<paragraph id="idE97F665B6208400D91886FE9ACDCF1F8"> <enum>(2)</enum> <header>Council</header> <text>The term <term>Council</term> means the Dolores River National Conservation Area Advisory Council established under section 103(a).</text> </paragraph> <paragraph id="id8D9317A060344D2C82349E99362E8805"> <enum>(3)</enum> <header>Covered land</header> <text>The term <term>covered land</term> means—</text> 
<subparagraph id="id6866147D40004AF8AD43001B06085AA4"> <enum>(A)</enum> <text>the Conservation Area; and</text> </subparagraph> <subparagraph id="id51B6FA8756F64DB885CE88C347482DDE"> <enum>(B)</enum> <text>the Special Management Area.</text> </subparagraph> </paragraph> 
<paragraph id="id10806663C3B84C9C9E7ACDAF71CD7231"> <enum>(4)</enum> <header>Dolores Project</header> <text>The term <term>Dolores Project</term> has the meaning given the term in section 3 of the Colorado Ute Indian Water Rights Settlement Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/585">Public Law 100–585</external-xref>; 102 Stat. 2974).</text> </paragraph> <paragraph id="IDc34ff96102264eb68297efb1381300cc"> <enum>(5)</enum> <header>Map</header> <text>The term <term>Map</term> means the map prepared by the Bureau of Land Management entitled <quote>Proposed Dolores River National Conservation Area and Special Management Area</quote> and dated December 13, 2024.</text> </paragraph> 
<paragraph id="id9c9d07834ca64b88bed0bbc48a34ecd5"> <enum>(6)</enum> <header>Secretary</header> <text>The term <term>Secretary</term> means—</text> <subparagraph id="idf9a38fd2bace40ff9c5fa1d2d382596b"> <enum>(A)</enum> <text>in title I, the Secretary of the Interior;</text> </subparagraph> 
<subparagraph id="idf2b33367cd0449b0bb219e44f22a8cdf"> <enum>(B)</enum> <text>in title II, the Secretary of Agriculture; and</text> </subparagraph> <subparagraph commented="no" id="idFF67D1BA601D4971A8BB4992CBB0EAD8"> <enum>(C)</enum> <text>in title IV—</text> 
<clause commented="no" id="id01D5C0127C3246698F34749ECAB864FA"> <enum>(i)</enum> <text>the Secretary of the Interior, with respect to land under the jurisdiction of the Secretary of the Interior; and</text> </clause> <clause commented="no" id="id7F748BA5D5784F959705FD25801F9A09"> <enum>(ii)</enum> <text>the Secretary of Agriculture, with respect to land under the jurisdiction of the Secretary of Agriculture.</text> </clause> </subparagraph> </paragraph> 
<paragraph id="id38f39f6508494e458f284337704cc4e6"> <enum>(7)</enum> <header>Special Management Area</header> <text>The term <term>Special Management Area</term> means the Dolores River Special Management Area established by section 201(a).</text> </paragraph> <paragraph id="id3B4D8FC3888C4048A2385BA3CD3C1C63"> <enum>(8)</enum> <header>State</header> <text>The term <term>State</term> means the State of Colorado.</text> </paragraph> 
<paragraph id="id28f9922951cf497489d646c33238a1b9" changed="not-changed"> <enum>(9)</enum> <header>Unreasonably diminish</header> <text>The term <term>unreasonably diminish</term> has the same meaning as used in section 7(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1278">16 U.S.C. 1278(a)</external-xref>).</text> </paragraph> <paragraph id="idaa4a6d616c4546e7a3470502a8c2a09c"> <enum>(10)</enum> <header>Water resource project</header> <text>The term <term>water resource project</term> means any dam, irrigation and pumping facility, reservoir, water conservation work, aqueduct, canal, ditch, pipeline, well, hydropower project, and transmission and other ancillary facility, and other water diversion, storage, and carriage structure.</text> </paragraph> </section> 
<title id="id44E4F3A5F98044B38B1D841093F247E7"> <enum>I</enum> <header>Dolores River National Conservation Area</header> 
<section id="ID801e5e4b1edf46309da608ffb95c4654"> <enum>101.</enum> <header>Establishment of Dolores River National Conservation Area</header> 
<subsection id="ID3e1e2530c2654771a5f37e5319b13c2d"> <enum>(a)</enum> <header>Establishment</header> 
<paragraph id="idFC9BFD5CC2AC4F45BF2EE1B3F9137DE5"> <enum>(1)</enum> <header>In general</header> <text>Subject to valid existing rights, there is established the Dolores River National Conservation Area in the State.</text> </paragraph> <paragraph id="ID9610713015d64a49bd49565c244cc3c6"> <enum>(2)</enum> <header>Land included</header> <text>The Conservation Area shall consist of approximately 52,872 acres of Bureau of Land Management land in the State, as generally depicted as <quote>Proposed Lower Dolores River National Conservation Area</quote> on the Map.</text> </paragraph> </subsection> 
<subsection id="id4e3508d6844946298a65b580f662f192"> <enum>(b)</enum> <header>Purpose</header> <text>The purpose of the Conservation Area is to conserve, protect, and enhance the native fish, whitewater boating, recreational, hunting, fishing, scenic, cultural, archaeological, natural, geological, historical, ecological, watershed, wildlife, educational, and scientific resources of the Conservation Area.</text> </subsection> <subsection id="ID10ad95722b1547ca903294febaef56c1"> <enum>(c)</enum> <header>Map and legal description</header> <paragraph id="id5A601B16F5E94C1D83AAA5D56956F931" changed="not-changed"> <enum>(1)</enum> <header>In general</header> <text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a map and legal description of the Conservation Area.</text> </paragraph> 
<paragraph id="IDc0f4b9a935a14d9f9d014819d60a97d3"> <enum>(2)</enum> <header>Effect</header> <text>The map and legal description prepared under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct minor errors in the map or legal description.</text> </paragraph> <paragraph id="ID35ca21cee11a4fdda74859bfb76ea628"> <enum>(3)</enum> <header>Public availability</header> <text>A copy of the map and legal description shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text> </paragraph> </subsection> </section> 
<section id="IDedb3c68240a44a03849cdf56322cbc12"> <enum>102.</enum> <header>Management of Conservation Area</header> 
<subsection id="ID1ae5450347b341ecad05ae0654246181"> <enum>(a)</enum> <header>In general</header> <text>The Secretary shall manage the Conservation Area in accordance with—</text> <paragraph id="id5FED7198D6E547D4829A538E2AEF7450"> <enum>(1)</enum> <text>this Act;</text> </paragraph> 
<paragraph id="idDB7B6FFBE27A4F3CA7B450A1E6445FC8"> <enum>(2)</enum> <text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text> </paragraph> <paragraph id="idA63BF8E2C7874BBCA4591E22889F0433"> <enum>(3)</enum> <text>other applicable laws.</text> </paragraph> </subsection> 
