (if appointed), shall launch an international initiative (referred to in this section as the <term>initiative</term>) to provide financial assistance to, and facilitate the building of technical capacities by, in accordance with this section, embarking civil nuclear nations for activities relating to the development of civil nuclear energy programs.</text>
            </subsection>
            <subsection id="id159600c6addb4f638f334c5e4307c46c">
                <enum>(b)</enum>
                <header>Financial assistance</header>
                <paragraph id="idA9885D9B44AA41FEB7AC4C69A62E0E60">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>In carrying out the initiative, the Secretary of State, in coordination with the Secretary and the Assistant (if appointed), is authorized to award grants of financial assistance in amounts not greater than $5,500,000 to embarking civil nuclear nations in accordance with this subsection—</text>
                    <subparagraph id="id2CC462229994427CB4740433137EEC37">
                        <enum>(A)</enum>
 <text>for activities relating to the development of civil nuclear energy programs; and</text>
                    </subparagraph>
                    <subparagraph id="idEE37F9A5A5484818869DDEE261094D63">
                        <enum>(B)</enum>
 <text>to facilitate the building of technical capacities for those activities.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="id553CF41B85AA4C05A9CA528DEDB0D257">
                    <enum>(2)</enum>
                    <header>Limitations</header>
 <text>The Secretary of State, in coordination with the Secretary and the Assistant (if appointed), may award—</text>
                    <subparagraph id="id6CDBCE2D23944FCFA5C02782F5CF6783">
                        <enum>(A)</enum>
 <text>not more than 1 grant of financial assistance under paragraph (1) to any 1 embarking civil nuclear nation each fiscal year; and</text>
                    </subparagraph>
                    <subparagraph id="id9017EC36C29847528655F2AA2142DFAF">
                        <enum>(B)</enum>
 <text>not more than a total of 5 grants of financial assistance under paragraph (1) to any 1 embarking civil nuclear nation.</text>
                    </subparagraph>
                </paragraph>
            </subsection>

                <enum>(c)</enum>
                <header>Senior advisors</header>
                <paragraph id="idE6D17EDB8C6146BFB26D0130D66A00BF">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>In carrying out the initiative, the Secretary of State, in coordination with the Secretary and the Assistant (if appointed), is authorized to provide financial assistance to an embarking civil nuclear nation for the purpose of contracting with a U.S. nuclear energy company to hire 1 or more senior advisors to assist the embarking civil nuclear nation in establishing a civil nuclear program.</text>
                </paragraph>

 <text>Financial assistance under this subsection is authorized to be provided to an embarking civil nuclear nation in addition to any financial assistance provided to that embarking civil nuclear nation under subsection (b).</text>
                </paragraph>
            </subsection>
            <subsection id="idDB63173C1BA34742A0BBBBFE012E1B56">
                <enum>(d)</enum>
                <header>Limitation on assistance to embarking civil nuclear nations</header>
 <text>Not later than 1 year after the date of enactment of this Act, the Offices of the Inspectors General for the Department of State and the Department of Energy shall coordinate—</text>
                <paragraph id="id1F263E39266747C6A5A557711DF923E7">
                    <enum>(1)</enum>
 <text>to establish and submit to the appropriate committees of Congress a joint strategic plan to conduct comprehensive oversight of activities authorized under this section to prevent fraud, waste, and abuse; and</text>
                </paragraph>
                <paragraph id="idE681A2E284D24EA48667EA21F25A60DC">
                    <enum>(2)</enum>
 <text>to engage in independent and effective oversight of activities authorized under this section through joint or individual audits, inspections, investigations, or evaluations.</text>
                </paragraph>
            </subsection>

                <enum>(e)</enum>
                <header>Authorization of appropriations</header>
 <text>Of funds appropriated or otherwise made available to the Secretary of State to carry out the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>) in fiscal years 2026 through 2030, the Secretary of State may use $50,000,000 to carry out this section.</text>
            </subsection>
        </section>

