        <official-title>To address national security risks and prohibit the use of Federal funds for
            the procurement of certain vehicles and vehicle technologies produced or provided by
            entities based in certain countries, and for other purposes.</official-title>

    <legis-body display-enacting-clause="yes-display-enacting-clause">
        <section section-type="section-one" id="S1">
            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Transit Operations to Prohibit China Act</short-title></quote> or the <quote><short-title>STOP China Act</short-title></quote>.</text>
        </section>
        <section commented="no" display-inline="no-display-inline" id="id53582fe075ff4ad5bf66cf2f0df6c523">
            <enum>2.</enum>
            <header>Sense of Congress</header>
 <text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="id3249654fc1624f689750fa43da7ceac7"> <enum>(1)</enum> <text>the People’s Republic of China (referred to in this section as the <term>PRC</term>) uses a deliberately intricate web of industrial policies to distort market behavior to achieve dominance in global markets and increase the dependence of the United States on imports from the PRC;</text>
            </paragraph>
            <paragraph id="id86b5c153bb224cb99c5f32bbf9064a27">
                <enum>(2)</enum>
 <text>the adoption of PRC-developed technologies in the United States, including those used in certain vehicles, poses a significant risk to national security and threatens the long-term competitiveness of the United States;</text>
            </paragraph>
            <paragraph id="ide4882d9d7e6d4c86a0ef48f935fa8a85">
                <enum>(3)</enum>
 <text>the PRC intentionally creates overcapacity and sells products at below-market prices to gain market share and undermine United States domestic supply chains;</text>
            </paragraph>
            <paragraph id="id809a1ca131f94d489f32d395a43c3b1a">
                <enum>(4)</enum>
 <text>Congress must continue to confront the military-civil fusion strategy of the PRC and the intrusion of the PRC into the United States transportation market, as Congress has done in the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; 133 Stat. 1198) and the FAA Reauthorization Act of 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/63">Public Law 118–63</external-xref>; 138 Stat. 1025);</text>
            </paragraph>
            <paragraph id="idf0914f157e0048979aa2f3ce082ca1eb">
                <enum>(5)</enum>
 <text>United States taxpayer dollars should not be used to fund PRC-subsidized vehicle manufacturing or technology companies; and</text>
            </paragraph>
            <paragraph id="id397ac945c45843d9a6280b3b5cae6638">
                <enum>(6)</enum>
 <text>any entity accepting Federal funding must be prevented from procuring certain vehicles—</text>
                <subparagraph commented="no" display-inline="no-display-inline" id="idb267d6bec42847d9bf74ae3d74d7f662">
                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">from a PRC entity or an entity otherwise related legally or financially to a corporation based in the PRC; or</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline" id="idae64f97aad064f41a679b4c5efa8c50d">
                    <enum>(B)</enum>
 <text>that contain certain vehicle technologies identified as matters of national security concern.</text>
                </subparagraph>
            </paragraph>
        </section>
        <section id="id4798e6e102d6467ca3166fe921fd6fd5">
            <enum>3.</enum>
            <header>Prohibitions relating to certain vehicles produced or provided by entities based
                in certain countries</header>
 <text display-inline="no-display-inline">Section 5323(u) of title 49, United States Code, is amended—</text>
            <paragraph commented="no" display-inline="no-display-inline" id="id2235a5608d6044048eec3ef3056a3c31">
                <enum>(1)</enum>
 <text display-inline="yes-display-inline">by striking paragraphs (1) and (2) and inserting the following:</text>
                <quoted-block style="OLC" display-inline="no-display-inline" id="id9a0d1029a17a42fa9d73b5218a7470db">
                    <paragraph commented="no" display-inline="no-display-inline" id="idaaf1555ec546460d8acf7456101f687a">
                        <enum>(1)</enum>
                        <header>Definitions</header>
 <text>In this subsection:</text> <subparagraph id="id151f0072fe7046849ab34d50d3023676"> <enum>(A)</enum> <header>Covered entity</header> <text>The term <term>covered entity</term> means an entity (including a corporation, partnership, association, organization, or other entity)—</text>
                            <clause id="id64f3c73e0b6c4e74ac2c915378fbc0c3">
                                <enum>(i)</enum>
 <text>the principal place of business of which is in a covered nation;</text>
                            </clause>
                            <clause id="id15383f86685843e7a7e6b352760e8fd3">
                                <enum>(ii)</enum>
 <text>that is headquartered in, incorporated in, or otherwise organized under the laws of a covered nation;</text>
                            </clause>
                            <clause id="id3a8c7b55bab549059ffc1025e2419a28">
                                <enum>(iii)</enum>
 <text>that, regardless of where the entity is organized or doing business, is owned or controlled by a covered nation or covered individual, including circumstances in which a covered individual possesses the power to determine, direct, or decide matters affecting the entity—</text>
                                <subclause id="id8f2ea24724174245b5a9cb2b89f07fb9">
                                    <enum>(I)</enum>