<subsection id="idc8cbd1658d8e44f486012795d8d6c1db"> <enum>(b)</enum> <header>Uses</header> <text>Subject to the provisions of this Act, the Secretary shall allow only such uses of the Conservation Area as are consistent with the purpose described in section 101(b).</text> </subsection> <subsection id="ID53263a6c834e43f984e07589cfbd8e72"> <enum>(c)</enum> <header>Management plan</header> <paragraph id="ID12b4e78fd6c34912b3d9c3399c090cb7"> <enum>(1)</enum> <header>Plan required</header> <subparagraph id="id9D1503132617450FB4DB1B8FBD77CF6A"> <enum>(A)</enum> <header>In general</header> <text>Not later than 3 years after the date of enactment of this Act, the Secretary shall develop a management plan for the long-term protection, management, and monitoring of the Conservation Area.</text> </subparagraph> 
<subparagraph id="idEC11D5DFE93547AB8C81F64FBA9DAC8E"> <enum>(B)</enum> <header>Review and revision</header> <text>The management plan under subparagraph (A) shall, from time to time, be subject to review and revision, in accordance with—</text> <clause id="id13CD0F0665D8406B9BC27DEBF0D8DCCD"> <enum>(i)</enum> <text>this Act;</text> </clause> 
<clause id="id2F347D79C17746158B29B1F8473E38E1"> <enum>(ii)</enum> <text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text> </clause> <clause id="idBA62F3D83B424E8FB37EFE9B1708E6C6"> <enum>(iii)</enum> <text>other applicable laws.</text> </clause> </subparagraph> </paragraph> 
<paragraph id="ID0d19eb37fb334232b42f65fedb38799d"> <enum>(2)</enum> <header>Consultation and coordination</header> <text>The Secretary shall prepare and revise the management plan under paragraph (1)—</text> <subparagraph id="id493C1CC984CB4ECCA9004C6830879C89"> <enum>(A)</enum> <text>in consultation with—</text> 
<clause id="id54DF6EB3D55646A49F652BCE058D4DA7"> <enum>(i)</enum> <text>the State;</text> </clause> <clause id="idE71BEDAA823547ABB23EB19C8B40695F"> <enum>(ii)</enum> <text>units of local government;</text> </clause> 
<clause id="id3E68C19CEA7A4DC785DFFB8419B4059F"> <enum>(iii)</enum> <text>the public;</text> </clause> <clause id="id4E8374564FB54CD9BA2DBF0ADB9F8C0B"> <enum>(iv)</enum> <text>the Council; and</text> </clause> 
<clause id="idb4f5a7e06f4a474796f3873fd99594fa"> <enum>(v)</enum> <text>the Native Fish Monitoring and Recommendation Team, as described in section 402(b)(1); and</text> </clause> </subparagraph> <subparagraph id="id513D5021E41345FBB5C8C1FAC24143CE"> <enum>(B)</enum> <text>in coordination with the Secretary of Agriculture, with respect to the development of the separate management plan for the Special Management Area, as described in section 202(c).</text> </subparagraph> </paragraph> 
<paragraph id="idbfd8052df85442fe86cde14a9a43606f"> <enum>(3)</enum> <header>Recommendations</header> <text>In preparing and revising the management plan under paragraph (1), the Secretary shall take into consideration any recommendations from the Council.</text> </paragraph> <paragraph id="id7323e52edab04459930c2ca71dcaba1d"> <enum>(4)</enum> <header>Treaty rights</header> <text>In preparing and revising the management plan under paragraph (1), taking into consideration the rights and obligations described in section 402, the Secretary shall ensure that the management plan does not alter or diminish—</text> 
<subparagraph id="idA5E20E3096B046849943307AE6272DD9"> <enum>(A)</enum> <text>the treaty rights of any Indian Tribe;</text> </subparagraph> <subparagraph id="id0D9663929CCF466DAA6F8042710DF5EC"> <enum>(B)</enum> <text>any rights described in the Colorado Ute Indian Water Rights Settlement Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/585">Public Law 100–585</external-xref>; 102 Stat. 2973); or</text> </subparagraph> 
<subparagraph id="idC457B6C3CAE04A37B2C1B8815428E1C2"> <enum>(C)</enum> <text>the operation or purposes of the Dolores Project.</text> </subparagraph> </paragraph> </subsection> <subsection id="ID649c364afeaf437e897a141a2049ba52"> <enum>(d)</enum> <header>Incorporation of acquired land and interests</header> <text>Any land or interest in land located within the boundary of the Conservation Area that is acquired by the United States in accordance with section 401(c) after the date of enactment of this Act shall—</text> 
<paragraph id="id8922DF7FA9664D01AD8433F2C3DF559F"> <enum>(1)</enum> <text>become part of the Conservation Area; and</text> </paragraph> <paragraph id="id54716BDBE1934979AADCF211719D7665"> <enum>(2)</enum> <text>be managed as provided in this section.</text> </paragraph> </subsection> 
<subsection id="id79ff58035a9a4b0d850211ac29cff3e5"> <enum>(e)</enum> <header>Department of Energy leases</header> 
<paragraph id="id5438750f1f554175a8940e5ebd2bb54e"> <enum>(1)</enum> <header>In general</header> <text>Nothing in this title affects valid leases or lease tracts existing on the date of enactment of this Act issued under the uranium leasing program of the Department of Energy.</text> </paragraph> <paragraph id="ideca6c7fc7c1644199f689685234bf193"> <enum>(2)</enum> <header>Management</header> <subparagraph id="iddd8d7544bde44a05bb680d8629f48c50"> <enum>(A)</enum> <header>In general</header> <text>Subject to subparagraph (B), land designated for the program described in paragraph (1) shall be—</text> 
<clause id="idacdcda87eff64d3b80ba47f68f341940"> <enum>(i)</enum> <text>exempt from section 401(b); and</text> </clause> <clause id="idd51c4b5cfbc9478ebf571c5a38070501"> <enum>(ii)</enum> <text>managed in a manner that allow the leases to fulfill the purposes of the program, consistent with the other provisions of this title and title IV.</text> </clause> </subparagraph> 
<subparagraph id="ida3a4b2e742f24e9680249ac7fee1bd10"> <enum>(B)</enum> <header>Designation</header> <text>Land subject to a lease described in paragraph (1) shall be considered part of the Conservation Area and managed in accordance with other provisions of this title on a finding by the Secretary that—</text> <clause id="id73bbec8cc4f543c3b6b72cffa9c477a8"> <enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="idD8B6C33734F64329A8A054A7F9991BEA"> <enum>(I)</enum> <text>the lease has expired; and</text> </subclause> 
<subclause id="idB8A80FA2BF324FB79CD8B476DD664DCE" indent="up1"> <enum>(II)</enum> <text>the applicable lease tract has been removed from the leasing program by the Secretary of Energy; and</text> </subclause> </clause> <clause id="id59a80487b3634668b30b7763fbc2d515"> <enum>(ii)</enum> <text>the land that was subject to the lease is suitable for inclusion in the Conservation Area.</text> </clause> </subparagraph> 
<subparagraph id="id2e87b42f64c748f3b7a3e7d9b7b7061d"> <enum>(C)</enum> <header>Effect</header> <text>Nothing in subparagraph (B) prevents the Secretary of Energy from extending any lease described in paragraph (1).</text> </subparagraph> </paragraph> </subsection> </section> <section commented="no" id="IDd35fc883e7484ea99da0d767ae6b41d4"> <enum>103.</enum> <header>Dolores River National Conservation Area Advisory Council</header> <subsection commented="no" id="IDbb369c049e824350b86542be4ba49ca1"> <enum>(a)</enum> <header>Establishment</header> <text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish an advisory council, to be known as the <quote>Dolores River National Conservation Area Advisory Council</quote>.</text> </subsection> 
