        <official-title>To amend the National Housing Act to authorize State-licensed appraisers to
            conduct appraisals in connection with mortgages insured by the FHA and to ensure
            compliance with the existing appraiser education and competency requirements, and for
            other purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Appraisal Industry Improvement Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Appraiser standards</header>
            <subsection id="HCEB57A4A918E47C09FA0A73C736248EC">
                <enum>(a)</enum>
                <header>Certification or licensing</header>
                <paragraph id="id9600D9C256374B03A6C8F8B195CE0134">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">Section 202(g)(5) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(g)(5)</external-xref>) is amended—</text>
                    <subparagraph commented="no" display-inline="no-display-inline" id="ida487c0b92fcc4041a22d5ab64216a061">
                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">by moving the paragraph two ems to the left; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="ida8ff4d2127ba4f1c92c99e5174583848">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">by striking subparagraphs (A) and (B) and inserting the following:</text>
                        <quoted-block style="OLC" display-inline="no-display-inline" id="H642307B339C448E69546EFC4A662C21E">
                            <subparagraph id="HFABCA42540AF4222AA7A6D09EA48A4A0" indent="up1">
                                <enum>(A)</enum>
 <text display-inline="yes-display-inline">be certified or licensed by the State in which the property to be appraised is located, except that a Federal employee who chooses to become State-licensed or certified real estate appraisers need to only be licensed or certified in 1 State or territory to perform real estate appraisal duties as a Federal employee in all States and territories;</text>
                            </subparagraph>
                            <subparagraph id="idCBF73D256C03413CBA266E23C7C35016" indent="up1">
                                <enum>(B)</enum>
 <text>meet the competency requirements described in the Uniform Standards of Professional Appraisal Practice before accepting an assignment; and</text>
                            </subparagraph>
                            <subparagraph id="id344EBBCB50904850916933704AD07BA0" indent="up1">
                                <enum>(C)</enum>
 <text>have demonstrated verifiable education in the appraisal requirements established by the Federal Housing Administration under this subsection, which shall include the completion of a course or seminar that educates appraisers on those appraisal requirements, which shall be—</text>
                                <clause id="id920136B43FBA4FCB8387F2720CA7A20B">
                                    <enum>(i)</enum>
 <text>provided by the Federal Housing Administration or a private or public organization with special competence in and knowledge of appraisal education through contracts, grants, or other assistance provided by the Secretary; or </text>
                                </clause>
                                <clause id="idDBF88532821C4286879D337E4F77212E">
                                    <enum>(ii)</enum>
 <text>approved by the Course Approval Program of the Appraiser Qualification Board of the Appraisal Foundation or a State appraiser certifying and licensing agency.</text>
                                </clause>
                            </subparagraph>
                            <after-quoted-block>.</after-quoted-block>
                        </quoted-block>
                    </subparagraph>
                </paragraph>
                <paragraph id="id5D11750F8F7D43EAB8A6271CC0FF7F30">
                    <enum>(2)</enum>
                    <header>Application</header>
 <text>Subparagraph (C) of section 202(g)(5) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(g)(5)</external-xref>), as added by paragraph (1), shall not apply with respect to any appraiser approved by the Federal Housing Administration to conduct appraisals on mortgages insured under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>) on or before the date on which the mortgagee letter or other guidance or regulations take effect under subsection (c)(3).</text>
                </paragraph>
            </subsection>
            <subsection id="H899E02D1132E486AA24D60124F087C52">
                <enum>(b)</enum>
                <header>Compliance with verifiable education and competency requirements</header>
 <text display-inline="yes-display-inline">Effective beginning on the date on which the mortgagee letter or other notice or regulations take effect under subsection (c)(3), no appraiser may conduct an appraisal for any mortgage insured under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>) unless—</text>
                <paragraph id="idBB7F189683774D498E390DE0D63D548F">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">the appraiser is in compliance with the requirements under subparagraphs (A) and (B) of section 202(g)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(g)(5)</external-xref>), as amended by subsection (a); and</text>
                </paragraph>
                <paragraph id="idB2C63C405AC04BE08401458928B2841E">
                    <enum>(2)</enum>
 <text>if the appraiser was not approved by the Federal Housing Administration to conduct appraisals on mortgages insured under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>) before the date on which the mortgagee letter or other notices or regulations take effect under subsection (c)(3), the appraiser is in compliance with subparagraph (C) of such section 202(g)(5).</text>
                </paragraph>
            </subsection>
            <subsection id="H5D3749CF7AC5446884A7106998A55B63">
                <enum>(c)</enum>
                <header>Implementation</header>
 <text display-inline="yes-display-inline">Not later than the 240 days after the date of enactment of this Act, the Secretary of Housing and Urban Development shall issue a mortgagee letter or other notice or regulations that shall—</text>
                <paragraph id="H10569D2EA9FE4B5786E6EDB2F14F4338">
                    <enum>(1)</enum>
 <text>implement the amendments made by subsection (a);</text> </paragraph> <paragraph id="HA0AA4F963C7043AEBB79DDA5C0E3B156"> <enum>(2)</enum> <text>clearly set forth all of the specific requirements under section 202(g)(5) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(g)(5)</external-xref>), as amended by subsection (a), for approval to conduct appraisals under title II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>), which shall include—</text>
                    <subparagraph id="H0149D15B0C924D989D3C9A745CC16207">
                        <enum>(A)</enum>
 <text>providing that, before the effective date of the mortgagee letter or other guidance or regulations, a demonstration of competency and completion of training that meet the requirements under subparagraphs (A), (B), and (C) of such section 202(g)(5), as amended by subsection (a), shall be considered to fulfill the requirements under such subparagraphs; and</text>
                    </subparagraph>
                    <subparagraph id="H0F86206E5AF54545955E593C54F82EB5">
                        <enum>(B)</enum>
 <text>providing a method for appraisers to demonstrate such prior competency and completion; and</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="HD1A1E9BEDB024A69A5993FA6E1BC7E1E">
                    <enum>(3)</enum>
 <text>take effect not later than the date that is 180 days after the date on which the Secretary issues the mortgagee letter or other notice or regulations.</text>
                </paragraph>
            </subsection>
        </section>
        <section id="H0B11B4E126C54AA0B7631C6CBD5A01D2">
            <enum>3.</enum>
            <header>Annual registry fees for appraisal management companies</header>
 <text display-inline="no-display-inline">Section 1109(a) of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3338">12 U.S.C. 3338(a)</external-xref>) is amended, in the matter following clause (ii) of paragraph (4)(B), by adding at the end the following: <quote>If the Appraisal Subcommittee determines that the fees established under clause (i) or (ii) result in adverse consequences or are otherwise not appropriately tailored to meet the functions of the Appraisal Subcommittee under this Act, the Appraisal Subcommittee may establish a new formula to decrease the amount of the fees.</quote>.</text>
        </section>

