which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 1151 of title 14, United States Code, to modify the restriction on construction of Coast Guard vessels in foreign shipyards.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Modification of restriction on construction of vessels in foreign shipyards</header><text display-inline="no-display-inline">Section 1151 of title 14, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id686c223e3f5d49e7865f9ee0b72067ea"><enum>(1)</enum><text>in subsection (a), by striking <quote>Except</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE898C17788A24262B00655D845ECE37A"><subsection id="ide17cf6378a94465ea5fba152654e49a9"><enum>(a)</enum><header>In general</header><text>Except</text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e49936088fe4476ba83fbfe4a2058c4"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5DFAD2EB9A974794A8F3AE71EAE1F09D"><subsection id="id67480abf76834fdc94f3b5d391846d9a"><enum>(b)</enum><header>Exceptions</header><paragraph commented="no" display-inline="no-display-inline" id="idd8e1526670ac440096cdbf1c7e000138"><enum>(1)</enum><header display-inline="yes-display-inline">National security interest</header><subparagraph commented="no" display-inline="no-display-inline" id="id19c61d1e240146ccb5a22afa371ba8a8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The President may authorize exceptions to the prohibition in subsection (a) when the President determines that it is in the national security interest of the United States to do so. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17b1791a2d694826bd7e5372769a0c5a"><enum>(B)</enum><header>Notification</header><text display-inline="yes-display-inline">The President shall transmit notice to Congress of any such determination, and no contract may be made pursuant to the exception authorized until the end of the 30-day period beginning on the date the notice of such determination is received by Congress. </text></subparagraph><subparagraph id="idee4bbe512236457da67f343e6d6c5dea"><enum>(C)</enum><header>Certification</header><text>The President may only authorize an exception under this paragraph if the President, in coordination with the Commandant, has certified to Congress that—</text><clause id="id78ddcc55decf46b6a0bf6107bc01def0"><enum>(i)</enum><text>the foreign shipyard concerned is—</text><subclause commented="no" display-inline="no-display-inline" id="id6a377494b77a4a568321689908578aa1"><enum>(I)</enum><text display-inline="yes-display-inline">a member of the North Atlantic Treaty Organization; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id896388703cd34a48b1c5850bd603a544"><enum>(II)</enum><text display-inline="yes-display-inline">party to an active United States defense treaty in the Indo-Pacific region;</text></subclause></clause><clause id="idb8fced0cbf264491963d551338d1024f"><enum>(ii)</enum><text>the cost to the United States Government of using such foreign shipyard for construction described in subsection (a) is less than the cost to the United States Government of using a domestic shipyard for such construction; </text></clause><clause id="ida582b7df7a13492081a526fe86ac3200"><enum>(iii)</enum><text>the timeline for the design, construction, and delivery of a vessel or major component described in subsection (a) from a domestic shipyard is more than 18 months later than the timeline for the design, construction, and delivery of such vessel or major component from such foreign shipyard; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id9f248d266a734dfab6d38f4f82bb6af5"><enum>(iv)</enum><text display-inline="yes-display-inline">during the 5-year period ending on the date on which the certification is submitted, the foreign shipyard concerned has demonstrated the capacity to design, construct, and deliver a vessel capable of performing the missions specified in section 888(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/8/468">8 U.S.C. 468(a)</external-xref>)—</text><subclause commented="no" display-inline="no-display-inline" id="idda72484d79eb46348e90fb674d6203c0"><enum>(I)</enum><text display-inline="yes-display-inline">at a cost to the United States Government that is less than the cost of using a domestic shipyard; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id769be5cc62884b5f88084b013e49f51a"><enum>(II)</enum><text display-inline="yes-display-inline">within a timeline for design, construction, and delivery that is less than 18 months later than such a timeline from a domestic shipyard.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida63689f6a4344cc1b2dafed894c0da40"><enum>(2)</enum><header>Acquisition of completed vessel</header><text display-inline="yes-display-inline">The Secretary may acquire from a foreign shipyard a completed vessel if—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfec71433f752428a9afbf20049b502d9"><enum>(A)</enum><text display-inline="yes-display-inline">the foreign shipyard is—</text><clause commented="no" display-inline="no-display-inline" id="idabe56b601c3b4026a8ea4d968ca821cd"><enum>(i)</enum><text display-inline="yes-display-inline">a member of the North Atlantic Treaty Organization; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0a1ee85e766843e39b520b487c8ea0a5"><enum>(ii)</enum><text display-inline="yes-display-inline">party to an active United States defense treaty in the Indo-Pacific region; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45aa37a1daea4fe699cdc901cad85d50"><enum>(B)</enum><text display-inline="yes-display-inline">the government of the country in which the foreign shipyard is located enters into a warranty agreement with the United States Government with respect to such vessel.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
