                <header>Advance deposit wager</header>
 <text>The term <term>advance deposit wager</term> means a legal form of parimutuel wager in which an individual deposits money into an account and such funds are used to pay for parimutuel wagers made either on-track or off-track.</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline"

                <enum>(2)</enum>
                <header>Board</header>
 <text>The term <term>Board</term> means the board of directors of the Racehorse Health and Safety Organization established under section 101.</text>
            </paragraph>
            <paragraph id="H6A36BDF6F4AF42C1A2AD942830F33576">
                <enum>(3)</enum>
                <header>Breed registry</header>
 <text>The term <term>breed registry</term>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H001F269C3066401F8AC0823AFAE720F7"> <enum>(A)</enum> <text display-inline="yes-display-inline">means the organization with which an owner or breeder officially registers his or her horse for horseracing; and </text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                    id="H4A01BD3E2FB44BE08516B8BC0636147D">
                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">includes—</text> <clause id="HEB089E3465C7437FBCA97DBC463C2460"> <enum>(i)</enum> <text display-inline="yes-display-inline">in the case of Thoroughbreds, the Jockey Club;</text>
                    </clause>
                    <clause id="HE5847557DC6340F5AB23D3367C09F779">
                        <enum>(ii)</enum>
 <text>in the case of Standardbreds, the United States Trotting Association; and</text>
                    </clause>
                    <clause id="HA825FD22DFD0407CA2D30204BB99B338">
                        <enum>(iii)</enum>
 <text>in the case of Quarter Horses, the American Quarter Horse Association.</text>
                    </clause>
                </subparagraph>
            </paragraph>
            <paragraph id="H45C6C3E887EF482A8E1840CE8764DB66">
                <enum>(4)</enum>
                <header>Covered horse</header>
 <text>The term <term>covered horse</term> means any Thoroughbred, Standardbred, or Quarter Horse during the period—</text>
                <subparagraph id="H97583C72377843509BFF5A0B3F78C5DF">
                    <enum>(A)</enum>
 <text>beginning on the date of the horse’s first timed and reported workout at a racetrack that participates in covered horseraces or at a training facility; and</text>
                </subparagraph>
                <subparagraph id="HD88F68E8D87143D2A777E45B5BF4C8DF">
                    <enum>(B)</enum>
 <text>ending on the earlier of—</text> <clause id="HBA1FEE70D21548BBADBCD5AC3CEA2D5D"> <enum>(i)</enum> <text>the date on which the horse is permanently ineligible to be entered in a covered horserace; or</text>
                    </clause>
                    <clause id="H467CBD768A55467E8BCFD71E55AA316A">
                        <enum>(ii)</enum>
 <text>the date of the death of the horse.</text> </clause> </subparagraph> </paragraph> <paragraph id="H541E72DE25C64470A33D93F00D484890"> <enum>(5)</enum> <header>Covered horserace</header> <text>The term <term>covered horserace</term> means any horserace involving covered horses that has a substantial relation to interstate commerce, including any horserace that is the subject of interstate off-track wagers or advance deposit wagers.</text>
            </paragraph>

                <enum>(6)</enum>
                <header>Covered person</header>
 <text>The term <term>covered person</term> means any trainer, owner, breeder, jockey, driver, racetrack, veterinarian, person (as defined in section 1, of title 1, United States Code) licensed by a State racing commission, any agent, assign, or employee of such a person, and any other horse support personnel engaged in the care, training, or racing of covered horses.</text>
            </paragraph>
            <paragraph id="H3BF2E5A9FDF6448CA719E8F392355E8C">
                <enum>(7)</enum>
                <header>Equine industry representative</header>
 <text>The term <term>equine industry representative</term> means an organization representing the interests of, and whose membership consists in whole or in part of, owners, breeders, trainers, racetracks, veterinarians, State racing commissions, jockeys, and drivers.</text>
            </paragraph>

                <enum>(8)</enum>
                <header>Immediate family member</header>
 <text display-inline="yes-display-inline">The term <term>immediate family member</term> includes a spouse, domestic partner, mother, father, aunt, uncle, sibling, child, or member of the same household.</text>

            <paragraph commented="no" display-inline="no-display-inline"

                <enum>(9)</enum>
                <header>Interstate compact</header>
 <text>The term <term>interstate compact</term> means the interstate compact entered into pursuant to this Act.</text>
            </paragraph>

                <enum>(10)</enum>
                <header>Interstate off-track wager</header>
 <text>The term <term>interstate off-track wager</term> has the meaning given that term in section 3 of the Interstate Horseracing Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3002">15 U.S.C. 3002</external-xref>).</text>
            </paragraph>

                <enum>(11)</enum>
                <header>Jockey; driver</header>
 <text>The terms <term>jockey</term> and <term>driver</term> mean an individual who is a rider or driver of a covered horse in a covered horserace.</text>
            </paragraph>

                <enum>(12)</enum>
                <header>Member State</header>
 <text display-inline="yes-display-inline">The term <term>member State</term> means a State that is a member of the interstate compact.</text>
            </paragraph>

                <header>Owner; breeder</header>
 <text>The terms <term>owner</term> and <term>breeder</term> mean an individual who—</text>

                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">holds an ownership interest in a covered horse; or </text>
                </subparagraph>

                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">is in the business of breeding covered horses.</text>
                </subparagraph>
            </paragraph>

                <enum>(14)</enum>
                <header>Racetrack</header>
 <text>The term <term>racetrack</term> means an organization or person licensed by a State racing commission to conduct covered horseraces.</text>
            </paragraph>

                <enum>(15)</enum>
                <header>Racehorse Health and Safety Organization; RHSO</header>
 <text>The terms <term>Racehorse Health and Safety Organization</term> and <term>RHSO</term> mean the Racehorse Health and Safety Organization established under section 101.</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline"

                <enum>(16)</enum>
                <header>Scientific medication control committee</header>
 <text>The term <term>scientific medication control committee</term> means a committee established under section 201.</text>
            </paragraph>

                <enum>(17)</enum>
                <header>State racing commission</header>
 <text>The term <term>State racing commission</term> means an entity designated by State law or regulation that has jurisdiction over the conduct of horseracing within the applicable State.</text>
            </paragraph>

                <enum>(18)</enum>
                <header>Trainer</header>
 <text>The term <term>trainer</term> means an individual that is engaged in the training of covered horses and is the recipient of direct or indirect compensation or anything of value for such services or expertise.</text>
            </paragraph>

                <enum>(19)</enum>
                <header>Training facility</header>
 <text display-inline="yes-display-inline">The term <term>training facility</term> means a location that—</text>
                <subparagraph commented="no" display-inline="no-display-inline"
                    id="HAB9CDA38B4D448AA853578C20C0816EA">
                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">is not a racetrack recognized and designated by the Racehorse Health and Safety Organization; and </text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                    id="H34A2CB45EF51451AA6FC82F1F122C586">
                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">operates primarily to house covered horses or to conduct official timed workouts or qualifying races.</text>
                </subparagraph>
            </paragraph>
            <paragraph id="HB1FD8D3B07AD454AB8D65251D70E5DF2">
                <enum>(20)</enum>
                <header>Veterinarian</header>
 <text>The term <term>veterinarian</term> means a licensed veterinarian who provides veterinary services to covered horses.</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline"

                <enum>(21)</enum>
                <header>Workout</header>
 <text>The term <term>workout</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H6045578DE8C745BC80D87820E6453C13"> <enum>(A)</enum> <text display-inline="yes-display-inline">a timed running of a horse over a predetermined distance not associated with a purse race; or</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                    id="HB693611CD1E5422DBFF7668B84D7099E">
                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">the competing of a horse in a harness qualifying race. </text>
                </subparagraph>
            </paragraph>
        </section>
        <section commented="no" display-inline="no-display-inline"
            id="H8A746E47B8B3484FA4EC50781B723D4C">
            <enum>3.</enum>
            <header>Repeal of the Horseracing Integrity and Safety Act of 2020</header>
 <text display-inline="no-display-inline">The Horseracing Integrity and Safety Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/3051">15 U.S.C. 3051 et seq.</external-xref>) is repealed. </text>
        </section>

            <enum>4.</enum>
            <header>Authorization to enter into interstate compact</header>
            <subsection id="HE6E3516340F94D1689BF0AECE7E13FBC">
                <enum>(a)</enum>
                <header>In general</header>
 <text>The consent of Congress is given for States to enter into an interstate compact in accordance with this Act.</text>
            </subsection>
            <subsection id="H5E4790E8D23448BBB03B9416BC4C00E3">
                <enum>(b)</enum>
                <header>Consent of States</header>
 <text>A State may demonstrate consent to enter into the interstate compact authorized under subsection (a) through the enactment of a State law that contains a provision indicating such consent that is substantially similar to the following:</text>

