<distribution-code>II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1706</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250508">May 8, 2025</action-date><action-desc><sponsor name-id="S347">Mr. Moran</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require aircraft operating in Class B airspace in the national airspace system to install and operate ADS–B In and ADS–B Out equipment, and for other purposes.</official-title></form><legis-body id="HAEE16BEA37034476B86D5E89CCB33859"><section id="idf9091cfb9f2a45e89defc5a56a4907f8" section-type="section-one"><enum>1.</enum><header>ADS–B In and ADS–B Out equipment required for aircraft operating in Class B airspace in the national airspace system</header><subsection commented="no" display-inline="no-display-inline" id="id8e7823a738024ef88176f68c97fbf5eb"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement</header><paragraph commented="no" display-inline="no-display-inline" id="id82189174d37444b780971253d75d99bf"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this Act, no aircraft, including military aircraft, shall be operated in Class B airspace in the national airspace system unless the aircraft has ADS–B In and ADS–B Out equipment that meets such performance requirements as the Administrator shall specify, and is installed, activated, and receiving whenever the aircraft is taxiing or in flight.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ea8689c4810437192eb666de3277f39"><enum>(2)</enum><header>Limitation on regulations</header><text>Neither the Secretary of Transportation nor the Administrator shall implement, administer, enforce, or otherwise give effect to any regulation that exempts aircraft, including military aircraft, from the requirements of paragraph (1).</text></paragraph></subsection><subsection id="idaf9bc66ddbd945d0958df3e431f1d3c8"><enum>(b)</enum><header>Repeal of exemption to requirement To install automatic dependent surveillance-Broadcast equipment on certain aircraft of Department of Defense</header><text display-inline="yes-display-inline">Section 1046 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is repealed.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id572767e00d6d4254ad4eb6de4ae8aca1"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="iddc895a13c7664aab94c6db83c715fb00"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Aviation Administration.</text></paragraph><paragraph id="id20fede39c8734052920c57f9a7858154" commented="no"><enum>(2)</enum><header>ADS–<enum-in-header>B</enum-in-header> in</header><text>The term <term>ADS–B In</term> means onboard avionics technology that periodically receives ADS–B Out broadcasts of an aircraft's state vector (3-dimensional position and 3-dimensional velocity) and other required information as described in part 91.277 of title 14, Code of Federal Regulations (or a successor regulation).</text></paragraph><paragraph id="idf5971258e1dd4b53a3f3fc4d3ee956c5" commented="no"><enum>(3)</enum><header>ADS–<enum-in-header>B</enum-in-header> out</header><text>The term <term>ADS–B Out</term> has the meaning given such term in section 91.227 of title 14, Code of Federal Regulations (or a successor regulation).</text></paragraph><paragraph id="ida2fba0acb1784969acd45ca17965faf0" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Aircraft</header><text>The term <term>aircraft</term> means fixed wing aircraft, rotorcraft, powered-lift aircraft, and any other form of manned aircraft.</text></paragraph></subsection></section></legis-body></bill>
