            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Dog Importation Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Importation of live dogs</header>
            <subsection id="H0DB8A21C4434428E885555F1D5B6999A">
                <enum>(a)</enum>
                <header>In general</header>
 <text display-inline="yes-display-inline">The Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8301">7 U.S.C. 8301 et seq.</external-xref>) is amended by inserting after section 10404 (<external-xref legal-doc="usc" parsable-cite="usc/7/8303">7 U.S.C. 8303</external-xref>) the following:</text>

                        <enum>10404A.</enum>
                        <header>Importation of live dogs</header>
                        <subsection id="HAB630F78CE0F4245BBD72D8A64E56D1A">
                            <enum>(a)</enum>
                            <header>Definitions</header>
 <text>In this section:</text> <paragraph id="HEA8E6B5297A4403FBC6EC7C3B8129228"> <enum>(1)</enum> <header>Compensation</header> <text display-inline="yes-display-inline">The term <term>compensation</term> means any act, consideration, or thing of value received by a person directly, including cash or noncash benefits, cost-avoidance, obtaining positive or avoiding negative publicity, an exchange of services, or maintaining a license issued under any local, State, or Federal government authority.</text>
                            </paragraph>
                            <paragraph id="HDF30C1A8B8EE45A2BD8C367D5B7A77FB">
                                <enum>(2)</enum>
                                <header>Import transporter</header>
 <text display-inline="yes-display-inline">The term <term>import transporter</term> means any person or entity that—</text>
                                <subparagraph id="HC018868B8A814AC998D37F283DAD90A5">
                                    <enum>(A)</enum>
 <text>receives an imported dog from any importer, dealer, research facility, exhibitor, operator of an auction sale, or department, agency, or instrumentality of the United States or of any State or local government; and</text>
                                </subparagraph>
                                <subparagraph id="H8B1239F0DF454D1EB6D473FE8A3DBF57">
                                    <enum>(B)</enum>
 <text>receives compensation for moving such dog in commerce.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="HB785F36B730D4E449108DBECFEECCFA1">
                                <enum>(3)</enum>
                                <header>Importer</header>
 <text>The term <term>importer</term> means any person who transports or causes the transportation of a dog into the United States from a foreign country. </text>
                            </paragraph>
                            <paragraph id="H5240C63F82BD4CCDA1E4B86234E130BD">
                                <enum>(4)</enum>
                                <header>Transfer</header>
 <text display-inline="yes-display-inline">The term <term>transfer</term> means a change of ownership or control of an imported dog to another person, including by sale, adoption, exchange, or donation.</text>
                            </paragraph>
                        </subsection>
                        <subsection id="H012A7914B3A94C9EAAF7A11F75E319A3">
                            <enum>(b)</enum>
                            <header>Requirements</header>
                            <paragraph id="H932D29827457496182D2C973C839729C">
                                <enum>(1)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">Except as provided in paragraph (2), no person shall import a dog into the United States unless prior to transport to the United States, the Secretary receives electronic documentation necessary, as determined by the Secretary, to demonstrate that the dog—</text>
                                <subparagraph id="H695EC470F47047CE8CAC44D0B8682200">
                                    <enum>(A)</enum>
 <text>is in good health; </text> </subparagraph> <subparagraph id="H9847F629F74444CE87C96BF062E621AD"> <enum>(B)</enum> <text display-inline="yes-display-inline">has received all necessary vaccinations and internal and external parasite treatment, and demonstrated negative test results, as required by the Secretary and evidenced by a certificate that—</text>
                                    <clause id="H274723AD1D97472293D6088299446C7F">
                                        <enum>(i)</enum>
 <text>is issued by a licensed veterinarian accredited by a competent veterinary authority recognized by the Secretary; and</text>
                                    </clause>
                                    <clause id="HB9D1AA78271B4F878794B541D8B7002D">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">is endorsed by that authority in a manner representing that the veterinarian issuing the certificate was authorized to do so;</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph id="H11FE8882D93A4F4C803E72A8C4AC6DBB">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">is officially identified by a permanent method approved by the Secretary; and</text>
