<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 1672</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250508">May 8, 2025</action-date><action-desc><sponsor name-id="S410">Ms. Lummis</sponsor> (for herself, <cosponsor name-id="S323">Mr. Risch</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S435">Mr. Sheehy</cosponsor>, and <cosponsor name-id="S317">Mr. Barrasso</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to clarify that a permit is not required under the National Pollutant Discharge Elimination System for a discharge resulting from the aerial application of certain products used for fire control and suppression, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5F97D80931FF4E72A6FBDC8FD297A325"><section section-type="section-one" id="H14EAACE0B38341978C2ACBADA08012E6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Protection and Wildland Firefighter Safety Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="H949B157062764AFFBA6529508B61926B"><enum>2.</enum><header>Limitation on permit requirement</header><text display-inline="no-display-inline">Section 402(l)(3) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(l)(3)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id35eb53c8d543422da898e03c1909d332"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H6A4512D90B174088BD6A518063F42A65"><enum>(A)</enum><text>by striking <quote>this section for a discharge from</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HD3FC5890CC97401D892FFB772D97A64B"><text>this section for—</text><clause id="H4EF3FECD229943058653BF354EFB4D37"><enum>(i)</enum><text display-inline="yes-display-inline">a discharge from</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H0156D8F5A17645B6ADE9A3B63A70F883"><enum>(B)</enum><text>in clause (i) (as so designated), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H4AA61F5AFE3949C69AF4AE276E0CEFF9"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H37062818C990477EA254BE519F5BE102"><clause id="H15A900DC78484337BB16C529C69C5384"><enum>(ii)</enum><text display-inline="yes-display-inline">a discharge resulting from the aerial application of a product used for fire control and suppression purposes that appears on the most current applicable Qualified Products List maintained by the Forest Service (or any successor list).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88ccb44f3f5e4e1688932f51a3160f55"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd30f282b4f2b434e95f2cccceeea8260"><enum>(A)</enum><text>by striking <quote>(C) The authorization</quote> and inserting the following:</text><quoted-block id="id2F57ACB61E9D4F3189481DD45C5321DC" style="OLC" act-name=""><subparagraph id="idD28443C030C64FD49B7095DF5BEA453E"><enum>(C)</enum><header>Applicability</header><text>The authorization</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc428bc7ae63c46bcb17339c95bdad8fd"><enum>(B)</enum><text>by striking <quote>Section 505(a)</quote> and inserting <quote>section 505(a)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81826b791d7c422595c688b3b50451f0"><enum>(C)</enum><text>by striking <quote>402(p)(6)</quote> and inserting <quote>subsection (p)(6)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id702d7b397b3340e982e2cd63dd452524"><enum>(D)</enum><text>by striking <quote>402(l)(3)(A)</quote> each place it appears and inserting <quote>subparagraph (A)</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