<subsection commented="no" id="ID2c97da2deeb94c48a86f0603ff2950de"> <enum>(b)</enum> <header>Duties</header> <text>The Council shall advise—</text> <paragraph commented="no" id="id9166816FDE504CF2B8624232A75BFC5F"> <enum>(1)</enum> <text>the Secretary with respect to the preparation, implementation, and monitoring of the management plan prepared under section 102(c); and</text> </paragraph> 
<paragraph commented="no" id="id8AABBEEAF7684AE49070469AD3523D26"> <enum>(2)</enum> <text>the Secretary of Agriculture with respect to the preparation, implementation, and monitoring of the management plan prepared under section 202(c).</text> </paragraph> </subsection> <subsection commented="no" id="ID59986ecf11e94cd18939457754af8250"> <enum>(c)</enum> <header>Applicable law</header> <text>The Council shall be subject to—</text> 
<paragraph commented="no" id="ID576846c2c824427b852bd574f3736fa0"> <enum>(1)</enum> <text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote><act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></quote>);</text> </paragraph> <paragraph commented="no" id="ID38bcc38a956649be9959554e36e5043c"> <enum>(2)</enum> <text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text> </paragraph> 
<paragraph id="id413a97ca3b044a5cbbdc81c14e9e1287"> <enum>(3)</enum> <text>this Act.</text> </paragraph> </subsection> <subsection commented="no" id="ID246bc81369794c62a83571b95aed593b"> <enum>(d)</enum> <header>Membership</header> <paragraph commented="no" id="IDa63c036bca954e17a7346fe72defe71f"> <enum>(1)</enum> <header>In general</header> <text>The Council shall include 14 members to be appointed by the Secretary, of whom, to the extent practicable—</text> 
<subparagraph commented="no" id="idF70FC83F18EB4D1F85AEC6697D998920"> <enum>(A)</enum> <text>2 members shall represent agricultural water user interests in the Conservation Area or the Dolores River watershed, of whom 1 shall represent the Dolores Water Conservancy District;</text> </subparagraph> <subparagraph commented="no" id="id39049AF736564BBEB2ECC7F4E4EB0A14"> <enum>(B)</enum> <text>2 members shall represent conservation interests in the Conservation Area;</text> </subparagraph> 
<subparagraph commented="no" id="id431FB04C6CE14CD7A7036FA113B08FE8"> <enum>(C)</enum> <text>2 members shall represent recreation interests in the Conservation Area, 1 of whom shall represent whitewater boating interests;</text> </subparagraph> <subparagraph commented="no" id="id63150178E8BE4F57BAC66CA6D67A882E"> <enum>(D)</enum> <text>1 member shall be a representative of Dolores County, Colorado;</text> </subparagraph> 
<subparagraph commented="no" id="id4B8440A3EC7A42979CDA19D445232185"> <enum>(E)</enum> <text>1 member shall be a representative of San Miguel County, Colorado;</text> </subparagraph> <subparagraph commented="no" id="id361E56196F5A4C8EB907DF56F3E1FF73"> <enum>(F)</enum> <text>1 member shall be a representative of Montezuma County, Colorado;</text> </subparagraph> 
<subparagraph commented="no" id="ID481cd4bdd1994b17ab92b5fc0679218f"> <enum>(G)</enum> <text>1 member shall be a private landowner that owns land in immediate proximity to the Conservation Area;</text> </subparagraph> <subparagraph commented="no" id="id63CDC056C1514C28BAD97E1ADBF61285"> <enum>(H)</enum> <text>1 member shall be a representative of Colorado Parks and Wildlife;</text> </subparagraph> 
<subparagraph commented="no" id="ID4223e6e97d0543b4b285a078c392c685"> <enum>(I)</enum> <text>1 member shall be a holder of a grazing-allotment permit in the Conservation Area; and</text> </subparagraph> <subparagraph commented="no" id="ID25b538f657c24a3bbedb0eea688d8fed"> <enum>(J)</enum> <text>2 members shall be representatives of Indian Tribes, 1 of whom shall be a representative of the Ute Mountain Ute Tribe.</text> </subparagraph> </paragraph> 
<paragraph id="ide51996b15e3946ecb0c04a9517d53099"> <enum>(2)</enum> <header>Representation</header> 
<subparagraph id="id056A077713334326972ABF8BC658A33F"> <enum>(A)</enum> <header>In general</header> <text>The Secretary shall ensure that the membership of the Council is fairly balanced in terms of the points of view represented and the functions to be performed by the Council.</text> </subparagraph> <subparagraph id="id0CA9CCF2F7CD4F73AD57E3B4A0835CB8"> <enum>(B)</enum> <header>Requirements</header> <clause id="idF14F62D186BE48D78F11BC714CCB0CFB"> <enum>(i)</enum> <header>In general</header> <text>The members of the Council described in subparagraphs (B) and (C) of paragraph (1) shall be residents that live within reasonable proximity to the Conservation Area.</text> </clause> 
<clause id="id636486FB29F046CEB6D6B301A87A4D10"> <enum>(ii)</enum> <header>County representatives</header> <text>The members of the Council described in subparagraphs (D) and (E) of paragraph (1) shall be—</text> <subclause id="idFA092E34374B4906BF6B1AFFE9B6073F"> <enum>(I)</enum> <text>residents of the respective counties referred to in those subparagraphs; and</text> </subclause> 
<subclause id="id08318F9681E44BDEB6FF9191C669FE8A"> <enum>(II)</enum> <text>capable of representing the interests of the applicable board of county commissioners.</text> </subclause> </clause> </subparagraph> </paragraph> </subsection> <subsection id="idac84e67bbf784088b61de8c76f17b5bc"> <enum>(e)</enum> <header>Terms of office</header> <paragraph id="idc45afaf6ea274d31927cbd54b887d337"> <enum>(1)</enum> <header>In general</header> <text>The term of office of a member of the Council shall be 5 years.</text> </paragraph> 
<paragraph id="id64ae14c700524266814c449135f529fe"> <enum>(2)</enum> <header>Reappointment</header> <text>A member may be reappointed to the Council on completion of the term of office of the member.</text> </paragraph> </subsection> <subsection id="id17fe0c5ad4d8469d9555bc87ddd030ac"> <enum>(f)</enum> <header>Compensation</header> <text>A member of the Council—</text> 
<paragraph id="idCF37B8DA05254D66AA8B34E7DA5110DD"> <enum>(1)</enum> <text>shall serve without compensation for service on the Council; but</text> </paragraph> <paragraph id="id9C436D8048444CF1A54D3EC74DB5D0F8"> <enum>(2)</enum> <text>may be reimbursed for qualified expenses of the member.</text> </paragraph> </subsection> 
<subsection id="id791ee5158be84619a423faed2c48e152"> <enum>(g)</enum> <header>Chairperson</header> <text>The Council shall elect a chairperson from among the members of the Council.</text> </subsection> <subsection id="idaea292ef7a6949d6bc72496f6b33114d"> <enum>(h)</enum> <header>Meetings</header> <paragraph id="id981a5b622022404a9d21154986fe527b"> <enum>(1)</enum> <header>In general</header> <text>The Council shall meet at the call of the chairperson—</text> 