 <text>through—</text> <item id="id9318b40793084bfda9944c871e3859b8"> <enum>(aa)</enum> <text>the ownership of a majority of the total outstanding voting interest in the entity;</text>
                                    </item>
                                    <item id="id60f30346a8bc4a83a48cfc378fa720fe">
                                        <enum>(bb)</enum>
 <text>board representation;</text> </item> <item id="idb05e1911f2934102ba92a73f2f9cdacc"> <enum>(cc)</enum> <text>proxy voting;</text>
                                    </item>
                                    <item id="id4e7639797b0a4623b01ed20e4c7663de">
                                        <enum>(dd)</enum>
 <text>a special share;</text> </item> <item id="id118ef1606a214d3a8321458a65c1fc64"> <enum>(ee)</enum> <text>contractual arrangements;</text>
                                    </item>
                                    <item id="id46d8d47c93bc431fa72ea7c6688b3d13">
                                        <enum>(ff)</enum>
 <text>formal or informal arrangements to act in concert; or</text>
                                    </item>
                                    <item id="ida61eded46119467f96969afbd55df33f">
                                        <enum>(gg)</enum>
 <text>other means; and</text> </item> </subclause> <subclause id="idb1e565d93021415595da8c31431c1e0a"> <enum>(II)</enum> <text>regardless of whether that power is—</text>
                                    <item id="idc63bae5254044d89931248289834ab7e">
                                        <enum>(aa)</enum>
 <text>direct; or</text> </item> <item id="id848b17ad590b449fa0684f9040421854"> <enum>(bb)</enum> <text>exercised or unexercised;</text>
                                    </item>
                                </subclause>
                            </clause>
                            <clause id="id89c99a8e40f54f5b8e0c8d1ae72051b5">
                                <enum>(iv)</enum>
 <text>is owned or controlled by, a subsidiary of, an affiliate of, or in a joint venture with an entity described in clause (i), (ii), or (iii);</text>
                            </clause>
                            <clause id="id7cf6eba994334b71a8e55406a3fb2e12">
                                <enum>(v)</enum>
 <text>is a manufacturer from which the procurement of rolling stock was ever prohibited under this subsections; or</text>
                            </clause>
                            <clause id="idf7432a35986f4003b23a9cac65e793ee">
                                <enum>(vi)</enum>
 <text>is an owner of, successor of, subsidiary of, affiliate of, or in a joint venture with a manufacturer described in clause (v).</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="id8d088dfc311f4f8c80fef6feba8874de">
                            <enum>(B)</enum>
                            <header>Covered funding</header>
 <text>The term <term>covered funding</term> means any financial assistance made available under this chapter.</text>
                        </subparagraph>
                        <subparagraph id="ide23a7a6db43446649ccaa25bddd79373">
                            <enum>(C)</enum>
                            <header>Covered individual</header>
 <text>The term <term>covered individual</term> means any individual, wherever located—</text>
                            <clause id="iddfa58ff65b2343169d3d2edb87449c47">
                                <enum>(i)</enum>
 <text>whose activities are directly or supervised, directed, controlled, financed, or subsidized, in whole or in majority part, by a covered nation;</text>
                            </clause>
                            <clause id="idcc3b703207014c5cbdf7661d3adaab33">
                                <enum>(ii)</enum>
 <text>who acts as an agent, representative, or employee of a covered nation or an individual described in clause (i);</text>
                            </clause>
                            <clause id="id40b94bdcf73d4aeca05ea06ed532c2d7">
                                <enum>(iii)</enum>
 <text>who acts in any other capacity at the order of, at the request of, or under the direction or control of a covered nation or an individual described in clause (i); or</text>
                            </clause>
                            <clause id="idb0bd76acf7234120b409bc59df6aa358">
                                <enum>(iv)</enum>
 <text>who—</text> <subclause id="ida6938775c2f24fa88bb6294388b8ad86"> <enum>(I)</enum> <text>is a citizen or resident of a covered nation or a country controlled by a covered nation; and</text>
                                </subclause>
                                <subclause id="id405b39c61f1a4d7a8381558a1ea25bb9">
                                    <enum>(II)</enum>
 <text>is not a citizen or permanent resident of the United States.</text>
                                </subclause>
                            </clause>
                        </subparagraph>
                        <subparagraph id="idd0c6af845c8b44ae8cc96297067de956">
                            <enum>(D)</enum>
                            <header>Covered nation</header>
 <text>The term <term>covered nation</term> has the meaning given the term in section 4872(d) of title 10.</text>
                        </subparagraph>
                        <subparagraph id="id761d81b11e4d4b4d8b2a763353aece90">
                            <enum>(E)</enum>
                            <header>Covered vehicle</header>
 <text>The term <term>covered vehicle</term> means rolling stock that—</text>
                            <clause id="ide89fbdf1bfcd45759909d74ad21dd954">
                                <enum>(i)</enum>
 <text>is produced or provided by a covered entity included on the list developed under paragraph (2)(B); or</text>
                            </clause>