            </subsection>
            <subsection id="H396F5075598D4AA0A37EB36763A4C7CB">
                <enum>(c)</enum>
                <header>Prohibition on interstate off-Track wagers among non-Member States</header>
                <paragraph id="HCAF6FF4AEC3D4EA1960DCC62EC8B9F2C">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">Subject to, and in accordance with, the Interstate Horseracing Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3001">15 U.S.C. 3001 et seq.</external-xref>), a host State that is a member State of the interstate compact may allow the interstate transmission of any electronic signal for the purposes of allowing for the placement of interstate off-track wagers or advance deposit wagers pertaining to the covered horserace concerned.</text>
                </paragraph>
                <paragraph id="H6B920FA46EB7489F8FA392CD4AA5E80E">
                    <enum>(2)</enum>
                    <header>Exception</header>
 <text display-inline="yes-display-inline">A host State that is not a member State of the interstate compact is prohibited from allowing interstate transmission of any electronic signal for the purposes described in paragraph (1). </text>
                </paragraph>

                    <enum>(3)</enum>
                    <header>Host State defined</header>
 <text>In this subsection, the term <term>host State</term> means a State in which a horserace subject to an interstate off-track wager takes place.</text>
                </paragraph>
            </subsection>
        </section>

            <enum>I</enum>
            <header>Racehorse Health and Safety Organization</header>
            <section id="HD1722BEF8A8F437E997A4D09BC19ED0C">
                <enum>101.</enum>
                <header>Racehorse Health and Safety Organization</header>
                <subsection id="H15C4933105A84111A409DFCC3E1E3F48">
                    <enum>(a)</enum>
                    <header>In general</header>
 <text>States that are members of the interstate compact shall—</text> <paragraph id="HE52C129AADE34B628A40CEFF09F83505"> <enum>(1)</enum> <text>establish and participate in an organization, to be known as the <quote>Racehorse Health and Safety Organization</quote> or the <quote>RHSO</quote>, to coordinate the decision making and actions of the State racing commission of each member State; and</text>
                    </paragraph>
                    <paragraph id="H7A1115E4551E44C6BFA2F8F6DB552386">
                        <enum>(2)</enum>
 <text display-inline="yes-display-inline">develop bylaws and rules governing the RHSO, including rules establishing the RHSO as an agency for purposes of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code.</text>
                    </paragraph>
                </subsection>
                <subsection id="H69EDA7B7EE214E0591D5E6B8AC276F44">
                    <enum>(b)</enum>
                    <header>Board of directors</header>
                    <paragraph id="H04E0B86786774F1DB30891B0484F240A">
                        <enum>(1)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">The RHSO shall be governed by a board of directors composed of 9 members, of whom—</text>
                        <subparagraph id="H2B3E1791E3DE4490AF7C2925AC1B4B18">
                            <enum>(A)</enum>
 <text display-inline="yes-display-inline">5 shall be appointed by the State racing commission of each of the 5 member States that had the greatest number of racing days during the preceding 3-year period, with each such State racing commission appointing 1 member; and</text>
                        </subparagraph>
                        <subparagraph id="H04297FE377B24840B71B515624943329">
                            <enum>(B)</enum>
 <text>4 shall be appointed by the State racing commissions of the remaining member States. </text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HD358311C59064A5198D74F9EA8DD97AD">
                        <enum>(2)</enum>
                        <header>Membership</header>
                        <subparagraph id="H7AED13A5493B4A84AB0B92D6E0A3ACA1">
                            <enum>(A)</enum>
                            <header>Chairperson</header>
 <text>The chairperson of the Board shall be elected annually by majority vote from among the members of the Board.</text>
                        </subparagraph>
                        <subparagraph id="H115501D23F2346D7989D0CDBB4B40DDD">
                            <enum>(B)</enum>
                            <header>Term</header>
                            <clause id="HD94E705173F94531929FE554C1800D99">
                                <enum>(i)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">Except as provided in clauses (ii) and (iii), the term of a member of the Board shall not exceed 3 years.</text>
                            </clause>
                            <clause id="HB38C843738B64FE2B06ECFF3E515025B">
                                <enum>(ii)</enum>
                                <header>Initial appointment</header>
 <text display-inline="yes-display-inline">For purposes of staggering terms of appointment, the initial members appointed to the Board by the State racing commissions in the 5 member States that had the greatest number of racing days during the prior 3-year period shall serve an initial term of 4 years.</text>
                            </clause>
                            <clause id="H2E260CB85B91427FB9FE5C48533D6996">
                                <enum>(iii)</enum>
                                <header>Expansion in case of fewer than 9 member States</header>
 <text display-inline="yes-display-inline">If, as of the date described in section 501(a), fewer than 9 States have entered the interstate compact, the Board shall add a new member as each new State enters the interstate compact, up to a maximum of 9 members. </text>
                            </clause>
                            <clause id="H28BE850B482E459185CAE23F6938EB52">
                                <enum>(iv)</enum>
                                <header>Vacancies</header>
 <text display-inline="yes-display-inline">A vacancy on the Board shall be filled in the same manner as the position was appointed immediately prior to the vacancy. An individual appointed to fill a vacancy occurring before the expiration of the term for which the predecessor of that individual was appointed shall be appointed for the remainder of that term. When the term of office of a member ends, the member may continue to serve until a successor is appointed. </text>
                            </clause>
                            <clause commented="no" display-inline="no-display-inline"

                                <enum>(v)</enum>
                                <header>Term limits</header>
 <text display-inline="yes-display-inline">No member of the Board shall serve more than 3 full terms.</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="HD0B1842ACFF145D2A716F156FCC12895">
                            <enum>(C)</enum>
                            <header>Conflicts of interest</header>
                            <clause id="HF773C5A1DFD54EB7B643F0A19EA70779">
                                <enum>(i)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">Each member of the Board shall—</text>
                                <subclause id="HC6F415396853477FAB61C1B44CBC06DE">
                                    <enum>(I)</enum>
 <text display-inline="yes-display-inline">before accepting appointment as a member of the Board, disclose any potential conflict of interest; </text>
                                </subclause>
                                <subclause id="H0FA3180FA4544BD7B1EE8275577C2F6C">
                                    <enum>(II)</enum>

 <text>A member of the Board shall recuse himself or herself from discussion of any item before the Board if such discussion—</text>

 <text>relates to the direct financial interest of the member of the Board or an immediate family member of the member of the Board; and</text>

                                </subclause>
                            </clause>
                        </subparagraph>

                            <header>Removal and ethics</header>
 <text>The Board may remove by majority vote a member of the Board, including the chairperson of the Board, for—</text>
                            <clause id="HDE0B9CA5E7DC4132A1F83457746E384B">
                                <enum>(i)</enum>
 <text display-inline="yes-display-inline">neglect of duty, unethical behavior, or malfeasance in office (including conduct determined by the Board to be injurious to the integrity of horseracing, such as contract violations or perjury); or</text>
                            </clause>
                            <clause commented="no" display-inline="no-display-inline"

                                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">conviction of a violation of a Federal or State civil or criminal law related to horseracing. </text>

                            <enum>(E)</enum>
                            <header>Quorum</header>
 <text display-inline="yes-display-inline">In order to consider at a meeting any item requiring the approval of the Board, the Board shall have in attendance at such a meeting (either in person or remotely) a majority of the members of the Board.</text>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection id="H2FCCCDC8319847F79700325B5F20F85F">
                    <enum>(c)</enum>
                    <header>Duties of the Board</header>
 <text display-inline="yes-display-inline">The duties of Board shall be—</text> <paragraph id="HEC884266803D488CBB4BE092FEC8092F"> <enum>(1)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HD27553877B8F4B35AB81ADA1C01BAAA1"> <enum>(A)</enum> <text>to adopt rules with respect to scientific medication control recommended by each scientific medication control committee under section 202; or</text>
                        </subparagraph>
                        <subparagraph id="H622DAD4E1F0D4CB6A509209B7F57665A" indent="up1">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">to modify, or not adopt rules so recommended or adopt alternative rules if the Board determines, by a preponderance of evidence, that such recommendations do not meet the requirements specified in paragraph (4);</text>
                        </subparagraph>
                    </paragraph>