<subparagraph id="id51413F73C98E4FC39B448ABA42A1723D"> <enum>(A)</enum> <text>not less frequently than quarterly until the management plan under section 102(c) is developed; and</text> </subparagraph> <subparagraph id="id3459FC80D80F45FAA42108DBCA4F6336"> <enum>(B)</enum> <text>thereafter, at the call of the Secretary.</text> </subparagraph> </paragraph> 
<paragraph id="id25a372a90c0640c6928e86ff340b2f17"> <enum>(2)</enum> <header>Public meetings</header> <text>Each meeting of the Council shall be open to the public.</text> </paragraph> <paragraph id="id10aee08a214b4a9ca2537f0b3a296843"> <enum>(3)</enum> <header>Notice</header> <text>A notice of each meeting of the Council shall be published in advance of the meeting.</text> </paragraph> </subsection> 
<subsection id="idab42565df1aa40cfb3b0b4f50cf27218"> <enum>(i)</enum> <header>Technical assistance</header> <text>The Secretary shall provide, to the maximum extent practicable in accordance with applicable law, any information and technical services requested by the Council to assist in carrying out the duties of the Council.</text> </subsection> <subsection id="id2520377e4cbf4d60ac4a8a15949cdf0b"> <enum>(j)</enum> <header>Renewal</header> <text>The Secretary shall ensure that the Council charter is renewed as required under applicable law.</text> </subsection> 
<subsection id="id43c7aa62b5fa4f58b2a567767f4445a9"> <enum>(k)</enum> <header>Duration</header> <text>The Council—</text> <paragraph id="id06E8A604C81747C9A7572CDEDED2C97B"> <enum>(1)</enum> <text>shall continue to function for the duration of existence of the Conservation Area; but</text> </paragraph> 
<paragraph id="id77F678DB5A494AFE873831514ED94A32"> <enum>(2)</enum> <text>on completion of the management plan, shall only meet—</text> <subparagraph id="id233E55FDE08342D985DD566D2A19CB28"> <enum>(A)</enum> <text>at the call of the Secretary; or</text> </subparagraph> 
<subparagraph id="id93EB46BA31FF4DC7B9C9DC1AF1FB1604"> <enum>(B)</enum> <text>in the case of a review or proposed revision to the management plan.</text> </subparagraph> </paragraph> </subsection> </section> </title> <title id="id02420BF3C446416D8E026D80162D7C81" style="OLC"> <enum>II</enum> <header>Dolores River Special Management Area</header> <section id="id6CF6935C913C4D65A12CC59CA741170B"> <enum>201.</enum> <header>Designation of Dolores River Special Management Area</header> <subsection id="idb335d3dd2f414eeca72c82ff8ef6228e"> <enum>(a)</enum> <header>Establishment</header> <paragraph id="ida5488242ee2f4ce3b29c58d40fa71160"> <enum>(1)</enum> <header>In general</header> <text>Subject to valid existing rights, there is established the Dolores River Special Management Area in the State.</text> </paragraph> 
<paragraph id="id93a3d9e498e84c59a7b7c6439709e127"> <enum>(2)</enum> <header>Land included</header> <text>The Special Management Area shall consist of approximately 15,452 acres of Federal land in the San Juan National Forest in the State, including National Forest System land in the Dolores River segment that extends from the Dolores Project boundary downstream to the boundary of the San Juan National Forest, as of the date of enactment of this Act, as generally depicted as <quote>Proposed Dolores River Special Management Area</quote> on the Map.</text> </paragraph> </subsection> <subsection id="idfec93741bb8b4f8b88226ca1dfc77f52"> <enum>(b)</enum> <header>Purpose</header> <text>The purpose of the Special Management Area is to conserve, protect, and enhance the native fish, whitewater boating, recreational, hunting, fishing, scenic, cultural, archaeological, natural, geological, historical, ecological, watershed, wildlife, educational, and scientific resources of the Special Management Area.</text> </subsection> 
<subsection id="ida9adfbb6f76e4f5da8cb7c61ff12c573"> <enum>(c)</enum> <header>Map and legal description</header> 
<paragraph id="idce20928ea6d64a0cac24c122164c733f"> <enum>(1)</enum> <header>In general</header> <text>As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of the Special Management Area with the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</text> </paragraph> <paragraph id="id2e291df7f21243b697ca1270ea8014aa"> <enum>(2)</enum> <header>Effect</header> <text>The map and legal description prepared under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct minor errors in the map or legal description.</text> </paragraph> 
<paragraph id="id4ea4b9c8a52f41618b83d6c5d2ec4c91"> <enum>(3)</enum> <header>Public availability</header> <text>A copy of the map and legal description shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text> </paragraph> </subsection> </section> <section id="idBA5301894FA24E2DA1D67A38FE0D8924"> <enum>202.</enum> <header>Management of Special Management Area</header> <subsection id="id333A82E64790413EBEEA58D5BBACE113"> <enum>(a)</enum> <header>In general</header> <text>The Secretary shall manage the Special Management Area in accordance with—</text> 
<paragraph id="id3C5EFFB77CD545E08B12528CC2C73F9A"> <enum>(1)</enum> <text>this Act;</text> </paragraph> <paragraph id="id0DCF401746FB4FB5A6EE9841590A07AC"> <enum>(2)</enum> <text>the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>); and</text> </paragraph> 
<paragraph id="idB60BB629B1EA4B6995E135BEDCCFD389"> <enum>(3)</enum> <text>other applicable laws.</text> </paragraph> </subsection> <subsection id="id9b6a150ea56f4e10985351153116bc45"> <enum>(b)</enum> <header>Uses</header> <text>The Secretary shall allow only such uses of the Special Management Area as the Secretary determines would further the purpose of the Special Management Area, as described in section 201(b).</text> </subsection> 
<subsection id="idf43cacb6470349a58c237efa78c18a45"> <enum>(c)</enum> <header>Management plan</header> 
<paragraph id="idbc2b425b2590454b98a588f7c891be82"> <enum>(1)</enum> <header>Plan required</header> 
<subparagraph id="id5524999F17A1496499B5C48082F90CC9"> <enum>(A)</enum> <header>In general</header> <text>Not later than 3 years after the date of enactment of this Act, the Secretary shall develop a management plan for the long-term protection, management, and monitoring of the Special Management Area.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idE5EAF4A0724D4338BD528CF9659F25CE"> <enum>(B)</enum> <header>Review and revision</header> <text>The management plan under subparagraph (A) shall, from time to time, be subject to review and revision in accordance with—</text> 
