which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Arms Export Control Act to include Taiwan among the list of recipient countries with respect to which shorter certification and reporting periods apply and to expedite licensing for allies transferring military equipment to Taiwan, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Our Regional Companions Upgraded Protection in Nefarious Environments Act</short-title></quote> or <quote><short-title>PORCUPINE Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id07864b7addc54ca19fa798865bd9e840"><enum>2.</enum><header display-inline="yes-display-inline">Modification of certification and reporting requirements under the Arms Export Control Act</header><text display-inline="no-display-inline">The Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id978709e567374813b2d54e98d00bec79"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida99ae5a5b37d40dbbd9f8b618d565f7f"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by inserting <quote>the Government of Taiwan,</quote> before <quote>or the</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida01e55be72e84b2499370e732d2496b5"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><clause commented="no" display-inline="no-display-inline" id="id199351c4c4c6487dbcefe0fd949bf6b8"><enum>(i)</enum><text>in paragraph (2)(B), by striking <quote>or New Zealand</quote> and inserting <quote>New Zealand, or Taiwan</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id566bce04913d4055be69faa008ba27bf"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (3)(A)(i), by striking <quote>or New Zealand</quote> and inserting <quote>New Zealand, or Taiwan</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b5f889f64ba46698b9f33d4206a8ae6"><enum>(5)</enum><text display-inline="yes-display-inline">in section 63(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/22/2796b">22 U.S.C. 2796b(a)(2)</external-xref>), in the matter preceding subparagraph (A), by striking <quote>or New Zealand</quote> and inserting <quote>New Zealand, or Taiwan</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id874f8387a55c4f8da369b3f2cc4f945c"><enum>3.</enum><header>Expedited licensing for allies transferring military equipment to Taiwan</header><subsection commented="no" display-inline="no-display-inline" id="id082261e674e6446b9cfac1945bbe92ec"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall establish an expedited decision-making process for blanket third party transfers of defense articles and services from North Atlantic Treaty Organization member countries, Japan, Australia, the Republic of Korea, Israel, or New Zealand to Taiwan, including transfers and re-transfers of United States origin grant, Foreign Military Sales, and Direct Commercial Sales end-items not covered by an exemption under the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddc96e07a19db42359f6a19b834645146"><enum>(b)</enum><header display-inline="yes-display-inline">Availability</header><text>The expedited decision-making process described in subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="id9d8bca7324ca4ee2a2ae6f03f877195b"><enum>(1)</enum><text display-inline="yes-display-inline">shall be available for classified and unclassified items; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idceb4eaf406bb421f86fcd222cbc727ba"><enum>(2)</enum><text display-inline="yes-display-inline">shall, to the extent practicable—</text><subparagraph id="id2b4426af50f0458cbeb5ab9abb5ff9fc"><enum>(A)</enum><text>require the approval, return, or denial of any licensing application to export defense articles and services that is related to a government-to-government agreement within 15 days after the submission of such application; and</text></subparagraph><subparagraph id="id3f2ff862b8a64004b23af95766c9846d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>require the completion of the review of all other licensing requests not later than 30 days after the submission of such application.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4ddd6c84b8e2403a90ecc2a0fc80c71c"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date on which the expedited decision-making process under subsection (a) is established, the Secretary of State shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on the implementation and effectiveness of such process, including an assessment of the actions taken to coordinate with North Atlantic Treaty Organization member countries, Japan, Australia, the Republic of Korea, Israel, and New Zealand to ensure alignment with the respective export control regulations of such countries.</text></subsection></section></legis-body></bill>
