Limitation on nonstatutory Federal mandates imposed on entities seeking Federal funds.</toc-entry> </toc></subsection></section><section id="id2A5B50F7A638460CBBA69BB707DBB527"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id9E0FEC975553441597B5FFF33E77AB37" commented="no"><enum>(1)</enum><text>the efforts of the Federal Government to support the domestic semiconductor industry and increase our science, technology, engineering, and mathematics (referred to in this Act as <quote>STEM</quote>) workforce capacity is imperative for the United States to remain technologically competitive;</text></paragraph><paragraph id="idA5736F8D5B2146FE9E63433663344113" commented="no"><enum>(2)</enum><text>such efforts should prioritize speed and leverage all relevant STEM talent in the United States, without regard to race, color, ethnicity, sex, or sexual orientation;</text></paragraph><paragraph id="id649ADC0674B24854BECB339CEC978D4A" commented="no"><enum>(3)</enum><text>programs, initiatives, and other activities related to diversity, equity, and inclusion (referred to in this Act as <quote>DEI</quote>) allow preferential treatment based on the characteristics described in paragraph (2);</text></paragraph><paragraph id="id183E6240B6BF4F5B87BE2F534BED4D7D" commented="no"><enum>(4)</enum><text>these activities are discriminatory and divisive, and deviate away from the main objectives and priorities, actively adding more bureaucracy and neglecting to provide equal opportunity to all STEM workers and students; and</text></paragraph><paragraph id="id4E42FD87EFA7457AB66DD759C0C02A5D" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>repealing or amending programs and requirements related to DEI that were passed into law as part of the CHIPS Act of 2002 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>; 136 Stat. 1372) and the Research and Development, Competition, and Innovation Act (division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>; 136 Stat. 1399) (commonly known, collectively, as the <quote>CHIPS and Science Act</quote>) will restore the original intention.</text></paragraph></section><title id="id1d36a148663a4b49bfb6bf81e40e36f4" style="OLC"><enum>I</enum><header>Repeals and modifications</header><section id="idb250c923e7104c1fbc3779e664312bb2"><enum>101.</enum><header>Repeal of certain requirements relating to opportunity and inclusion</header><text display-inline="no-display-inline">The CHIPS Act of 2022 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>; 136 Stat. 1372) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idfcf73abc4a5845409fc601c08c5c21fb"><enum>(1)</enum><text>by striking section 104 (<external-xref legal-doc="usc" parsable-cite="usc/15/4652">15 U.S.C. 4652</external-xref> note); and</text></paragraph><paragraph id="id90b05092e0ae4b7a835cb4ab8cdc8c1b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by redesignating sections 105, 106, and 107, as sections 104, 105, and 106, respectively.</text></paragraph></section><section id="id875093f12be443e7a9dd000d3134cc4d"><enum>102.</enum><header>Repeal of redundant scientific collaboration programs</header><subsection commented="no" display-inline="no-display-inline" id="id8a9571c444824f99892f6b0fa80a9541"><enum>(a)</enum><header>Repeals</header><paragraph commented="no" display-inline="no-display-inline" id="idd5b990fceb9c477ebd8d60908cef6a17"><enum>(1)</enum><header display-inline="yes-display-inline">Department of Energy Research and Innovation Act</header><text>Section 312 of the Department of Energy Research and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18650">42 U.S.C. 18650</external-xref>) is repealed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide849c73362fe4bd69823387da0a575d6"><enum>(2)</enum><header>Research and Development. 136 Stat. 1399).</text></subsection></section><section id="id899768cbdde84124b5c00c8492bc8048"><enum>104.</enum><header>Repeal of requirement to recruit STEM educators that advance DEI for National STEM Teacher Corps</header><text display-inline="no-display-inline">Section 10311(c)(6)(B) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18991">42 U.S.C. 18991(c)(6)(B)</external-xref>) is amended by striking <quote>applicants,</quote> and all that follows through the semicolon at the end and inserting <quote>applicants;</quote>.</text></section><section id="id6723c439836d43a3a130107084506231"><enum>105.