        <legis-type>A BILL</legis-type>
        <official-title>To amend the Clean Air Act to prohibit State standards relating to the
            control of emissions from existing locomotives and engines used in locomotives, and for
            other purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lifting Overburdensome Commerce Obstructions and Motives Act</short-title></quote> or the <quote><short-title>LOCOMOTIVES Act</short-title></quote>.</text>
        </section>
        <section section-type="subsequent-section" id="H9E32796D83BF4DCB909390B539079052">
            <enum>2.</enum>
            <header>Prohibition on State standards relating to the control of emissions from
                existing locomotives and engines used in locomotives</header>
 <text display-inline="no-display-inline">Section 209(e)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(e)(1)</external-xref>) is amended—</text>
            <paragraph id="H7C91C64E6338435AB053AFE659EE66A3">
                <enum>(1)</enum>
 <text>by striking <quote>either of the following new nonroad engines or nonroad vehicles subject to regulation under this Act—</quote> and inserting <quote>any of the following nonroad engines or nonroad vehicles:</quote>;</text>
            </paragraph>

                <enum>(2)</enum>
 <text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>which are used in construction equipment or vehicles or used in farm equipment or vehicles and which are smaller than 175 horsepower.</quote> and inserting</text>

 <text>, which are—</text> <clause id="H5F7EB8897FF34B16A99D2CFC8E8D1B1A"> <enum>(i)</enum> <text display-inline="yes-display-inline">used in construction equipment or vehicles or used in farm equipment or vehicles;</text>
                    </clause>
                    <clause id="H0FDFB1F43E254C349B768778F154F404">
                        <enum>(ii)</enum>
 <text>smaller than 175 horsepower; and</text> </clause> <clause id="HD620865F4F97456393588492C9795B14"> <enum>(iii)</enum> <text display-inline="yes-display-inline">subject to regulation under this Act.</text>
                    </clause>

                <enum>(3)</enum>
 <text>in subparagraph (B), by inserting <quote>, which are subject to regulation under this Act</quote> after <quote>in locomotives</quote>; and</text>
            </paragraph>

                <enum>(4)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="H9E33D637DCA34CD685B75C87B8559DCB" display-inline="no-display-inline" style="OLC"> <subparagraph id="H9DB7C2F68DAC4BCF80D4C23A36834513"> <enum>(C)</enum> <text display-inline="yes-display-inline">Locomotives or engines used in locomotives—</text>
                        <clause id="HDB80FE6F2F0149E28015C3504A88DA67">
                            <enum>(i)</enum>
 <text>other than the locomotives and engines described in subparagraph (B); and</text>
                        </clause>
                        <clause id="HBD2EF6982D724BDC93CE9959F6821725" commented="no" display-inline="no-display-inline">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">which are engaged in commerce, which shall encompass all locomotives engaged in providing common carrier railroad transportation for compensation pursuant to section 10102 of title 49, United States Code.</text>
                        </clause>
