which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish standards for trauma kits purchased using funds provided under the Edward Byrne Memorial Justice Assistance Grant Program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="S1"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Police Critical Aid for Responding to Emergencies Act</short-title></quote> or the <quote><short-title>Improving Police CARE Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id38D8635D75234891B12A50E39046ABF1"><enum>2.</enum><header display-inline="yes-display-inline">Trauma kit standards</header><text display-inline="no-display-inline">Section 521 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10202">34 U.S.C. 10202</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id03dd098025c84d118df4629e12b4f23e"><subsection commented="no" display-inline="no-display-inline" id="idd07e05ca2c5b409ebe36deb714eef3f9"><enum>(d)</enum><header display-inline="yes-display-inline">Trauma kits</header><paragraph commented="no" display-inline="no-display-inline" id="iddada5adfe491433181bed888bdc3d05b"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>trauma kit</term> means a first aid response kit, which includes a bleeding control kit that can be used for controlling a life-threatening hemorrhage.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0b8295ef5c84083a0f80a1147066219"><enum>(2)</enum><header display-inline="yes-display-inline">Requirement for trauma kits</header><subparagraph commented="no" display-inline="no-display-inline" id="iddd2f67dcda7e4c648a0944080e267862"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a grantee may only purchase a trauma kit using funds made available under this part if the trauma kit meets the performance standards established by the Director of the Bureau of Justice Assistance under paragraph (3)(A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02c3032af4d04399a3dea320926180b2"><enum>(B)</enum><header display-inline="yes-display-inline">Authority to separately acquire</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall prohibit a grantee from separately acquiring the components of a trauma kit and assembling complete trauma kits that meet the performance standards.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id605ab8ef3f6a465bbed960ef78f7a0f7"><enum>(3)</enum><header display-inline="yes-display-inline">Performance standards and optional agency best practices</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Director of the Bureau of Justice Assistance, in consultation with organizations representing trauma surgeons, emergency medical response professionals, emergency physicians, other medical professionals, relevant law enforcement agencies of States and units of local government, professional law enforcement organizations, local law enforcement labor or representative organizations, and law enforcement trade associations, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9c4af77ad43e47f09b195e9c05a29327"><enum>(A)</enum><text display-inline="yes-display-inline">develop and publish performance standards for trauma kits that are eligible for purchase using funds made available under this part that, at a minimum, require the components described in paragraph (4) to be included in a trauma kit; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87236782f8d34cb29826ed3613c2b2ff"><enum>(B)</enum><text display-inline="yes-display-inline">develop and publish optional best practices for law enforcement agencies regarding—</text><clause commented="no" display-inline="no-display-inline" id="id39229c82b15f432b86bb758f4bdc889b"><enum>(i)</enum><text display-inline="yes-display-inline">training law enforcement officers in the use of trauma kits;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2a8ff74d58294014987e823acb5b4468"><enum>(ii)</enum><text display-inline="yes-display-inline">the deployment and maintenance of trauma kits in law enforcement vehicles; and</text></clause><clause id="id87fc99b6b73842999cffd77f817a4b2d"><enum>(iii)</enum><text display-inline="yes-display-inline">the deployment, location, and maintenance of trauma kits in law enforcement agency or other government facilities.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf67fb846f8e14faba9b4b07195cc03d3"><enum>(4)</enum><header>Components</header><text>The components of a trauma kit described in this paragraph are—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ad137474f69436193f93ad911dce7da"><enum>(A)</enum><text display-inline="yes-display-inline">a tourniquet recommended by the Committee on Tactical Combat Casualty Care;</text></subparagraph><subparagraph id="id53a64ff5771a4bc2bcb017de7d9fbb17"><enum>(B)</enum><text>a bleeding control bandage;</text></subparagraph><subparagraph id="id0dfdb27eb0eb469c96cbb300dd82cb89"><enum>(C)</enum><text>a pair of nonlatex protective gloves and a pen-type marker;</text></subparagraph><subparagraph id="id4082c7d2b753451086c0c4d0db5d27dc"><enum>(D)</enum><text>a pair of blunt-ended scissors;</text></subparagraph><subparagraph id="idae9a911896fd4a70b3ee555f6a591fba"><enum>(E)</enum><text>instructional documents developed—</text><clause id="id38c493874006487089dc5fd0164d5d62"><enum>(i)</enum><text>under the <quote>Stop the Bleed</quote> national awareness campaign of the Department of Homeland Security, or any successor thereto;</text></clause><clause id="id672f0afdd5a346c289cd318858050ae3"><enum>(ii)</enum><text>by the American College of Surgeons Committee on Trauma;</text></clause><clause id="id9f536d11fb534131addb61ea2ae9b403"><enum>(iii)</enum><text>by the American Red Cross; or</text></clause><clause id="idf38e40d89e6142ff956169f476bf6259"><enum>(iv)</enum><text>by any partner of the Department of Defense;</text></clause></subparagraph><subparagraph id="id98ee532042024bf4acc54b644251b883"><enum>(F)</enum><text>a bag or other container adequately designed to hold the contents of the kit; and</text></subparagraph><subparagraph id="id7c249a1c469c48e2affea0c4085565e6"><enum>(G)</enum><text>any additional trauma kit supplies that—</text><clause id="ide064dab1bf8e4050bd935bd7397ea31c"><enum>(i)</enum><text>are approved by a State, local, or Tribal law enforcement agency or first responders;</text></clause><clause id="idc4d5257af8ad4370878aafe780a8ebbf"><enum>(ii)</enum><text>can adequately treat a traumatic injury; and</text></clause><clause id="idbe2d189beabe4d47a13cf97a6260a564"><enum>(iii)</enum><text>can be stored in a readily available kit.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