                            <clause id="id5aa3e5e0dd78403a90c2d7d00fb120f2">
                                <enum>(ii)</enum>
 <text>incorporates an electric power train produced or provided by a covered entity included on the list developed under paragraph (2)(B).</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="id80faf50ff88e405da343e6f6a13edda3">
                            <enum>(F)</enum>
                            <header>Electric power train</header>
 <text>The term <term>electric power train</term> has the meaning given the term in section 571.305 of title 49, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>STOP China Act</short-title>).</text>
                        </subparagraph>
                    </paragraph>
                    <paragraph id="id5e18dde93a95489a88478a1118663492">
                        <enum>(2)</enum>
                        <header>Prohibition</header>
                        <subparagraph id="ida06a03387e264110aa8015758984c1e9">
                            <enum>(A)</enum>
                            <header>In general</header>
 <text>Subject to subparagraph (C), on and after the date of enactment of the <short-title>STOP China Act</short-title>, the Secretary may not award or obligate covered funding—</text>
                            <clause commented="no" display-inline="no-display-inline" id="idf74947fc240c4db1849373996f5d30c7">
                                <enum>(i)</enum>
 <text display-inline="yes-display-inline">for a contract or subcontract for the procurement of a covered vehicle; or</text>
                            </clause>
                            <clause id="id7b0f04accef64e4885a2e6a956ca2778">
                                <enum>(ii)</enum>
 <text>for the construction, installation, or maintenance of infrastructure to fuel or charge a covered vehicle that is a bus, if the applicable covered vehicle is procured under a contract or subcontract executed on or after the date of enactment of the <short-title>STOP China Act</short-title>.</text>
                            </clause>
                        </subparagraph>
                        <subparagraph id="id1a97a484d98a44efabab8b806d3c39b5">
                            <enum>(B)</enum>
                            <header>List of covered entities</header>
                            <clause id="id57d19b13d8d4474ca9bc5527d0a4ca4a">
                                <enum>(i)</enum>
                                <header>In general</header>
 <text>Not later than 30 days after the date of enactment of the <short-title>STOP China Act</short-title>, the United States Trade Representative, in consultation with the Attorney General and the Secretary, shall make publicly available, including on a publicly accessible website, a list of covered entities that produce or provide—</text>
                                <subclause id="idc54f24e2cc88453c89dd01ca338b019a">
                                    <enum>(I)</enum>
 <text>rolling stock to which the prohibition under subparagraph (A) applies; or</text>
                                </subclause>
                                <subclause id="id282c5dedb83a4fecab2eae30eaca05f3">
                                    <enum>(II)</enum>
 <text>electric power trains the incorporation of which into rolling stock would render the rolling stock subject to the prohibition under subparagraph (A).</text>
                                </subclause>
                            </clause>
                            <clause id="id1f7c28b1d68f45108f12a87ea273a205">
                                <enum>(ii)</enum>
                                <header>Updates</header>
 <text>The United States Trade Representative shall update the list required under clause (i)—</text>
                                <subclause id="id72a629bd785e4d9fb0ff88ca97c521e9">
                                    <enum>(I)</enum>
 <text>based on information provided to the United States Trade Representative by the Attorney General and the Secretary; and</text>
                                </subclause>
                                <subclause id="id847839a66e9444f9ba2a81654c50612e">
                                    <enum>(II)</enum>
 <text>not less frequently than—</text> <item id="id5ba1f1ab60a74e9491e738826ef156c9"> <enum>(aa)</enum> <text>once every 90 days during the 180-day period beginning on the date of initial publication of the list under that clause; and</text>
                                    </item>
                                    <item id="idea4915a2a18e4d6f8e1740aa5da60462">
                                        <enum>(bb)</enum>
 <text>annually thereafter.</text> </item> </subclause> </clause> </subparagraph> <subparagraph id="ideb343ead65ac41e281833e0293001c83"> <enum>(C)</enum> <header>Exception</header> <text>Notwithstanding subparagraph (A), the Secretary may procure a covered vehicle or construct, install, or maintain infrastructure to fuel or charge a covered vehicle for purposes of—</text>
                            <clause id="idb45885f414ad40379904a965f8a17ff4">
                                <enum>(i)</enum>
 <text>the inspection or investigation of a motor vehicle or equipment; or</text>
                            </clause>
                            <clause id="id354723aafe0841ca9ef7951780363ec9">
                                <enum>(ii)</enum>
 <text>motor vehicle safety research, development, or testing.</text> </clause> </subparagraph> </paragraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </paragraph> <paragraph id="idf549a2070a3b42948893e5f7e6821adf"> <enum>(2)</enum> <text>in paragraph (4), by striking <quote>paragraph (1)</quote> each place that term appears and inserting <quote>paragraph (2)</quote>;</text>
            </paragraph>

