        <official-title>To restore fairness to service members who filed religious accommodation
            requests and ensure their career progression is justly reviewed.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reaffirming Every Servicemembers' Trust Of Religious Exemptions Act</short-title></quote> or the <quote><short-title>RESTORE Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Establishment of the special review board for impacted service members</header>
            <subsection commented="no" display-inline="no-display-inline" id="id552bc9f14e2e45b4bf96a57d4f67c45b">
                <enum>(a)</enum>
                <header>Establishment of review board</header>
 <text>The Secretary of Defense shall convene a special review board under the Deputy Under Secretary of Defense for Personnel and Readiness to audit religious accommodation requests and disposition and review the personnel records of each service member who filed a religious accommodation request specifically for the COVID–19 vaccine and remained in service (in this section referred to as the <quote>Special Review Board</quote>).</text>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id5dbb24cccadd40dea864b1444b0ed796">
                <enum>(b)</enum>
                <header>Duties of the review board</header>
 <text>The Special Review Board shall perform the following duties:</text> <paragraph id="id89e1edac51204026811e573b155d55cf"> <enum>(1)</enum> <header>Audit scope of religious accommodation decisions since 2020</header> <text>Conduct a Department of Defense-wide audit to assess full number of submissions, approvals, and consistency of compliance with the Religious freedom Restoration Act of 1993 (RFRA) (<external-xref legal-doc="usc" parsable-cite="usc/42/2000bb">42 U.S.C. 2000bb et seq.</external-xref>).</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="idd2678cd24f174979b7cc734df0d60813">
                    <enum>(2)</enum>
                    <header>Assess career impact</header>
 <text>Determine whether the service member’s career progression, promotions, assignments, retention, or professional development opportunities were negatively affected by their religious accommodation request or COVID–19 vaccine refusal.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id38ad3e971f9f4fc395b6569c01d66768">
                    <enum>(3)</enum>
                    <header>Adjudicate career restorations</header>
 <text>Determine and take corrective action if the service member is eligible for—</text>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id7b5a76d9fa6847d789ef26aa1322571a">
                        <enum>(A)</enum>
 <text>backdated promotion to the rank they would have achieved absent the adverse impact;</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id9b5a35d2587b48e8ac317187263fe45b">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">correction of their Date of Rank (DOR) to align with their peer group;</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idd709f7588a9c4b43abcb72a0c63d8d17">
                        <enum>(C)</enum>
 <text>restoration of lost pay and benefits, including back pay, retirement contributions, and applicable bonuses; and</text>
                    </subparagraph>
                    <subparagraph id="id1bd3c1fce1e6478bba1ed906b925f374">
                        <enum>(D)</enum>
 <text>reinstatement to service if they left service due to denial of religious accommodation that has since been determined as unlawful.</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id3b0b1dd3168a49929b3c19e34bc3a8d1">
                    <enum>(4)</enum>
                    <header>Expungement of adverse actions</header>
 <text>Ensure that all adverse administrative actions related to refusal of the COVID–19 vaccine (or other protected religious accommodation) are expunged from the service member’s record, including—</text>
                    <subparagraph id="ide2c386ab5de047949a0fa378168ce68f">
                        <enum>(A)</enum>
 <text>administrative reprimands;</text> </subparagraph> <subparagraph id="id6a39a9e0b2894b149b04fc0aeebebdf4"> <enum>(B)</enum> <text>negative or inconsistent evaluations;</text>
                    </subparagraph>
                    <subparagraph id="id3c17c855ebf74ab89c0d9787d9a95934">
                        <enum>(C)</enum>
 <text>promotion delays or denials;</text> </subparagraph> <subparagraph id="id943604bf261649cc869b237c9cfd2d2a"> <enum>(D)</enum> <text>issuance of Inactive Duty Training points to reserve component personnel so that if affected they shall receive a satisfactory year for participation; and</text>
                    </subparagraph>
                    <subparagraph id="id803a9814d2ee4a0fbd85cb23e1dc775a">
                        <enum>(E)</enum>
 <text>career assignment considerations to improve service-member competitiveness previously impacted solely due to vaccine refusal (or religious accommodation).</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id7969ce056a6a4eb5ada57fa43ef3e767">
                    <enum>(5)</enum>
                    <header>Review process</header>
 <text>Establish a mechanism for service members to request review of decisions if they previously submitted a religious accommodation and believe their records or career progression were adversely impacted regardless of accommodation request outcome.</text>
                </paragraph>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id9f7046e133c84f38bb3f6754d650b9d8">
                <enum>(c)</enum>
                <header>Timeline for review and reporting</header>
                <paragraph commented="no" display-inline="no-display-inline" id="idb7f7acc7eb1040168f9eccb181097880">
                    <enum>(1)</enum>
                    <header>Review</header>
 <text>The Special Review Board shall complete a full review of all affected military personnel not later than one year after the date of the enactment of this Act.</text>
                </paragraph>
                <paragraph id="ida1ca349f12da44d290e44a5a4f73dcff">
                    <enum>(2)</enum>
                    <header>Report</header>
 <text>Not later than 60 days after the review is completed, the Deputy Under Secretary of Defense for Personnel and Readiness shall submit to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives a report detailing—</text>
                    <subparagraph id="idbffcbe2964f144128f89f7c2d1d48609">
