 Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure transparency with respect to the impact of certain tariffs on the prices of goods, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5EF7825F47B1499FA9CD4355DE990E64"><section id="idb3c31f2e53ec40b08fc4a25d5ce53044" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Tariffs Act</short-title></quote>.</text></section><section id="HE0190F81B6D448C5900658D667D6B8DC"><enum>2.</enum><header>Tariff impact transparency</header><subsection id="H0C443ADD538843CBAA9862F9B600C85D"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Beginning on the date that is 30 days after the date of enactment of this section, subject to subsection (b), no person may sell to a consumer in the United States a good without displaying to such consumer, in a clear and conspicuous manner, the portion of the price of such good that is attributable to a covered tariff, which shall be identified to the consumer as the <quote>tariff surcharge</quote>.</text></subsection><subsection id="H95AE6A4D6A074062A07EC232A39844A3"><enum>(b)</enum><header>Exemption</header><text>The requirements of subsection (a) shall not apply to a sale made by a small business concern (as such term is defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)).</text></subsection><subsection id="H55329962208A43EC9E001D5FCBED6787"><enum>(c)</enum><header>Enforcement by the Commission</header><paragraph id="H8D8C71226AA94C05B4A812AF0E3F1C8F"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="HD19FE9F326BB4D7BA363F20F6F29AC73"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="idc3a6d04e54c245d68616f462485546ba"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall enforce this section and the regulations promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdd197ead2c3426da58c8b8007433c5b"><enum>(B)</enum><header>Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b24cc950f184d43bf7269ed1d2c26b5"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c04ab25d6464851adf0f708e24cc5af"><enum>(D)</enum><header>Rulemaking</header><text>The Commission may promulgate, in accordance with section 553 of title 5, United States Code, such regulations as may be necessary to carry out this section.</text></subparagraph></paragraph></subsection><subsection id="HAE5309AAE45940B983FCA6E3567C595B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H30193AFC6A704D76A7659FA54F0B8B64"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id674b44f317014b2fbc28ba65e06c6814"><enum>(2)</enum><header display-inline="yes-display-inline">Covered tariff</header><text>The term <term>covered tariff</term> means a tariff, including a tariff rate change—</text><subparagraph id="HED28FB10237A4F2391D167B4D05960B8"><enum>(A)</enum><text display-inline="yes-display-inline">imposed on an emergency or other discretionary basis by the President; and</text></subparagraph><subparagraph id="H53922A2776AA40BA857BD89CEAE40397"><enum>(B)</enum><text>that entered into force on or after January 20, 2025.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
