which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food, Agriculture, Conservation, and Trade Act of 1990 with respect to emergency assistance for farmworkers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2B2B83DCE83D4769AB27D191D7EFB3B9"><section section-type="section-one" id="H2DA02B57C10345AAB2FA4B21AF763283"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Relief for Farmworkers Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="id5D5B136A5541406D87524BD3DFFB407A"><enum>2.</enum><header>Emergency assistance for farmworkers</header><text display-inline="no-display-inline">Section 2281 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/5177a">42 U.S.C. 5177a</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAECA495556FF4D33B8DA956459930438"><section commented="no" display-inline="no-display-inline" id="H0720BB41F4D94C7B91C92BD626917FBD"><enum>2281.</enum><header>Emergency assistance for farmworkers</header><subsection commented="no" display-inline="no-display-inline" id="HC2B6FE98D6904A44A5030C81CF756E29"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" id="H715DD9452B514BF08E0B036ED8687F37"><enum>(1)</enum><header>Covered disaster</header><text display-inline="yes-display-inline">The term <term>covered disaster</term> means—</text><subparagraph commented="no" id="H20BCCDE3335246429B4B2854C05DF92E"><enum>(A)</enum><text display-inline="yes-display-inline">an adverse weather event, such as a drought, wildfire, earthquake, hurricane, flood, derecho, excessive heat, tornado, winter storm, freeze, hail, polar vortex, smoke exposure, or excessive moisture;</text></subparagraph><subparagraph commented="no" id="HDE63825E44264184B15A106FB9631040"><enum>(B)</enum><text>an unexpected health crisis, such as a pandemic; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E83F6CDDED0411C9C79D74354AE07D8"><enum>(C)</enum><text display-inline="yes-display-inline">such other event or condition that has caused farmworkers to lose income, be unable to work, or stay home or return home in anticipation of work shortages.</text></subparagraph></paragraph><paragraph id="H4A164687128642DCA1CC42A274C23C09"><enum>(2)</enum><header>Eligible farmworker organization</header><text display-inline="yes-display-inline">The term <term>eligible farmworker organization</term> means an organization that is—</text><subparagraph id="id27376ACD81AB4A69B486638377BA0C48"><enum>(A)</enum><text display-inline="yes-display-inline">a farmworker membership-based organization; or</text></subparagraph><subparagraph id="HCCD6382FD4A344A9ABC4DC315B66A428"><enum>(B)</enum><text display-inline="yes-display-inline">an organization—</text><clause id="id6631E6EC592A4A2B891D42ED4916A0FF"><enum>(i)</enum><text display-inline="yes-display-inline">described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code; and</text></clause><clause id="H5B2BB83550F3427A899FCAEE2D1E2D49"><enum>(ii)</enum><text>that has experience in providing support or relief services to farmworkers, including migrant or seasonal farmworkers.</text></clause></subparagraph></paragraph><paragraph id="H8F1E9F28FD7444A9AE9C6A0F3E2E370E"><enum>(3)</enum><header>Migrant or seasonal farmworker</header><text display-inline="yes-display-inline">The term <term>migrant or seasonal farmworker</term> means an individual—</text><subparagraph id="H82359E7E0FE3484586509FDD8C22A8F3"><enum>(A)</enum><text>who has, during any consecutive 12-month period within the preceding 24-month period, performed farm work for wages; and</text></subparagraph><subparagraph id="HB74C03CF26A74550BCBB56834E1197D8"><enum>(B)</enum><text>who has received not less than ½ of such individual’s total income from, or been employed at least ½ of such individual's total work time in, farm work.</text></subparagraph></paragraph><paragraph id="idab07941e2a1b4022823a416953ac1e4f"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF243C4D8B5C64376BC05BBFCD740BA36"><enum>(b)</enum><header display-inline="yes-display-inline">Emergency relief</header><text display-inline="yes-display-inline">For fiscal year 2024 and each succeeding fiscal year, during any period for which the Secretary determines there is a covered disaster, the Secretary, acting through the Under Secretary for Rural Development, shall make grants to eligible farmworker organizations to provide emergency relief to farmworkers affected by that covered disaster.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H9659EBFFDE4E43D9B38ACEAF8110D59E"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible farmworker organization may use funds received pursuant to a grant awarded under subsection (b)—</text><paragraph id="HE4C93AECCCF448088051058394E01BBA"><enum>(1)</enum><text display-inline="yes-display-inline">to provide emergency relief (including through direct distribution of funding) to farmworkers to address loss and damage due to the covered disaster;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E2B3CF3C2774274B25C8F2870177FDB"><enum>(2)</enum><text display-inline="yes-display-inline">to build capacity to provide emergency relief described in paragraph (1); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51254A820ACE470EAC4455630DEAD16E"><enum>(3)</enum><text display-inline="yes-display-inline">to build resiliency in farmworker communities to address future losses and damages due to covered disasters; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF92CECDBC09442308DDB36FA2D5D8D63"><enum>(4)</enum><text display-inline="yes-display-inline">to provide infrastructure support, including shelter; and</text></paragraph><paragraph id="H016FB274C21A45EB9D36B4458ED07973"><enum>(5)</enum><text display-inline="yes-display-inline">to provide emergency services (including such types of assistance as the Secretary determines to be appropriate) to farmworkers in response to the covered disaster.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2D6471122D7C4DCF8C5A05F0B4D1D2AF"><enum>(d)</enum><header>Availability of funds</header><text>Any funds provided to an eligible farmworker organization under this section shall remain available until expended.</text></subsection><subsection id="HA8EE442DCA454A6BB74F5A801E914BBA"><enum>(e)</enum><header>Promotional plan</header><text display-inline="yes-display-inline">The Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id71395a1562614d1b90b4be9dd03e7ca8"><enum>(1)</enum><text display-inline="yes-display-inline">before making grants under subsection (b), develop a promotional plan; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id270cce0482b14cef8468f5976e2012f2"><enum>(2)</enum><text display-inline="yes-display-inline">carry out that promotional plan throughout the distribution of those grants. </text></paragraph></subsection><subsection commented="no" id="H3AD88B05C7154105BC55F89B6B38815B"><enum>(f)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall consult with eligible farmworker organizations.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
