which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Lacey Act Amendments of 1981 to prohibit certain activities involving prohibited primate species, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8E6ABA9B93704E09A0AC26DFA3715A89"><section section-type="section-one" id="HE4AD369D49E24AE4AA9A8A3B92C13EE3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Captive Primate Safety Act</short-title></quote>.</text></section><section id="H83B43E1D521E41C18E9BA2036DCF527F"><enum>2.</enum><header>Prohibition of certain activities involving prohibited primate species</header><subsection id="H39C0AA3427E947BA8A82D3C728ADD635"><enum>(a)</enum><header>Definition of prohibited primate species</header><text display-inline="yes-display-inline">Section 2 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id83b61ec405e44608a95ad0bebb2090f7"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (h) through (l) as subsections (i) through (m), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3bd3ff6ab89649fea4c08b100c3077ac"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA41CF89A1643444D812253A001C49AEC"><subsection id="H093A68F4BFB1418CAA1EA792DF199C08"><enum>(h)</enum><header>Prohibited primate species</header><text display-inline="yes-display-inline">The term <term>prohibited primate species</term> means any live species of nonhuman primate, including species of chimpanzee, galago, gibbon, gorilla, lemur, loris, monkey, orangutan, tarsier, or any hybrid of such species.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB0B9657DACE94133886A8DC45D4F525C"><enum>(b)</enum><header>Prohibited acts</header><text>Section 3(e) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372(e)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id40108e17cb7044648e359badb4995c07"><enum>(1)</enum><text>by striking paragraph (1) and all that follows through the period at the end of the undesignated matter following subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAF6F679BCD15411883964920984958C8"><paragraph commented="no" display-inline="no-display-inline" id="ida33db70dcbef42498c2dd994de129677"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), it is unlawful for any person—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0a49371749214c5b97f03970db40262e"><enum>(A)</enum><text display-inline="yes-display-inline">to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce, or in a manner substantially affecting interstate or foreign commerce, any prohibited wildlife species or prohibited primate species; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idac21a02e01d24bd083a43da282d651a4"><enum>(B)</enum><text>to breed or possess any prohibited wildlife species or prohibited primate species.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H0C6A85180DA444F4AF208EADD58B8FBD"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HBB76BFC44F884206928718B3220CF229"><enum>(A)</enum><text>in subparagraph (C), by inserting <quote>or prohibited primate species</quote> after <quote>prohibited wildlife species</quote> each place it appears; and</text></subparagraph><subparagraph id="idf3681871a0db42dbad05ee1aae315ff2"><enum>(B)</enum><text>by striking subparagraphs (D) and (E) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8162C6C5BBA64B1E831EB976F1F5B985"><subparagraph commented="no" display-inline="no-display-inline" id="id0ae14f535d054feb9369790b90616a2c"><enum>(D)</enum><text>an entity or individual that has custody of any prohibited wildlife species or prohibited primate species for the purpose of expeditiously transporting the prohibited wildlife species or prohibited primate species, as applicable, to an entity or individual described in this paragraph with respect to the species;</text></subparagraph><subparagraph id="HD9C8B4437E05457CAD29BED3E9663BF7"><enum>(E)</enum><text display-inline="yes-display-inline">an entity or individual that is in possession of any prohibited wildlife species or prohibited primate species that was born before the date of the enactment of the Big Cat Public Safety Act, with respect to a prohibited wildlife species, or the <short-title>Captive Primate Safety Act</short-title>, with respect to a prohibited primate species, if the entity or individual—</text><clause id="H1C41377952CE465C881A687C99359EA1"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of the applicable Act, registers each individual animal of each prohibited wildlife species or prohibited primate species, as applicable, possessed by the entity or individual with the United States Fish and Wildlife Service;</text></clause><clause id="H68D550727C9A4AE99DF4489767055F3B"><enum>(ii)</enum><text display-inline="yes-display-inline">does not breed, acquire, or sell any prohibited wildlife species or prohibited primate species, as applicable, after the date of enactment of the applicable Act; and</text></clause><clause id="H41A89B7868AB4775A20393A3F39A93BD"><enum>(iii)</enum><text display-inline="yes-display-inline">does not allow direct contact between the public and any prohibited wildlife species or prohibited primate species, as applicable; or</text></clause></subparagraph><subparagraph id="H2272104C1D9F4C7DBA11E84862F2C56A"><enum>(F)</enum><text display-inline="yes-display-inline">a research facility that conducts research that involves a prohibited primate species that is registered with the Department of Agriculture, if the research facility holds the registration in good standing.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HA5BD78F2269342939BDF57A359D66DEA"><enum>(c)</enum><header>Regulations</header><paragraph id="HEA9EAAD01B384ECCA661604523F22F82"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of the Interior shall promulgate regulations implementing the amendments made by subsections (a) and (b).</text></paragraph><paragraph id="H943DA7D083354FB0BB4B9DD539C859F9"><enum>(2)</enum><header>Enforceability</header><text display-inline="yes-display-inline">The enforceability of the amendments made by subsections (a) and (b) shall not be affected by a failure of the Secretary of the Interior to timely promulgate regulations under paragraph (1).</text></paragraph></subsection><subsection commented="no" id="idd39b28251b894a22b411c9714a93b999"><enum>(d)</enum><header>Technical amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id17b1a03755124423a77a022b3a1a2733"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id30c9a08e2ed54638bcc4dd1e3590b656"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="id5e1e1a76491040938cd5f7d5a654f3a5"><enum>(i)</enum><text>in the second sentence, by striking <quote>subpenas</quote> and inserting <quote>subpoenas</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida07f9cd02d1d4bfb91be545463ea97de"><enum>(ii)</enum><text display-inline="yes-display-inline">in the fourth sentence, by striking <quote>subpena issued pursuant to this paragraph</quote> and inserting <quote>subpoena issued pursuant to this subsection</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id078764a722304908abfe142a4d48617a"><enum>(B)</enum><text>in subsection (e), in the first sentence, by striking <quote>Fishery Conservation and Management Act of 1976</quote> and inserting <quote>Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>)</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb45d59a1cec24385b625a11621acdf04"><enum>(2)</enum><text>Section 6(b) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3375">16 U.S.C. 3375(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idea36289adefe48038ca70fad3b685746"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding the proviso, by striking <quote>Attorney General;</quote> and inserting <quote>Attorney General:</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id247cb9cc351349838ff5a0d5ac1dec79"><enum>(B)</enum><text display-inline="yes-display-inline">in the first sentence of the proviso, by striking <quote>subpena</quote> and inserting <quote>subpoena</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id897ea1d71a9042a1b4701a71e295c6bd"><enum>(3)</enum><text>Section 8(a) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3377">16 U.S.C. 3377(a)</external-xref>) is amended by striking <quote>Fishery Conservation and Management Act of 1976</quote> and inserting <quote>Magnuson-Stevens Fishery Conservation and Management Act</quote>.</text></paragraph></subsection></section></legis-body></bill>
