Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended—</text><paragraph id="H8593D327BC394D5FB5FEDEE423C781E6"><enum>(1)</enum><text>in subsection (f)(1)—</text><subparagraph id="H8C057574742344F7A5469168E9ACF2C1"><enum>(A)</enum><text>in subparagraph (H), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="H9CE50F80ADA34A8797849A36733F3132"><enum>202.</enum><header>SBIR and STTR fellowships</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended—</text><paragraph id="HE89F434F076C44AA8663B2CB1198C018"><enum>(1)</enum><text>in subsection (f), by adding at the end the following:</text><quoted-block style="OLC" id="H88019CA3821640B9AAB38BEF3106F5C5"><paragraph id="H562D88FF698A4B5FAEB268957AB13DE0"><enum>(5)</enum><header>Fellowships</header><subparagraph id="H723F2C0DC6D4402BA87E7494DF40C698"><enum>(A)</enum><header>In general</header><text>A Federal agency may provide grants or awards, either directly or in partnership with a third party, to small business concerns that have received SBIR or STTR Phase II awards to provide fellowship and internship opportunities at the undergraduate, baccalaureate, graduate, and postdoctoral levels in fields that are important to the Federal agency.</text></subparagraph><subparagraph id="HE8E319267929464DA9C2D3770191800A"><enum>(B)</enum><header>Enhanced outreach</header><text>Each Federal agency that makes an award or enters into a partnership under subparagraph (A) shall provide for enhanced outreach to increase the participation of women, socially disadvantaged individuals (as described in section 8(a)(5)), and economically disadvantaged individuals (as described in section 8(a)(6)(A)) in the fellowship and internship opportunities described in subparagraph (A).</text></subparagraph><subparagraph commented="no" id="H569F5F52EE024927902A29D81EB2E85D"><enum>(C)</enum><header>Support organization</header><text display-inline="yes-display-inline">Each Federal agency that makes an award or enters into a partnership under subparagraph (A) may partner with or provide grants or awards to a third-party organization to support and facilitate the enhanced outreach under subparagraph (B), provided that the third-party organization is a nonprofit organization with relevant experience and demonstrated expertise in delivery of services described in subparagraph (B).</text></subparagraph><subparagraph id="HB36C854C2F224C1CA6C5BE55619C799E"><enum>(D)</enum><header>Funding</header><text>In carrying out this paragraph, a Federal agency may use only the following amounts:</text><clause id="H81A4351B3755478CA1F6E3A94AA4CE71"><enum>(i)</enum><text>With respect to a Federal agency that uses the authority under subsection (mm), the funds authorized under such subsection.</text></clause><clause id="H69557E3450574003AB1B532E3D764F37"><enum>(ii)</enum><text>With respect a Federal agency other than a Federal agency described in clause (i), not more than 3 percent of the funds required to be expended under paragraph (1).</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2B1FB6BE2B8444F79694D35780633945"><enum>(2)</enum><text>in subsection (n), by adding at the end the following:</text><quoted-block style="OLC" id="H84A4B127716B4237A3F77C760997B8C2"><paragraph display-inline="yes-display-inline">A Federal agency may provide grants or awards, either directly or in partnership with a third party, to small business concerns that have received SBIR or STTR id="H359A003F293B49C58FB03CD31F3FF949"><enum>203.</enum><header>Application assistance to broaden participation</header><subsection id="H411186A2D19F4AD98437BE777689DD8F"><enum>(a)</enum><header>In general</header><text>Section 9(mm)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(mm)(1)</external-xref>) is amended—</text><paragraph id="HC3BC783C721048DFB6A638274E727AE3"><enum>(1)</enum><text>in subparagraph (J), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HFC8C16B34C734D2A86A7DA01733AF022"><enum>(2)</enum><text>in subparagraph (K), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HE82B4939E1F740DFB2CF35F2D598028B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HBEE85714E32E4DDEBA1A9090F4CAB416"><subparagraph id="HC005CB04585541A39D16E67B981DC0BC"><enum>(L)</enum><text>providing small business concerns with assistance applying to the SBIR program or STTR program of the Federal agency, including providing such assistance to carry out the policy directives required under paragraphs (2)(F) and (5) of subsection (j) and subsection (p)(2)(H) to increase the participation of States with respect to which a low level of SBIR or STTR awards have historically been awarded.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD1EC1CBE08094E8F90FF2D1E8C4F0A40"><enum>(b)</enum><header>Enhanced minority institution participation</header><paragraph id="H92F69B3CAACF4C86AD0C872BE900BFC0"><enum>(1)</enum><header>SBIR</header><text>Section 9(j) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)</external-xref>), is amended by adding at the end the following:</text><quoted-block style="OLC" id="HDD740181B0A0463C91DD74B35B4DD981"><paragraph id="HAE380F10FBA94E2282F562EAEBF98C98"><enum>(5)</enum><header>Increased outreach requirements</header><text>Not later than 90 days after the date of enactment of this paragraph, the Administration shall modify the policy directives issued pursuant to this subsection to require enhanced outreach efforts to increase the participation of individuals conducting research at minority institutions (as defined in section 365 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k</external-xref>)) and Hispanic-serving institutions (as defined in section 