 <text display-inline="yes-display-inline">to modify, or not adopt rules so recommended or adopt alternative rules if the Board determines, by a preponderance of evidence, that such recommendations do not meet the requirements specified in paragraph (4);</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="H677C4CEB56FE41AAA53FD4D1C7DFC0FF">
                        <enum>(3)</enum>
 <text>to adopt rules with respect to rule violations, as described in sections 401, 402, and 403;</text>
                    </paragraph>
                    <paragraph id="HB8F2458DF3F6402A920DB3C2C6DB1491">
                        <enum>(4)</enum>
 <text display-inline="yes-display-inline">to ensure that any rule adopted under paragraph (1), (2), or (3) is based on generally accepted scientific principles and methods, and to the extent possible, on peer-reviewed scientific data and studies;</text>
                    </paragraph>
                    <paragraph id="H6E30912B698040C0AC994AED1089FC88">
                        <enum>(5)</enum>
 <text display-inline="yes-display-inline">to hold open meetings with respect to proposed rules recommended under sections 202 and 303, at which the chairperson of the scientific medication control committee concerned or the chairperson of the Racetrack Safety Committee, as applicable, or the representative of such chairperson, shall present such proposed rules;</text>
                    </paragraph>
                    <paragraph id="HA23FDA858A1547148C86413A34929B5E">
                        <enum>(6)</enum>
 <text display-inline="yes-display-inline">not later than 45 days before any such meeting is to be held—</text>
                        <subparagraph id="H9D8BFF00D4BF47C1A43461E526B52C71">
                            <enum>(A)</enum>
 <text>to post on the internet website of the RHSO any proposed rule described in paragraph (1) or (2) (or modifications to such rules) under consideration at such meeting; and</text>
                        </subparagraph>
                        <subparagraph id="HEA007A9CD09E42F1AD55F55558CE2C43">
                            <enum>(B)</enum>
 <text>to submit to each State racing commission (and to any other individual upon request) notification of such meeting;</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HBACFE83D49E94BD4A49ADCD136FC3CAD">
                        <enum>(7)</enum>
 <text display-inline="yes-display-inline">to adopt any rule under paragraphs (1), (2), or (3) by a vote of not less than a two-thirds majority of the Board, determine the effective date of any such rule, and update any such rule in accordance with the process established under paragraphs (5) and (6);</text>
                    </paragraph>
                    <paragraph id="H3C79039E9CD243E398277CDB985D4D2C">
                        <enum>(8)</enum>
 <text>after notice and an opportunity for public comment, in consultation with the State racing commissions, to develop and maintain a nationwide database of racehorse safety, performance, health, and injury information for the purpose of conducting an epidemiological study;</text>
                    </paragraph>
                    <paragraph id="H56818991E10A49E9BE3474D44D82B366">
                        <enum>(9)</enum>
 <text display-inline="yes-display-inline">in carrying out paragraph (8), to require covered persons and equine industry representatives to collect and submit for inclusion in such database such information as the RHSO considers necessary to further the goal of increased horse welfare;</text>
                    </paragraph>
                    <paragraph id="H77C40CB603DE4C5E82495EFB9E948BEA">
                        <enum>(10)</enum>
 <text>with respect to covered persons—</text> <subparagraph id="H127674F8802742109BED5A48B52F0792"> <enum>(A)</enum> <text>subject to section 102, to issue subpoenas and investigate rule violations; and</text>
                        </subparagraph>
                        <subparagraph id="H2E5C71D16852449DABE011FC73A122C1">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">to refer to the appropriate State racing commission any such violation for enforcement action unless the State racing commission concerned agrees to give that enforcement authority to the RHSO;</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="H9A5579DBEA034330A5A044133178AE36">
                        <enum>(11)</enum>
 <text display-inline="yes-display-inline">in consultation with member States, to develop uniform standards for veterinarian’s and steward’s lists and uniform procedures for entering horses on, and removing horses from, such lists;</text>
                    </paragraph>
                    <paragraph id="HFF398C09BE574E48817D75FE9487DA3D">
                        <enum>(12)</enum>
 <text>to establish, and conduct oversight activities with respect to, the scientific medication control committees under section 201 and the Racetrack Safety Committee under 302;</text>
                    </paragraph>
                    <paragraph id="H25AC2C2D1BDE4BD89DF1886462AF5737">
                        <enum>(13)</enum>
 <text>in carrying out paragraph (12), with respect to members of the committees referred to in that paragraph—</text>
                        <subparagraph id="H4360F5DC7E5A43F1AF25D2902EC111A6">
                            <enum>(A)</enum>
 <text>to assess such members for potential conflicts on a case-by-case basis; and</text>
                        </subparagraph>
                        <subparagraph id="H42E1AB31CD804705A42850FC65626E68">
                            <enum>(B)</enum>
 <text>to determine, in the sole discretion of the Board, whether the potential conflict requires removal from the committee or denial of the opportunity to vote on an item pending before the relevant committee;</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HF6FB40DCC1564EC0B7AFE9C62CFD33EC">
                        <enum>(14)</enum>
 <text>to carry out activities described in subsection (e) relating to laboratory accreditation; and</text>
                    </paragraph>
                    <paragraph id="H5CC77591921B4AF0A2A39F7ECC7A3518">
                        <enum>(15)</enum>
 <text display-inline="yes-display-inline">to ensure that member States comply with the terms of this Act, the interstate compact, and the rules adopted by the Board under this section, including the prohibition on interstate off-track wagers among non-member States specified in section 4(c).</text>
                    </paragraph>
                </subsection>
                <subsection id="H532F3E58969843D3934DCA952237F00A">
                    <enum>(d)</enum>
                    <header>Funding</header>
                    <paragraph commented="no" id="HDF6D37D4F3FB462791AB8AA4B798C387">
                        <enum>(1)</enum>
                        <header>Initial funding</header>
 <text display-inline="yes-display-inline">The RHSO, acting through the Board, shall assess an initial fee from each State racing commission of a member State in an amount determined by the Board to be sufficient to cover the startup costs of the racing commission for the first full year that begins after the effective date specified in section 501(a). </text>
                    </paragraph>

                        <enum>(2)</enum>
                        <header>Permanent funding</header>
                        <subparagraph id="H96E0ED0706AF4E8CB89DC4844D1E011E">
                            <enum>(A)</enum>
                            <header>Assessment and collection of fees by States</header>
                            <clause id="HC0642F435D9F45CD8639296C57B6F8BF">
                                <enum>(i)</enum>
                                <header>In general</header>
 <text>Beginning on a date determined by the RHSO, each State racing commission of a member State shall remit to the RHSO an amount of fees determined under subparagraph (B), in accordance with a schedule developed by the RHSO.</text>
                            </clause>
                            <clause id="H9AFF38B568F44D9AB29424D6CAEFE978">
                                <enum>(ii)</enum>
                                <header>Determination of methods</header>
 <text display-inline="yes-display-inline">Each State racing commission of a member State shall determine, subject to the applicable laws, regulations, and contracts of the State concerned, the method by which the amount of fees determined in accordance with subparagraph (B) shall be allocated, assessed, and collected. </text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="H3F4D8EFF93A6482184269D85B3FE37B0">
                            <enum>(B)</enum>
                            <header>Annual calculation of amounts required</header>
                            <clause id="HF6FE7239534043A2AE86724A51971466">
                                <enum>(i)</enum>
                                <header>In general</header>
 <text>For the first year in which fees are collected under this subsection, not later than the date determined by the RHSO, and not later than November 1 each year thereafter, the RHSO shall determine and provide to each State racing commission the estimated amount required from each member State—</text>
                                <subclause commented="no" id="HFD8EB4A718754339B7F1A9905E0A28D2">
                                    <enum>(I)</enum>
 <text>to fund the proportionate share of the member State of the expenditures incurred in administering the horseracing scientific medication control rules under subsection (c)(1) and the racetrack safety rules under section subsection (c)(2) for each breed of covered horses racing in covered horseraces in the State; and</text>
                                </subclause>
                                <subclause id="HC94D2DD1848241C7AC1D23AE0D9810A4">
                                    <enum>(II)</enum>
 <text>to liquidate any loan undertaken or other debt incurred to cover a shortfall in fees assessed for the current calendar year and any preceding calendar year.</text>
                                </subclause>
                            </clause>

                                <enum>(ii)</enum>
                                <header>Basis of calculation</header>
 <text>The amounts calculated under clause (i) shall be based on the annual breed-specific budget of the RHSO for the breed in that State for the following year as approved by the Board after taking into account—</text>
                                <subclause id="HD8FC1D8742CE49FE8571271801EC71E7">
                                    <enum>(I)</enum>
 <text>the projected number of racing starts for the year separately for each breed in that State; and</text>
                                </subclause>
                                <subclause id="H998A285E6FF540B285B50E240E36315D">
                                    <enum>(II)</enum>
 <text>any other sources of RHSO income.</text> </subclause> </clause> </subparagraph> <subparagraph id="HAB4D24A88A0B45DF8DD7BA518C2820B1"> <enum>(C)</enum> <header>State racing commission assessment</header> <clause id="H5742F3BEA95B4937ACFCE84371F5119D"> <enum>(i)</enum> <header>Sources</header> <text display-inline="yes-display-inline">A State may fund the amount required under subparagraph (B)(i) from a variety of sources, including foal registration fees, sales contributions, starter fees, track fees, and other fees on covered persons. </text>
                            </clause>

                                <enum>(ii)</enum>
                                <header>Breed-specific assessments</header>
                                <subclause commented="no" display-inline="no-display-inline"