            <enum>9.</enum>
            <header>Biennial cabinet-level international conference on nuclear safety, security,
                safeguards, and sustainability</header>
            <subsection id="id3e8263f7d84c47038f1d1ea4d52fcce3">
                <enum>(a)</enum>
                <header>In general</header>
 <text>The President, in coordination with international partners, as determined by the President, and industry, shall hold a biennial conference on civil nuclear safety, security, safeguards, and sustainability (referred to in this section as a <term>conference</term>).</text>
            </subsection>
            <subsection id="idCB162EC06ECC4F3A9C345BEC7F1A600D">
                <enum>(b)</enum>
                <header>Conference functions</header>
 <text>It is the sense of Congress that each conference should—</text> <paragraph id="idAA58D1902CA0469AA04241EBF1231E9B"> <enum>(1)</enum> <text>be a forum in which ally or partner nations may engage with each other for the purpose of reinforcing the commitment to—</text>
                    <subparagraph id="id42CABE5238F0460AB0F93A077760E298">
                        <enum>(A)</enum>
 <text>nuclear safety, security, safeguards, and sustainability;</text> </subparagraph> <subparagraph id="id85A6759C2BBA4D739A2A4758B059FEA2"> <enum>(B)</enum> <text>environmental safeguards; and</text>
                    </subparagraph>
                    <subparagraph id="id92589D46D020485C9CA5CD98CB38311A">
                        <enum>(C)</enum>
 <text>local community engagement in areas in reasonable proximity to nuclear sites; and</text>
                    </subparagraph>
                </paragraph>

 <text>cooperative financing relationships to promote competitive alternatives to Chinese and Russian financing;</text>
                        </clause>

                            <enum>(iv)</enum>
 <text>a standardized financing and project management framework for the construction of civil nuclear power plants;</text>
                        </clause>
                        <clause id="id05a81f0811c14a3592fcb5239499f142">
                            <enum>(v)</enum>
 <text>a standardized licensing framework for civil nuclear technologies;</text>
                        </clause>
                        <clause id="id0d090364bcdf4ece8ae1c49a031dd321">
                            <enum>(vi)</enum>
 <text>a strategy to change internal policies of multinational development banks, such as the World Bank, to support the financing of civil nuclear projects;</text>
                        </clause>

                            <enum>(vii)</enum>
 <text>a document containing any lessons learned from countries that have partnered with the Russian Federation or the People’s Republic of China with respect to civil nuclear power, including any detrimental outcomes resulting from that partnership; and</text>

                            <enum>(viii)</enum>
 <text>a global civil nuclear liability regime;</text> </clause> </subparagraph> <subparagraph id="id8864525A9BE54459993AF0FB42224E53"> <enum>(B)</enum> <text>cooperation for enhancing the overall aspects of civil nuclear power, such as—</text>

 <text>the development and determination of the mechanisms described in paragraphs (7) and (8) of section 10(a), if the President intends to establish an Advanced Reactor Coordination and Resource Center as described in that section. </text>

                </paragraph>
            </subsection>

                <enum>(c)</enum>
                <header>Input from industry and government</header>
 <text>It is the sense of Congress that each conference should include a meeting that convenes nuclear industry leaders and leaders of government agencies with expertise relating to nuclear safety, security, safeguards, or sustainability to discuss best practices relating to—</text>
                <paragraph id="id62b80b666dc64e0aa404200b4c32d050">
                    <enum>(1)</enum>
 <text>the safe and secure use, storage, and transport of nuclear and radiological materials;</text>
                </paragraph>
                <paragraph id="idb749a6d7b2a94a1a87f7ceb446017a83">
                    <enum>(2)</enum>
 <text>managing the evolving cyber threat to nuclear and radiological security; and</text>
                </paragraph>
                <paragraph id="id1cae557ab2b34270945e6546c03b9e87">
                    <enum>(3)</enum>
 <text>the role that the nuclear industry should play in nuclear and radiological safety, security, and safeguards, including with respect to the safe and secure use, storage, and transport of nuclear and radiological materials, including spent nuclear fuel and nuclear waste.</text>
                </paragraph>
            </subsection>
        </section>

            <enum>10.</enum>
            <header>Advanced reactor coordination and resource center</header>
            <subsection id="id431312C573A2458DA18B4C98537FF902">
                <enum>(a)</enum>
                <header>In general</header>
 <text display-inline="yes-display-inline">The President shall consider the feasibility of leveraging existing activities or frameworks or, as necessary, establishing a center, to be known as the <quote>Advanced Reactor Coordination and Resource Center</quote> (referred to in this section as the <term>Center</term>), for the purposes of—</text>
                <paragraph id="id8DCE50E3C52D41C9B9FE354777CE2027">
                    <enum>(1)</enum>
 <text>identifying qualified organizations and service providers—</text> <subparagraph id="idA5255B42F3D940EF9AACBB0E767710F7"> <enum>(A)</enum> <text>for embarking civil nuclear nations;</text>
                    </subparagraph>
                    <subparagraph id="id6D566E599D0248739C1D51C8E6828D67">
                        <enum>(B)</enum>
 <text>to develop and assemble documents, contracts, and related items required to establish a civil nuclear program; and</text>
                    </subparagraph>
                    <subparagraph id="id3363512B1F4841CC988CAA6DA6D4F798">
                        <enum>(C)</enum>
 <text>to develop a standardized model for the establishment of a civil nuclear program that can be used by the International Atomic Energy Agency;</text>
                    </subparagraph>
                </paragraph>