502(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>)) in SBIR programs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE66F0934261C4FC889A5734848880CFD"><enum>(2)</enum><header>STTR</header><text>Section 9(p)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(p)(2)</external-xref>) is amended—</text><subparagraph id="HA916C6639F614F20B10B7C6BE0F1FB77"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HFED904ABF9F745F8ADBD23FF47F9F883"><enum>(B)</enum><text>in subparagraph (G)(iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HDAD5754195ED46A4AD405606759CEE0E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HAC97A7B8859D499097458B35614561F5"><subparagraph id="H6356C18416F44CC9A5649F27903B16EE"><enum>(H)</enum><text>procedures for outreach efforts to increase the participation of individuals conducting research at minority institutions (as defined in section 365 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k</external-xref>)) and Hispanic-serving institutions (as defined in section 16 502(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>)) in STTR programs.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="HACE5C0BEB28F4ABD830995410DA11993"><enum>204.</enum><header>Technical and business assistance improvements</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(q)</external-xref>) is amended—</text><paragraph id="HEAC3CACDC66C423988191E51002F993A"><enum>(1)</enum><text>in subsection (q)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb12637d256844875bd3e74cddb1d61c8"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A)—</text><clause id="H6DB0B92BF21940319D279D6679486F7A"><enum>(i)</enum><text>by striking <quote>may enter into an agreement with 1 or more vendors selected under paragraph (2)(A) to provide small business concerns engaged in SBIR or STTR projects with technical and business assistance services</quote> and inserting <quote>shall authorize recipients of awards under the SBIR program or the STTR program to select, if desired, technical and business assistance provided under subparagraph (A), (B), or (C) of paragraph (2) with respect to SBIR or STTR projects</quote>; </text></clause><clause id="HE7FB603AE0BA4747A3C1CA3863019FDE"><enum>(ii)</enum><text>by inserting <quote>cybersecurity assistance,</quote> after <quote>intellectual property protections,</quote>; and</text></clause><clause id="id2cd2fb2bfc5345aea69f47a777038f4d"><enum>(iii)</enum><text>by striking <quote>such concerns</quote> and inserting <quote>such recipients</quote>; the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14da690340cd41f1b2d2bc8569fe9950"><subparagraph commented="no" display-inline="no-display-inline" id="id3a6f192f5b9d49dc8cd2b1826de0fa58"><enum>(C)</enum><header>Staff</header><text>A small business concern may, by contract or otherwise, use funding provided under this section to hire new staff, augment staff, or direct staff to conduct or participate in training activities consistent with the goals listed in paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1646B0D255534744873EAC67F03E4017"><enum>(C)</enum><text>in paragraph (3)—</text><clause id="H6B1B9E2B3E064C60B80271819135D3E3"><enum>(i)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" (ii).</text></clause></subparagraph><subparagraph id="H73492FF6D6AD467B90DC0B29EBE76847"><enum>(B)</enum><header>Phase II</header><text>A Federal agency described in paragraph (1) shall authorize a recipient of a Phase II SBIR or STTR award to utilize not more than $50,000 per project, included as part of the award of the recipient or in addition to the amount of the award of the recipient as (iii).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id6aae7f02c51b4b02b2989b4c0c8a43c9"><enum>(D)</enum><text>by id="H8FF60A5685384CD3B3047B690EEB9E60"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H885A8EBFAA8C4481A277D1C507A5FE14"><subsection id="H45AFDF78939C4D29B622B97065BAECE2"><enum>(aaa)</enum><header>I–Corps participation</header><paragraph id="H24334E3684334EB6BAF4D2BC67C826CD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each Federal agency that is, as of January 1, 2025, required to conduct an SBIR or STTR program with an Innovation Corps program (established under section 601 of the American Innovation and Competitiveness Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1862s-8">42 U.S.C. 1862s–8</external-xref>) and commonly known as <quote>I–Corps</quote>) shall—</text><subparagraph id="HE046DE32A57544309ECA94BBA6BDFD97"><enum>(A)</enum><text>provide an option for participation in an I–Corps teams course, I–Corps bootcamp, or another equivalent training program to recipients of an award under the SBIR or STTR program; and</text></subparagraph><subparagraph id="H1E535C19D79E4375823A18283925AA8D"><enum>(B)</enum><text display-inline="yes-display-inline">authorize the recipients described in subparagraph (A) to use amounts authorized under this subsection to participate in the I–Corps teams course, I–Corps bootcamp, or another equivalent training program.</text></subparagraph></paragraph><paragraph id="HCAFC3675E92C405F8FED1314F1BF2DD2"><enum>(2)</enum><header>Cost of participation</header><text>The cost of participation by a recipient described in paragraph (1)(A) in an I–Corps course, I–Corps bootcamp, or another equivalent training program may be provided by—</text><subparagraph id="HE9CDAA45703B4C2FB7E677701ADCDD9F"><enum>(A)</enum><text>an I–Corps team grant;</text></subparagraph><subparagraph id="H3673476716A8448FA44C6AB4CF54B756"><enum>(B)</enum><text>funds awarded to the recipient under this subsection;</text></subparagraph><subparagraph id="HF8881283E63C4EF084C7A0AA1658F123"><enum>(C)</enum><text>the participating teams or other sources as appropriate; or</text></subparagraph><subparagraph id="H12A9FC0533324AB581C92164ADA7ED97"><enum>(D)</enum><text>any combination of sources described in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H51E0041827F1404C8E1EA3B0B8319D6A"><enum>205.