 <text>by striking <quote>the manufacturer</quote> and inserting <quote>the covered entity</quote>; and</text>
                    </clause>

 <text>by striking <quote>date of enactment of this subsection</quote> and inserting <quote>date of enactment of the <short-title>STOP China Act</short-title></quote>;</text>
                    </clause>
                </subparagraph>
                <subparagraph id="id2a6b73db944243eeacb7d77ded0d9806">
                    <enum>(B)</enum>
 <text>by striking subparagraph (B) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id818b4f734f844161afa688dc1ade8c9a"> <subparagraph id="idc844e688149f422e8e1a322aa3176a09"> <enum>(B)</enum> <header>Contract completion</header> <text>Notwithstanding paragraph (2), covered funds may be obligated for a contract or subcontract that was eligible for assistance under this chapter under the provisions of this subsection prior to the date of enactment of the <short-title>STOP China Act</short-title> until the delivery of rolling stock is complete under such contract.</text>
                        </subparagraph>

                    <enum>(C)</enum>

                        <header>Severability</header>
 <text>If any provision of this subsection, or the application of this subsection to any person or circumstance, is held to be unconstitutional or otherwise invalid, the remainder of this subsection, and the application of the provision to any other person or circumstance, shall not be affected.</text>

            <enum>4.</enum>
            <header>Prohibitions relating to additional vehicles produced or provided by entities
                based in certain countries</header>
            <subsection id="ideda6d1c1ba524bec8e865f4649e3d1c4">
                <enum>(a)</enum>
                <header>Definitions</header>
 <text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="idbecd95930a804350bc3ac1ad72f1ed82"> <enum>(1)</enum> <header>Covered entity; covered individual; covered nation; covered vehicle; electric power train</header> <text>The terms <term>covered entity</term>; <term>covered individual</term>, <term>covered nation</term>, <term>covered vehicle</term>, and <term>electric power train</term> have the meanings given those terms in section 5323(u)(1) of title 49, United States Code.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id7f0c3133b4c044ef8a2c05933a2b9264">
                    <enum>(2)</enum>
                    <header>Covered funding</header>
 <text>The term <term>covered funding</term> means any appropriations made available to the Department, other than funds made available under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code.</text>
                </paragraph>