<clause commented="no" display-inline="no-display-inline" id="idBDCA0758EBD0419C80EF3C8F4C8A6EDF"> <enum>(i)</enum> <text>this Act;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="id6F9744BC9F8E4AF59FD771077C83818A"> <enum>(ii)</enum> <text>the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>); and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="idAC150AA3F44D4082987EAEE46D068F5D"> <enum>(iii)</enum> <text>other applicable laws.</text> </clause> </subparagraph> </paragraph> <paragraph id="id42262693B87044E39A57B3EF30692B0B"> <enum>(2)</enum> <header>Consultation and coordination</header> <text>The Secretary shall prepare and revise the management plan under paragraph (1)—</text> 
<subparagraph id="id5B82E1ED7F0043AEB7C470CE4D22D84F"> <enum>(A)</enum> <text>in consultation with—</text> <clause id="idB440C00D6B334068A76FEF71093A823E"> <enum>(i)</enum> <text>the State;</text> </clause> 
<clause id="id0A3C7706CA914B62B0B6F102FB865D1C"> <enum>(ii)</enum> <text>units of local government;</text> </clause> <clause id="id9B2ACE2C21A6460F87A6D0153B1A70F3"> <enum>(iii)</enum> <text>the public;</text> </clause> 
<clause id="id54C1D0CC838E4F6CA1FA9612F728286F"> <enum>(iv)</enum> <text>the Council; and</text> </clause> <clause id="idB7A81F26787E4D7389E5DB5720067260"> <enum>(v)</enum> <text>the Native Fish Monitoring and Recommendation Team, as described in section 402(b)(1); and</text> </clause> </subparagraph> 
<subparagraph id="id59CEC3D9CB3B45A4AF308ADB13BA4BAE"> <enum>(B)</enum> <text>in coordination with the Secretary of the Interior, with respect to the development of the separate management plan for the Conservation Area, as described in section 102(c).</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id589C7CEA34C84FB39A71DAA414D24ECC"> <enum>(3)</enum> <header>Recommendations</header> <text>In preparing and revising the management plan under paragraph (1), the Secretary shall take into consideration any recommendations from the Council.</text> </paragraph> 
<paragraph commented="no" id="idc10cb46c19ea402ebdb14e60223d752c"> <enum>(4)</enum> <header>Treaty rights</header> <text>In preparing and revising the management plan under paragraph (1), taking into consideration the rights and obligations described in section 402, the Secretary shall ensure that the management plan does not alter or diminish—</text> <subparagraph commented="no" id="id29fc44ae56914f66b86cbf708e31b212"> <enum>(A)</enum> <text>the treaty rights of any Indian Tribe;</text> </subparagraph> 
<subparagraph commented="no" id="idf0a197ad448f4706a6bd405c7d6fef45"> <enum>(B)</enum> <text>any rights described in the Colorado Ute Indian Water Rights Settlement Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/585">Public Law 100–585</external-xref>; 102 Stat. 2973); or</text> </subparagraph> <subparagraph commented="no" id="id8cd2e9e12c094179af5b6b2c0795d93a"> <enum>(C)</enum> <text>the operation or purposes of the Dolores Project.</text> </subparagraph> </paragraph> </subsection> 
<subsection id="id25a79e15e21e446ea7a6dc8eaa225027"> <enum>(d)</enum> <header>Incorporation of acquired land and interests</header> <text>Any land or interest in land located within the boundary of the Special Management Area that is acquired by the United States in accordance with section 401(c) after the date of enactment of this Act shall—</text> <paragraph id="idA3E038B9CB224A6DA9C086A103171628"> <enum>(1)</enum> <text>become part of the Special Management Area; and</text> </paragraph> 
<paragraph id="id30957300920B4FB3AAA91440DF7990A3"> <enum>(2)</enum> <text>be managed as provided in this section.</text> </paragraph> </subsection> </section> </title> <title id="idE244398EDC674940ABF80E7F3CB94A4E" style="OLC"> <enum>III</enum> <header>Technical modifications to potential additions to National Wild and Scenic Rivers System</header> <section commented="no" display-inline="no-display-inline" id="id072E4112F0E34B5684CA4371F3619475"> <enum>301.</enum> <header>Purpose</header> <text display-inline="no-display-inline">The purpose of this title is to release portions of the Dolores River and certain tributaries from designation for potential addition under the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>) or from further study under that Act.</text> </section> 
<section commented="no" display-inline="no-display-inline" id="id259982D481F74241BA85310FFB3B96AA"> <enum>302.</enum> <header>Release of designated segments from Dolores River congressional study area</header> <text display-inline="no-display-inline">Section 5(a)(56) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(a)(56)</external-xref>) is amended by inserting <quote>and the segments of the Dolores River located in the Dolores River National Conservation Area designated by the <short-title>Dolores River National Conservation Area and Special Management Area Act</short-title></quote> before the period at the end.</text> </section> <section id="id09b883e96fc14fe590ce4dec3a3e9dc2"> <enum>303.</enum> <header>Applicability of continuing consideration provision</header> <text display-inline="no-display-inline">Section 5(d)(1) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1276">16 U.S.C. 1276(d)(1)</external-xref>) shall not apply to—</text> 
<paragraph id="idC591233BA69241F89333B4531CFB9CB1"> <enum>(1)</enum> <text display-inline="yes-display-inline">the Conservation Area; or</text> </paragraph> <paragraph id="id18242CDA2D7C46C6BCF311FA1790DF08"> <enum>(2)</enum> <text display-inline="yes-display-inline">the Special Management Area.</text> </paragraph> </section> </title> 
<title id="id4640BB216A6D4BCA88B45951B27430FD" style="OLC"> <enum>IV</enum> <header>General provisions</header> 
<section id="id563EA00F7CDA4AE0B4CBFFD535FFC4AD"> <enum>401.</enum> <header>Management of covered land</header> 
<subsection commented="no" id="ID706f955dc9334ad5b5bc4ad9eb948b3f"> <enum>(a)</enum> <header>Motorized vehicles</header> 
<paragraph commented="no" id="id3FF59E4004B94AF5BC6EEA050B7F71AC"> <enum>(1)</enum> <header>In general</header> <text>Except in cases in which motorized vehicles are needed for administrative purposes or to respond to an emergency, the use of motorized vehicles in the covered land shall be permitted only on designated routes.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ID8fe8c49326184a3bbbdd7fdf309bd67a"> <enum>(2)</enum> <header>Road construction</header> <text>Except as necessary for administrative purposes, protection of public health and safety, or providing reasonable access to private property, the Secretary shall not construct any permanent or temporary road within the covered land after the date of enactment of this Act.</text> </paragraph> </subsection> 
<subsection id="ID334e2335fbe84a5eaa2438875037a926"> <enum>(b)</enum> <header>Withdrawals</header> <text>Subject to valid existing rights, all covered land, including any land or interest in land that is acquired by the United States within the covered land after the date of enactment of this Act, is withdrawn from—</text> <paragraph id="ID1c9ce8453e954086aff1be5efedd4526"> <enum>(1)</enum> <text>entry, appropriation or disposal under the public land laws;</text> </paragraph> 