</enum><header>Improvements to website relating to the SBIR program and STTR program</header><subsection id="HA2B299205BE34C0E970267958E432338"><enum>(a)</enum><header>SBIR program</header><text>Section 9(g)(8) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(g)(8)</external-xref>) is amended—</text><paragraph id="H6606B72480FC47A98A6A4ACA2B1AE26D"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the 1067q(a)</external-xref>).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HDA40A2D430074939A25063080B094D77"><enum>(D)</enum><text>in paragraph (3)(C), by striking <quote>Phase I or Phase II award</quote> each place it appears and inserting <quote>Phase I, Phase II, or Phase III award</quote>.</text></subparagraph></paragraph><paragraph id="HFF8744A2CC2B473DA41E1DDE96F33DF9"><enum>(2)</enum><header>Database update deadline</header><text>Notwithstanding paragraphs (1) or (2) of section 9(k) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(k)</external-xref>), the Administrator shall, not later than 1 year after the date of enactment of this Act, include—</text><subparagraph id="HEB7BEF564CA340EAB7929AF964C974B1"><enum>(A)</enum><text>in the database described such paragraph (1) the information required under Improvements</header><section id="H58A966259C414A0EA6B5B26379BCBC5D"><enum>301.</enum><header>Phase III award education</header><text display-inline="no-display-inline">Section 9(r) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(r)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HA72190C5B28D43B5B6F547F40B80920A"><paragraph id="H58F120A7386F4AF2B8D229705CAB76A1"><enum>(5)</enum><header>Workforce training</header><subparagraph id="H8054131C7A09402DA6755E41255825E7"><enum>(A)</enum><header>In general</header><text>The Administrator, in coordination with the Secretary of Defense, the Administrator of General Services, and the head of any other Federal agency that the Administrator determines appropriate, shall establish training activities for contracting officers and the agency acquisition workforce of Federal agencies to ensure that all such individuals are fully aware of all aspects of Phase III acquisitions under the SBIR and STTR programs, as applicable.</text></subparagraph><subparagraph id="H9930D8CBC9734930852D0FD954A55382"><enum>(B)</enum><header>Training topics</header><text>The training activities required under subparagraph (A) shall include training on—</text><clause id="H712904D3E0BB44EB8C203B9352B7C054"><enum>(i)</enum><text>the missions, goals, and authorities of the SBIR and STTR programs;</text></clause><clause id="H3BFDBE49E8ED4FD2B657BB0D776A3AA6"><enum>(ii)</enum><text>the use of Phase III agreement;</text></clause><clause id="H68404C48189C4B66A7BDAFDD649590D0"><enum>(iii)</enum><text>Phase III data rights; and</text></clause><clause id="HE041DDF801374176942F0C5C08132BDB"><enum>(iv)</enum><text>the execution of Phase III sole source award contracts.</text></clause></subparagraph><subparagraph id="HBB33B145CB6D49AFA4420F0F8A8870B4"><enum>(C)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause id="H7FBAC711787A4E659844E4C889860A36"><enum>(i)</enum><header>Agency acquisition workforce</header><text display-inline="yes-display-inline">The term <term>agency acquisition workforce</term> means the employees of a Federal agency that have procurement or acquisition responsibilities, including—</text><subclause id="H1FAAD724EA4B4A9F96A9F3E43D771DBE"><enum>(I)</enum><text>employees described in section 1703 of title 41, United States Code; and</text></subclause><subclause id="H6A73F3C58C634DAF8C9FCAAA65CD84D7"><enum>(II)</enum><text>individuals that are part of the acquisition workforce (as that term is defined in section 101(a) of title 10, United States Code).</text></subclause></clause><clause commented="no" id="HFB1A1C5FF0CA49E68865AC4069F80CDB"><enum>(ii)</enum><header>Phase III acquisition</header><text>The term <term>Phase III acquisition</term> means an acquisition of a good or service from a participant in Phase III that such participant has commercialized or is seeking to commercialize as such a participant.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3E09E0D523474E7590F3C9031B12ECBB"><enum>302.</enum><header>Report on certain denials of Phase III</header><text display-inline="no-display-inline">Section 9(r) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(r)</external-xref>), as amended by section 301, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H0C8557D323D6471A84883565C6D4F25A"><paragraph id="H4630444571FE4BBBAA7EAD9BD2F273DD"><enum>(6)</enum><header>Reporting</header><text>Not later than 30 days after the date on which the Department of Defense denies a small business concern Phase III agreement, the Secretary of Defense shall report that denial to the Administrator.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBF7DA9EC171440A7BA4410DF40444376"><enum>303.