                    <enum>(3)</enum>
                    <header>Department</header>
 <text>The term <term>Department</term> means the Department of Transportation.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="ideeb5d7337efe46a088eb38252a46e6fd">
                    <enum>(4)</enum>
                    <header>Secretary</header>
 <text>The term <term>Secretary</term> means the Secretary of Transportation.</text>
                </paragraph>
            </subsection>
            <subsection id="id18c10ff75fee413989a6115c8ecb3dc0">
                <enum>(b)</enum>
                <header>Prohibition</header>
                <paragraph commented="no" display-inline="no-display-inline" id="idc4bb0114c2b2432894359e2559e31b96">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">Subject to paragraph (3), the Department may not award, obligate, allocate, or expend covered funding—</text>
                    <subparagraph id="id3e716d4448064abea2ee5519f23cdf18">
                        <enum>(A)</enum>
 <text>for the procurement of a covered vehicle by the Department or any other agency or person; or</text>
                    </subparagraph>
                    <subparagraph id="idc31313a16f7f4ca286aac6748a49cd6c">
                        <enum>(B)</enum>
 <text>for the construction, installation, or maintenance of infrastructure to fuel or charge a covered vehicle that is a bus, if the applicable covered vehicle is procured under a contract or subcontract executed on or after the date of enactment of this Act.</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="idbabee9f3db4f40ecb1e34d798f00588a">
                    <enum>(2)</enum>
                    <header>List of covered entities</header>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id3f49c7547769429b83560ed9214254ea">
                        <enum>(A)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the United States Trade Representative, in consultation with the Attorney General and the Secretary, shall make publicly available, including on a publicly accessible website, a list of covered entities that produce or provide—</text>

                            <enum>(i)</enum>
 <text display-inline="yes-display-inline">covered vehicles to which the prohibition under paragraph (1) applies; or</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="ide7da682148364c0c8b457a2802bb901b">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">electric power trains the incorporation of which into a covered vehicle would render the covered vehicle subject to the prohibition under that paragraph.</text>
                        </clause>
                    </subparagraph>

                        <enum>(B)</enum>
                        <header>Updates</header>
 <text>The United States Trade Representative shall update the list required under subparagraph (A)—</text>
                        <clause commented="no" display-inline="no-display-inline" id="id0cb71f7b7e62449bb662d0446034c547">
                            <enum>(i)</enum>
 <text display-inline="yes-display-inline">based on information provided to the United States Trade Representative by the Attorney General and the Secretary; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="idb93f4596810c4d0f89816dda4242e291">
                            <enum>(ii)</enum>
 <text>not less frequently than—</text> <subclause commented="no" display-inline="no-display-inline" id="id0cf802eaf1294357b234287ebf1810f4"> <enum>(I)</enum> <text display-inline="yes-display-inline">once every 90 days during the 180-day period beginning on the date of initial publication of the list under that subparagraph; and</text>
                            </subclause>
                            <subclause commented="no" display-inline="no-display-inline" id="idd2081e1a786b435a890158c3729f45ee">
                                <enum>(II)</enum>
 <text>annually thereafter.</text> </subclause> </clause> </subparagraph> </paragraph> <paragraph id="id3c7eb7e067a045d4ab0aef4c35e367a6"> <enum>(3)</enum> <header>Exception</header> <text>Notwithstanding paragraph (1), the Department may procure a covered vehicle or construct, install, or maintain infrastructure to fuel or charge a covered vehicle for purposes of—</text>

                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">the inspection or investigation of a motor vehicle or equipment; or</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idd8275b79cde0417fb085f947345f4cb1">
                        <enum>(B)</enum>
 <text>motor vehicle safety research, development, or testing.</text> </subparagraph> </paragraph> </subsection> <subsection id="idbdcce714992a4b298e8a49d64784ac01"> <enum>(c)</enum> <header>Severability</header> <text>If any provision of this section, or the application of this section to any person or circumstance, is held to be unconstitutional or otherwise invalid, the remainder of this section, and the application of the provision to any other person or circumstance, shall not be affected.</text>
