        <official-title>To direct the Secretary of Agriculture to establish oversight mediation
            committees to help resolve property boundary disputes regarding National Forest System
            land, and for other purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fence Line Fairness Act of 2025</short-title></quote>.</text>
        </section>
        <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idc6a5a9be16c14bc1964a785621ccb3c9">
            <enum>2.</enum>
            <header display-inline="yes-display-inline">National Forest System oversight mediation
                committees</header>
            <subsection commented="no" display-inline="no-display-inline" id="idbbc6e68e312846e19c36612fa1910d17">
                <enum>(a)</enum>
                <header display-inline="yes-display-inline">In general</header>
 <text display-inline="yes-display-inline">The Secretary of Agriculture (referred to in this section as the <term>Secretary</term>), in consultation with State departments of agriculture and State departments of natural resources, shall establish in each State in which National Forest System land is located an oversight mediation committee (referred to in this section as a <term>mediation committee</term>) to help resolve disputes between private landowners and the Secretary regarding the location of boundaries between National Forest System land and private land.</text>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id54ff3f21b952457a91fb94a72d2a93b4">
                <enum>(b)</enum>
                <header>Composition</header>
                <paragraph commented="no" display-inline="no-display-inline" id="id40748ab6ed9940a8ad202a437f10c7eb">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">A mediation committee shall be composed of—</text>
                    <subparagraph id="id27243010e1b64b79a50a1311b72fac7b">
                        <enum>(A)</enum>
 <text>2 individuals who are private, active farmers or ranchers from the State in which the mediation committee is established, to be appointed by the Secretary; and</text>
                    </subparagraph>
                    <subparagraph id="id5a4db65283d6407abcb0bbc4d0002ce9">
                        <enum>(B)</enum>
 <text>3 individuals who are private, active farmers or ranchers from the State in which the mediation committee is established, to be appointed by the applicable State department of agriculture or State department of natural resources.</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id265b7defb8584d51a69d2cc2ea35ec6b">
                    <enum>(2)</enum>
                    <header>Terms</header>
 <text>A member of a mediation committee—</text> <subparagraph id="idf2531066bf36480cbc1df88640cb1a22"> <enum>(A)</enum> <text>shall be appointed for a term of 5 years; and</text>
                    </subparagraph>
                    <subparagraph id="id579f481507834ae98b182651929bc551">
                        <enum>(B)</enum>
 <text>may serve for not more than 2 terms.</text> </subparagraph> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="idc9636fccc2254a3a93c681da3d18954f"> <enum>(c)</enum> <header>Notification</header> <text>If there is a dispute regarding the location of a boundary between National Forest System land and private land, the Secretary shall—</text>
                <paragraph commented="no" display-inline="no-display-inline" id="id15fc98991f924f5c83faebab5030f04d">
                    <enum>(1)</enum>
 <text>notify the private landowner of the dispute not later than 30 days after the date on which the Secretary becomes aware of the dispute; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id280beb4373984f3ba1bc1f8e600590f5">
                    <enum>(2)</enum>
 <text>provide to the private landowner the option to use the mediation committee process described in subsection (d) to help resolve the dispute.</text>
                </paragraph>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id4e5b30cd111f4432bf660d458c97c34f">
                <enum>(d)</enum>
                <header>Dispute resolution process</header>
                <paragraph commented="no" display-inline="no-display-inline" id="id16294f5ff858485695836a5395cf5d29">
                    <enum>(1)</enum>
                    <header>Referral</header>
 <text>If a private landowner notifies the Secretary that the landowner chooses to use the mediation committee process referred to in subsection (c)(2), the Secretary shall refer the dispute to the applicable mediation committee not later than 60 days after the date on which the private landowner notifies the Secretary.</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id3d7d2b19b819486ea3b41e00d85eebe5">
                    <enum>(2)</enum>
                    <header>Process</header>
 <text display-inline="yes-display-inline">With respect to a dispute referred to a mediation committee under paragraph (1), the mediation committee shall—</text>
                    <subparagraph id="id04b867ace1114df4984cf25c8bedd7bb">
                        <enum>(A)</enum>
 <text>hold private hearings regarding the dispute to analyze information and testimony from the private landowner and appropriate officials of the Forest Service;</text>
                    </subparagraph>
                    <subparagraph id="id8296fe1e62dd4bf8a34a460cc8efcffd">
                        <enum>(B)</enum>
 <text>provide to the parties to the dispute described in subparagraph (A) recommendations for actions that can be taken by the parties to resolve the dispute; and</text>
                    </subparagraph>
                    <subparagraph id="idc49ed356ebaf466f8f5b06f47c850993">
                        <enum>(C)</enum>
 <text>submit a report describing findings of fact regarding the dispute and recommendations described in subparagraph (B) to—</text>
                        <clause id="id76e41888b8c24b72bfa80f929b74994f">
                            <enum>(i)</enum>
 <text>the Secretary;</text> </clause> <clause id="id45e1ecd0f372464c98fdb8d6a51a026b"> <enum>(ii)</enum> <text>the Chief of the Forest Service;</text>
                        </clause>
                        <clause id="id6cdd91e1c6164978a1401e36c9b99119">
                            <enum>(iii)</enum>
 <text>the head of the applicable State department of agriculture;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="id60da3c6fdec248f8a22ccbde4e4d42e9"> <enum>(iv)</enum> <text>the head of the applicable State department of natural resources;</text>
                        </clause>
                        <clause id="id3afecfef973d4e5a979c18bbbcdd71e6">
                            <enum>(v)</enum>
 <text>the Committee on Agriculture, Nutrition, and Forestry of the Senate; and</text>
                        </clause>
                        <clause id="id9dae7e80965d4097831f058216da91b2">
                            <enum>(vi)</enum>
 <text>the Committee on Agriculture of the House of Representatives.</text>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="ide428500fe93745a78839352f7d8af921">
                    <enum>(3)</enum>
                    <header>Timeline</header>
 <text>Not later than 180 days after the date on which a dispute is referred to a mediation committee under paragraph (1), the mediation committee shall commence holding hearings under paragraph (2)(A).</text>