</enum><header>Technology Commercialization Official</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by section 204, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF880F864BB414F999A45D0EEC4F2D084"><subsection id="HF8713C51F2EC4F86BB82E67D372F5D6B"><enum>(bbb)</enum><header>Technology Commercialization Official</header><text>The head of each Federal agency required to establish an SBIR or STTR program shall—</text><paragraph id="H276A592287C8424CB163D143B43E29CB"><enum>(1)</enum><text>designate an existing official within the Federal agency as the Technology Commercialization Official of that Federal agency, who shall—</text><subparagraph id="HC6D627B0E5D54A7ABC7747059131F1B6"><enum>(A)</enum><text>have sufficient experience with commercialization;</text></subparagraph><subparagraph id="H9597361722AF47018BA87C8A4B66CD81"><enum>(B)</enum><text>provide guidance to SBIR and STTR program awardees in commercializing and transitioning technologies;</text></subparagraph><subparagraph id="H710F4E3B39534EFF90F9346A59BADBBB"><enum>(C)</enum><text display-inline="yes-display-inline">coordinate with the Administrator and the Technology Commercialization Officials of other Federal agencies to identify additional markets and commercialization pathways for promising SBIR and STTR program technologies;</text></subparagraph><subparagraph id="H0D882BB177454827B29BD20CAA4E5BDB"><enum>(D)</enum><text>submit to the Administrator an annual report on the number of technologies from that SBIR or STTR program that have advanced commercialization activities, including information required in the commercialization impact assessment report under subsection (ccc);</text></subparagraph><subparagraph id="HD0DF62B966C640F197128DDAAA9F627A"><enum>(E)</enum><text>identify and advocate for SBIR and STTR technologies with sufficient technology and commercialization readiness to advance to Phase III awards or other non-SBIR or STTR program contracts;</text></subparagraph><subparagraph id="H794C0BC4E7CB416092320AA9BD83F4F4"><enum>(F)</enum><text>submit to the Administrator an annual report on— </text><clause commented="no" display-inline="no-display-inline" id="idd8a341554dd64aecb9a84055a83737cc"><enum>(i)</enum><text display-inline="yes-display-inline">the actions taken by that Federal agency to simply, standardize, and expedite the application process and requirements, procedures, and contracts as required under subsection (hh); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb37eebca809f40788d77b17f8f384be9"><enum>(ii)</enum><text>the results of the actions taken under clause (i); and</text></clause></subparagraph><subparagraph id="HF2517D6D3BD04EB3914294DE72E2EE99"><enum>(G)</enum><text>carry out such other duties as the head of that Federal agency determines necessary; or</text></subparagraph></paragraph><paragraph id="HCD6B0F79CA9B4BC08E04ED42E10476D2"><enum>(2)</enum><text>identify an official in that Federal agency carrying out responsibilities that are substantially similar to those described in subparagraphs (A) through (F) of paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8A37A245E9F24C86B3469806F9E7573B"><enum>304.</enum><header>Phase III improvements</header><subsection id="H395C8F688A6B485EAB3C7E8F740EBEB1"><enum>(a)</enum><header>Procurement center representative directives</header><paragraph id="H0F29E5D213D648B4AEA48742D9841B93"><enum>(1)</enum><header>In general</header><text>Section 9(j)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)(4)</external-xref>) is amended by inserting before the period at the end the following: <quote>, and advocate for the maximum practicable use and transition of products, services, and technologies developed under SBIR or STTR programs to Phase III by means of Phase III awards to small business concerns</quote>.</text></paragraph><paragraph id="HFB30ADB7475049DAAA2BAFDDBB4044AB"><enum>(2)</enum><header>Modification deadline</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Small Business Administration shall modify the policy directives issues pursuant to subsection (j) of section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(j)</external-xref>) in accordance with paragraph (4) of that subsection, as amended by paragraph (1).</text></paragraph></subsection><subsection id="H57FC9E5E2D9F4823B66BF62675C472C0"><enum>(b)</enum><header>Phase III award simplification</header><text>Section 9(r)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(r)(4)</external-xref>) is amended—</text><paragraph id="H57D0D0B2A8EF4B268D8A241488914A0A"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H324F4A5FF7984C15A007DC3D10195189"><enum>(2)</enum><text>in subparagraph (B), by striking the period at STTR programs can be expected to provide as part of market research or as part of a proposal by those small business concerns to establish eligibility for Phase III awards.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title id="H5AD1A402C92C48D9916FF984D8683D80"><enum>IV</enum><header>Pilot Programs</header><section id="HB91A09FC93084F91870DEDF89D0028CE"><enum>401.</enum><header>Extend and modify assistance for administrative, oversight, and contract processing costs</header><subsection id="H96DDF879DDBD467BAC9855CD273E36ED"><enum>(a)</enum><header>In general</header><text>Section 9(mm)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(mm)(1)</external-xref>), as amended by section 203, is further amended—</text><paragraph commented="no" id="H0BE60BA9CA554193A3052BD38A45DFBE"><enum>(1)</enum><header>In general</header><text>Section 9(mm)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(mm)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H22EA7CD96261462998A989795B7F34E4"><paragraph id="HAAE8BB114DDB4A62A50385F3F43463F9"><enum>(2)</enum><header>Outreach and technical assistance</header><text>A Federal agency participating in the program under this subsection may use a portion of the funds authorized for uses under paragraph (1) to carry out the policy directive required under subsection (j)(2)(F) and to increase the participation of States with respect to which a low level of SBIR awards have historically been awarded.