</enum><header>Repeal of diversity requirements for participation in national network for microelectronics education</header><text display-inline="no-display-inline">Section 10318(b) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18997">42 U.S.C. 18997(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0ef6b8ec84864207b8e7c2c9573de042"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbcac550845964e2ba8d0300cabb5310b"><paragraph commented="no" display-inline="no-display-inline" id="ide422fb84cd8c47bd86983d014da34039"><enum>(5) </enum><header>Partnerships</header><text display-inline="yes-display-inline">The Director shall encourage the submission of proposals that are led by or include partnerships with historically Black colleges and universities, or Tribal Colleges or Universities.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddedd0b40a60a4c908e10d47713293887"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (6); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf20a467a34e649998abb34cf68aaf254"><enum>(2)</enum><text>by redesignating subsections (g) and (h) as subsections (e) and (f), respectively.</text></paragraph></subsection></section><section id="idad510303335346048e789208ebaf4581"><enum>111.</enum><header>Modification of outreach requirement for the Entrepreneurial Fellowship Program</header><text display-inline="no-display-inline">Subsection (c) of section 10392 of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19112">42 U.S.C. 19112(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfed60eeb76494177981b2708873bdfa2"><subsection id="id308f573850a74fa391a32329dcfa7fff"><enum>(c)</enum><header>Outreach</header><text>The Director shall conduct program outreach to recruit fellowship applicants from all regions of the country.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ida3e23b3f004249f2acc6d4ad554384d8"><enum>112.</enum><header>Amendment of requirements for NSF scholarships and fellowships</header><text display-inline="no-display-inline">Section 10393 of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19113">42 U.S.C. 19113</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id81628dbae6d34ab18eead0fb735756b2"><enum>(1)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0e1e5e17191c4d12a475d5baf458f162"><subsection id="id7f4f9e02871f45fc95844a7c9a33b3ac" commented="no"><enum>(b)</enum><header>Implementation</header><paragraph commented="no" display-inline="no-display-inline" id="id6e8b380a9d45427a970a25d1f2e9f050"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Director may carry out subsection (a) by making awards—</text><subparagraph id="idbcc422f34855496c8be166d282c64ff7" commented="no"><enum>(A)</enum><text>directly to students; and</text></subparagraph><subparagraph id="id214e14b862244cf59307c2206e8a9425" commented="no"><enum>(B)</enum><text>to institutions of higher education or consortia of institutions of higher education, including those institutions or consortia involved in operating Regional Innovation Engines established under section 10388.</text></subparagraph></paragraph><paragraph id="id8cce36284537426897de74f32de4d0cb" commented="no"><enum>(2)</enum><header>Addressing gaps</header><text>The Director shall address current and expected gaps in the availability or skills of the STEM workforce and needs of the STEM workforce, including by increasing educational capacity at institutions and prioritizing awards to citizens or lawful permanent residents of the United States and individuals that will grow the domestic workforce. The Director may take steps to—</text><subparagraph id="id78de2b0574264095acb597868b0de897" commented="no"><enum>(A)</enum><text>support traineeships or other relevant programs at historically Black colleges or universities and Tribal Colleges or Universities;</text></subparagraph><subparagraph id="id569ba5965de54446a2c4a7b52f5ae4a9" commented="no"><enum>(B)</enum><text>enable low-income populations to pursue associate, undergraduate, or graduate degrees in STEM; and</text></subparagraph><subparagraph id="idcf28038ae0ff4baeb4e9dbce217ea34b" commented="no"><enum>(C)</enum><text>address geographic diversity in the STEM workforce.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8cd008ef381a4b3fbae7d044f2e0433e"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (c);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b99667054d640488e475fbdaeeca6bf"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) through (g) as subsections (c) through (f), respectively;           <header>Limitation</header>
 <text>The head of an agency may not impose on an entity seeking Federal funding from the agency a nonstatutory mandate to have in effect any of the following policies:</text>

 <text>Policies for a workforce plan or a commitment to include plans to hire, train, and retain a diverse workforce, including economically disadvantaged individuals.</text>

            <enum>(3)</enum>