                    <enum>(2)</enum>
 <text>coordinating with countries participating in the Center and with the Nuclear Exports Working Group established under section 3(b)—</text>
                    <subparagraph id="id3D8FF8A7D9EF407A8EE33E83AB65269F">
                        <enum>(A)</enum>
 <text>to identify funds to support payment for services required to develop a civil nuclear program;</text>
                    </subparagraph>

                            <enum>(iii)</enum>
 <text>models for nonelectric applications market analysis; and </text> </clause> <clause id="idC3A8EF718AAF4C82B5C432DEF90FD266"> <enum>(iv)</enum> <text>financial models;</text>
                        </clause>
                    </subparagraph>
                </paragraph>

                    <enum>(3)</enum>
 <text>identifying and developing the safety, security, safeguards, and nuclear governance required for a civil nuclear program;</text>
                </paragraph>

                    <enum>(4)</enum>
 <text>supporting multinational regulatory standards to be developed by countries with civil nuclear programs and experience;</text>
                </paragraph>
                <paragraph id="idC23B837D6D9A4FEF9C645BA66CCE6592">
                    <enum>(5)</enum>
 <text>developing and strengthening communications, engagement, and consensus-building;</text>
                </paragraph>
                <paragraph id="id64A2B6575391449C89208D3DFCE5D5EF">
                    <enum>(6)</enum>
 <text>carrying out any other major activities to support export, financing, education, construction, training, and education requirements relating to the establishment of a civil nuclear program;</text>
                </paragraph>
                <paragraph id="id9FAC5124F4934D90AFDCE26E9431F737">
                    <enum>(7)</enum>
 <text>developing mechanisms for how to fund and staff the Center; and</text> </paragraph> <paragraph id="idE9FD07CC3F4C449DBABA262201463C33"> <enum>(8)</enum> <text>determining mechanisms for the selection of the location or locations of the Center.</text>
                </paragraph>
            </subsection>
            <subsection id="idDB96113FE69D48778AD826F8E801C22D">
                <enum>(b)</enum>
                <header>Objective</header>
 <text>The President shall carry out subsection (a) with the objective of establishing the Center if the President determines that it is feasible to do so.</text>
            </subsection>
        </section>

            <enum>11.</enum>
            <header>Strategic infrastructure fund working group</header>
            <subsection id="id1a1d98a2eb23456f8287b6fc9e18ef93">
                <enum>(a)</enum>
                <header>Establishment</header>
 <text>There is established a working group, to be known as the <quote>Strategic Infrastructure Fund Working Group</quote> (referred to in this section as the <term>working group</term>) to provide input on the feasibility of establishing a program to support strategically important capital-intensive infrastructure projects.</text>
            </subsection>
            <subsection id="idec3a74f7864946699006727bdc4e4186">
                <enum>(b)</enum>
                <header>Composition</header>
 <text>The working group shall be—</text> <paragraph id="id3FC3C0FF131A4857A289F6E76B9612AE"> <enum>(1)</enum> <text>led by a White House official, who may be the Assistant (if appointed), who shall serve as the White House focal point with respect to matters relating to the working group; and</text>
                </paragraph>
                <paragraph id="id18FA27527C674717BD967E954AF6ABF3">
                    <enum>(2)</enum>
 <text>composed of—</text> <subparagraph id="id253B32C724314F75B7E3667792B8BB52"> <enum>(A)</enum> <text>senior-level Federal officials, selected by the head of the applicable Federal agency or organization, from any Federal agency or organization that the President determines to be appropriate;</text>
                    </subparagraph>
                    <subparagraph id="id98D32C0698384917BBA37EE15745E2DC" commented="no">
                        <enum>(B)</enum>
 <text>other senior-level Federal officials, selected by the head of the applicable Federal agency or organization, from any other Federal agency or organization that the Secretary determines to be appropriate; and</text>
                    </subparagraph>

                        <enum>(C)</enum>
 <text>any senior-level Federal official selected by the White House official described in paragraph (1) from any Federal agency or organization.</text>
                    </subparagraph>
                </paragraph>
            </subsection>