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HCC2D77DFC4CB4772ABC8A79294EB84F9"><enum>(2)</enum><header>Conforming amendment</header><text>Section 9(mm)(6) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(mm)(6)</external-xref>) is amended by striking <quote>including</quote> and all that follows and inserting the following:</text><quoted-block style="OLC" this subsection shall include in the next report submitted by that Federal agency under subsection (g)(9) following that exercise of authority the number and amount of awards provided under this subsection by that Federal agency during the period covered by that report.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H27CE8D75F8534EB4BF3E090FB6C9D4DD"><enum>403.</enum><header>Extend commercialization readiness program for civilian agencies</header><text display-inline="no-display-inline">Section 9(gg) of the diversification and commercialization</header><subsection id="H2AF9B7003EF3494A90302A7FFAA134E0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE8499D419BBE43FD85ED450EF886DAE9"><enum>(1)</enum><header>Federal agency; SBIR; STTR</header><text>The terms <term>Federal agency</term>, <term>SBIR</term>, and <term>STTR</term> have the meanings given those terms in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>).</text></paragraph><paragraph id="HD65B46DCCE8E4C41AAA23A96BB3729F7"><enum>(2)</enum><header>New entrant</header><text>The term <term>new entrant</term> means a small business concern that has not previously received an SBIR or STTR award.</text></paragraph><paragraph id="H412998E3B01041FA98A531B8F0CC7F40"><enum>(3)</enum><header>Underrepresented groups</header><text>The term <term>underrepresented groups</term> means small business concerns located in States with respect to which a low level of SBIR and STTR awards have historically been awarded, small business concerns owned and controlled by women, and small business concerns owned and controlled by socially and economically disadvantaged individuals.</text></paragraph><paragraph id="H863F0796F0664B80A96B94CD4C3DD1A6"><enum>(4)</enum><header>Participating agency</header><text>The term <term>participating agency</term> means a Federal agency carrying out an SBIR or STTR program under section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>).</text></paragraph><paragraph id="H6D513FED92764562A59F617AFD23289F"><enum>(5)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph><paragraph id="H2EE611E7C37E4CF8B20F18B62BEB6C66"><enum>(6)</enum><header>Small business concern owned and controlled by socially and economically disadvantaged individuals; small business concern owned and controlled by women</header><text>The terms <term>small business concern owned and controlled by socially and economically disadvantaged individuals</term> and <term>small business concern owned and controlled by women</term> have the meanings given those terms in section 8(d) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)</external-xref>).</text></paragraph></subsection><subsection id="H48AFFD79897848A89E1278211F586F67"><enum>(b)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the Senate</committee-name> and the <committee-name committee-id="">Committee on Small Business of the House of Representatives</committee-name> a report on the effectiveness of the SBIR and STTR programs with respect to diversification of participants and commercialization.</text></subsection><subsection id="H472BCE5B2BF44600BC973AC8D8DA3DF6"><enum>(c)</enum><header>Contents</header><text>The report shall include, to the extent practicable, an assessment of—</text><paragraph id="HF0D573623AA54F0ABB053300B155E668"><enum>(1)</enum><text>the demographics of small business concerns receiving SBIR or STTR awards, including new entrants and underrepresented groups;</text></paragraph><paragraph id="H2184D7593E9748CB92BEF36ABF1724D9"><enum>(2)</enum><text>the efforts of participating agencies to broaden representation and participation of new entrants and underrepresented groups in the SBIR and STTR programs;</text></paragraph><paragraph id="H8B42E86363FE4FBC9F8721810CAE2380"><enum>(3)</enum><text>how participating agencies develop solicitation topics and attract applicants;</text></paragraph><paragraph id="HE92417E206B743B390EB89A9A3A3F661"><enum>(4)</enum><text>the efforts of participating agencies to support technology commercialization;</text></paragraph><paragraph id="H28D537179C784262AB982082DCA524AA"><enum>(5)</enum><text>the extent to which the SBIR and STTR awards made by each participating agency align with the research priorities and technology needs of that participating agency; and</text></paragraph><paragraph id="H9868CB4CB47F49189A44AC1E0A83B8D8"><enum>(6)</enum><text>such other matters as the Comptroller General, in consultation with the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the Senate</committee-name> and the <committee-name committee-id="">Committee on Small Business of the House of Representatives</committee-name>, determines appropriate.</text></paragraph></subsection></section><section id="H90D4A5A72B2F43F49159DA36D333C2AD"><enum>503.