<paragraph id="IDa963b67fc18b4f56a77d9e0b5ff93e5c"> <enum>(2)</enum> <text>location, entry, and patent under the mining laws; and</text> </paragraph> <paragraph id="IDccaf085f97804869abbb0199d56de5ff"> <enum>(3)</enum> <text>operation of the mineral leasing, mineral materials, and geothermal leasing laws, except as provided in section 102(e).</text> </paragraph> </subsection> 
<subsection id="IDdf46c973249c4c9c8301466d4d669b0f"> <enum>(c)</enum> <header>Willing sellers</header> <text>Any acquisition of land or interests in land under this Act shall be only by purchase from willing sellers, donation, or exchange.</text> </subsection> <subsection id="id84318e2dfdf64321be20d8bb6a8a5664"> <enum>(d)</enum> <header>Grazing</header> <text>The Secretary shall issue and administer any grazing leases or permits and trailing permits and administer allotments in the covered land in accordance with the laws (including regulations) applicable to the issuance and administration of leases and permits on other land under the jurisdiction of the Bureau of Land Management or Forest Service, as applicable.</text> </subsection> 
<subsection id="id3fd9ba35e5d14f14a4f7bf85311bef99"> <enum>(e)</enum> <header>Access to private land</header> <text>To ensure reasonable use and enjoyment of private property (whether in existence on the date of enactment of this Act or in an improved state), the Secretary shall grant reasonable and feasible access through the covered land to any private property that is located within or adjacent to the covered land, if other routes to the private property are blocked by physical barriers, such as the Dolores River or the cliffs of the Dolores River.</text> </subsection> <subsection id="id3B17DA491FFD4B0DAF8FC31DED3E4366"> <enum>(f)</enum> <header>Easements</header> <text>The Secretary may lease or acquire easements on private land from willing lessors, donors, or sellers for recreation, access, conservation, or other permitted uses, to the extent necessary to fulfill the purposes of the Conservation Area or Special Management Area, as applicable.</text> </subsection> 
<subsection id="id760DE220450646B28BAFF6EEA5D2D0B6"> <enum>(g)</enum> <header>Wildfire, insect, and disease management</header> <text>The Secretary may take any measures that the Secretary determines to be necessary to control fire, insects, and diseases in the covered land, (including, as the Secretary determines to be appropriate, the coordination of the measures with the State or a local agency).</text> </subsection> <subsection id="id1678C6184EA74C229772858A5D7BA240"> <enum>(h)</enum> <header>Management of Ponderosa Gorge</header> <paragraph id="idCE5D4FA59D9542128E86EF812514B9AE"> <enum>(1)</enum> <header>In general</header> <text>The Secretary shall manage the areas of the Conservation Area and Special Management Area identified on the Map as <quote>Ponderosa Gorge</quote> in a manner that maintains the wilderness character of those areas as of the date of enactment of this Act.</text> </paragraph> 
<paragraph id="id136CE63D99034B168561EF5CC15AFA2C"> <enum>(2)</enum> <header>Prohibited activities</header> <text>Subject to paragraphs (3) and (4), in the areas described in paragraph (1), the following activities shall be prohibited:</text> <subparagraph id="id14EE769D7BBE4437BA4890E8309A4670"> <enum>(A)</enum> <text>New permanent or temporary road construction or the renovation of nonsystem roads in existence on the date of enactment of this Act.</text> </subparagraph> 
<subparagraph id="id4AB6BD0646B546C9B310420B06A9D4E3"> <enum>(B)</enum> <text>The use of motor vehicles, motorized equipment, or mechanical transport, except as necessary to meet the minimum requirements for the administration of the Federal land, to protect public health and safety, or to conduct ecological restoration activities to improve the aquatic habitat of the Dolores River channel.</text> </subparagraph> <subparagraph id="id8224A6F975274FF2A7D13BB5EF2C1DDE"> <enum>(C)</enum> <text>Projects undertaken for the purpose of harvesting commercial timber.</text> </subparagraph> </paragraph> 
<paragraph id="idDE681E388E874685A4FCC105C5705B66"> <enum>(3)</enum> <header>Utility corridor</header> <text>Nothing in this subsection affects the operation, maintenance, or location of the utility right-of-way within the corridor, as depicted on the Map.</text> </paragraph> <paragraph id="idF39CE1F7AFC64BF7BE2D8933D130121B"> <enum>(4)</enum> <header>Effect on certain vegetation management projects</header> <text>Nothing in this subsection—</text> 
<subparagraph id="idFAFA58039B104FC7ADAED873DA33709B"> <enum>(A)</enum> <text>affects the implementation of the Lone Pine Vegetation Management Project authorized by the Forest Service in a decision notice dated January 23, 2020; or</text> </subparagraph> <subparagraph id="id426040D57C844CC9A5AF47C4D42B7E2E"> <enum>(B)</enum> <text>prohibits activities relating to the harvest of merchantable products that are byproducts of activities conducted—</text> 
<clause id="idA24B0D6FD39843E3BB8E7BDBC917E455"> <enum>(i)</enum> <text>for ecological restoration; or</text> </clause> <clause id="id9AC23D0FFBD240F5A06185866BC8782E"> <enum>(ii)</enum> <text>to further the purposes of this Act.</text> </clause> </subparagraph> </paragraph> </subsection> 
<subsection id="id2A8D3DD519474A929DE179FCB79F51B4"> <enum>(i)</enum> <header>Effect</header> <text>Nothing in this Act prohibits the Secretary from issuing a new permit and right-of-way within the covered land for a width of not more than 150 feet for a right-of-way that serves a transmission line in existence on the date of enactment of this Act, on the condition that the Secretary shall relocate the right-of-way in a manner that furthers the purposes of this Act.</text> </subsection> <subsection id="id6f222a7985a443f3b8b2239bcff4c2b7"> <enum>(j)</enum> <header>Climatological data collection</header> <text>Subject to such terms and conditions as the Secretary may require, nothing in this Act precludes the installation and maintenance of hydrologic, meteorological, or climatological collection devices in the covered land if the facilities and access to the facilities are essential to public safety, flood warning, flood control, water reservoir operation activities, or the collection of hydrologic data for water resource management purposes.</text> </subsection> </section> 
<section id="idBA27B341F22F4128A571FF625B38C819"> <enum>402.</enum> <header>Protection of water rights and other interests</header> 
<subsection id="id38aae7b211d847628a2ece0dc7d4af64"> <enum>(a)</enum> <header>Dolores Project</header> 
