<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 166</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250121">January 21, 2025</action-date><action-desc><sponsor name-id="S384">Mr. Tillis</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to create or enhance penalties for murder and assault committed against a law enforcement officer, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Fallen Law Enforcement Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd3b306d4cbc04242b409b7f36ed10f3f"><enum>2.</enum><header>Crimes</header><text display-inline="no-display-inline">Part I of title 18, United States Code, is amended—</text><paragraph id="ide36aa0499dca41e7a2f1fa0fd77db994"><enum>(1)</enum><text>in section 111, by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id581FF4F3ED8A410DAC4C9EAB9385661C"><subsection commented="no" display-inline="no-display-inline" id="id532f2f342679458abb2f99e6ed425ea2"><enum>(d)</enum><header>Commission against a law enforcement officer</header><text display-inline="yes-display-inline">Whoever commits any act described in subsection (a)(1) against a Federal law enforcement officer, or against a State or local law enforcement officer if the perpetrator plans or facilitates the act with an instrument of interstate commerce or commits the act with a weapon that has traveled in interstate commerce, resulting in serious injury to the law enforcement officer, shall be imprisoned not less than 20 years.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id785acc5b62764a82a096a07b3917c1bb"><enum>(2)</enum><text display-inline="yes-display-inline">in chapter 51—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8a87b7c4f9274128b93b022887f23682"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting after section 1122 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id60C7CB98D31141CFA63ED3300CB08046"><section commented="no" display-inline="no-display-inline" id="id97236868617f491eadfb41f8d243773d"><enum>1123.</enum><header>Protection of law enforcement officers</header><text display-inline="no-display-inline">Whoever commits the murder of a Federal law enforcement officer, or a State or local law enforcement officer if the perpetrator plans or facilitates the murder with an instrument of interstate commerce or commits the murder with a weapon that has traveled in interstate commerce, shall be sentenced as provided under section 1111 for murder in the first degree.</text></section><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03af2fb1371548fe9085507fb423afa8"><enum>(B)</enum><text>in the table of sections, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC83DFAF4B8BB4D6690F65CFA459CB7FF"><toc><toc-entry level="section">1123. Protection of law enforcement officers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id8fdb3fb4a1434f64a8f48997794562f0"><enum>3.</enum><header>Report required</header><text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, the Attorney General shall submit to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> a report on prosecutions conducted as the result of the amendments made by this Act.</text></section></legis-body></bill>