 <text display-inline="yes-display-inline">In assessing fees to meet the requirement under subparagraph (B), a State racing commission shall assess fees on a breed-specific basis, for the Standardbred, Thoroughbred, and the Quarter Horse industries operating within that State.</text>
                                </subclause>
                                <subclause commented="no" display-inline="no-display-inline"

                                    <header>Elements</header>
 <text display-inline="yes-display-inline">Each assessment under subclause (I) shall be specifically earmarked for the development, refinement, and maintenance of—</text>

 <text display-inline="yes-display-inline">horseracing scientific medication control rules consistent with subsection (c)(1) that are specific and limited to the unique performance model and developed safety protocols for each breed; and</text>

                                    <item id="H99A2B1DA4876413F8CF9DDD59B5FFA9E">
                                        <enum>(bb)</enum>
 <text display-inline="yes-display-inline">racetrack safety rules consistent with subsection (c)(2) that are specific and limited to the unique performance model and developed safety protocols for each breed.</text>
                                    </item>
                                </subclause>
                            </clause>
                            <clause id="H09C12E2461AD471CB48BC27E224568BE">
                                <enum>(iii)</enum>
                                <header>No commingling</header>
 <text>A State racing commission of a member State shall ensure that funds assessed by the member State for a single breed of covered horses shall not be commingled for the use or subsidy of any other breed of covered horses. </text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="H50970C1440314AB786509EE33034720C">
                            <enum>(D)</enum>
                            <header>Three-fourths majority vote required for rate increases</header>
 <text display-inline="yes-display-inline">In the case of a proposed increase in the amount required under subparagraph (B)(i) that exceeds 5 percent, such increase shall only become effective if the increase is approved by a vote of not less than a three-fourths majority of the Board.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HFE0077DAA32442F59E5D7A1236BCF8A4">
                        <enum>(3)</enum>
                        <header>Borrowing</header>
 <text display-inline="yes-display-inline">The RHSO may incur debt to carry out the duties of the RHSO but may not accept loans from any covered person or equine industry representative. </text>
                    </paragraph>
                </subsection>

                    <enum>(e)</enum>
                    <header>Testing laboratories</header>
                    <paragraph commented="no" id="H2C31A25E6D52405886DF8E5AB442E77F">
                        <enum>(1)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">The RHSO shall review existing rules relating to laboratory accreditation and testing standards issued by the State racing commissions and the National Veterinary Services Laboratories of the Animal and Plant Health Inspection Service of the Department of Agriculture. </text>
                    </paragraph>
                    <paragraph commented="no" id="HD07F96F9FB4547279E3C598677E2FB28">
                        <enum>(2)</enum>
                        <header>Administration</header>

 <text>The RHSO shall select an accreditation body to conduct the accreditation of laboratories and the audits of laboratories so accredited to ensure compliance with rules issued under subsection (c)(1).</text>
                        </subparagraph>
                        <subparagraph commented="no" id="H8F2B418AD0864DD9AF340D36FAD6B29B">
                            <enum>(B)</enum>
                            <header>Authority</header>
 <text>The accreditation body selected under subparagraph (A) shall have the authority to require specific test samples to be directed to, and tested by, laboratories with special expertise in the required tests.</text>
                        </subparagraph>
                        <subparagraph id="H8BA6C2FB9B2D409997C3C78F2700C355">
                            <enum>(C)</enum>
                            <header>Condition of accreditation</header>
 <text>The accreditation body so selected shall ensure that each laboratory seeking accreditation to conduct testing of covered horses has a relationship with a national laboratory, such as the National Veterinary Services Laboratories of the Animal and Plant Health Inspection Service.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph commented="no" id="H5FAFA4FE5CCE43A2815310C12569D17C">
                        <enum>(3)</enum>
                        <header>Selection of laboratories</header>
                        <subparagraph commented="no" id="H5CB802617C07475F8C6BB03D93AA28CA">
                            <enum>(A)</enum>
                            <header>In general</header>
 <text display-inline="yes-display-inline">A State racing commission may select, for purposes of testing samples from covered horses racing in covered horseraces in the State concerned, a laboratory accredited by the accreditation body selected under paragraph (2).</text>
                        </subparagraph>

                            <enum>(B)</enum>
                            <header>Selection by the RHSO</header>
 <text display-inline="yes-display-inline">If a State racing commission selects a laboratory that is not accredited by the accreditation body selected under paragraph (2), the RHSO shall select a laboratory accredited by the accreditation body selected under paragraph (2) to test samples taken in that State.</text>
                        </subparagraph>
                    </paragraph>
                </subsection>

                <header>Role of States and State racing commissions</header>

                        <enum>(1)</enum>
                        <header>State election To enforce</header>
 <text>A State racing commission may elect to exercise enforcement authority with respect to the rules issued under paragraphs (1) and (2) of section 101(c) within the State concerned.</text>
                    </paragraph>
                    <paragraph id="H3B51011780D542DE889994A8120EACD0">
                        <enum>(2)</enum>
                        <header>RHSO rules</header>
 <text display-inline="yes-display-inline">If a State racing commission does not make the election described in paragraph (1), the RHSO shall enforce the rules issued under paragraphs (1) and (2) of section 101(c) within the State, pursuant to a memorandum of understanding entered into with the RHSO.</text>
                    </paragraph>
                </subsection>
                <subsection id="HF833D29799E24AF48EC0F3162674E4F3">
                    <enum>(b)</enum>
                    <header>Preemption</header>
 <text display-inline="yes-display-inline">The rules of the RHSO promulgated in accordance with this Act shall preempt any provision of State law or regulation of member States with respect to matters within the jurisdiction of the RHSO.</text>
                </subsection>
                <subsection id="H2DDC0C0FC8CE485483EF640A926C7D60">
                    <enum>(c)</enum>
                    <header>Unfair or deceptive acts or practices</header>
 <text> Each member State shall, as a condition of being a member of the interstate compact, have in effect a statute that treats as an unfair or deceptive act or practice the sale of a covered horse, or of any other horse in anticipation of its future participation in a covered race, if the seller—</text>
                    <paragraph id="H8E97F4CC829147E6961D281401D633E7">
                        <enum>(1)</enum>
 <text>knows or has reason to know the horse has been administered—</text> <subparagraph id="H69930207103F4530A81D5AE8773C43BC"> <enum>(A)</enum> <text>a bisphosphonate prior to the horse’s fourth birthday; or</text>
                        </subparagraph>
                        <subparagraph id="H33B6E3950CEB47D798571FD1955E8B0F">
                            <enum>(B)</enum>
 <text>any other substance or method the RHSO determines has a long-term degrading effect on the soundness of the covered horse; and</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HA25460C2C2364FCF8C0765FD643826AA">
                        <enum>(2)</enum>
 <text>fails to disclose to the buyer the administration of the bisphosphonate or other such substance or method.</text>
                    </paragraph>
                </subsection>

                    <enum>(d)</enum>
                    <header>Membership</header>

                        <enum>(1)</enum>
                        <header>Composition</header>
 <text>Each scientific medication control committee shall be composed of 7 members, as follows: </text>

                            <enum>(A)</enum>
                            <header>Regulatory members</header>
 <text display-inline="yes-display-inline">Three members of each scientific medication control committee shall be appointed—</text>

                                <enum>(i)</enum>
 <text>by the Board from within the equine industry; and</text> </clause> <clause id="HCADD33BCE0A94A0AB10AC160A6E01EF7"> <enum>(ii)</enum> <text>based on their knowledge of equine exercise physiology, forensic toxicology, or equine pharmacology.</text>
                            </clause>
                        </subparagraph>

                            <enum>(B)</enum>
                            <header>Industry members</header>
 <text>Four members of each scientific medication control committee shall be appointed as follows:</text>

 <text>For the Standardbred Racing Scientific Medication Control Committee, such appointments shall be made by the United States Trotting Association.</text>
                            </clause>

 <text display-inline="yes-display-inline">For the Quarter Horse Racing Scientific Medication Control Committee, such appointments shall be made by the American Quarter Horse Association.</text>
                            </clause>

                                <enum>(iii)</enum>
 <text display-inline="yes-display-inline">For the Thoroughbred Racing Scientific Medication Control Committee, such appointments shall be made by the National Horsemen’s Benevolent and Protective Association.</text>
                            </clause>
                        </subparagraph>
                    </paragraph>

                        <enum>(2)</enum>
                        <header>Qualifications</header>
                        <subparagraph commented="no" display-inline="no-display-inline"

                            <header>In general</header>
 <text display-inline="yes-display-inline">The members of a scientific medication control committee appointed under paragraph (1)(B) shall—</text>

 <text display-inline="yes-display-inline">have significant, recent experience in medication control or toxicology research; and</text>

                                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">hold a doctorate of philosophy or equivalent degree.</text>