<paragraph id="idF7D5F50FCB1947D1A418C6C0A7566CE6"> <enum>(1)</enum> <header>Operation</header> <text>The Dolores Project and the operation of McPhee Reservoir shall continue to be the responsibility of, and be operated by, the Secretary, in cooperation with the Dolores Water Conservancy District, in accordance with applicable laws and obligations.</text> </paragraph> <paragraph id="id4d6fec2f4b7e4bf5aae380dc395c5d03"> <enum>(2)</enum> <header>Effect</header> <text>Nothing in this Act affects the Dolores Project or the current or future operation of McPhee Reservoir in accordance with—</text> 
<subparagraph id="idfc730d1f9da54ca78232bc4dfd913a5e"> <enum>(A)</enum> <text>the reclamation laws;</text> </subparagraph> <subparagraph id="id00c042e9158f410f9fef3caed42a4983"> <enum>(B)</enum> <text>any applicable—</text> 
<clause id="id24EE52D7916B4623B5E0C921A7825808"> <enum>(i)</enum> <text>Dolores Project water contract, storage contract, or carriage contract; or</text> </clause> <clause id="idfebf9aed92104c7a9b5f19b838dfbe85"> <enum>(ii)</enum> <text>allocation of Dolores Project water;</text> </clause> </subparagraph> 
<subparagraph id="id180794aa32844086996a802f0395f42e"> <enum>(C)</enum> <text>the environmental assessment and finding of no significant impact prepared by the Bureau of Reclamation Upper Colorado Region and approved August 2, 1996;</text> </subparagraph> <subparagraph id="id06bcf213231e4a1da2be315a67f8b3e6"> <enum>(D)</enum> <text>the operating agreement entitled <quote>Operating Agreement, McPhee Dam and Reservoir, Contract No. 99-WC-40-R6100, Dolores Project, Colorado</quote> and dated April 25, 2000 (or any subsequent renewal or revision of that agreement);</text> </subparagraph> 
<subparagraph id="id770422c2f6bc43169ad1fb4c49663dd2"> <enum>(E)</enum> <text>mitigation measures for whitewater boating, including any such measure described in—</text> <clause id="idCECE9467B22341B8B77DFE11110C26C1"> <enum>(i)</enum> <text>the document entitled <quote>Dolores Project Colorado Definite Plan Report</quote> and dated April 1977;</text> </clause> 
<clause id="id1624C75A56C5414D8F06CCD1607A1954"> <enum>(ii)</enum> <text>the Dolores Project final environmental statement dated May 9, 1977; or</text> </clause> <clause id="id88C0FCAD80A0428DBDD388B2E02A850A"> <enum>(iii)</enum> <text>a document referred to in subparagraph (C) or (D);</text> </clause> </subparagraph> 
<subparagraph id="id92c8c03bae4f47f0b03845b231832a12"> <enum>(F)</enum> <text>applicable Federal or State laws relating to the protection of the environment, including—</text> <clause id="id3A6C6DF3D97B4366BA9AC55800387C5A"> <enum>(i)</enum> <text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text> </clause> 
<clause id="id77FC4D6DD23E4C3AAF788A6DB22D2764"> <enum>(ii)</enum> <text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text> </clause> <clause id="id724D986CD32442A7A57DF5DADD7C1687"> <enum>(iii)</enum> <text>the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); and</text> </clause> </subparagraph> 
<subparagraph id="idcd28ead63641491b88c0f0b9a29f5096"> <enum>(G)</enum> <text>the Colorado Ute Indian Water Rights Settlement Act of 1988 (<external-xref legal-doc="public-law" parsable-cite="pl/100/585">Public Law 100–585</external-xref>; 102 Stat. 2973).</text> </subparagraph> </paragraph> </subsection> <subsection commented="no" id="idcd7c665f4e1a41e5b145bff467245061"> <enum>(b)</enum> <header>Management of flows</header> <paragraph id="idd1635e6fba3046ae8480ed24f4ca3aa3"> <enum>(1)</enum> <header>In general</header> <text>In managing available flows below McPhee Dam to conserve, protect, and enhance the resources described in sections 101(b) and 201(b) of the Dolores River within the covered land, including native fish and whitewater boating resources, the Secretary shall seek to provide regular and meaningful consultation and collaboration with interested stakeholders, including the Native Fish Monitoring and Recommendation Team, which includes water management entities, affected counties, conservation interests, whitewater boating interests, Colorado Parks and Wildlife, and the Ute Mountain Ute Tribe, during the process of decision making.</text> </paragraph> 
<paragraph id="idb87cb1e5a422413691035423d1180826"> <enum>(2)</enum> <header>Annual report</header> <text>Beginning on the date that is 1 year after the date of enactment of this Act and annually thereafter, the Commissioner of Reclamation shall prepare and make publically available a report that describes any progress with respect to the conservation, protection, and enhancement of native fish in the Dolores River.</text> </paragraph> </subsection> <subsection id="id8924818d816c4b11b59a32566bad0e99"> <enum>(c)</enum> <header>Water resource projects</header> <paragraph id="id0b6dd77973174161af7934b60a44a8d7"> <enum>(1)</enum> <header>In general</header> <text>Subject to valid existing rights and paragraph (2), after the date of enactment of this Act, the Secretary or any other officer, employee, or agent of the United States may not assist by loan, grant, license, or otherwise in the construction or modification of any water resource project—</text> 
<subparagraph id="id43461db9176747c1bb5eb332d35a634f"> <enum>(A)</enum> <text>located on the covered land that would—</text> <clause id="id120668bcb6474fe9823343a7c4c3161a"> <enum>(i)</enum> <text>affect the free-flowing character of any stream within the covered land; or</text> </clause> 
<clause id="id6249ce574078467ea89cc96d83ba81d5"> <enum>(ii)</enum> <text>unreasonably diminish the resource values described in sections 101(b) and 201(b) of the Dolores River within the covered land; or</text> </clause> </subparagraph> <subparagraph id="id275e5f30ac5d47a19c900999dd0c85cc"> <enum>(B)</enum> <text>located outside the covered land that would unreasonably diminish the resource values described in sections 101(b) and 201(b) of the Dolores River within the covered land.</text> </subparagraph> </paragraph> 
<paragraph id="id3419d9ebf1464878a778ee9cc04688f4"> <enum>(2)</enum> <header>Limitations</header> <text>Subject to the requirements of this section, nothing in paragraph (1)—</text> <subparagraph id="id9AF19FE30326433CACB691960ECC120C"> <enum>(A)</enum> <text>prevents, outside the covered land—</text> 
<clause id="idC7D30B52BCAB4CA3846D2E0FE32B3443"> <enum>(i)</enum> <text>the construction of small diversion dams or stock ponds;</text> </clause> <clause id="id22A962E031E940C38F1BF96A809C1654"> <enum>(ii)</enum> <text>new minor water developments in accordance with existing decreed water rights; or</text> </clause> 