</enum><header>Extend the report on award timeliness</header><text display-inline="no-display-inline">Section 9(ii)(2)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(ii)(2)(A)</external-xref>) is amended—</text><paragraph id="HA35C13DE3E4A49B4A232E729D285E3DA"><enum>(1)</enum><text>in the matter preceding clause (i), by striking <quote>3 years</quote> and inserting <quote>11 years</quote>;</text></paragraph><paragraph id="HB8BEB5A6B47E4C2CB24B93669FCDBA66"><enum>(2)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HB530CC4F2679417F9914C1A876BD7FC5"><enum>(3)</enum><text>by redesignating clause (ii) as clause (iii); and</text></paragraph><paragraph id="H0405472A3A7C4ED38B88E49C1C7F09EB"><enum>(4)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" id="H7B66EE17D9134CB282E2DA63094DF44B"><clause id="H8B8EABC6C3FF4456BC33859B01C52EDA"><enum>(ii)</enum><text>provides the average and median amount of time that each Federal agency with an SBIR or STTR program takes to review and make a final decision on proposals submitted under the program; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H30C98C8CF36F4EF9AD15FB46251AC0EE"><enum>504.</enum><header>Pilot program to accelerate national institutes of health evaluation process</header><subsection id="H556A5E119C29489D9B66123FBE77B920"><enum>(a)</enum><header>In general</header><text>Section 9(hh) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(hh)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD628FEB3D3024AC381D15EDC1966D3CB"><paragraph id="H4F3A76F9846F4EADAF1118D5D0D9D05E"><enum>(3)</enum><header>Pilot program to accelerate the National Institutes of Health SBIR and STTR awards</header><subparagraph id="H5B2CE2F89BAF4E19BEC7A25338F236A2"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this paragraph, the Director of the National Institutes of Health shall establish a pilot program to reduce the time for awards under the SBIR and STTR programs of the National Institutes of Health.</text></subparagraph><subparagraph id="H598A00BFFFF14EBB8B1B5D718B6D0A7D"><enum>(B)</enum><header>Award procedures</header><text display-inline="yes-display-inline">In carrying out the pilot program under subparagraph (A), the Director of the National Institutes of Health shall develop simplified and standardized procedures across all relevant awarding offices at the National Institutes of Health and reduce the amount of time between the provision of notice of those awards and the subsequent release of funding with respect to the awards to be as close to 90 days as possible.</text></subparagraph><subparagraph id="HDAA168B6E469405E8DF69E428F844597"><enum>(C)</enum><header>Merit review</header><clause id="HFA04A7384F3F4E5DB5A258E3FBEBEB50"><enum>(i)</enum><header>In general</header><text>Under the pilot program under subparagraph (A), the Director of the National Institutes of Health may, with respect to awards under the SBIR and STTR programs of the National Institutes of Health, use such peer review procedures (including consultation with appropriate scientific experts) as the Director determines to be appropriate to obtain assessments of scientific and technical merit and potential for commercialization.</text></clause><clause id="H923A2DE11B6F47DAB64E3E752C4867E7"><enum>(ii)</enum><header>Deemed</header><text>The use of peer review procedures under clause (i) shall be deemed to fulfill any requirements applicable to the award under the SBIR or STTR program of the National Institutes of Health under sections 406(a)(3)(A) and 492 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284a">42 U.S.C. 284a(a)(3)(A)</external-xref>, 289a).</text></clause></subparagraph><subparagraph id="HC81FF4D5553A4ABCAD60D855F20CCE5A"><enum>(D)</enum><header>Termination</header><text>The pilot program under subparagraph (A) shall terminate on September 30, 2030.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD35F6CBBA15A4BFEA1FFDD396A4F5324"><enum>(b)</enum><header>Evaluation report</header><text>Not later than 3 years after the date of enactment of this Act, the Director of the National Institutes of Health shall submit to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the Senate</committee-name> and the <committee-name committee-id="">Committee on Small Business</committee-name> and the <committee-name committee-id="">Committee on Science, Space, and Technology of the House of Representatives</committee-name> an evaluation of the pilot program established under paragraph (3) of section 9(hh) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(hh)</external-xref>), as added by subsection (a), including an analysis of the peer review procedures used under subparagraph (C) of that paragraph and the effects on award times.</text></subsection></section><section id="H2DE9C7A4E8E84018AC668253AADE78E6"><enum>505.</enum><header>Codifying safeguards for small business concerns majority-owned by venture capital operating companies, hedge funds, or private equity firms</header><subsection id="HDA1A8F8C9883477F9A0E709BA2067F65"><enum>(a)</enum><header>In general</header><text>Section 9(dd) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(dd)</external-xref>) is amended—</text><paragraph id="H41A125E225674AF7903D9D1286460879"><enum>(1)</enum><text>in paragraph (6)(B), by striking <quote>If a Federal</quote> and inserting <quote>Except as provided in paragraph (8), if a Federal</quote>; and</text></paragraph><paragraph id="HF2147343471B4427AA84C666B6FBA9BB"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96efa460b77e4a4285669fa182ac7dd4"><paragraph id="HEF875286D07F4151BDD116314833049A"><enum>(8)</enum><header>Participation limits</header><subparagraph id="HE6CEAB87CC3F45FD9246DD599A733421"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HEE5E9F1AE6CB435A9D3DCEBB6A5671CE"><enum>(i)</enum><header>Covered foreign entity</header><text>the term <term>covered foreign entity</term>—</text><subclause id="HDBB82DD13D2F4E689D5AFBFFD4B66433"><enum>(I)</enum><text>means—</text><item id="H6E75261F48EE486EB861ADF32922DBCB"><enum>(aa)</enum><text>a foreign entity