            <enum>4.</enum>
            <header>State credentialed trainee appraisers</header>
            <subsection id="H6BF5F09EBAF146108195BF02AA2328BE">
                <enum>(a)</enum>
                <header>Maintenance on national registry</header>
 <text display-inline="yes-display-inline">Section 1103(a) of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3332">12 U.S.C. 3332(a)</external-xref>) is amended—</text>
                <paragraph id="idAF7DA595BC9C4E60A1A67BFEB3E914DF">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">in paragraph (3)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id7c777bc3c15b45c09c5b9ebe7a11e874"> <enum>(A)</enum> <text display-inline="yes-display-inline">by inserting <quote>and State credentialed trainee appraisers</quote> after <quote>licensed appraisers</quote>; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id52fff76e46d64666a7834fcd22424a60">
                        <enum>(B)</enum>
 <text>by striking <quote>and</quote> at the end;</text> </subparagraph> </paragraph> <paragraph id="idDD7D35283CFE4F6CA1894DC1440998C4"> <enum>(2)</enum> <text>by striking paragraph (4);</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id6351bba788214099a5d3434ebb6183db">
                    <enum>(3)</enum>
 <text>by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively; and</text>
                </paragraph>
                <paragraph id="idB8822CFA85CF4591A5B947D37C62D7A0">
                    <enum>(4)</enum>
 <text>in paragraph (4), as so redesignated—</text> <subparagraph id="idB00B3EF02B4546A4AFBC59A2406C5813"> <enum>(A)</enum> <text>by striking <quote>year. The report shall also detail</quote> and inserting <quote>year, details</quote>;</text>
                    </subparagraph>
                    <subparagraph id="id3EB9A9B199D14B0EB10993B81E0ED033">
                        <enum>(B)</enum>
 <text>by striking <quote>provide</quote> and inserting <quote>provides</quote>; and</text>
                    </subparagraph>
                    <subparagraph id="idDB3EAB3FC4734F2A9EADB926B4B1A5D6">
                        <enum>(C)</enum>
 <text>by striking the period at the end and inserting <quote>; and</quote>.</text>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection id="H1F0D92AD42AF4A74822146964CF848D6">
                <enum>(b)</enum>
                <header>Annual registry fees</header>
                <paragraph id="id5F023C02617740688D767DBA17B10E7F">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text display-inline="yes-display-inline">Section 1109 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3338">12 U.S.C. 3338</external-xref>) is amended—</text>
                    <subparagraph id="id61b5f0f531944ac1a7005d275d550bb6">
                        <enum>(A)</enum>
 <text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">or licensed</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">, licensed, and credentialed trainee</header-in-text></quote>; and</text>
                    </subparagraph>
                    <subparagraph id="id00ec5fd1d24e496989b1f82baee22f25">
                        <enum>(B)</enum>
 <text>in subsection (a)—</text> <clause id="id63E6AE478855425B936E919B0DAC7104"> <enum>(i)</enum> <text>in paragraph (1), by inserting <quote>, and in the case of a State with a supervisory or trainee program, a roster listing individuals who have received a State trainee credential</quote> after <quote>this title</quote>;</text>
                        </clause>
                        <clause id="id82ef7ba955374a5eb3debcd358f59811">
                            <enum>(ii)</enum>
 <text>by striking paragraph (2) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id12c6023725d946738befe251dc65efd2"> <paragraph id="id44fdab1d126f4c128bf84e83239ffec1"> <enum>(2)</enum> <text>transmit reports on the issuance and renewal of licenses, certifications, credentials, sanctions, and disciplinary actions on a timely basis to the national registry of the Appraisal Subcommittee;</text>
                                </paragraph>
                                <after-quoted-block>; and </after-quoted-block>
                            </quoted-block>
                        </clause>
                        <clause id="H1748066E592942E593280A73DFC7B3DC">
                            <enum>(iii)</enum>
 <text>in paragraph (4)(A)—</text> <subclause id="id9FA797AD15274E4D91B6EC9F89FB6738"> <enum>(I)</enum> <text>by inserting <quote>including State credentialed trainee appraisers,</quote> after <quote>transactions,</quote>; and</text>
                            </subclause>
                            <subclause id="H0FD5DB91E72442FBA8A061FD80468C9B">
                                <enum>(II)</enum>
 <text>by inserting <quote>and from State credentialed trainee appraisers, an annual registry fee of not more than $20,</quote> after <quote>$40,</quote>.</text>
                            </subclause>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph id="idCECD8533D9444882BB87BDAE076EBCA1">
                    <enum>(2)</enum>
                    <header>Rule of construction</header>
 <text>Nothing in the amendments made by paragraph (1) shall require a State to establish or operate a program for State credentialed trainee appraisers, as defined in paragraph (12) of section 1121 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989, as added by subsection (d) of this section.</text>
                </paragraph>
            </subsection>
            <subsection id="id07E2C0EF74F3483FAAA306CFD4FA9C0D">
                <enum>(c)</enum>
                <header>Transactions requiring the services of a State certified appraiser</header>
 <text>Section 1113 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3342">12 U.S.C. 3342</external-xref>) is amended—</text>