                                </subparagraph>
                                <subparagraph id="H7512DA8591F34574BF4B2F0AD29B6F0F">
                                    <enum>(D)</enum>
 <text>in the case that the dog is intended for transfer—</text> <clause id="HA996530201AB42F7AC040ACDBAECF555"> <enum>(i)</enum> <text>is at least 6 months old; and</text>
                                    </clause>
                                    <clause id="H54F0FD5FCF1540BABDB55ECC9D75F648">
                                        <enum>(ii)</enum>
 <text>is accompanied by an import permit issued by the Secretary under this Act.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="HB8146F44B6B7469583B259D6EE7B571B">
                                <enum>(2)</enum>
                                <header>Exceptions</header>
 <text display-inline="yes-display-inline">The Secretary, by regulation, shall provide an exception to any requirement under this Act in any case in which a dog is imported for purposes of transfer—</text>
                                <subparagraph id="HD820D5BE31B2455997601C906545C74A">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">as a personal pet of United States origin returning to the United States;</text>
                                </subparagraph>
                                <subparagraph id="H84DAB6D1CC7E4B4793325F7B28E2CF35">
                                    <enum>(B) </enum>
 <text display-inline="yes-display-inline">as a United States military working dog or contracted working dog supporting a military mission or tasking; </text>
                                </subparagraph>
                                <subparagraph id="H07BDCE53E66C44FEAF08B1DD838B0D26">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">for research purposes;</text>
                                </subparagraph>
                                <subparagraph id="HEEB6D04903884E5A810A71D04BAB6845">
                                    <enum>(D)</enum>
 <text display-inline="yes-display-inline"> for veterinary treatment which is paid for by the importer, subject to the condition that the dog—</text>
                                    <clause id="H7564B0B2962A489CB808F483C2094572">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">is taken directly to a veterinary facility for treatment with appropriate quarantine until the dog meets the criteria described in paragraph (1); and </text>
                                    </clause>
                                    <clause id="H049077414E0C43AAAE28F7A815062D3C">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">is then exported to its country of origin; or</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph id="H7ACB5D832B8A4E999A6BFABAF03470FD">
                                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">in the case of a dog that is less than 6 months old, for lawful importation into the State of Hawaii from the British Isles, Australia, Guam, or New Zealand in compliance with the regulations of the State of Hawaii and the other requirements of this section, if the dog is not transported out of the State of Hawaii for transfer at less than 6 months of age.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="HBC585F358DF645178FF29407ADCB5ACC">
                            <enum>(c)</enum>
                            <header>Implementation and regulations</header>
 <text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of the <short-title>Healthy Dog Importation Act</short-title>, the Secretary, in consultation with the Secretary of Health and Human Services, the Secretary of Commerce, the Secretary of Homeland Security, and the Secretary of Transportation, shall promulgate such regulations as the Secretary determines necessary to implement and enforce this section, including regulations—</text>
                            <paragraph id="H0092B52654D54DD7A9854E2FE552854F">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">to facilitate electronic submission and interagency sharing of all documentation required prior to the importation of a dog into the United States under subsection (b)(1);</text>
                            </paragraph>
                            <paragraph id="HBA69D7466F1B4809AD33D9CC519170AA">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">to establish any necessary post-arrival verification processes for imported dogs;</text>
                            </paragraph>
                            <paragraph id="H69B4F20DFFDB4AB0AF4054E4B07FC0C8">
                                <enum>(3)</enum>
 <text display-inline="yes-display-inline">to ensure the denial of entry into the United States of any dog attempted to be imported into the United States in violation of subsection (b)(1);</text>
                            </paragraph>
                            <paragraph id="HC41918C808834E0DAD114E40EDC10406">
                                <enum>(4)</enum>