of concern;</text></item><item id="HAE81F6D69A4E4D66A7A139346915DA2C"><enum>(bb)</enum><text display-inline="yes-display-inline">a government or political party of a foreign country of concern;</text></item><item id="H4C55FE9D049C460BBF40A5215396D765"><enum>(cc)</enum><text>a natural person who is not a lawful permanent resident of the United States, citizen of the United States, or any other protected individual (as that term is defined in section 274B(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324b">8 U.S.C. 1324b(a)(3)</external-xref>)); or</text></item><item id="H643F049C86CE40709399A39F881A620F"><enum>(dd)</enum><text>a partnership, association, corporation, organization, or other combination of persons organized under the laws of or having its principal place of business in a foreign country of concern; and</text></item></subclause><subclause id="H67C699583707474EAB1D80A36E03EE10"><enum>(II)</enum><text>includes—</text><item id="HC86CB35F036947148CF70DAC9DD1EC0C"><enum>(aa)</enum><text>any entity owned by, controlled by, or subject to the jurisdiction or direction of an entity listed in subclause (I);</text></item><item id="HD24827119B0E4517B0A870B0A9F10A0A"><enum>(bb)</enum><text display-inline="yes-display-inline">any person, wherever located, who acts as an agent, representative, or employee of an entity listed in subclause (I);</text></item><item id="H73C02B32B7BE4C5BB6ACB38DE78C6E73"><enum>(cc)</enum><text display-inline="yes-display-inline">any person who acts in any other capacity at the order, request, or under the direction or control, of an entity listed in subclause (I), or of a person whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in majority part by an entity listed in subclause (I);</text></item><item id="HA3D3B28E5CDF468D90691C0647362D77"><enum>(dd)</enum><text display-inline="yes-display-inline">any person who directly or indirectly through any contract, arrangement, understanding, relationship, or otherwise, owns 25 percent or more of the equity interests of an entity listed in subclause (I);</text></item><item id="HD163590106F849BB91101D8BA2B41848"><enum>(ee)</enum><text display-inline="yes-display-inline">any person with significant responsibility to control, manage, or direct an entity listed in subclause (I);</text></item><item id="H0D105EBAE47244B7BF73E8C11A222BCF"><enum>(ff)</enum><text display-inline="yes-display-inline">any person, wherever located, who is a citizen or resident of a country controlled by an entity listed in subclause (I); or</text></item><item id="HEABBDC528EF94337A228D850997A9275"><enum>(gg)</enum><text display-inline="yes-display-inline">any corporation, partnership, association, or other organization organized under the laws of a country controlled by an entity listed in subclause (I).</text></item></subclause></clause><clause id="HFE8707E50B1B4F40ACE65286483F61A4"><enum>(ii)</enum><header>Foreign entity of concern</header><text>The term <term>foreign entity of concern</term> means a foreign entity that is—</text><subclause id="HA70103AC2BBE4A0DAA12239879BD7B99"><enum>(I)</enum><text display-inline="yes-display-inline">designated as a foreign terrorist organization by the Secretary of State under section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>);</text></subclause><subclause id="HCF7833C1DC474295AA96BB487E95F1BF"><enum>(II)</enum><text>included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury (commonly known as the SDN list);</text></subclause><subclause id="HE136E88033394C4489B0C7B1595B2F00"><enum>(III)</enum><text>owned by, controlled by, or subject to the jurisdiction or direction of a government of a foreign country that is a covered nation (as that term is defined in section 4872 of title 10, United States Code);</text></subclause><subclause id="H2A7F102BC1BE4D4889C9BD4DBBC18B77"><enum>(IV)</enum><text>alleged by the Attorney General to have been involved in activities for which a conviction was obtained under—</text><item id="HBF979D13336D41289566CC519FE6CD68"><enum>(aa)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code (commonly known as the <quote>Espionage Act</quote>);</text></item><item id="H239DB55173A745319DEAD10B3FA23047"><enum>(bb)</enum><text>section 951 or 1030 of title 18, United States Code;</text></item><item id="H939312FE356E40C4AB5D2007F053DB3E"><enum>(cc)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/90">chapter 90</external-xref> of title 18, United States Code (commonly known as the <quote>Economic Espionage Act of 1996</quote>);</text></item><item id="HC159BB11CBA7478FBDE704663C9C2560"><enum>(dd)</enum><text>the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>);</text></item><item id="H0B94978C11AD4234BFA2D95B65E1B94A"><enum>(ee)</enum><text>section 224, 225, 226, 227, or 236 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2274">42 U.S.C. 2274</external-xref>, 2275, 2276, 2277, and 2284);</text></item><item id="H881EB2990BBF449391EE548646B489E1"><enum>(ff)</enum><text>the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>); or</text></item><item id="HFC661E7841894F08876C638E61628C42"><enum>(gg)</enum><text>the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or</text></item></subclause><subclause id="HE428D9BD568E4A2497F4C4ACF0FC0710"><enum>(V)</enum><text>determined by the Secretary of Commerce, in consultation with the Secretary of Defense and the Director of National Intelligence, to be engaged in unauthorized conduct that is detrimental to the national security or foreign policy of the United States.