<clause id="id2CD29A1011B3407EB3DF39B3BB0D7C5D"> <enum>(iii)</enum> <text>minor modifications to structures; or</text> </clause> </subparagraph> <subparagraph id="idca3c230722014f20b5cdb8e172c7fdf6"> <enum>(B)</enum> <text>affects access to, or operation, maintenance, relicensing, repair, or replacement of, existing water resource projects.</text> </subparagraph> </paragraph> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="id1CDA62D3C25A4D1C9CBE94E14BD0121C"> <enum>(d)</enum> <header>Effect</header> <text display-inline="yes-display-inline">Nothing in this Act—</text> <paragraph commented="no" display-inline="no-display-inline" id="id0C422CF3971B4555A9D1AC530ED43CFC"> <enum>(1)</enum> <text display-inline="yes-display-inline">affects—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="idFAEF437D333541A0BA4FFF5FE8CCB868"> <enum>(A)</enum> <text display-inline="yes-display-inline">any water right that is—</text> <clause commented="no" display-inline="no-display-inline" id="id07DFEA5749F24F438049F86219E824CF"> <enum>(i)</enum> <text display-inline="yes-display-inline">decreed under the laws of the State; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="id26FA9F215CF447DD80B0B1A2F069DF84"> <enum>(ii)</enum> <text display-inline="yes-display-inline">in existence on the date of enactment of this Act;</text> </clause> </subparagraph> <subparagraph id="id6900a0b7ee7b411c8bb37987b13c5311"> <enum>(B)</enum> <text>the use, allocation, ownership, or control, in existence on the date of enactment of this Act, of any water or water right;</text> </subparagraph> 
<subparagraph id="id25daa8f769ff4ddb9800d9a2e27dac34"> <enum>(C)</enum> <text>any vested absolute or decreed conditional water right in existence on the date of enactment of this Act, including any water right held by the United States;</text> </subparagraph> <subparagraph id="idf3c9452c123145f5a8e3e5f8bec39d1d"> <enum>(D)</enum> <text>any interstate water compact in existence on the date of enactment of this Act; or</text> </subparagraph> 
<subparagraph id="id055c7cc6aa84459b864354d389b5c8aa"> <enum>(E)</enum> <text>State jurisdiction over any water law, water right, or adjudication or administration relating to any water resource;</text> </subparagraph> </paragraph> <paragraph id="idb008ad0861074af6af8937d972a8a476"> <enum>(2)</enum> <text>imposes—</text> 
<subparagraph id="idb1ab8ee944954cd883e02d9bcfec8203"> <enum>(A)</enum> <text>any mandatory streamflow requirement within the covered land; or</text> </subparagraph> <subparagraph id="id68b1fbb3d7f04bab999663928eda9cf4"> <enum>(B)</enum> <text>any Federal water quality standard within, or upstream of, the covered land that is more restrictive than would be applicable if the covered land had not been designated as the Conservation Area or Special Management Area under this Act; or</text> </subparagraph> </paragraph> 
<paragraph id="id28fdeb2e4d8a43169bcfc2525153b67d"> <enum>(3)</enum> <text>constitutes an express or implied reservation by the United States of any reserved or appropriative water right within the covered land.</text> </paragraph> </subsection> </section> <section commented="no" display-inline="no-display-inline" id="id61C89E1D700542BFA6CE42F096387F36"> <enum>403.</enum> <header>Effect on private property and regulatory authority</header> <subsection commented="no" display-inline="no-display-inline" id="id1D52C482FEC4473EB61BC57BC32B0B52"> <enum>(a)</enum> <header>Effect</header> <text display-inline="yes-display-inline">Nothing in this Act—</text> 
<paragraph id="id4B5FF26A9C214C1899786F67A476420E"> <enum>(1)</enum> <text>affects valid existing rights;</text> </paragraph> <paragraph id="idF6A72F44B79B4420A72B6B14434CF730"> <enum>(2)</enum> <text>requires any owner of private property to bear any costs associated with the implementation of the management plan under this Act;</text> </paragraph> 
<paragraph commented="no" id="ID308a8dba2d6e4470b60810f29d235369"> <enum>(3)</enum> <text>affects the jurisdiction or responsibility of the State with respect to fish and wildlife in the State;</text> </paragraph> <paragraph id="idC137738D69784AB9BE77D8BC3A0FF65E"> <enum>(4)</enum> <text>requires a change in or affects local zoning laws of the State or a political subdivision of the State; or</text> </paragraph> 
<paragraph id="id5d1fbd1d3ab2455face36484733829df"> <enum>(5)</enum> <text>affects—</text> <subparagraph id="idBE1F9BC4089448C68AE07E32DE7E050D"> <enum>(A)</enum> <text>the jurisdiction over, use, or maintenance of county roads in the covered land; or</text> </subparagraph> 
<subparagraph id="idC4794912C0134B63B3A71D317E6FFA35"> <enum>(B)</enum> <text>the administration of the portion of the road that is not a county road and that is commonly known as the <quote>Dolores River Road</quote> within the Conservation Area, subject to the condition that the Secretary shall not improve the road beyond the existing primitive condition of the road.</text> </subparagraph> </paragraph> </subsection> <subsection id="ida6c65b9ec86e4173a2b3de5e81b669d4"> <enum>(b)</enum> <header>Adjacent management</header> <paragraph id="id2635d853f9474dd496842934a138d68a"> <enum>(1)</enum> <header>No buffer zones</header> <text>The designation of the Conservation Area and the Special Management Area by this Act shall not create any protective perimeter or buffer zone around the Conservation Area or Special Management Area, as applicable.</text> </paragraph> 
<paragraph id="idf11944552c2b4f388ca2a3a651c0552d"> <enum>(2)</enum> <header>Private land</header> <text>Nothing in this Act requires the prohibition of any activity on private land outside the boundaries of the Conservation Area or the Special Management Area that can be seen or heard from within such a boundary.</text> </paragraph> </subsection> </section> <section commented="no" id="ide69b7897b13a44eba43076f69f7782cf"> <enum>404.</enum> <header>Tribal rights and traditional uses</header> <subsection commented="no" id="idf3ea74c786f8453280aaca0d1f87e7b3"> <enum>(a)</enum> <header>Treaty rights</header> <text>Nothing in this Act affects the treaty rights of any Indian Tribe, including rights under the Agreement of September 13, 1873, ratified by the Act of April 29, 1874 (18 Stat. 36, chapter 136).</text> </subsection> 
<subsection commented="no" id="idabefd592f55f4ac590ab9faaaf364bd8"> <enum>(b)</enum> <header>Traditional tribal uses</header> <text>Subject to any terms and conditions as the Secretary determines to be necessary and in accordance with applicable law, the Secretary shall allow for the continued use of the covered land by members of Indian Tribes—</text> <paragraph commented="no" id="id4b269f6f4d60458cb1466596da61c98f"> <enum>(1)</enum> <text>for traditional ceremonies; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="ida64695fb2d3f4a668dfd841d6d0f88e1"> <enum>(2)</enum> <text>as a source of traditional plants and other materials.</text> </paragraph> </subsection> </section> </title> </legis-body> </bill>