                <enum>(c)</enum>
                <header>Reporting</header>
 <text>The working group shall report to the National Security Council.</text> </subsection> <subsection id="iddf84b3f2796446cebd842c2477d0e6a0"> <enum>(d)</enum> <header>Duties</header> <text>The working group shall—</text>
                <paragraph id="idf592aff8f5884d14a2f47cb62ec37edf">
                    <enum>(1)</enum>
 <text>provide direction and advice to the officials described in section 3(a)(2)(A) and appropriate Federal agencies, as determined by the working group, with respect to the establishment of a Strategic Infrastructure Fund (referred to in this subsection as the <term>Fund</term>) to be used—</text>
                    <subparagraph id="id5522CA35515B4A85B7B1524ABE531E1D">
                        <enum>(A)</enum>
 <text>to support those aspects of projects relating to—</text> <clause id="idA0185DA084894361B483546BB78FFD52"> <enum>(i)</enum> <text>civil nuclear technologies; and</text>
                        </clause>
                        <clause id="idF5E9922875404CCD8228F66E4E948C67">
                            <enum>(ii)</enum>
 <text>microprocessors; and</text> </clause> </subparagraph> <subparagraph id="idF5F48B76CE33479E9E660D800B66C57C" commented="no" display-inline="no-display-inline"> <enum>(B)</enum> <text>for strategic investments identified by the working group; and</text>
                    </subparagraph>
                </paragraph>

                    <enum>(2)</enum>
 <text>address critical areas in determining the appropriate design for the Fund, including—</text>
                    <subparagraph id="id294e04382f18443e8565e365b4d138b1">
                        <enum>(A)</enum>
 <text>transfer of assets to the Fund;</text> </subparagraph> <subparagraph id="id4e8c7ab9b62340fc8929962c24b3e0a8"> <enum>(B)</enum> <text>transfer of assets from the Fund;</text>
                    </subparagraph>
                    <subparagraph id="id6929e253e6cc4f078b527f8455d3eccf">
                        <enum>(C)</enum>
 <text>how assets in the Fund should be invested; and</text> </subparagraph> <subparagraph id="id160d1eb4eae1476d8277b348f4dd28d8"> <enum>(D)</enum> <text>governance and implementation of the Fund.</text>
                    </subparagraph>
                </paragraph>
            </subsection>

                <header>Briefing and report required</header>

 <text>Not later than 180 days after the date of enactment of this Act, the working group shall brief the committees described in paragraph (3) on the status of the development of the processes necessary to implement this section.</text>
                </paragraph>

                    <enum>(2)</enum>
                    <header>Report</header>
 <text>Not later than 1 year after the date of the enactment of this Act, the working group shall submit to the committees described in paragraph (3) a report on the findings of the working group that includes suggested legislative text for how to establish and structure a Strategic Infrastructure Fund.</text>
                </paragraph>

                    <header>Committees described</header>

        </section>

            <header>Joint assessment between the United States and india on nuclear liability
                rules</header>

                <enum>(a)</enum>
                <header>In general</header>
 <text>The Secretary of State, in consultation with the heads of other relevant Federal departments and agencies, shall establish and maintain within the U.S.-India Strategic Security Dialogue a joint consultative mechanism with the Government of the Republic of India that convenes on a recurring basis—</text>

 <text>to assess the implementation of the Agreement for Cooperation between the Government of the United States of America and the Government of India Concerning Peaceful Uses of Nuclear Energy, signed at Washington October 10, 2008 (TIAS 08–1206);</text>

                    <enum>(2)</enum>
 <text>to discuss opportunities for the Republic of India to align domestic nuclear liability rules with international norms; and</text>
                </paragraph>
                <paragraph id="id82fbdfd4fc214d50bf54926b24332910">
                    <enum>(3)</enum>
 <text>to develop a strategy for the United States and the Republic of India to pursue bilateral and multilateral diplomatic engagements related to analyzing and implementing those opportunities.</text>

                <enum>(b)</enum>
                <header>Report</header>
 <text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter for 5 years, the Secretary of State, in consultation with the heads of other relevant Federal departments and agencies, shall submit to the appropriate committees of Congress a report that describes the joint assessment developed pursuant to subsection (a)(1).</text>

            <enum>13.</enum>
            <header>Rule of construction</header>
 <text display-inline="no-display-inline">Except as expressly stated in this Act, nothing in this Act may be construed to alter or otherwise affect the interpretation or implementation of section 123 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2153">42 U.S.C. 2153</external-xref>) or any other provision of law, including the requirement that agreements pursuant to that section be submitted to Congress for consideration.</text>