                            <header>Additional qualifications</header>

 <text>at least 1 member shall be a mathematician or statistician with experience in threshold determination;</text>

                            <header>Initial term</header>
 <text display-inline="yes-display-inline">For purposes of staggering the terms of appointment, the members first appointed under paragraph (1)(A) shall serve an initial term of 4 years.</text>
                        </subparagraph>

                            <enum>(C)</enum>
                            <header>Limitation</header>
 <text>No member of a scientific medication control committee may serve as a member on more than 2 scientific medication control committees.</text>
                        </subparagraph>

                            <enum>(D)</enum>
                            <header>No term limits</header>
 <text>The term of a member of a scientific medication control committee is renewable for an indefinite number of terms.</text>
                        </subparagraph>
                    </paragraph>

                        <enum>(4)</enum>
                        <header>Chairperson</header>
 <text>The chairperson of each scientific medication control committee shall be elected annually from among the members of the scientific medication control committee by majority vote of the scientific medication control committee.</text>
                    </paragraph>

                        <enum>(5)</enum>
                        <header>Conflicts of interest</header>
 <text display-inline="yes-display-inline">Each member appointed to a scientific medication control committee shall, before the beginning of any meeting of the scientific medication control committee, declare any conflicts of interest directly pertinent to the agenda of such meeting.</text>
                    </paragraph>
                    <paragraph id="H02900DCBBC844BAA8AE7EF98971EB18B">
                        <enum>(6)</enum>
                        <header>Quorum</header>
 <text display-inline="yes-display-inline">In order to consider at a meeting any rule being proposed to the Board, each scientific medication control committee shall have in attendance at such a meeting (either in person or remotely) a majority of the members of the scientific medication control committee.</text>
                    </paragraph>
                </subsection>
                <subsection id="HAD38B87918DD47F39E335EB609446BDD">
                    <enum>(e)</enum>
                    <header>Rules for scientific medical control</header>
                    <paragraph id="HEE45BEDF9ED94618B63A3EAFEC549EAB">
                        <enum>(1)</enum>
                        <header>Adoption of rules</header>
 <text display-inline="yes-display-inline">Not later than 90 days before the consideration of a rule (or a modification to such a rule), each scientific medication control committee shall hold an open meeting at which covered persons or their representatives may provide input.</text>
                    </paragraph>
                    <paragraph id="H216D0868A3924D4DB73429975F46B24C">
                        <enum>(2)</enum>
                        <header>Notice of meeting</header>
 <text display-inline="yes-display-inline"><italic/>Not later than 45 days before the date on which the meeting referred to in paragraph (1) is to be held, the agenda, location, and date of such meeting shall be—</text>
                        <subparagraph id="H9EA4C49476E44E0790CD4370483EF6BD">
                            <enum>(A)</enum>
 <text>posted on the internet website of the RHSO; </text> </subparagraph> <subparagraph id="HC174A793C3A64BD4BAF26A9B2C5DE6A7"> <enum>(B)</enum> <text display-inline="yes-display-inline">submitted to the Racing Medication and Testing Consortium, the Harness Racing Medication Collaborative, and the American Quarter Horse Association Medication Committee; and</text>
                        </subparagraph>
                        <subparagraph id="H080BF8D8821949CE8D59FD1B6DA682E3">
                            <enum>(C)</enum>
 <text>provided to any individual or entity requesting such information.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="H8707AEAC64A74FE993924F0521EF7279">
                        <enum>(3)</enum>
                        <header>Recording of input</header>
 <text>If any input from a covered person (or a representative of a covered person) is provided during a meeting referred to in paragraph (1), or provided in writing, such input shall be transcribed and recorded and made part of the record of the scientific medication control committee concerned.</text>
                    </paragraph>

                        <enum>(4)</enum>
                        <header>Review of medication and threshold rules</header>
                        <subparagraph id="H75D67047BE184E81A9B2C633345B64E5">
                            <enum>(A)</enum>
                            <header>In general</header>
 <text>Each scientific medication control committee shall review—</text> <clause id="H22AF303675C9464FB83927456C9DF5BC"> <enum>(i)</enum> <text>all existing medication and threshold rules <italic/>issued by State racing commissions with respect to covered horses; and</text>
                            </clause>
                            <clause id="HDE0466DEEE374FD2A2A0605EA3CF496D">
                                <enum>(ii)</enum>
 <text>all available research on medication thresholds for covered horses.</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="H41ADE2C2B77148A9A27A68BBB21B8BD9">
                            <enum>(B)</enum>
                            <header>Penalty recommendations</header>
 <text>A scientific medication control committee may revise penalty recommendations with respect to each substance reviewed as part of the medication and threshold review under subparagraph (A).</text>
                        </subparagraph>
                        <subparagraph id="HBC18D62F6800400581269A883CCAFF29">
                            <enum>(C)</enum>
                            <header>Medications</header>
 <text>Each scientific medication control committee shall—</text> <clause id="HDCE0C7B7162641D18FE8354C2AEF9FDE"> <enum>(i)</enum> <text>review the development of any new medication on an ongoing basis to determine whether such medication should be subject to the medication control rules issued pursuant to section 101(c); and</text>
                            </clause>
                            <clause id="HBC2CE1F15F614D828CE953C09ACB774F">
                                <enum>(ii)</enum>
 <text>if the scientific medication control committee determines that such a medication should be subject to such rules, the scientific medication control committee shall develop and submit to the Board for approval proposed modifications to such rules to include such medication.</text>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
            </section>
            <section display-inline="no-display-inline" section-type="subsequent-section"

                <enum>202.</enum>
                <header>Horseracing scientific medication control rules</header>
                <subsection id="HC5CDC7AA91B146D6B9A6558B1D9FF150">
                    <enum>(a)</enum>
                    <header>Applicability</header>
 <text display-inline="yes-display-inline">Scientific medication control rules issued under section 101(c)(1) for each breed of covered horse shall apply to—</text>
                    <paragraph id="H805476DA6FAF437B81F01306183988B9">
                        <enum>(1)</enum>
 <text display-inline="yes-display-inline">covered horseraces, covered persons, and covered horses in member States; and</text>
                    </paragraph>
                    <paragraph id="H1E4D3F7E4ECB46C0AF9CCFE5422742B2">
                        <enum>(2)</enum>
 <text>any covered horse or covered person from a State that is not a member State that seeks to race in a covered horserace in a member State.</text>
                    </paragraph>
                </subsection>
                <subsection id="HDA424EE7D0DF439D8C810A4DC11ACB22">
                    <enum>(b)</enum>
                    <header>Development of proposed rules</header>
                    <paragraph id="H5375DD548A354A9D8D748E41D57955C6">
                        <enum>(1)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">In developing proposed scientific medication control rules with respect to a breed of covered horses, to the extent possible, a scientific medication control committee shall—</text>
                        <subparagraph id="HF59D4F6B1D704C3FA52A3F6532C6E37A">
                            <enum>(A)</enum>
 <text>use scientific methods; </text> </subparagraph> <subparagraph id="H6D58306CB09A4EF2A1033DF1C1867DFC"> <enum>(B)</enum> <text>address all topics set forth in subsection (c); and</text>
                        </subparagraph>
                        <subparagraph id="H26E8CB6FB60643B59E4F276D7A21DBA1">
                            <enum>(C)</enum>
 <text display-inline="yes-display-inline">take into account the unique characteristics and needs of such breed and its racing performance model, including the varying number and nature of races each year for the breed.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HC9AA8BD649444AEA8E757E1F2C8DFAAC">
                        <enum>(2)</enum>
                        <header>Transition</header>
 <text>Until the date on which rules issued by the RHSO pursuant to section 101(c) become effective, the rules of the State concerned shall apply with respect to the administration of medication to covered horses racing in covered horseraces in that State. </text>
                    </paragraph>
                </subsection>
                <subsection id="H41AE49669FF4406986E29E3EAA6ED7ED">
                    <enum>(c)</enum>
                    <header>Elements</header>
 <text>The proposed rules referred to in subsection (b) shall provide—</text> <paragraph id="H1F57046AF71F4C2AB67BF7CB4DD2CCF7"> <enum>(1)</enum> <text>that—</text>
                        <subparagraph commented="no" display-inline="no-display-inline"
                            id="HDFA22ECA10504DE983107608A292D74C">
                            <enum>(A)</enum>
 <text display-inline="yes-display-inline">a covered horse may only compete in a covered horserace if the horse is—</text>
                            <clause commented="no" display-inline="no-display-inline"
                                id="H4626B013FD834E6A9B2512AA3937C7B7">
                                <enum>(i)</enum>
 <text display-inline="yes-display-inline">free from the active pharmacological effect of medications, other foreign substances, and methods that enhance the natural performance of the covered horse; and</text>
                            </clause>
                            <clause commented="no" display-inline="no-display-inline"