                        <enum>(A)</enum>
 <text>the Special Review Board’s findings;</text> </subparagraph> <subparagraph id="id878c3f3632f44552a609e352d0019d37"> <enum>(B)</enum> <text>the number of cases reviewed; and</text>
                    </subparagraph>
                    <subparagraph id="id1d2236b6f8714948854144b5b7d42ee2">
                        <enum>(C)</enum>
 <text>corrective actions taken.</text> </subparagraph> </paragraph> </subsection> <subsection id="id3deaee78ca034998bada6ec8c83b2abc"> <enum>(d)</enum> <header>Deadline for compensation</header> <text>The Secretary of Defense shall ensure that service members determined by the Special Review Board to be eligible for backdated reinstatements, promotions, pay, and benefits receive such compensation not later than 60 days after their case-review under subsection (c)(1) is completed.</text>
            </subsection>
        </section>
        <section commented="no" display-inline="no-display-inline" id="idebecae19ec8f4a86b55927c6dfe587f6">
            <enum>3.</enum>
            <header>Congressional oversight and accountability</header>
            <subsection id="idb82b69303417490ab520e4688ffb995d">
                <enum>(a)</enum>
                <header>Report of initial findings</header>
 <text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives a report with initial findings of the audit directed in section 2(a). The report should provide statistical analysis of affected service member population, assess compliance of Department of Defense with RFRA, and provide plans to address identified areas of opportunity.</text>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id4a2a34ffe321443eba22e8c8e1249d43">
                <enum>(b)</enum>
                <header>Quarterly reports</header>
 <text>The Secretary of Defense shall provide quarterly reports to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives detailing—</text>

                    <enum>(1)</enum>
 <text>the number of cases reviewed by the Special Review Board;</text> </paragraph> <paragraph id="id7b5676a40ef34e47ab1d63b9c3080f25"> <enum>(2)</enum> <text>the number of service members granted back pay, promotions, or restored benefits;</text>
                </paragraph>
                <paragraph id="id0faa1fbcf8f347329f5e89464a9d21a1">
                    <enum>(3)</enum>
 <text>the number of adverse actions expunged from military records;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idc90dc35cc4154c71b71064bb4aa045eb"> <enum>(4)</enum> <text display-inline="yes-display-inline">statistics on the performance of identified service member populations with respect to boards, career progression, and competitive assignment; and</text>
                </paragraph>
                <paragraph id="id0befddfc58be4745a9970bf4b51220e9">
                    <enum>(5)</enum>
 <text>recommendations for further legislative action to ensure fairness in military personnel policies.</text>
                </paragraph>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id6eb5aa3edabf4f7286077971600b3b66">
                <enum>(c)</enum>
                <header>Inspector general audit</header>
 <text>Not later than 18 months after the date of the enactment of this Act, the Department of Defense Inspector General shall conduct an independent audit and compliance review of the implementation of this Act. The Inspector General shall review overall data of religious accommodations and determine if RFRA was applied consistently across the Department of Defense.</text>
            </subsection>
        </section>
        <section commented="no" display-inline="no-display-inline" id="id9fc1c63f13cc440fa94e48345ae97fe1">
            <enum>4.</enum>
            <header>Definitions</header>
 <text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id3036635f5011437093b775143b3d45dd"> <enum>(1)</enum> <header>Adverse action</header> <text>The term <term>adverse action</term> includes—</text>
                <subparagraph commented="no" display-inline="no-display-inline" id="idaec08361ceb04c9ab5b2fea8586aad86">
                    <enum>(A)</enum>
 <text>administrative reprimands;</text> </subparagraph> <subparagraph id="ida235ae6ce7f6497a8dc7584d037e48ff" commented="no"> <enum>(B)</enum> <text>denial or delay of promotions;</text>
                </subparagraph>
                <subparagraph id="id2420b37951ee488091d6a1d9f6a56880" commented="no">
                    <enum>(C)</enum>
 <text>negative performance evaluations;</text> </subparagraph> <subparagraph id="idafa42d10570f47b989894674a21768f7" commented="no"> <enum>(D)</enum> <text>forced involuntary separation;</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline" id="id09729810084a49119dfbd94f2f75501a">
                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">coerced voluntary separation; and</text>
                </subparagraph>
                <subparagraph id="ideaa15b122a654be58c8f738ad3b1b254" commented="no">
                    <enum>(F)</enum>
 <text>denial of career-enhancing assignments.</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id04db6d6ddd6e4ad79438b6cb66b31f4e"> <enum>(2)</enum> <header>Religious accommodation</header> <text>The term <term>religious accommodation</term> refers to a formally submitted request for exemption from a military order, policy, or directive on religious grounds, in accordance with the respective service branch’s religious accommodation policies.</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id8f335af4e0b94cc2b5b861bd90d157ea">
                <enum>(3)</enum>
                <header>Service member</header>
 <text>The term <term>service member</term> means a member of the Armed Forces total force serving on active duty, reserve (to include Individual Ready Reserve (IRR)), or National Guard status in any branch of the Department of Defense.</text>
            </paragraph>
        </section>
        <section id="id63e6d7dabaad4c5abf64786e926d9e48" commented="no" display-inline="no-display-inline" section-type="subsequent-section">
            <enum>5.</enum>
            <header>Authorization of appropriations</header>
 <text display-inline="no-display-inline">There is authorized to be appropriated such sums as may be necessary to carry out this Act. The Secretary of Defense shall allocate necessary resources to support the Special Review Board.</text>