</text></subclause></clause></subparagraph><subparagraph id="H4F5EA0DED2714D88851F5742C92CDC59"><enum>(B)</enum><header>Ownership by a covered foreign entity</header><text>A small business concern that is majority-owned by multiple venture capital operating companies, hedge funds, or private equity firms is ineligible to receive an award under any SBIR program if the Administrator determines that such small business concern is, or is owned and controlled in majority part by, a covered foreign entity.</text></subparagraph><subparagraph id="H2E2EAEFC06C64398AAB9B00B53F08801"><enum>(C)</enum><header>Ownership determination</header><text>In determining whether a small business concern is ineligible to receive an award under any SBIR program under subparagraph (A), the Administrator shall consider whether the small business concern is a direct or indirect subsidiary of a foreign-owned firm.</text></subparagraph><subparagraph id="HC687E3A3DDA0491F9BFDD594924254E7"><enum>(D)</enum><header>Size standards</header><text>The Administrator shall establish size standards for small business concerns seeking to participate in an SBIR program solely under the authority under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7E69D69FB26141CF83E3D5DC45678AD4"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply only with respect to awards made under a Small Business Innovation Research Program (as defined in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>)) after the date of enactment of this Act.</text></subsection></section><section id="HA98E1E7B472749F7887780DB9FC38816"><enum>506.</enum><header>Commercialization impact assessment</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by section 303, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0E00097786C74EAEA13ED523B4AEC8BD"><subsection id="H56230A58074F49FA90C17A2492840ED7"><enum>(ccc)</enum><header>Commercialization impact assessment</header><paragraph id="H20DD013E962840C9BFDE4D022D2FE32A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall coordinate with the head of each Federal agency with an SBIR or STTR program to develop an annual commercialization impact assessment, which shall measure, for each small business concern that has received not less than 50 Phase II awards on or after October 1 of the ninth full fiscal year beginning before the fiscal year in which the assessment is carried out—</text><subparagraph id="H940F571C535B4E938E7093EA21DBDAEE"><enum>(A)</enum><text display-inline="yes-display-inline">the total dollar value of Federal awards, subgrants, contracts, and subcontracts, other than SBIR or STTR awards, received by the small business concern in the preceding 9 fiscal years;</text></subparagraph><subparagraph id="H3C6C9F7DE3124632BE6E7F607829F60A"><enum>(B)</enum><text display-inline="yes-display-inline">the total dollar value of all SBIR and STTR Phase I and Phase II awards received by the small business concern in the preceding 9 fiscal years;</text></subparagraph><subparagraph id="HC84F893B1F954C87B43AA22B9A5F692E"><enum>(C)</enum><text display-inline="yes-display-inline">the average annual gross revenue of the small business concern over the preceding 9 fiscal years;</text></subparagraph><subparagraph id="H6B1F095A64534A7B86FA941023D52C36"><enum>(D)</enum><text>the total revenue of the small business concern received or realized in the preceding 9 fiscal years from the sale or licensing of any product or service resulting from research conducted under an SBIR or STTR award, which shall be disaggregated by the revenue from those sales and the revenue from that licensing;</text></subparagraph><subparagraph id="H8230BADA0DF140D4A26A55F0401BDFA0"><enum>(E)</enum><text>additional investments in the small business concern from any source, other than Phase I or Phase II SBIR or STTR awards, to further the research and development conducted under an SBIR or STTR award received by the small business concern in the preceding 9 fiscal years;</text></subparagraph><subparagraph id="HA926AE7428E54F46B86D8BBB6FA9F51B"><enum>(F)</enum><text>any mergers and acquisitions of SBIR or STTR award recipients during or after the completion of a Phase II award;</text></subparagraph><subparagraph id="H80D1FB267EE24607AB5B88F0E0669886"><enum>(G)</enum><text>new, unique spin-out companies and third party revenues from any businesses in the preceding 9 fiscal years resulting from research conducted by the small business concern under an SBIR or STTR award;</text></subparagraph><subparagraph id="HF800062BEE6A47E389201D5533124F38"><enum>(H)</enum><text>the year in which the first Phase II award was received by the small business concern and the total number of employees of the small business concern at the time of the first Phase II award;</text></subparagraph><subparagraph id="H5FF120818F0945EAAAA2B124577C6F24"><enum>(I)</enum><text>the number of employees, as of the end of the most recently completed fiscal year; and</text></subparagraph><subparagraph id="H4D45F583A4FC4739B186D240005BF113"><enum>(J)</enum><text>the total number and value of Phase III awards received by the small business concern.</text></subparagraph></paragraph><paragraph id="HE823F1CFCBDF48E98B62EE0F269DE3A0"><enum>(2)</enum><header>Publication</header><text>The Administrator shall create a report on the findings of each commercialization impact assessment and shall—</text><subparagraph id="H492F2DF6B0F64CF6B0BD3BE018D1D97C"><enum>(A)</enum><text>include that report in the annual report required under subsection (b)(7); and</text></subparagraph><subparagraph id="H0089E7C987F04EDAA4EF368E72D6ACBF"><enum>(B)</enum><text>submit that report to—</text><clause id="H9E19CFD08D7043E69FF90D9A1D84085C"><enum>(i)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the