                                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">unencumbered by—</text> <subclause commented="no" display-inline="no-display-inline" id="H6AF29735AE1E4563922FDC4B9DFF23AF"> <enum>(I)</enum> <text display-inline="yes-display-inline">foreign substances; and</text>
                                </subclause>
                                <subclause commented="no" display-inline="no-display-inline"

                                    <enum>(II)</enum>
 <text display-inline="yes-display-inline">diseases or conditions; </text>
                                </subclause>
                            </clause>
                        </subparagraph>
                        <subparagraph id="HE9543BB8A1044B6683D4776A6D537231">
                            <enum>(B)</enum>
 <text>a covered horse that is injured or determined by a veterinarian to be unsound may not train or participate in a covered horserace;</text>
                        </subparagraph>
                        <subparagraph id="H2DD8AD131BD94B7DB6901A8BDE2DEA05">
                            <enum>(C)</enum>
 <text>the use of medications, other foreign substances, and treatment methods that mask pain in order to allow an injured or unsound covered horse to train or race in a covered horserace shall be prohibited;</text>
                        </subparagraph>
                        <subparagraph commented="no" display-inline="no-display-inline"
                            id="H630C30F7AE11415883F785E5C4635A17">
                            <enum>(D)</enum>
 <text>with respect to the uniformity of rules, standards, procedures, and protocols regulating medication and treatment methods for covered horses and covered horseraces, such rules, standards, procedures, and protocols—</text>
                            <clause id="H945ED6DADCBB4CA9A1C3CEBD322B866E">
                                <enum>(i)</enum>
 <text>shall be uniform within each breed of covered horse; and</text>
                            </clause>
                            <clause id="HEA0B1C628AEC400485DFD3EFFABF0881">
                                <enum>(ii)</enum>
 <text>shall not be imposed on all 3 breeds unless specifically adopted by the scientific medication control committee for each breed; and</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="H6B8C97AC44FD4F12832E5037F16BEFFE">
                            <enum>(E)</enum>
 <text display-inline="yes-display-inline">breed-specific rules, standards, procedures, and protocols shall include breed-specific permissible thresholds, medication withdrawal guidelines, and other breed-specific concerns with respect to the administration of medication; and</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HFEAD19E2372B496EAD50A5D54FAF36DA">
                        <enum>(2)</enum>
 <text display-inline="yes-display-inline">for—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H59BB41F7D1E54969B6103CF08ABB68CD"> <enum>(A)</enum> <text display-inline="yes-display-inline">the development, in consultation with the State racing commissions and the National Veterinary Services Laboratories of the Animal and Plant Health Inspection Service of the Department of Agriculture, of a list of permitted and prohibited medications, methods, and substances for each breed of covered horse;</text>
                        </subparagraph>
                        <subparagraph id="HDF279BE872E745768EE4DE25406C1770">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">a process for the review by the scientific medication control committee concerned for the administration of any medication to a covered horse during the 24-hour period preceding the next racing start of the covered horse; and</text>
                        </subparagraph>
                        <subparagraph id="H9FC8390131204915815FD2FB338F98EA">
                            <enum>(C)</enum>
 <text display-inline="yes-display-inline">the performance and management of test distribution planning (including intelligence-based testing), the sample collection process, and in-competition and out-of-competition testing (including no-advance-notice testing).</text>
                        </subparagraph>
                    </paragraph>
                </subsection>
            </section>
        </title>

            <enum>III</enum>
            <header>Racetrack safety </header>

                <enum>301.</enum>
                <header>Definition of Committee</header>
 <text display-inline="no-display-inline">In this title, the term <term>Committee</term> means the Racetrack Safety Committee established under section 302.</text>
            </section>

                <header display-inline="yes-display-inline">Racetrack Safety Committee</header>

                    <enum>(a)</enum>
                    <header>In general</header>
 <text>For the purposes of developing, updating, and implementing mandatory horseracing racetrack safety rules for covered horses, covered persons, and covered horseraces under this Act, the RHSO shall establish a Racetrack Safety Committee.</text>
                </subsection>
                <subsection id="H3176C34963AB42F1BF6B914A5EA772B6">
                    <enum>(b)</enum>
                    <header>Duties</header>
 <text display-inline="yes-display-inline">The Committee shall—</text> <paragraph id="H6F2DD4F9C47344B1B05FCA7011B16B8B"> <enum>(1)</enum> <text display-inline="yes-display-inline">draft proposed rules with respect to racetrack safety for each horse breed competing in covered horseraces, in accordance with subsection (d);</text>
                    </paragraph>
                    <paragraph id="HA9C3AA0A4C2C40F187A06933F6558DB3">
                        <enum>(2)</enum>
 <text>recommend such proposed rules to the Board; and</text> </paragraph> <paragraph id="HB40E4EA2E1B74E25830EEBC3AF90CB8E"> <enum>(3)</enum> <text display-inline="yes-display-inline">for purposes of making such recommendations, obtain testimony or other documented comment from racetrack superintendents from each affected breed of covered horses.</text>
                    </paragraph>
                </subsection>

                    <enum>(c)</enum>
                    <header>Membership</header>
                    <paragraph commented="no" display-inline="no-display-inline"

 <text display-inline="yes-display-inline">before accepting appointment as a member of the Committee, disclose any potential conflict of interest; and</text>
                            </clause>

 <text>notify the full Board immediately upon engaging in any activity that the RHSO determines may be perceived as a conflict.</text>
                            </clause>
                        </subparagraph>

                            <enum>(B)</enum>
                            <header>Recusal required</header>
 <text>A member of the Committee shall recuse himself or herself from discussion of any item at a meeting of the Committee if such discussion—</text>

                                <enum>(i)</enum>
 <text>relates to the direct financial interest of any member of the Committee; and</text>
                            </clause>

                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">conviction of a violation of a Federal or State civil or criminal law related to horseracing.</text>
                        </subparagraph>
                    </paragraph>

                        <enum>(8)</enum>
                        <header>Quorum</header>
 <text display-inline="yes-display-inline">In order to consider at a meeting any rule being proposed to the Board, the Committee shall have in attendance at such a meeting (either in person or remotely) a majority of the members of the Committee.</text>

                </subsection>

                    <enum>(d)</enum>
                    <header>Process for adoption of rules</header>

                        <enum>(1)</enum>
                        <header>In general</header>
 <text>Not later than 90 days before the consideration of a proposed rule (or a modification to such a rule), the Committee shall hold an open meeting at which covered persons or their representatives may provide input.</text>
                    </paragraph>

                        <enum>(2)</enum>
                        <header>Notice of meeting</header>
 <text>Not later than 45 days before the date on which the meeting referred to in paragraph (1) is to be held, the agenda, location, and date of such meeting shall be—</text>

 <text>provided to any individual or entity requesting such information.</text>
                        </subparagraph>
                    </paragraph>

                        <header>Recording of input</header>
 <text>If any input from a covered person (or a representative of a covered person) is provided during a meeting referred to in paragraph (1), or provided in writing, such input shall be transcribed and recorded and made part of the record of the Committee.</text>