                    <enum>(1)</enum>
 <text>by striking <quote>In determining</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—In determining</quote>; and</text>
                </paragraph>

                    <enum>(2)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id6F4E39B812724A98B802C1DA1ECF77F7"> <subsection id="idED2FEA4224394981BBD949A6F35CB69D"> <enum>(b)</enum> <header>Use of State credentialed trainee appraisers</header> <text>In performing an appraisal under this section, a State certified appraiser may use the assistance of a State credentialed trainee appraiser or an unlicensed trainee appraiser.</text>

                <header>Definition</header>
 <text display-inline="yes-display-inline">Section 1121 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3350">12 U.S.C. 3350</external-xref>) is amended by adding at the end the following:</text>

                            <enum>(A)</enum>
 <text display-inline="yes-display-inline">meets the minimum criteria established by the Appraiser Qualification Board for a trainee appraiser credential; and</text>
                        </subparagraph>

                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">is credentialed by a State appraiser certifying and licensing agency.</text>
                        </subparagraph>

        </section>

            <header>Grants for workforce and training</header>
 <text display-inline="no-display-inline">Section 1109(b) of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3338">12 U.S.C. 3338(b)</external-xref>) is amended—</text>

                <enum>(1)</enum>
 <text>in paragraph (5), by striking <quote>and</quote> at the end;</text> </paragraph> <paragraph id="id647d6f4cff9048e98cbbf9a30064d98e"> <enum>(2)</enum> <text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text>

            <enum>6.</enum>
            <header>Appraisal Subcommittee</header>
 <text display-inline="no-display-inline">Section 1011 of the Federal Financial Institutions Examination Council Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3310">12 U.S.C. 3310</external-xref>) is amended, in the first sentence, by inserting <quote>the Department of Veterans Affairs, the Rural Housing Service of the Department of Agriculture, the Department of Housing and Urban Development,</quote> after <quote>Financial Protection,</quote>.</text>