 <text display-inline="yes-display-inline">to provide that each importer, import transporter, intermediate handler, or carrier receiving a certificate of veterinary inspection required under this section shall submit a copy of the certificate to the Secretary, who shall, upon receipt, record and maintain the information in a centralized database and, upon request by a State veterinarian, share the information with such State veterinarian within 3 days;</text>
                            </paragraph>
                            <paragraph id="H96A266F877CA4EA3B15187D86F3F435C">
                                <enum>(5)</enum>
 <text display-inline="yes-display-inline">to require the Secretary to annually report aggregated data submitted under paragraph (4), including information on country of origin and purpose of import; and</text>
                            </paragraph>
                            <paragraph commented="no" id="HAB72915ADC6948A9BF384E0AD8222378">
                                <enum>(6)</enum>
 <text display-inline="yes-display-inline">to determine and establish such fees for the verification of documentation and issuance of permits required under subsection (b)(1) as may be necessary to fund the implementation and enforcement of this section.</text>
                            </paragraph>
                        </subsection>
                        <subsection id="H7AA1ED548DEB4611AE4D9972CEEFEE9C">
                            <enum>(d)</enum>
                            <header>Rule of construction</header>
 <text display-inline="yes-display-inline">Nothing in subsection (c)(6) shall be construed as limiting the availability of funding made available under section 10417 to carry out this section.</text>
                        </subsection>
                        <subsection id="HB74CF4E8F7F24341A11DEEF0DA89D68D">
                            <enum>(e)</enum>
                            <header>Enforcement</header>
                            <paragraph id="H536C16E06C2E486B9DF7F9DDF8A4B796">
                                <enum>(1)</enum>
                                <header>Authority</header>
 <text display-inline="yes-display-inline">The Secretary shall have the authority granted under section 10414 to enforce this section.</text>
                            </paragraph>
                            <paragraph id="H7742E16EED224A5A8E3B6F380C42290E">
                                <enum>(2)</enum>
                                <header>Penalties</header>
 <text>An importer or import transporter that fails to comply with this section shall—</text>
                                <subparagraph id="H03387D53287449D99917DACD2F2AB61F">
                                    <enum>(A)</enum>
 <text>be subject to penalties under section 10414; and</text> </subparagraph> <subparagraph id="H0CC2311FEA0643BCA3B24535BE3D005D"> <enum>(B)</enum> <text display-inline="yes-display-inline">provide, as the Secretary may determine, at the expense of the importer or import transporter, for—</text>
                                    <clause id="H55AEDB1111D449F989B1CD02A4748200">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">the care (including appropriate veterinary care), forfeiture, quarantine, and removal from the United States of each applicable dog; and </text>
                                    </clause>
                                    <clause id="H5C6C266B12644F5086D6404DCC67DA50">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">the return of each applicable dog to its place of export, with due care for the welfare of each applicable dog.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                    </section>

            </subsection>
            <subsection commented="no" id="H3F6BCDFF68D740E98BDAB4C83B03B9D6">
                <enum>(b)</enum>
                <header>Transition period</header>
                <paragraph commented="no" id="HB449FF1704E5481090344F1CFCD919F0">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>During the transition period, regulations promulgated under section 18 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2148">7 U.S.C. 2148</external-xref>) (as in effect on the day before the date of enactment of this Act) relating to the importation of live dogs shall continue to apply to the extent that such regulations do not conflict with section 10404A of the Animal Health Protection Act (as inserted by subsection (a)).</text>
                </paragraph>
                <paragraph commented="no" id="H7B696162CABE42B39D40A1868A183D5E">
                    <enum>(2)</enum>
                    <header>Transition period defined</header>
 <text>In this subsection, the term <term>transition period</term> means the period beginning on the date of enactment of this Act and ending on the date on which final regulations are promulgated under such section 10404A.</text>
                </paragraph>
            </subsection>
            <subsection id="H36E4CA6F0E424A54811B87DD3555CBF4">
                <enum>(c)</enum>
                <header>Conforming amendment</header>
 <text>Section 18 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2148">7 U.S.C. 2148</external-xref>) is repealed.</text> </subsection> </section> </legis-body> </bill>
