which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to ensure veterans of secrecy oath programs receive the full benefits they have earned, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Obligations to Aberdeen’s Trusted Heroes Act of 2025</short-title></quote> or the <quote><short-title>OATH Act of 2025</short-title></quote>.</text></section><section id="idd482e7c16d744e11a92e8b364f472a09"><enum>2.</enum><header>Definition of secrecy oath program</header><text display-inline="no-display-inline">Section 5100 of title 38, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03fcb282ab2d4888a143a1b05fc5ebd4"><paragraph id="id1b6d0a688f774bdab2bed3aa04baee78"><enum>(3)</enum><text>The term <term>secrecy oath program</term> means a United States Government program in which participants are required to sign a non-disclosure agreement preventing the disclosure of any information regarding the program under penalty of court-martial or criminal punishment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id65d410464862413189bd219a28fe255b"><enum>3.</enum><header>Notice to veterans of secrecy oath programs regarding benefits</header><subsection id="id2e43c98ef1ca4bf9887f88353d79c610"><enum>(a)</enum><header>Notice required</header><paragraph id="id3618a283634b47e9bfda2dcd54e19547"><enum>(1)</enum><header>In general</header><text>Section 6303 of title 38, United States Code, is amended—</text><subparagraph id="id24680bb8aa3e46a49d4d6865e7a519d5"><enum>(A)</enum><text>by redesignating subsections (c), (d), and (e) as subsections (d), (e), and (f), respectively; and</text></subparagraph><subparagraph id="idf0aa8125acd444e2ba7432f5ffe93b54"><enum>(B)</enum><text>by inserting after subsection (b) the following new subsection (c):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb87e6149ced2425d83ddfacd53390aa0"><subsection id="id3e6e8fe21dc348e1abc6a1bc8883c8f5"><enum>(c)</enum><header>Notice to veterans of secrecy oath programs</header><paragraph commented="no" display-inline="yes-display-inline" id="ide35d049ad2624ed49920358fa352eeb0"><enum>(1)</enum><text>Not later than 90 days after the date on which participants in a secrecy oath program are released from the oath taken under such program, the Secretary shall—</text><subparagraph id="ide56f5bfb55d64961ace59031c41c3af1" indent="up1"><enum>(A)</enum><text>identify the veterans who participated in the program;</text></subparagraph><subparagraph id="id6dc69fb6398a4dd295a081e695600c68" indent="up1"><enum>(B)</enum><text>notify each such veteran of all benefits and services under laws administered by the Department for which the veteran may be eligible; and</text></subparagraph><subparagraph id="idf4a62321a5e74894a485e0d6a408d4da" indent="up1"><enum>(C)</enum><text>distribute the information described in subsection (d)(1) as required by such subsection.</text></subparagraph></paragraph><paragraph id="idb01a4122444846d8b7d407b16f8496b8" indent="up1"><enum>(2)</enum><text>If the Secretary identifies any veterans who are entitled to notice under paragraph (1) and did not receive such notice, the Secretary shall, not later than 90 days after the date of any such identification—</text><subparagraph id="id32fabc9f1bf04f96abbb6500c33cf942"><enum>(A)</enum><text>notify each such veteran of all benefits and services under laws administered by the Department for which the veteran may be eligible; and</text></subparagraph><subparagraph id="id267f43fa20864e88b8af6da6b21c8d6b"><enum>(B)</enum><text>distribute the information described in subsection (d)(1) as required by such subsection.</text></subparagraph></paragraph><paragraph id="ida42d9d506d9440bba3903bd91b9c9f5f" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>secrecy oath program</term> has the meaning given that term in section 5100 of this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id901f6ab5806c472e89cefd83543aaeaf"><enum>(2)</enum><header>Conforming amendments</header><text>Section 6303 of such title is further amended—</text><subparagraph id="idc348b24d597d43e2be41ea155ce31431"><enum>(A)</enum><text>in subsection (a), by striking <quote>through (d)</quote> and inserting <quote>through (e)</quote>; and</text></subparagraph><subparagraph id="ide8017df151f94866a8ccdde79e762896"><enum>(B)</enum><text>in subsection (e), as redesignated by subsection (a)(1)(A), by striking <quote>subsections (b) and (c)</quote> and inserting <quote>subsections (b), (c), and (d)</quote>.</text></subparagraph></paragraph></subsection><subsection id="id584f69e502a04a1f97cdd5cc5ab51135"><enum>(b)</enum><header>Edgewood Arsenal program</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall—</text><paragraph id="ide85531ef1e4644a3b246d2518e61724d"><enum>(1)</enum><text>identify the veterans who participated in the secrecy oath program at Edgewood Arsenal at Aberdeen Proving Ground, Maryland, at any time during the period beginning on January 1, 1948, and ending on December 31, 1975;</text></paragraph><paragraph id="id595bf1ace6354a9eb9a53c961b311442"><enum>(2)</enum><text>notify each such veteran of all benefits and services under laws administered by the Department of Veterans Affairs for which the veteran may be eligible; and</text></paragraph><paragraph id="idbde34dffff094410a77871320dd1e752"><enum>(3)</enum><text>distribute the information described in section 6303(d)(1) of title 38, United States Code, as amended by subsection (a), as required by such section.</text></paragraph></subsection></section><section id="idfb5c8a3a9d6040a49608711462b900c4"><enum>4.</enum><header>Effective dates of awards of disability compensation for participants in secrecy oath programs</header><text display-inline="no-display-inline">Section 5110(b) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idea32792b1ed543b48287745ad4416a63"><paragraph id="id0d6710f9e3354c7bba71ce6ba1bcc164" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3fdd6e71aed943b8bc6d90d715c644b5"><enum>(A)</enum><text>The effective date of an award of disability compensation to a veteran described in subparagraph (B) shall be the day following the date of the veteran’s discharge or release.</text></subparagraph><subparagraph id="id8d9977edae524d8f867e85d566f64919" indent="up1"><enum>(B)</enum><text>A veteran described in this subparagraph is a veteran who—</text><clause id="id39b7f1268507416292a23d87aff93dc0"><enum>(i)</enum><text>participated in the secrecy oath program at Edgewood Arsenal at Aberdeen Proving Ground, Maryland, at any time during the period beginning on January 1, 1948, and ending on December 31, 1975; or</text></clause><clause id="ida370b0987018436588ad24bf3a3b54e2"><enum>(ii)</enum><text>participated in any other secrecy oath program not described in clause (i).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
