and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b5f889f64ba46698b9f33d4206a8ae6"><enum>(5)</enum><text display-inline="yes-display-inline">in section 63(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/22/2796b">22 U.S.C. 2796b(a)(2)</external-xref>), in the matter preceding subparagraph (A), by striking <quote>or New Zealand</quote> and inserting <quote>New Zealand, or Taiwan</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id874f8387a55c4f8da369b3f2cc4f945c" changed="deleted" reported-display-style="strikethrough" committee-id="SSFR00"><enum>3.</enum><header>Expedited licensing for allies transferring military equipment to Taiwan</header><subsection commented="no" display-inline="no-display-inline" id="id082261e674e6446b9cfac1945bbe92ec"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall establish an expedited decision-making process for blanket third party transfers of defense articles and services from North Atlantic Treaty Organization member countries, Japan, Australia, the Republic of Korea, Israel, or New Zealand to Taiwan, including transfers and re-transfers of United States origin grant, Foreign Military Sales, and Direct Commercial Sales end-items not covered by an exemption under the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddc96e07a19db42359f6a19b834645146"><enum>(b)</enum><header display-inline="yes-display-inline">Availability</header><text>The expedited decision-making process described in subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="id9d8bca7324ca4ee2a2ae6f03f877195b"><enum>(1)</enum><text display-inline="yes-display-inline">shall be available for classified and unclassified items; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idceb4eaf406bb421f86fcd222cbc727ba"><enum>(2)</enum><text display-inline="yes-display-inline">shall, to the extent practicable—</text><subparagraph id="id2b4426af50f0458cbeb5ab9abb5ff9fc"><enum>(A)</enum><text>require the approval, return, or denial of any licensing application to export defense articles and services that is related to a government-to-government agreement within 15 days after the submission of such application; and</text></subparagraph><subparagraph id="id3f2ff862b8a64004b23af95766c9846d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>require the completion of the review of all other licensing requests not later than 30 days after the submission of such application.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4ddd6c84b8e2403a90ecc2a0fc80c71c"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date on which the expedited decision-making process under subsection (a) is established, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on the implementation and effectiveness of such process, including an assessment of the actions taken to coordinate with North Atlantic Treaty Organization member countries, Japan, Australia, the Republic of Korea, Israel, and New Zealand to ensure alignment with the respective export control regulations of such countries.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id293e7a88-0e2a-401b-bdc0-b811b8c19083" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Our Regional Companions Upgraded Protection in Nefarious Environments Act</short-title></quote> or <quote><short-title>PORCUPINE Act</short-title></quote>.</text></section><section id="id0f0c447b573f4978ba3f1436640f0494" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>2.</enum><header>Modification of certification and reporting requirements under the Arms Export Control Act</header><subsection id="idb889e2744f0040a3a72cc40e3f50b552"><enum>(a)</enum><header>In general</header><text>The Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>) is amended—</text><paragraph id="id136e51863a9244f991a0260e37fd7a24"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>)—</text><subparagraph id="idfa6747a93be84caabba4a299c2a87036"><enum>(A)</enum><text>in subsection (b)(2), by inserting <quote>Taiwan,</quote> before <quote>or the</quote>; and</text></paragraph><paragraph id="id5b4f7dda621943df9c656351af6455fb"><enum>(5)</enum><text>in section 63(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/22/2796b">22 U.S.C. 2796b(a)(2)</external-xref>), in the matter preceding subparagraph (A), by striking <quote>or New Zealand</quote> and inserting <quote>New Zealand, or Taiwan</quote>.</text></paragraph></subsection><subsection id="idbb5e719d603b471a9b5f0f669ac217ef"><enum>(b)</enum><header>Report</header><text>Not later than two years after the date of the enactment of this section, and every two years thereafter, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on the implementation and effectiveness of the amendments made by this section.</text></subsection></section><section id="ide29d58d5a3434bd29150533743686c74" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>3.</enum><header>Feasibility assessment of expedited licensing for allies transferring military equipment to Taiwan</header><subsection id="id25849219596d49b3994115eb0fb94d78"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall conduct an assessment of the feasibility of establishing an expedited decision-making process for third party transfers of defense articles and services from North Atlantic Treaty Organization member countries, Japan, Australia, the Republic of Korea, New Zealand, or Israel to Taiwan, including transfers and re-transfers of United States-origin grant, Foreign Military Sales, and Direct Commercial Sales end-items not covered by an exemption under the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations.</text></subsection><subsection id="id3bf441f5f34c4154a1242b0df743c32c"><enum>(b)</enum><header>Elements</header><text>The assessment required by subsection (a) shall include an assessment of the following:</text><paragraph id="id5e302115f78a4af8b2f5a281a1a3bcc4"><enum>(1)</enum><text>The availability of such an expedited decision-making process for classified and unclassified items.</text></paragraph><paragraph id="id1d78885d54274ca08f0fb16861e008d5"><enum>(2)</enum><text>The feasibility of requiring—</text><subparagraph id="id797d6ff2284b4576887615c6cddb4e07"><enum>(A)</enum><text>the approval, return, or denial of any licensing application to export defense articles and services that is related to a government-to-government agreement within 15 days after the submission of such application; and</text></subparagraph><subparagraph id="ide45c63ef0a9140fb85c1fbefd2f30f7e"><enum>(B)</enum><text>the completion of the review of all other licensing requests not later than 30 days after the submission of such application.</text></subparagraph></paragraph></subsection><subsection id="id2076467c8904451a8f4f0eecd39c9e48" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Briefing</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall provide the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives with a briefing on the outcome of the assessment required by subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idfe12eb4ef72549e2882c8749310b97d0" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>4.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to alter the policy of the United States toward Taiwan as specified in the Taiwan Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/22/3301">22 U.S.C. 3301 et seq.</external-xref>).</text></section><section id="ida41252a1468c4b46b869116d2ca990fe" changed="added" reported-display-style="italic" committee-id="SSFR00"><enum>5.</enum><header>Sunset</header><text display-inline="no-display-inline">This Act shall cease to have effect on the date that is 7 years after the date of the enactment of this Act.</text></section></legis-body><endorsement><action-date date="20251030">October 30, 2025</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