                <header>Racetrack safety rules</header>
                <subsection id="H67C74F1513EB494982CBA134A2EEF994">
                    <enum>(a)</enum>
                    <header>Applicability</header>
 <text>The racetrack safety rules established pursuant to section 101(c)(2) shall apply with respect to covered horses, covered persons, and covered horseraces.</text>
                </subsection>
                <subsection id="H79803FB63C3E4BA89E9D3B54602891DA">
                    <enum>(b)</enum>
                    <header>Development of proposed rules</header>
 <text>In developing proposed racetrack safety rules, the Committee shall—</text> <paragraph id="HCF03D6A1EE3144F58CC86A7DE81EA877"> <enum>(1)</enum> <text>consult with the State racing commissions; and</text>
                    </paragraph>
                    <paragraph id="HAF4861F1329F4D1994A66E9CF410E278">
                        <enum>(2)</enum>
 <text>take into consideration safety standards in use as of the date of the enactment of this Act, including—</text>
                        <subparagraph id="H230FA952ACAD4E26BF71725F4117E02F">
                            <enum>(A)</enum>
 <text>the National Thoroughbred Racing Association Safety and Integrity Alliance Code of Standards; and</text>
                        </subparagraph>
                        <subparagraph id="HC4FE46274F9544A89EB044061FDF5811">
                            <enum>(B)</enum>
 <text>the Association of Racing Commissioners International Model Rules.</text>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection id="HA76B13C72D344BD1B4DA50EC6644169F">
                    <enum>(c)</enum>
                    <header>Elements</header>
 <text display-inline="yes-display-inline">The proposed rules referred to in subsection (b) shall include the following:</text>
                    <paragraph id="H615E69B513474DF593AE5E82189D848B">
                        <enum>(1)</enum>
 <text>Training and racing safety standards and protocols that—</text> <subparagraph id="HA1436366089F4EAA81D0DC15E6ED90D0"> <enum>(A)</enum> <text>take into account regional differences and the character of different racing facilities that may cause variations based on geographical and environmental differences; </text>
                        </subparagraph>
                        <subparagraph id="HB72150F69EEC4DD68E13FFF1CE7AA3AE">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">are otherwise uniform within each breed of covered horses and unique to the performance model of each such breed;</text>
                        </subparagraph>
                        <subparagraph id="H0603400DDB0841D09CB2DC2EF8E0719A">
                            <enum>(C)</enum>
 <text display-inline="yes-display-inline">are consistent with the humane treatment of covered horses; and</text>
                        </subparagraph>
                        <subparagraph id="HA3F8AC0C5F9947BF8D32B0D8CDECAE96">
                            <enum>(D)</enum>
 <text>may include lists of permitted and prohibited practices, methods, and track surfaces that affect safety.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="H3EE069F147E347CEBEC2D219921394A4">
                        <enum>(2)</enum>
 <text>Track safety standards and protocols, uniform within each breed of covered horses, which may include rules governing—</text>
                        <subparagraph id="HA7533298C4E947B6907638B81606C9D2">
                            <enum>(A)</enum>
 <text>human and equine injury reporting and prevention; and</text> </subparagraph> <subparagraph id="H332BDD59932E4DE0A9C6A17E04521AC5"> <enum>(B)</enum> <text>oversight and movement of covered horses.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph display-inline="no-display-inline"
                        id="H82AF375D74194BA586289059F1C4127E">
                        <enum>(3)</enum>
 <text display-inline="yes-display-inline">With respect to the accreditation by the RHSO of racetracks within each breed of covered horses racing in covered horseraces—</text>
                        <subparagraph id="H62C071E4BBA44D6E86693344A0C25646">
                            <enum>(A)</enum>
 <text>safety, training, and performance standards of such accreditation;</text>
                        </subparagraph>
                        <subparagraph id="HDB11D517FBBB44D48530B41D2CBBF2CB">
                            <enum>(B)</enum>
 <text>the process by which a racetrack within each breed may achieve and maintain such accreditation; and</text>
                        </subparagraph>
                        <subparagraph id="H23581ECB8B6341C59F3A3BFCBFEDA528">
                            <enum>(C)</enum>
 <text>the penalties to be imposed by the RHSO or a State racing commission, as applicable, in the case of a racetrack not complying with such standards.</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HE908118365E1456C93100D82345220CB">
                        <enum>(4)</enum>
 <text display-inline="yes-display-inline">In the case of a racetrack that does not, as of the date on which the rules established pursuant to section 101(c)(2) become effective, meet the standards for accreditation issued pursuant to paragraph (3), a process for the extension of provisional or interim accreditation for a period not to exceed 1 year—</text>
                        <subparagraph id="H7ED054B483714E0FAFD05D4B359FC89A">
                            <enum>(A)</enum>
 <text>to a racetrack accredited by the National Thoroughbred Racing Association Safety and Integrity Alliance; and</text>
                        </subparagraph>
                        <subparagraph id="H3437C44DD7934F41B6E9D8795C05D9E7">
                            <enum>(B)</enum>
 <text>that is—</text> <clause commented="no" display-inline="no-display-inline" id="H42DF6AA62D6E4DA8980653BB6331C904"> <enum>(i)</enum> <text display-inline="yes-display-inline">determined at a meeting that takes place on a date during such 1-year period; and </text>
                            </clause>
                            <clause commented="no" display-inline="no-display-inline"
                                id="HB85A7623350D4B1BB1C0E3AC99B6234A">
                                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">sanctioned by the United States Trotting Association or any entity empowered to perform such function on behalf of the American Quarter Horse Association.</text>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="HC6B8F6A81F6842F28C78E97D521D0B28">
                        <enum>(5)</enum>
 <text>The establishment and process for maintaining a racing surface quality maintenance system that—</text>
                        <subparagraph id="H87E63ACCFB1541A391C887634D678B23">
                            <enum>(A)</enum>
 <text>takes into account regional environmental differences and the character of different racing facilities, including differences among breeds; and</text>
                        </subparagraph>
                        <subparagraph id="H88BCE83DEA4E493E8E117B3B098E1EAE">
                            <enum>(B)</enum>
 <text>may include requirements for—</text> <clause id="H0CFC0E8B78C14BD49FED6345500F2B19"> <enum>(i)</enum> <text>track surface design and consistency; and</text>
                            </clause>
                            <clause id="H3AAA79D704C04D18828BAE85BECC8569">
                                <enum>(ii)</enum>
 <text>standard operating procedures related to track surface monitoring and maintenance, such as standardized seasonal assessment, daily tracking, and measurement.</text>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="H7FA44932C1FB403084F4D58D52E89384">
                        <enum>(6)</enum>
 <text>A process for injury and fatality analysis, which may include—</text> <subparagraph id="H1079091987864778B066857F3CDFEF80"> <enum>(A)</enum> <text>pre-training, post-training, and race inspections;</text>
                        </subparagraph>
                        <subparagraph id="H9FAE5FCC4EBC482FA04FFFF59AB0D737">
                            <enum>(B)</enum>
 <text>use of a veterinarian’s list or a steward’s list that meet standards specified under section 101(c)(11); and</text>
                        </subparagraph>
                        <subparagraph id="H39F4C617FD3A4DBE9247BCD31ACBA9E3">
                            <enum>(C)</enum>
 <text>jockey, exercise rider, and driver concussion protocols.</text> </subparagraph> </paragraph> <paragraph id="HC35A9034DC604C489D49F4C03C72E88E"> <enum>(7)</enum> <text>Requirements relating to the conduct of safety and performance research.</text>
                    </paragraph>
                    <paragraph id="H0F3D98C5035B4674A61977E1F7960F3A">
                        <enum>(8)</enum>
 <text>Rules relating to the establishment of educational programs.</text> </paragraph> </subsection> </section> </title> <title id="H5AD71110000E46E8B82B0215D1936D98"> <enum>IV</enum> <header>Rule violations</header> <section commented="no" id="H03CC00B5327E49C1900B769E1E969A19"> <enum>401.</enum> <header>Prohibited acts</header> <text display-inline="no-display-inline"><italic/> In enforcing the rules issued under section 101(c), the Board shall prohibit the following:</text>

                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">Certain nontherapeutic medications and substances, including—</text>

                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">the administration to a covered horse of such a medication or substance;</text>
                    </subparagraph>
                    <subparagraph id="HFD7C9A2673F742BA97E39F36C560226D">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">the presence of such a medication or substance in a blood, urine, or hair sample of a covered horse;</text>
                    </subparagraph>
                    <subparagraph id="HDE8F31039CEE496CAE3B8236F2E52634">
                        <enum>(C)</enum>
 <text display-inline="yes-display-inline">the use or attempted use of such a medication or substance on a covered horse;</text>
                    </subparagraph>
                    <subparagraph id="H593447EEF6514D76B767B4FB5888A372">
                        <enum>(D)</enum>
 <text display-inline="yes-display-inline">possession or attempted possession of such a medication or substance;</text>
                    </subparagraph>
                    <subparagraph id="HDAF43CA6E72549EB8B0C4DF27E987357">
                        <enum>(E)</enum>
 <text display-inline="yes-display-inline">trafficking or attempted trafficking in any such medication or substance; and</text>
                    </subparagraph>
                    <subparagraph id="H5791EE8D5F9646A59A573F123C5A26DF">
                        <enum>(F)</enum>
 <text display-inline="yes-display-inline">manufacturing, producing, or formulating such a medication or substance.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="HE2EF8F524F0640B6B1E070D62419AEF4">
                    <enum>(2)</enum>
 <text>Certain therapeutic medications and substances in quantitative amounts that exceed the irrelevant concentration present in a covered horse during a prohibited timeframe before or after the covered horse races in a covered horserace, including—</text>
                    <subparagraph commented="no" id="HA482CB08679D48AA9F902A7C11A2D428">
                        <enum>(A)</enum>
 <text>the administration to a covered horse of such a medication or substance;</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H02D93527057C4F42B148F47E5EC35F21">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">the presence of such a medication or substance in a blood, urine, or hair sample of a covered horse; and</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H930C8D6A28F245698E4FECBABFC744F7">
                        <enum>(C)</enum>
 <text display-inline="yes-display-inline">the use or attempted use of such a medication or substance on a covered horse;</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" id="H332A75D8BB2D413E93BCAD2BA2346122">
                    <enum>(3)</enum>
 <text>Refusal or failure—</text> <subparagraph id="HC9CE29A335704C7986C2B95498A05E0D"> <enum>(A)</enum> <text display-inline="yes-display-inline">without compelling justification, to submit a covered horse for collection of a blood, urine, or hair sample;</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H385991E23F00477A93AEA459EE87DDD5">
                        <enum>(B)</enum>
 <text>to cooperate with the RHSO, a State racing commission, or an agent thereof during any investigation;</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H4E8299C26073446FAA312BBFC8482D2D">
                        <enum>(C)</enum>
 <text>of a covered person to respond truthfully, to the best of the person’s knowledge, to a question of the RHSO, a State racing commission, or an agent thereof with respect to any matter under the jurisdiction of such entity; and</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H552FC24210BF41539A4DEAACA07D4471">
                        <enum>(D)</enum>
 <text>in the case of a racetrack, to be in compliance with track safety standards.</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" id="HB94B8D2C4B5D4574BE93169D790E45D6">
                    <enum>(4)</enum>
 <text>Tampering or attempted tampering with the application of the rules issued or process adopted by the RHSO under section 101(c), including—</text>
                    <subparagraph commented="no" id="H6993BA88E1EE4D7BA07505C4E8447B11">
                        <enum>(A)</enum>
 <text>the intentional interference, or an attempt to interfere, with the RHSO, a State racing commission, or an agent thereof;</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H3015192A662147E09A1AF1DA2BA9DF24">
                        <enum>(B)</enum>
 <text>the procurement or the provision of fraudulent information to the RHSO, a State racing commission, or an agent thereof; and</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H21EF661C47FB4BA6B936486539EAB009">
                        <enum>(C)</enum>
 <text>the intimidation of, or an attempt to intimidate, a potential witness.</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" id="H9E14C32DD6A3472AB5856FFE697D8AF2">
                    <enum>(5)</enum>
 <text>Assisting, encouraging, aiding, abetting, conspiring, covering up, or any other type of intentional complicity involving a violation of a rule issued under section 101(c) or the violation of a period of suspension or eligibility imposed on a covered person, covered horse, or covered horserace.</text>
                </paragraph>
                <paragraph commented="no" id="HB48C59D5BE7841C588CBE7A07D39ED60">
                    <enum>(6)</enum>
 <text>Threatening or seeking to intimidate a person with the intent of discouraging the person from the good faith reporting to the RHSO, a State racing commission, or an agent thereof, of information that relates to—</text>
                    <subparagraph commented="no" id="H7C3DCA8686AA49C595F1A888CF9F31FC">
                        <enum>(A)</enum>
 <text>an alleged violation of a rule issued by the RHSO under section 101(c); or</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H56E834F5829A446FBC4DAF4392989C2C">
                        <enum>(B)</enum>
 <text>alleged noncompliance with such a rule.</text> </subparagraph> </paragraph> </section> <section commented="no" id="HDD89564384274114AEEC9F90E7F24D8B"> <enum>402.</enum> <header>Results management and disciplinary process</header> <subsection id="H4CA0E7152A3F482C9A362FAA257B0B18"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">The Board shall issue rules with respect to the disciplinary process for safety, performance, and scientific medication control rule violations, which may include the existing Model Rules of the Association of Racing Commissioners International.</text>
                </subsection>
                <subsection commented="no" id="HDB91FD8C8DA948639F75AB71178EDEBB">
                    <enum>(b)</enum>
                    <header>Elements</header>
 <text>The rules and processes issued under subsection (a) shall include the following:</text>
                    <paragraph commented="no" id="H024EF12AA65F42018256AE957D26D735">
                        <enum>(1)</enum>
 <text>The undertaking of investigations at racetrack and nonracetrack facilities related to safety violations. In performing investigations, the RHSO and State racing commissions shall seek assistance as needed.</text>
                    </paragraph>
                    <paragraph commented="no" id="H7900C67655C54FA48B8732F7226AD60D">
                        <enum>(2)</enum>
 <text>Procedures for—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H3B0EEEE5F6684F85998C5EBD43EE78FD"> <enum>(A)</enum> <text display-inline="yes-display-inline">investigating, charging, and adjudicating violations; and</text>
                        </subparagraph>
                        <subparagraph commented="no" display-inline="no-display-inline"
                            id="HF8BA5BD00E854EB5AE125E947C2323EF">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">the enforcement of administrative sanctions.</text>
                        </subparagraph>
                    </paragraph>

 <text display-inline="yes-display-inline">impartial hearing officers or tribunals commensurate with the seriousness of the alleged safety, performance, or scientific medication control rule violation and the possible civil sanctions for such violation; </text>
                    </paragraph>
                    <paragraph commented="no" display-inline="no-display-inline"
                        id="H0F0B4A101AF84213A8E45281649F6969">
                        <enum>(2)</enum>
 <text display-inline="yes-display-inline">the right to counsel, to confront witnesses, and to have a transcribed record of the proceedings; and</text>
                    </paragraph>
                    <paragraph commented="no" display-inline="no-display-inline"

                        <enum>(3)</enum>
 <text display-inline="yes-display-inline">the right to have a decision rendered not later than 60 days after the date on which the hearing closes.</text>
                    </paragraph>
                </subsection>
            </section>

                <enum>403.</enum>
                <header>Administrative sanctions</header>
                <subsection commented="no" id="H57E2A781D650439590EF11F798BDF8CE">
                    <enum>(a)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">The Board shall—</text> <paragraph id="HCB35EC0834CE463B99AA8D5EFC970C6D"> <enum>(1)</enum> <text>review existing Model Rules of the Association of Racing Commissioners International applicable to a specific breed that impose administrative sanctions against covered persons or covered horses for safety, performance, and medication control rule violations; and</text>
                    </paragraph>
                    <paragraph id="H297CBDA0E96948ADBEBE383980344A7D">
                        <enum>(2)</enum>
 <text display-inline="yes-display-inline">subject to subsection (b), issue and update rules relating to administrative sanctions referred to in paragraph (1). </text>
                    </paragraph>
                </subsection>

                    <enum>(b)</enum>
                    <header>Requirements</header>
 <text>The rules issued and updated under subsection (a)(2) shall—</text> <paragraph commented="no" id="H40059AD4833640EF8E2A2CF8FE9D5201"> <enum>(1)</enum> <text>take into account the unique aspects of horseracing;</text>
                    </paragraph>
                    <paragraph commented="no" id="H9D07C233549049BE9B13541AB8583CB7">
                        <enum>(2)</enum>
 <text>be designed to ensure fair and transparent horseraces; and</text> </paragraph> <paragraph commented="no" id="H58CE06215DF341B7BB6227C4A96EB02C"> <enum>(3)</enum> <text>deter safety, performance, and scientific medication control rule violations.</text>
                    </paragraph>
                </subsection>
                <subsection commented="no" id="HBBD794DB52114C98BC47EA8B2140F76A">
                    <enum>(c)</enum>
                    <header>Severity</header>
 <text display-inline="yes-display-inline">Administrative sanctions imposed pursuant to the rules issued and updated under subsection (a)(2) may include—</text>
                    <paragraph commented="no" id="H1850D46751374618B01449C19B4F11D7">
                        <enum>(1)</enum>
 <text>lifetime bans from horseracing, disgorgement of purses, monetary fines and penalties, and changes to the order of finish in covered races; and</text>
                    </paragraph>
                    <paragraph commented="no" id="H86D39D53BF23415C93D9C1A013692C1B">
                        <enum>(2)</enum>
 <text>with respect to scientific medication control rule violators, an opportunity to reduce the applicable administrative sanctions that is comparable to the opportunity provided by the existing Model Rules of the Association of Racing Commissioners International.</text>
                    </paragraph>

                <enum>501.</enum>
                <header>Effective dates</header>
                <subsection id="H3E1C8312CA4249D2A336E23F43A36A60">
                    <enum>(a)</enum>
                    <header>RHSO</header>
 <text>Except as provided in subsections (b) and (c), the provisions of this Act shall take effect on the later of—</text>
                    <paragraph id="HD8BBBEA3C55948E69C4E67912A828156">
                        <enum>(1)</enum>
 <text display-inline="yes-display-inline">the date that is 2 years after the date of the enactment of this Act; or </text>
                    </paragraph>
                    <paragraph id="H13274F20C44B40DBA462B5DB09F29107">
                        <enum>(2)</enum>
 <text display-inline="yes-display-inline">the date on which 2 or more States have entered into the interstate compact pursuant to section 4.</text>
                    </paragraph>
                </subsection>
                <subsection id="HCB0B9880553742FFB5F35E5F34D7C128">
                    <enum>(b)</enum>
                    <header>Exceptions</header>
 <text>Subsections (c), (d), and (e) of section 101, and titles II, III, and IV of this Act shall take effect 90 days after the date described in subsection (a). </text>
                </subsection>
                <subsection id="H6E02D3434F2C45D5AA85DC7FEC61D3CE">
                    <enum>(c)</enum>
                    <header>Immediate upon enactment</header>
 <text display-inline="yes-display-inline">Sections 1, 2, and 3 and subsections (a) and (b) of section 4 shall take effect immediately upon the date of the enactment of this Act. </text>
